ARBITRATION AT MUSLIM RELIGIOUS COMMITTEE COUNCILS IN SOUTHERN THAILAND 泰国南部穆斯林宗教委员会的仲裁

This paper analyses the function of arbitration at Patani Muslim Religious Committee Council (PMRCC) and offers mediation mechanisms as an alternative way of solving the matrimonial disputes among the Muslims in the Malay-Muslims majority areas. Conceptually, dispute resolution is being recognized as an effective way in the field of adjudication in Islamic law. Although there have been attempts to implement dispute resolution mechanisms in the Muslim Religious Committee Councils (MRCCs), no attempt so far has been made to upgrade them. To a large extent, dispute resolution has been implemented gradually since the beginning of the establishment of the councils. This paper intends to investigate the current trend and the future direction for the implementation of dispute resolution in PMRCC by exploring the available alternatives to the continued pursuit of the process of dispute resolution in PMRCC while at the same time strengthening the existing structures. Finally, the author will provide some suggestions as to how dispute resolution in PMRCC might operate. The author will also highlight the strength and weaknesses of arbitration under Thai civil law with a view toward a better legal provision for arbitration.

Analisis Kebebasan Beragama Menurut Perkara 14 Convention on The Rights of The Child dan Undang-Undang Brunei Darussalam

The Convention on the Rights of the Child (CRC) is an international human rights treaty that upholds the political, economic, social and cultural rights of all children under the age of 18 unless the State Party prescribes it earlier. Freedom of religion is one of the rights that is provided in Article 14 of the CRC whereby the State Party shall respect the rights of children to freedom of thought, conscience and religion. However, Brunei Darussalam placed a reservation on that Article when ratifying it on December, 27 1995, as it was deemed to be in conflict with Hukum Syara’, the Constitution and the laws of Brunei Darussalam. This paper aims to analyze freedom of religion for children from an Islamic perspective, the law of Brunei Darussalam and the CRC. In addition, this study explores the views and comments of the State Parties of the United Nations (UN) in order to identify and understand the reviews of religious freedom in their respective countries. This study uses a qualitative method by using comparative studies, descriptions, interpretations, case studies, and explaining the laws of Brunei Darussalam and provisions of the CRC. It also involves field research in order to obtain information on children who have converted to Islam in Brunei Darussalam. The results of the study found that the right to freedom of religion in the CRC is not in line with the principles and teachings of Islam and the imposition of Article 14 of the CRC should be in line with Hukum Syara’ and the laws in Brunei Darussalam.

PELAKSANAAN PENGAJIAN ILMU HADITH DALAM MATA PELAJARAN TURĀTH AL-SUNNAH KURIKULUM AL-SYAHADAH AL-ULYA ULUL ALBAB: SATU PENILAIAN AWAL

Pelaksanaan pengajian hadith secara turāthī di Malaysia, pada dahulunya mendapat tempat dalam kalangan guru-guru pondok dan juga madrasah pengajian hadith. Dewasa kini, Kementerian Pendidikan Malaysia (KPM) menunjukkan kesungguhan dalam memperkenalkan pengajian ilmu hadith secara turāthī dalam pelaksanaan mata pelajaran Turāth al-Sunnah  kurikulum al-Syahadah al-Ulya Ulul Albab khususnya di SM Imtiaz Yayasan Terengganu Besut, Terengganu (SMIYTB). Justeru, kajian ini meneroka sejauh mana pelaksanaan ilmu hadith dalam mata pelajaran turāth al-Sunnah kurikulum al-Syahadah al-Ulya Ulul Albab SMIYTB. Data kajian dikumpulkan melalui proses analisis dokumen dan juga proses temu bual semi struktur bersama seorang Guru Pendidikan Islam Turāth al-Sunnah (GPITS) dan juga perbincangan kumpulan fokus bersama 18 orang murid tingkatan 4. Pekali cohen kappa terhadap data-data yang dianalisis menunjukkan data-data temu bual yang diperoleh adalah berada pada tahap tinggi bagi kedua-dua temu bual iaitu temu bual GPITS (72%) dan temu bual murid (79%). Dapatan kajian menunjukkan pelaksanaan pengajian ilmu hadith dalam mata pelajaran turāth al-Sunnah adalah berasaskan kitab-kitab turath dalam bidang al-Ḥadīth dan Muṣṭalāḥ al-Ḥadīth. Ia diperkenalkan kepada murid-murid sebagai pendedahan dan pengenalan secara asas kepada mereka bagi mendalami hadith-hadith Nabi SAW secara tekstual dan kontekstual dan untuk memahami ilmu-ilmu Muṣṭalāḥ al-Ḥadīth secara asas. Namun demikian, oleh sebab ia dilaksanakan dalam tempoh 60 minit seminggu serta dalam tempoh dua tahun sahaja, setiap kitab yang dipelajari dalam mata pelajaran tersebut disesuaikan dengan sistem pendidikan Kementerian Pendidikan Malaysia (KPM) iaitu dengan diwujudkan sukatan pelajaran yang khusus bagi kedua-dua bidang pengajian tersebut. Justeru, kajian ini dilihat mampu memberikan maklumat penilaian awal yang mendalam tentang pelaksanaan pengajian ilmu hadith dalam mata pelajaran turāth al-Sunnah kurikulum al-Syahdah al-Ulya Ulul Albab di SMIYTB.

KAJIAN PEMAHAMAN AL-QARD & AL-DAYN DI KALANGAN PELAJAR-PELAJAR DI PERINGKAT INSTITUT PENGAJIAN TINGGI DI DAERAH BRUNEI & MUARA

Al-Qard (loan) and Al-Dayn (dependent or debt) are two words that give quite similar meanings but are actually different. This study was conducted to assess the students' understanding of these two terms. Through the habits of students, they consider the expressions for these two terms to be the same and cause misunderstandings that have a lasting impact, especially when it comes to Islamic financial transactions. The importance of this issue is highlighted and intended for students to be more alert of the difference between these two and they will directly convey this knowledge to the community widely. The methodology of this study is derived from references obtained from books, articles, paperwork and an online survey which focuses more on the students of higher education institutes only. The objective of the study is to give awareness of the importance of differences between these two terms which should be known at the early stage, especially by students of higher education institutes. The results concluded that the majority of respondents, more than 50%, thought that the terms were the same. Therefore, this study is expected to contribute to an increase in understanding about it. Although it seems simple, their views can have a big impact on raising awareness about Islamic finance practically, not only through learning (theory).

THE RELEVANCE OF MISYĀR MARRIAGE TO NIGERIAN MUSLIMS misyĀr婚姻与尼日利亚穆斯林的关系

Misyār (marriage of convenience) fulfils all the conditions of marriage contract in Islam except that certain conjugal rights are willingly obliterated by the couples. Though, the evolution of misyār in certain civilizations has inextricably invited contentions among Muslim scholars, the relevance of the practice in Nigeria is a thing of concern considering the level of poverty in the country and the fear of its being abused. The study explores scholastic opinions on the lawfulness and benefits of the marriage with a view to assessing its feasibility and relevance within the Nigerian environment using a combination of historical and descriptive research methods. Findings revealed that misyār, though with its advantages, is delicate to practice in Nigeria because it is vulnerably opened to abuse, and it therefore becomes the responsibility of Muslim scholars in the country to rather mature their thoughts and educate the ummah on the circumstances that could necessitate the practice and the limitations to its practicability.

Though, the evolution of misyār in certain civilizations has inextricably invited contentions among Muslim scholars, the relevance of the practice in Nigeria is a thing of concern considering the level of poverty in the country and the fear of its being abused. The study explores scholastic opinions on the lawfulness and benefits of the marriage with a view to assessing its feasibility and relevance within the Nigerian environment using a combination of historical and descriptive research methods. الإسناد عند علماء القراءات- مفهومه وأقسامه 读物学家的推论

It is evidently known that the Holy Qur’an, and its various readings and narrations, have received great attention since its revelation till today. The `Isnäd “attribution” of the Noble Qur’an is among those aspects that have elicited great interest to the scholars. Hence, this study is carried out to reveal efforts of these scholar in the aspect of readings. The problem of the subject is supped up in the fact that the `Isnäd is considered to be one of the most important component of any acceptable reading; so it is one of the conditions in awarding a reading license, which is considered evidence of the person’s eligibility to take the lead in reading. This study attempts to answer the following questions: what are the efforts of the scholars of readings in taking care of the `Isnäd of the Qur’an? What are the types of readings? Are these evidences still continuing to our present time? The researcher followed the inductive and historical approach to answer these questions, in order to show the adoption of the `Isnäd in the frequent readings in different eras. The study revealed that these chains of narration were written in the books of readings, and in the licenses granted by the reciters to their students, and they still exist to our present era. The Quranic reading license is the process of audio transmission of the Holy Qur’an from one generation to the next, through oral reception, and it is valid to grant the `Isnäd  and the license through modern means of communication and if the sheikh verifies the student’s mastery of reading, the visual face to face meeting with students and his Sheikh is not required for granting the license as such hearing is sufficient for the award of the licence.

It is evidently known that God - glory be to Him - has made it easy to memorise His Book. So He sent it down in many types of readings, to ease the recitation of the Quran for the Ummah and to remove embarrassment and hardship. Muslims have exerted great efforts on Quranic readings in learning and teaching, authoring and publishing, throughout the ages. In this era and with the spread of higher education and the emergence of modern technology - which contributed to the dissemination of legal sciences in general and Quranic readings science in particular - the Islamic world organised a scientific awakening in the renaissance of the Quranic readings, and developed various means of teaching and receiving, and offered specialised programmes in readings’ teaching; which gave a quantum leap to the flourishing of the science of Quranic readings, and to re-establish the Quranic readings from the well-known traditional method, which relied on approval from sheikhs and reading circles (halaqah), by teaching them in institutes and universities using modern technology in spreading them, and the Sultanate of Brunei Darussalam is not an exception to this for the nation is concerned with teaching Quranic readings, spreading the message of memorising Al-Quran, studying its sciences, and fulfilling the Islamic duty in preserving the revelation and its heritage. This topic was set out to find out the reality of teaching Quranic readings in Brunei Darussalam, and to shed light on the efforts made in this field through the programmes concerned with teaching Quranic readings in this country, and to introduce their curricula and teaching methods as to examine the possibility of developing these programmes to keep pace with their counterparts in the world so that student would not be harmed academically when furthering studies abroad.

Analisa Pendekatan Tarbiyah Sayyid Ahmad bin Idris Al Fasi dan Kesannya dalam Dakwah di Alam Melayu

Sayyid Ahmad bin Idris al Fasi is well known among the Muslim community in the Malay world. He was a Sufi scholar who mastered various fields of knowledge and was a leading religious scholar in his time. Sayyid Ahmad bin Idris al Fasi established a mission of inviting people to Islam (da’wah), which expanded throughout the world, especially in Southeast Asia, including in Malaya in the past. The success in producing champions of scholars among his students warrants a detailed study of his motivational teaching approach (tarbiyyah). The purpose of this research is to examine Sayyid Ahmad bin Idris al Fasi's tarbiyyah approach and its impact on da’wah in the Malay World. Descriptive methods through library studies and document analysis were used in this study. The findings of the study found that the tarbiyyah approach by Sayyid Ahmad bin Idris al Fasi had triggered an increase in the study of Islamic knowledge as well as the success of producing Zakir Muslims through da’wah in harmony and wisdom. This discussion is hoped to facilitate a deeper understanding of Sayyid Ahmad bin Idris Al Fasi’s credibility, which adds to the body of knowledge that will guide and benefit the entire ummah.

Menghayati Nilai Iman, Islam dan Ihsan dalam Mendepani Cabaran Kontemporari

Cabaran pada era kontemporari membawa masyarakat berdepan dengan masalah keruntuhan nilai kemanusiaan, jenayah yang berleluasa sertaketidakseimbangan emosi sehingga menimbulkan masalah kecelaruan jiwa. Realitinya keberagamaan masyarakat Islam berada pada tahap rendah atas pelbagai faktor antaranya rendahnya kefahaman agama, terpengaruh dengan budaya barat dan merasakan kehidupan beragama hanya bagi mereka yang berusia tua. Nilai-nilai keagamaan yang semakin rendah serta berlakunya konflik dalam institusi keluarga mampu menyumbang kepada wujudnya penyakit sosial masa kini. Krisis kejiwaan dan ketandusan spiritual manusia di era globalisasi dapat diatasi jika manusia kembali kepada agama dan mengamalkan ajaran-ajaran agamaMasyarakat perlu mempunyai kemahiran daya tahan dan jati diri yang kukuh bagi melahirkan insan seimbang dari aspek dalaman dan luaran. Oleh itu suntikan elemen agama dan kerohanian menjadi keutamaan sebagai usaha untukmeningkatkan kesejahteraan diri. Artikel ini menggunakan metod dokumentasi dengan mengumpulkan data-data berkaitan nilai tiga prinsip asas agama iaitu Iman, Islam dan Ihsan sebagai asas fardu ain yang menjadi kewajipan kepada setiap mukallaf untuk dipelajari, difahami, dihayati serta diamalkan. Artikel ini juga membincangkan 10 ciri amalan beragama di dalam Surah al-Ahzab ayat 35 sebagai ciri amalan beragama yang perlu diikuti oleh setiap individu muslim dalam mengharungi kehidupan seharian. Artikel ini menyimpulkan terdapat enam elemen utama dalam menghayati amalan beragama melalui tiga prinsip agama.Enam elemen ini yang berkait di antara satu sama lain iaitu; Ilmu; Amalan zahir dan batin; Hubungan dengan Allah dan manusia; Perintah suruhan dan tegahan; Amalan fardu dan nawafil dan Istiqomah.
