Public-Private Partnership (PPP) is an organizational model of public service delivery in which a public partner joins with a private one for a joint delivery of a public service, creating added value for both parties in this “partnership”. From the point of view of the public partner, it decreases public expenditure, increases the quality and distribution of public services, and reduces agency costs. From the point of view of the private partner, the benefits are in achieving the planned rate of return, reducing sub-investment costs, reducing agency costs, and avoiding debt risk. There are numerous studies on the correlation between economic development and investment through PPP, which have led to this research. According to the legal framework in Bosnia and Herzegovina, which is composed of entity and cantonal laws, a subject of PPPs may also be construction, use, maintenance and management or reconstruction of property for the purposes of meeting public needs in the health service sector. The aim of the paper is to explore the legal and institutional assumptions of investing through the PPP model in Bosnia and Herzegovina health service sector and to make recommendations for improving the PPP situation in the health service sector. In addition to the introduction and conclusion, the paper is structured in three parts. The first part represents a concise theoretical framework in which the subject of the research is situated, the second part presents the state of affairs pertaining to investments in the health service sector, and the third part analyzes the current state of the use of this form of public service delivery in Bosnia and Herzegovina. The concluding section makes recommendations for improvements in terms of improving the investment through PPP in the sector of health care services.

The aim of this paper is to consider the relationship between the regulation of state property and the rule of law, and for this purpose the authors analyze the Decision of the Constitutional Court of BiH No. U-4/21 which declared certain provisions of the Law on Forests of Republika Srpska unconstitutional. The paper discusses not only the issues of the relationship between state property and the rule of law, but also the issues of judicial activism and the rule of law. In particular, the authors analyze the extent to which the courts, and in this particular case the Constitutional Court of BiH, in order to protect the rule of law, may interfere in the competences of the legislature. In this context, the authors consider the justification of judicial activism of the Constitutional Court of BiH in case U-4/21, considering whether the Constitutional Court of BiH has the right to protect the principle of the rule of law in such a way. Finally, the authors explain why judicial activism is necessary when it comes to the relationship between constitutional and legislative power and why judicial activism of the BiH Constitutional Court was necessary in the case U-4/21.

The goal of this paper is to analyze the role of Congress in the formulation of American foreign policy towards Yugoslavia with special reference to the situation in Bosnia and Herzegovina in 1991. The paper is based on currently available Congressional archival materials, archives of individual former Senators, and media reports from that period. This paper will try to prove that some key members of the Senate started following the events in Yugoslavia very early on and that through their activities in the Senate they tried to shape the US foreign policy towards Yugoslavia in 1991.

Within the historical, cultural and political Bosnian people’s subjectivity, there is a constant possibility of its awareness in relation to the sovereign, territorially complete and politically independent Bosnian state. And the plan to prevent or destroy that is the essential content of the ethnonational teleologies of Serbs and Croats in which Bosnia and its people were considered only the means for the final achievement of ethnonational goals. That is why the ideology of anti-Bosnianism is an important content of ethnonational teleologies of Serbs and Croats. Although it changes forms, its essence lasts throughout the history of ethnonationalism. From tracking and studying the traces of various forms of ethnonational anti-Bosnianism through history, culture and politics, clues leading to the genocide that took place and weighed, from deciphering the mental states of both those who committed the crime and those suffering them, a question arises: which dimension of that complex phenomena most often eludes understanding and is left without a clear name? The name anti- overeignty seems to clearly reflect the core of that dimension in the semantic field of anti-Bosnian ideology. That name befits the mainstream ethnonational teleologies of Serbs and Croats in their relations to the possibilities of political awareness of the Bosnian people in its sovereign state. But the same name befits the essential contents of the state ideologies of Serbia and Croatia in their relations with the state sovereignty of Bosnia and Herzegovina, territorial integrity and political independence. Until these states recognize both de jure and de facto that Bosnia and Herzegovina's state sovereignty is as the same as theirs, and even more than that, there will not and cannot be harmonization of relations between them and the establishment of living conditions that would be persistently improved in politics. It means in reconciling conflicting interests towards the common good. When we say “more than that,” it means that Bosnia and Herzegovina's social pluralism, long threatened by Serbian and Croatian hegemony, must be protected as a political principle and as a condition for overcoming geopolitical insecurity in the European territory to which these countries belong. The state of Bosnia and Herzegovina is not the cause of that insecurity. These are the destructive attitudes of Serbian and Croatian political and cultural elites towards it. The framework of the state of Bosnia and Herzegovina, its history, culture and politics are long-lasting. And the constitutional rule in it, in the modern sense of the term, was established after World War II. The foundation of the current Bosnian order is the constitution adopted and guaranteed within the broadest framework of international law. However, it should be understood in the long history of the state of Bosnia and Herzegovina and the history of defending and denying the various constitutional arrangements that preceded it.

The paper presents a brief overview of the consequences of the actions of social elites in Serbia in terms of survival and nurturing of the nationalist course of society even after the disastrous results of the nationalist adventure of the 1990s, but also the interpretation seems to lead to its transformation. Social reality is still filled with a matrix of exclusive nationalism and chauvinism that is persistently created by political and intellectual elites leaving a narrow space for the actions of individuals and groups who would like a different social reality. The paper also presents some symbolic elements of the manifestation of the nationalist ideology of the Serbian elites, which aims to point out the deep connection between the elites and the consequences of their nationalist engagement. The prospects for their dissolution are emphasized through the necessary transformation of the value elements of society and the overthrow of the nationalist construct through deep democratization and the establishment of the rule of law. The author recognizes this path as a way of deconstructing the collectivist view of society about its own existence in an isolated and homogenized ethnic community that survives only in such circumstances. Slowly and painstakingly, the nationalist concept could be replaced by a civic and liberal one that emancipates a general community of individuals - a community that is peaceful on the inside and not a threat on the outside. The paper also points out that behind the nationalist activities of Serbian elites are often purely lucrative goals of individuals and groups with the aim of building, consolidating and gaining specific social positions, influence and wealth: some served nationalism "from profession and occupation", not out of conviction. This deep symbiosis is still obvious today and signals that social changes and the severance of their ties will be difficult, even if the leading political elites would sincerely want it.

Todorović","doi":"10.48052/19865244.2022.1.49","DOIUrl":"https://doi.org/10.48052/19865244.2022.1.49","url":null,"abstract":"The paper presents a brief overview of the consequences of the actions of social elites in Serbia in terms of survival and nurturing of the nationalist course of society even after the disastrous results of the nationalist adventure of the 1990s, but also the interpretation seems to lead to its transformation. Social reality is still filled with a matrix of exclusive nationalism and chauvinism that is persistently created by political and intellectual elites leaving a narrow space for the actions of individuals and groups who would like a different social reality. The paper also presents some symbolic elements of the manifestation of the nationalist ideology of the Serbian elites, which aims to point out the deep connection between the elites and the consequences of their nationalist engagement. The prospects for their dissolution are emphasized through the necessary transformation of the value elements of society and the overthrow of the nationalist construct through deep democratization and the establishment of the rule of law. The author recognizes this path as a way of deconstructing the collectivist view of society about its own existence in an isolated and homogenized ethnic community that survives only in such circumstances. Slowly and painstakingly, the nationalist concept could be replaced by a civic and liberal one that emancipates a general community of individuals - a community that is peaceful on the inside and not a threat on the outside. The paper also points out that behind the nationalist activities of Serbian elites are often purely lucrative goals of individuals and groups with the aim of building, consolidating and gaining specific social positions, influence and wealth: some served nationalism \"from profession and occupation\", not out of conviction.
