Eigenrechte der Natur – rechtsdogmatische und rechtspolitische Anmerkungen 自然教条与法律政策的主张

The article addresses the discussion on inherent rights of nature that is conducted on an international level by presenting reasons to assign subjective rights to non-human beings and attempting to refute objections against it. The article’s focal point is the question who could be a carrier of inherent rights of nature, which would be the content of such rights and which institutions could protect them.

Mit zunehmendem Zugang zum Internet hat sich das explorative Verhalten von Kindern zu Sexualität auch auf den Onlinebereich ausgeweitet. Dies führte zu einer Wiederbelebung der moralischen Panik rund um die kindliche Sexualität, insbesondere in Bezug auf das wachsende Phänomen des einvernehmlichen „Sextings“ zwischen Minderjährigen. Diese moralische Panik wird durch die Sorge um sexuellen Missbrauch und sexuelle Ausbeutung von Kindern im Kontext von „Kinderpornographie“ noch weiter befeuert. In dem Bestreben, Kinder vor solchen Straftaten zu schützen, wird einvernehmliches „Sexting“ zwischen Minderjährigen in manchen Ländern als Produktion und Verbreitung von „Kinderpornographie“ gewertet und führt so zur Strafverfolgung beteiligter Kinder als SexualstraftäterInnen. Effizienterer Menschenrechtsschutz durch Vorabbefassung des Europäischen Gerichtshofs für Menschenrechte? 通过欧盟人权法院前渗透更有效地保护人权?

Protocol No. 16 to the European Convention on Human Rights (ECHR), which came into force in August 2018, enables the member States to request the European Court of Human Rights to give advisory opinions on questions of principle relating to the interpretation and application of the rights and freedoms defined in the Convention and the Protocols thereto. The German Government does not consider it necessary to sign and ratify Protocol No. 16 at the moment referring to the well-developed constitutional protection of Human rights in Germany. This article critically assesses this view and argues that the possibility to apply to the Court for advisory opinions can contribute to making Human rights protection in Germany more effective.

In this paper, the author examines the effects that the judgment of the German Constitutional Court concerning the party ban in Art. 21 I GG (17 January 2017) had on government, legislator and society since it was rendered roughly two years ago. For this purpose, she illustrates the relevant changes of the procedural and substantive law of Art. 21 GG and analyses the historical and political background of those changes. She puts special emphasis on the influence that the case law of the ECHR had on the new interpretation of Art. 21 GG. In the end, she questions whether the judgment, which on the surface emphasises the importance of strengthening the freedom of political parties, is able to live up to it’s own standards in reality. For this, she studies to what extent state repression (also, and in particular illegal one) of political parties has increased during the time since the judgment.

The topic of restitution in UN-Documentation following WW II 第二次世界大战后联合国文件中的归还问题

Based on an examination of the relevant UN-Documentation, this report identifies four notable instances of the topic of restitutions and reparations for victims of the Third Reich appearing as a topic of interest for UN bodies: the provisions made in the interest of refugees as part of the Paris Agreement, the discussion surrounding the draft of the Genocide Convention, as well as the legislative involvement of the International Refugee Organization (IRO) and the Secretary General of the UN (Sec-Gen) in the (later) Federal Republic of Germany (FRG). The funds created by the Paris Agreement are, probably, of the least interest, since they were conceived more as immediate relief than as individualized reparation. The discussion surrounding the Genocide Convention is interesting from a historical standpoint, as it attests an early and acute awareness of the underlying issues. However, any discussion addressing the restitution and reparation of victims of genocide did not find its way into the Convention. The involvement of the IRO with the Office of the Military Government for Germany, United States (OMGUS) and the FRG, which resulted in the drafting of specific laws on the matters of restitution and reparation, is perhaps the most interesting of the instances noted here. Potentially, the IRO played a significant role in the move towards restitution during the short years of its existence. Further investigations based on sources other than UN Documentation could reveal the extent to which the IRO was materially involved in the drafting of specific laws. The efforts of the Sec-Gen towards the reparation of victims of “medical” experimentation provides great insight into the process by which one such issue was discovered and addressed within the UN at the time. Beyond that, this is an instance in which there is a deeper understanding of the specific involvement of a UN-body with German reparatory legislation. In this case, it amounted to bringing up the issue and urging appropriate action without much involvement in the particulars of the resulting measures. Overall, it should be summarized that there was no consolidated or systematic effort towards the restitution of victims of the Third Reich on the parts of the UN. Rather, the issue appeared and reappeared with some frequency and only in certain cases did the UN take action.

{"title":"The topic of restitution in UN-Documentation following WW II","authors":"Ben Adolff","doi":"10.5771/2193-7869-2022-3-227","DOIUrl":"https://doi.org/10.5771/2193-7869-2022-3-227","url":null,"abstract":"Based on an examination of the relevant UN-Documentation, this report identifies four notable instances of the topic of restitutions and reparations for victims of the Third Reich appearing as a topic of interest for UN bodies: the provisions made in the interest of refugees as part of the Paris Agreement, the discussion surrounding the draft of the Genocide Convention, as well as the legislative involvement of the International Refugee Organization (IRO) and the Secretary General of the UN (Sec-Gen) in the (later) Federal Republic of Germany (FRG). The funds created by the Paris Agreement are, probably, of the least interest, since they were conceived more as immediate relief than as individualized reparation. The discussion surrounding the Genocide Convention is interesting from a historical standpoint, as it attests an early and acute awareness of the underlying issues. However, any discussion addressing the restitution and reparation of victims of genocide did not find its way into the Convention. The involvement of the IRO with the Office of the Military Government for Germany, United States (OMGUS) and the FRG, which resulted in the drafting of specific laws on the matters of restitution and reparation, is perhaps the most interesting of the instances noted here. Potentially, the IRO played a significant role in the move towards restitution during the short years of its existence. Further investigations based on sources other than UN Documentation could reveal the extent to which the IRO was materially involved in the drafting of specific laws. The efforts of the Sec-Gen towards the reparation of victims of “medical” experimentation provides great insight into the process by which one such issue was discovered and addressed within the UN at the time. Beyond that, this is an instance in which there is a deeper understanding of the specific involvement of a UN-body with German reparatory legislation. In this case, it amounted to bringing up the issue and urging appropriate action without much involvement in the particulars of the resulting measures. Overall, it should be summarized that there was no consolidated or systematic effort towards the restitution of victims of the Third Reich on the parts of the UN. La Commission européenne a présenté une proposition de règlement « relative aux injonctions européennes de production et de conservation de preuves électroniques en matière pénale ». Il est destiné à répondre aux lacunes alléguées dans l'application de la loi lors de la collecte d'éléments de preuve à partir de données stockées dans le « cloud ». La proposition représente un changement de paradigme puisque le principe de territorialité est remplacé par le principe du marché. Elle implique un changement d'orientation du droit procédural pénal européen, qui passe de la reconnaissance mutuelle et de la coopération judiciaire à l'accès unilatéral de l'exécutif aux éléments de preuve. Cela porte atteinte aux principes de protection des données. Mais au-delà de ses conséquences immédiates, la proposition est avant tout un modèle à long terme pour déformer le système de justice pénale européen dans son ensemble. Elle fait partie d'un réseau européen d'enquête qui échappe largement à un contrôle judiciaire contraignant et efficace.
