This article starts from misunderstanding of some Muslims in reasoning maqashid al-syari'ah. Some of them argue that maqashid al-syari'ah is only what appears of the text to nash, so they reason the nash textually. As a result, Islamic law becomes rigid and it is easy to blame you. Some of them reasoned too much about maqashid al-syari'ah, thus canceling the text of the nash. As a result, he was brave enough to deconstruct a permanent Islamic law. Therefore, this article will examine maqashid al-syari'ah with a fair and moderate study (wasathiyah) that is not as extreme as textual or contextual reasoning. Through a library research study with a descriptive analysis approach, it was found that wasathiyah reasoning in maqashid al-syari'ah reasoning is to distinguish between worship and muamalat matters in terms of the intentions behind them; seek maqashid al-shari'ah before determining the law; and has the principle that the shari'a which is built on the qath'i argument will not conflict with benefit and common sense.

This study aims to find out the various perceptionof students regarding the use of ilegal sites in education when viewed from the prespective of islam and positif law, given that the number of users of illegal sites is widespread, both by the public and intelectuals. The method used in this research is a quantitative research method by conducting a survey through questionnaries distributed through google forms media. Based on the result of the research and the answers from the respondents, it can be concluced that the use of illegal sites, ecpecially in education, is indeed not recommended both from a levat prespective and the reception of each respondent. However, if you look at illegal sites in education based on positive law, which means it has benefits in it, then the islamic prespective itself raises the term istihsan to be used as a reference. In other words, the benefits or positive values that can bee taken from the use of these illegal sites in the world of education are permissible based on the islamic prespective of Istihsan Bil ’Urf with a note within reasonable limits. Cancellation or fasakh of marriage due to religious conversion is not included in the family cancellation of marriage as part of the competence of the Religious Courts, but it is implemented through divorce institutions, giving rise to disparities in decisions between fasakh, talak bain and talak raj'i permission. The author found two Supreme Court decisions that canceled and corrected the decisions of two High Religious Courts that canceled a marriage because it was proven that one of the husband and wife had a religious conversion. The Supreme Court is of the opinion that the permit to impose talak raj'i is more appropriate on the grounds according to the posita and petitum of the petition. The Supreme Court consistently applies this rule in its two decisions, but the author finds eleven decisions of the Religious Courts in the following years still impose fasakh if it is proven that one of the married couples is an apostate (out of Islam), even though it is not used as an excuse for divorce and is not requested by the party in the petitum. In this article, the author will examine the legal considerations of eleven Religious Court decisions using an explanatory method and presented qualitatively. The results of the author's study show that the judge's consideration is influenced by the judge's perception of the application of the ultra petita principle with the principle of ex aequo et bono, the judge's perception of the adjudication of fiqh schools and the judge's perception of the independence of judges and compliance with jurisdiction.

This article aims to discuss the epistemological footing of MUI's ecological fatwa and its contribution in responding to the phenomenon of climate change. Today's environmental crisis is no longer a threat to the earth, but has become a reality. Climate change that occurs on a national and global scale leaves a negative impact on the lives of the earth's inhabitants. One of the causes of the environmental crisis is the attitude of humans who are not friendly to the environment. Humans as God's ambassadors on earth are arbitrary in utilizing the potential of natural resources destructively and exploitatively. Therefore, guidance is needed for Muslims in their interactions with the surrounding environment. MUI as a religious authority has contributed in overcoming the environmental crisis and climate change. The ecological fatwas issued by MUI are expected to be able to change the attitude and behavior of Muslims to become environmentally aware (eco-literacy). Epistemologically, MUI's environmentally friendly fatwas are based on maqāṣid sharī'ah reasoning through maslahat-mafsadat analysis. The approach used in finding the value of the spirit of environmental conservation is based on naṣ qaṭ'ī, qaulī and manhajī methods. These three sources of knowledge are formulated in an environmentally friendly fatwa product as a response to the environmental crisis that has become a global discourse today. Thus, MUI's fatwa can function as a tool of social control and a tool of social engineering at the same time.

Infringements of so many intellectual property rights, especially copyrights, concern and even harm many creators. Decision No. 33/Pdt.Sus-Copyright/2018/PN Similar to the copyright litigation in Niaga Central Jakarta. Copyright owners sue in court for infringement. However, the lawsuit brought by the first-level copyright owner was duly flawed due to a personal error, namely a mispronunciation of Defendant I's name. This also happened with appeals at the level of renunciation. The petition filed by the petitioner will be dismissed because it merely repeats the matters reviewed by Judex Facti. This paper aims to discuss how legal protection for copyright owners against persona errors exists in legal regulations and Islamic law. This study is classified as a normative study. As a result of the discussion, it was concluded that there are no specific rules that provide for legal protection of copyright holders when persona claims are false, and that there is a problem of norm vacuum and that there are no rules. Fix implying issues. Under Islamic law, copyright owners must obtain legal protection in order to generate profits consistent with the purposes of maqasid as-syari'ah, including: preservation of the soul (Hifz al-nafs), preservation of reason (Hifz al-'aql), preservation of property (Hifz al-mal).

Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan disahkan kemudian disusul dengan Peraturan Pemerintah (PP) Nomor 9 Tahun 1975 tentang pelaksanaan Undang-Undang Nomor 1 Tahun 1974, sesuai dengan tujuannya pada pasal 1 Perkawinan adalah ikatan lahir batin antara seorang pria dengan seorang wanita sebagai suami istri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Meskipun demikian, isu dan perdebatan seputar Rancangan Undang-Undang Perkawinan telah mendapatkan atensi dari berbagai pihak, terutama dalam pembahasan sebagaimana tercermin dalam konfigurasi politik. Seperti kita maklumi, konfigurasi politik adalah proses pembuatan dan pelaksanaan hukum yang tercermin dalam karakter dan arah pembaharuan hukum. Tulisan ini berkesimpulan bahwa konfigurasi politik dalam legislasi undang-undang Perkawinan bersifat demokratis. Sebab dalam prosesnya membentuk pergulatan antara eksekutif, legislatif dan tokoh masyarakat Alim Ulama serta mahasiswa. Dan pada saat ini jalan ijtihad bagi masyarakat yang merasa dirugikan atas pengesahan suatu produk hukum dapat mengajukannya kepada Mahkamah Konstitusi. Ini sejalan dengan prinsip Fiqh siyasah, musyawarah syura, Kebebasan hurriyah, persamaan musawah. Kesimpulan itu ditarik dengan menggunakan analisis isi (content analysis), dengan menggunakan data primer dan sekunder. Yang pertama meliputi dokumen resmi terkait dengan Rancangan Undang-Undang, sedangkan yang kedua merujuk pada tulisan-tulisan terkait dengan perundang-undangan Perkawinan.

A growing economy creates cryptocurrency virtual money residing in cyberspace. Cryptocurrency Is an online payment tool that uses an open source peer-to-peer payment network. There are many problems faced by users, where Cryptocurrencies are said to include money or a commodity. This phenomenon really makes users feel uncomfortable, feel at a loss, therefore the government must immediately provide an evaluation of the use of Cryptocurrency as a means of obtaining transactions. more attention, especially from the government so that the community gets their rights and obligations in muamalah. This paper aims to discuss how to use Cryptocurrency transactions from the Perspective of the DSN-MUI Fatwa and Law No. 7 of 2011. This research is classified as normative research, using a statutory approach and a conceptual approach. The results of the discussion show that Cryptocurrency is linked in the DSN MUI fatwa No.28/DSN-MUI/III/2002 regarding al-sharf that in the provisions of the fatwa the conditions for exchanging Cryptocurrency digital money are prohibited because of the element of speculation. In Article 2 paragraph (1) of Law Number 7 of 2011 concerning Cryptocurrency, it does not meet the requirements as a type of currency in Indonesia. Judging from the six criteria of money, Cryptocurrency only meets the criteria of portability and visibility.

Sawit menjadi salah satu komoditas unggulan yang mendukung jalannya perekonomian nasional, Indonesia merupakan salah satu penyumbang minyak sawit terbesar di dunia. Tingginya pengaruh pertumbuhan ekonomi sawit di Indonesia telah menyebabkan pergeseran budidaya tanaman karet dan tanaman komersial konvensional lainnya di tingkat masyarakat, berubah menjadi sawit terlepas dari peran sawit bagi perekonomian bangsa. Industri perkebunan sawit tidak disambut baik oleh masyarakat indonesia, hal tersebut disebabkan karena praktik perkebunan sawit di Indonesia ditengarai sebagai salah satu pemicu berbagai permasalahan lingkungan dan sosial, seperti deforestasi, pembukaan lahan gambut, kebakaran hutan, hilangnya keanekaragaman hayati, dan konflik tenurial. Total luasan kebun sawit Indonesia itu sekitar 16,8 juta hektar, sekitar 3,47 juta hektar di antaranya berada di kawasan hutan. Perluasan industri sawit dikawasan hutan tersebut salah satunya disebabkan oleh pemberian kewenangan perizinan perkebunan sawit kepada pemerintah daerah, yang dianulir sebagai pemicu pembukaan lahan baru untuk perkebunan sawit didaerah. Tanpa adanya sistem pengendalian yang akuntabel dan ketat di dalam proses perizinan akan berdampak pada banyaknya izin perkebunan sawit yang diterbitkan cenderung banyak melanggar ketetuan tata ruang. Selain itu pengaturan lebih lanjut kebijakan mengenai kelapa sawit dalam undang-undang cipta kerja justru akan semakin menambah panjang konflik yang terjadi serta membuat proses pembenahan tata kelola kelapa sawit menjadi jauh lebih rumit. Penerapan model “white wash smell” sebagai upaya penyelesaian justru hanya akan mengurangi peluang penyelesaian, mengabaikan izin, tidak transparan, dan pada akhirnya merugikan masyarakat. Cash waqf management in Indonesia faces challenges due to the overload tasks of Sharia banks as the Sharia financial institution of cash waqf (SFI-CW). This research explored Sharia Bank's problems as an SFI-CW and looked for an effective model to manage cash waqf in Indonesia. The results of this research show that the existence of Sharia banks as SFI-CW has yet to be implemented optimally due to the overload tasks of the banks. To solve the problem and to make the cash waqf management run effectively, this study proposes some alternatives, including: first, simplifying the tasks of the SFI-CW; second, making the Baitul Maal wat Tamwil (henceforth BMT) or sharia cooperation as Nazhir of cash waqf as well as SFI-CW; and third, establishing waqf bank to optimize the management of cash waqf.

This study aims to analyze the practice of excessive pricing on airlines as a form of abuse of a dominant position from the perspective of business competition law. The practice of excessive pricing is a strategy of setting excessive and exploitative prices toward consumers. In this research, The researcher indicated unfair business competition associated with excessive pricing practices. In addition, the researcher also analyzed the impact of excessive pricing practices on consumers and business competition. The research method used is normative research with a doctrinal research approach. The study results show that many users of air transportation modes make airline business actors take advantage of these conditions to multiply company profits by selling tickets at very high prices exceeding the Excessive Pricing. However, in Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition, there is no explanation of whether excessive pricing practices abuse a dominant position or are just regular business activity. Therefore, this paper aims to analyze and simultaneously prove indications of unfair business competition by airline business actors through excessive pricing from the perspective of business competition law.
