ONLINE DISPUTE RESOLUTION IN PAKISTAN: CHALLENGES AND OPPORTUNITIES 巴基斯坦在线争议解决:挑战与机遇

Background and Purpose: In Pakistan, courts are still seen as the primary forum for resolving civil disputes. The large number of pending civil cases that require an unacceptable amount of time to achieve a final judgment is proof of this. Delays in the administration of justice and the length of trials are elements that have led to the development of Alternative Dispute Resolution (ADR) and Online Dispute Resolution (ODR) approaches; at the same time, they are critical issues that need to be addressed in Pakistan and throughout the world. Many procedural reforms have been implemented to date, and the mechanism of consumer redress has improved. However, existing institutions are ineffective in resolving the vast majority of consumer disputes that arise from online transactions. The study aims at exploring the legal and technical challenges that would not allow the use of ODR for disputes in Pakistan.   Methodology: This research uses the doctrinal legal analysis methodology by asking ‘what the law states about the ODR in Pakistan’ to enrich the subject matter of the ODR and cover all perspectives, issues, features, and the most current advancements in the area of ODR and ADR in Pakistan. Currently, there is no applicable national or international law in Pakistan mainly regulating ODR. Therefore, at this stage, this article analyses the existing rules such as Recognition and Enforcement (Arbitration Agreements and Foreign Arbitral Awards) Act 2011 and Alternative Dispute Resolution Act 2017 to examine whether they apply to ODR. Along with exploring the nature of existing legal framework on the ADR and ODR, this paper significantly develops a theoretical framework that application of ODR standards, in a substernal manner, depends on its socio-cultural acceptance.  Notably, this article does not employ empirical research on the data of ODR. Instead, it uses statistics provided by international and national commissions, groups and centres.     Findings: There is evidence that ODR is still at an early stage of evolution in Pakistan, as it faces cultural, regulatory and technological challenges that hinder the growth of ODR.   Contributions: Despite its incomplete development, ODR has demonstrated its potential adaptability by accommodating national contexts. This is an essential feature because the aim is not to blindly transfer a dispute resolution system from other jurisdictions but to habilitate it to the national cultural features as well as social limitations, especially those regarding ICT infrastructure. MUSLIM FEMINISTIC NARRATIVE IN POETRY: A LITERARY ANALYSIS OF FAHMIDA RIAZ'S POEMS 诗歌中的穆斯林女性主义叙事:法赫米达·里亚兹诗歌的文学分析

Background and Purpose: Fahmida Riaz was able to articulate precise feminist politics through her voice because she was audible to many women in the Pakistani context. The current study investigates how her     writings about the female body were not merely a tool to celebrate or raise the sexual distance, but also influenced a political intervention and shifted the dominant patriarchal structures present in literary as well as other social and political levels. The purpose of the research is to shed light on how a specific poet's voice was able to reach a large audience of women and articulate explicitly feminist politics in Pakistan.   Methodology: The Feminist Discourse Analysis (FCDA), another dimension of CDA, is employed in the analysis. The application of the FCDA model is adapted to examine how textual representations of gendered practices produce and sustain one gender power and dominance over the other. For the study, an operational method based on four models has been developed: the Fairclough Model, the Porreca Model (Porreca, 1984), Halliday's Transitivity Model (1985), and the FCDA (Lazar, 2005).   Findings: The findings clearly demonstrated how power abuse and gender domination are explicitly present in women's literature. The analysis discusses in detail how gender is constructed in these poems, and how this construction gave women a new perspective on life and defined how they are exploited in the name of social and religious cultures.   Contributions: With the rise of religious extremism in Pakistan, the male-dominated patriarchal narrative is receiving renewed attention. However, based on the findings obtained,  greater attention should be paid to the female narrative and the discourse produced by female writers. A similar analysis can be performed on the writings of Kishwar Naheed, another feminist writer, to gain a better understanding of the poetics of Muslim Feminist Narrative.   Keywords: Feminist politics, feminist critical discourse analysis, Porreca Model, Halliday’s transitivity model.   Cite as: Basra, Z., Alvi, U. HUMANISING MOBILE ONLINE ESL BLENDED LEARNING MODEL 人性化的移动在线esl混合式学习模式

Background and Purpose: The COVID-19 pandemic has given a massive proliferation of technology, particularly in education, redefining language learning from face-to-face (F2F) and off-classroom known as blended learning (BL) to a new kind in online distance learning/education (ODL/E). BL is now a mix of synchronous and asynchronous learning. The shift, however impressive it may appear, does not guarantee the effectiveness of the learning process. The gap that leads to the current study is how bibliometrics has shown minimal focus on undergraduates’ acceptance of these changes, especially in English as a Second Language (ESL) learning classes to the newly embraced online BL (OBL) and how humanistic values are important in ESL lessons. Thus the study sets out to understand several issues pertaining to the use of mobile communication devices as a learning tool in ESL MoBL.   Methodology: The present study is a mixed-method research approach using a sequential exploratory design. A set of Technology Acceptance Model (TAM) questionnaires was distributed to understand 264 teacher-trainers, degree and diploma students’ inclination towards ESL mobile learning platforms after a semester of mobile open blended learning (MoBL) integration, whilst side-lining the unnecessary information of Unified Theory of Acceptance and Use of Technology (UTAUT2). Interviews based on Analysis, Design, Assess, and Belief (ADAB) Model further enriched the data on the humanisation aspects of MoBL.   Findings: Findings showed that learners’ inclination to the new MoBL can be affected by gender, age, and maturity. Thus to implement a more humanistic learning modification demands a thorough understanding of students’ needs.   Contributions: The novelty of these findings is the sampling contrasting both degree and diploma students along with teacher-trainees’ perceptions of humanistic values in OBL highlights the effects of, age, maturity and gender on technology in education. This paper suggests a discussion on the humanistic MoBL model for ESL learners. CONTRIBUTIONS OF ISLAMIC FINANCE IN THE ECONOMIC DEVELOPMENT OF TURKEY: A REVIEW 伊斯兰金融对土耳其经济发展的贡献述评

World Bank data (2009-2019) provides that Turkey has been facing economic development challenges in terms of GDP growth rate, GDP per capita, inflation rate, unemployment rate, and youth unemployment rate during the last decade. Though 2020 data is not yet available, 2019 data depicted a very challenging year for Turkey. This paper aims to review the challenges in the economic development of Turkey and provide the solutions by applying the notions of participatory finance (Islamic finance) for the development of the economic growth, per capita income, inflation rate, unemployment rate, and the youth unemployment rate of Turkey. This study applied a critical literature review analysis to explore the challenges. The European Bank for Reconstruction and Development reported that Turkey observed a worsening asset quality of the banking sector, deleveraging by lenders, unstable market, reduced investor confidence, and shallow public and private investment in 2019. Similarly, the conventional finance literature illustrated prudent strategic financial decisions support in improving these issues. However, the Islamic finance literature demonstrated that interest-free financial mechanisms are comparatively more resilient and supported a sustainable economic development. Though the contributions of the participation (Islamic) finance are poor due to its size, this mechanism of finance has enormous prospect of contributions to the Turkey’s economy as demonstrated in other countries. Background and Purpose: Online learning has become a new norm to higher education institutions in the developing countries since COVID-19 pandemic. An overnight shift from conventional physical learning to online learning in this pandemic moment has posed a major challenge to most of the educational institutions. Student’s readiness and satisfaction towards online learning activities are important to ensure the effectiveness of this new learning method. Therefore, this study aims to examine the online learning readiness and satisfaction among the university students from four Asian countries during COVID-19 pandemic. The domains of the examinations included student learning preference, self- direction, self-efficacy, and hardware-soft skill support.   Methodology: This survey research employed a quantitative approach to gather data. The sample respondents were 1,195 university students from Thailand, Malaysia, Indonesia, and China, selected using a simple random sampling method. Online questionnaires were distributed to the respondents, comprising 37 items including demographic profiles, satisfaction, and online learning readiness assessment. The survey responses were analysed descriptively and inferentially using the Statistical Package for Social Sciences (SPSS) version 21.0.   Findings: Results showed that 74.7% of the participants had a middle level of online learning readiness, and only 20.1% had high online learning readiness. The levels of online learning readiness varied among the participating countries. The participants lacked online learning preference, as shown in the lower mean scores compared to the means of self-direction, self-efficacy, and hardware-soft skill supports. For satisfaction, students reflected that online course required improvement, as observed in only 31% satisfaction with the online learning courses provided. The results also revealed that there was a significant positive correlation (r=.383) between online learning readiness and students’ satisfaction.   Contributions: This study provides preliminary insights into the preparedness of online learning in higher educational institutions in the Asian countries. It implies a potential disruptive impact on the educational system during the pandemic. Background and Purpose: Different language learners have varying capacities to acquire L2, where some learners develop their learning strategies faster than others. Hence, it is critical for instructors to examine the degree of understanding and ability obtained by the learners through the investigation of their language learning strategies particularly on the type of schools the learners attend. This study, therefore, reveals frequently employed learning strategies in ESL classrooms based on the type of school the learners attend, notably the distinction between Cluster School of Excellence (CSE) and non-cluster primary school in Malaysia.   Methodology: This quantitative research gathered information through the administration of a survey questionnaire. In total, 112 young ESL Malaysian learners (CSE:56; Non-CSE:56) aged 11 were chosen through stratified random sampling in Samarahan, Sarawak. The close-ended Strategy Inventory for Language Learning (SILL) that consist of 50 questions was used to collect information and SSPS Version 25 was used to interpret an independent t-test to determine the significant in strategies employed by the respondents.   Findings: The data revealed that the most prevalent Language Learning Strategy (LLS) used by young Malaysian ESL learners are metacognitive strategies that allow learners to manage their learning. Learners in non-CSE school adopt learning strategies more than learners in CSE school and there is no significant difference in the type of learning strategies employed by both learners.   Contributions: School’s environment reflects a significant impact on the academic success of students and the result of the investigation helped throughout the educational process to tailor teaching strategies to help learners achieve common educational goals. Background and Purpose: Social Networking Services (SNS), especially Twitter, have been an increasingly popular communication medium, especially in political transformation. This research analyses the language of tweets by Director General Inter-Services Public Relations (DG ISPR) of Pakistan, shared during the recent standoff between India and Pakistan on the issue of the Pulwama Attack in February 2019 and the Revocation of Article 370 by the Indian Government in August 2019.   Methodology: The present research examines the linguistic techniques, and micro and macro approaches used in the discourse of tweets by DG ISPR on the said issues. Selection of vocabulary, tone of the message, and emotion in the discourse are studied through Ideological Square Model under the umbrella of CDA, with the aid of NVivo 12 Plus, to inspect the magnitude of the impact of linguistic memorandums from authoritative institutes.   Findings: This study has revealed that the impeccable choice of vocabulary by ISPR adequately represented the Military of Pakistan, nationally and internationally, and has brought a state of tranquility at the time of standoff between two rival countries. Selection of vocabulary, tone of the message, and emotion in the discourse are studied through Ideological Square Model under the umbrella of CDA, with the aid of NVivo 12 Plus, to inspect the magnitude of the impact of linguistic memorandums from authoritative institutes. \u0000  \u0000Findings: This study has revealed that the impeccable choice of vocabulary by ISPR adequately represented the Military of Pakistan, nationally and internationally, and has brought a state of tranquility at the time of standoff between two rival countries. A MOBILE APPLICATION DEVELOPED FOR SCAFFOLDING ESL LEARNERS IN PROVIDING PEER FEEDBACK 一个移动应用程序开发为脚手架esl学习者提供同伴反馈

Background and Purpose: Peer feedback has received significant research attention in teaching and learning of oral presentation skills. However, literature reveals a number of challenges concerning students’ provision of peer feedback. A mobile application was thus developed to scaffold students in this context. This study purports to evaluate the efficacy of the developed application by introducing it to the target users in an actual classroom setting.   Methodology: Thirty-three (33) ESL learners from one of the polytechnics in Malaysia were involved in this descriptive study. Both the peer feedback records (pre- and post-) were analyzed for the differences in peer feedback before and after the implementation of mobile application. A 20-item questionnaire was later administered to the target group to examine their perceptions on the developed application.   Findings: It was revealed that with the use of the newly developed application, students generally constructed more peer feedback with specific suggestions to improve oral presentation. Positive perceptions regarding the presentation, visual design, navigation and mobile app accessibility were also found. Contributions: This study adds to the limited research on the use of mobile-assisted peer feedback, which can be a practical way to develop ESL learners’ oral presentation skills. The findings offer insights into how a mobile application can help scaffold students in peer feedback provision and could help inform that scaffolding is deemed necessary in building an effective classroom culture of feedback. MALAY LITERATURE STUDENTS’ PERCEPTIONS OF ONLINE LEARNING EXPERIENCES DURING THE COVID-19 PANDEMIC AT A PUBLIC UNIVERSITY 公立大学马来文学学生对新冠疫情期间在线学习体验的看法

Background and Purpose: The COVID-19 pandemic has altered the landscape of human life all over the world, including the conventional face-to-face teaching method, which has been replaced with online classes. The drastic changes without a holistic planning makes online teaching prone to various shortcomings. Thus, this article aims to address two research objectives. The first objective is to determine Malay Literature students ‘online learning experiences, and the second objective is to analyse the demographic factors influencing students’ perceptions of online learning during the COVID-19 pandemic.   Methodology: This descriptive study employed a survey questionnaire to gather data. A sample consisting of 67 undergraduate students majoring in Malay Literature at a public university were recruited as respondents in the present study using a simple random sampling method.  After following 14 weeks of online lessons, a questionnaire form was distributed to the students. The research instrument is a questionnaire, which has been adapted and modified from a study by Baczek et al. (2020). The questionnaire form consists of two sections. Section A contains eight items related to respondents’ demographic background. Section B contains items related to students’ perceptions of online learning, in which six items are related to the benefits of online learning, five items are based on the disadvantages of online learning, and four items on students’ general perceptions of online learning. The responses from the questionnaire were analysed using Statistical Package for the Sosial Science 22.0 for descriptive analysis.   Findings: The study found that online learning is perceived by students as being more disadvantageous than beneficial. Respondents concluded that the advantage of online learning is that they could learn from their own homes according to the suitability of their time. They also acknowledged that they could access learning resources better in online classes. One of the factors influencing students’ perceptions of online learning is the speed of Internet connection.   Contributions: The study highlights the need for lecturers to be adequately prepared and to consider factors such as quality of Internet access, home location, students’ readiness and constraints faced by students.   Keywords: COVID-19, learning, literature, online learning, quality education.   Cite as: Veeramuthu, S. ESL TEACHERS’ PERCEPTION AND ATTITUDES TOWARDS THE ADOPTION OF EMERGENCY REMOTE TEACHING IN TIME OF CRISIS 英语教师对危机时采用紧急远程教学的认知与态度

Background and Purpose: The operation of educational institutions was suspended for a certain period due to the COVID-19 pandemic outbreak as social distancing came into effect as one of the World Health Organisation (WHO) strategies to help prevent further spreading of the virus. Subsequently, the education field witnessed a drastic shift in the mode of instruction, from the traditional physical classroom learning to online education and distance learning. Particularly in Malaysia, the suddenness of the implementation of Emergency Remote Teaching (ERT) as per suggested by the Ministry of Education Malaysia, has opened a new paradigm and brought a new experience in teaching for most teachers. With ERT being activated for the second time, it became a major concern to various parties on the effectiveness of the mode of instruction towards the teaching and learning processes for both teachers and students. Hence, this paper aims to investigate ESL teachers’ perceptions and attitudes towards ERT to further develop the quality and effective distance education programs should a crisis like the current situation ever happens again.   Methodology: This study employed a quantitative descriptive research approach as the research method. An online survey of 124 Malaysian English as Second Language (ESL) teachers was conducted for descriptive analysis. The respondents of this study were recruited using the purposive sampling technique. They should have at least one year experience in English language teaching prior to conducting lesson using ERT, and they should be in-service Malaysian ESL primary school teachers. Findings: The findings revealed that most of the teachers support ERT as the alternative mode of instruction in substituting the physical classroom learning in unprecedented time of crisis. However, certain difficulties remain, most notably issues regarding the digital divide. These implications call for more attention to developing more infrastructure and facilities, providing amenities and equipment as well as providing appropriate training to teachers.   Contributions: The findings provide valuable insights from the teachers’ perspective, also known as the policy implementers, to help develop better e-learning curriculum and develop better contingency plans or strategies for emergencies and time of crisis.   Keywords: Emergency remote teaching, ESL, e-learning, distance learning, COVID-19.   Cite as:  Junaidi, Y., Hashim, H., & Ismail, H.
