Im Folgenden werden drei Erfahrungsberichte von Doktorandinnen und Doktoranden dokumentiert, die eines der an der Fakultät für Rechts- und Politikwissenschaft der National University of Laos stattfindenden Seminare über rechtswissenschaftliche Methoden entscheidend gestaltet haben. Sie haben nicht den Anspruch, eine wissenschaftlich begründete Konzeption eines interkulturellen Austausches über juristische Grundlagen und Methodenlehre zu liefern. Vielmehr geben sie sehr persönlich gefärbte Eindrücke wieder, wie Grundprobleme und Herausforderungen dieses Austausches erlebt und bewältigt werden. Insofern mögen sie als Quelle, möglicherweise als Inspiration, dienen, wie Zusammenarbeit angesichts kultureller Differenz gestaltet werden könnte. Bewusst wurde die persönliche Note der Berichte nicht aussen vor gelassen, weil sie die Perspektive von Nachwuchsjuristinnen und - juristen spiegelt, die sich den Zumutungen des Rechts in einer globalisierten Welt stellen müssen.

Just a nudge into the right direction? It is in line with this maxim that the behavioural theory of liberal paternalism - recently met with increasing worldwide attention and approval - suggests to motivate citizens to healthy and sustainable decisions through a “nudge” by the state rather than legal compulsion. The article at hand examines if the use of nudges in German health law is expedient and in accordance with the constitution. In a first step it therefore lays out the fundamentals of the concepts and a second step presents possible examples of application which will then be critically examined.

Cette recherche porte sur la relation entre la promotion des investissements directs étrangers et la protection de l’environnement au Laos, sujet controversé dans un pays en développement considérant qu’attirer l’investissement étranger est une priorité nationale. Après avoir envisagé les caractéristiques générales du droit international des investissements étrangers et de la protection de l’environnement, cette étude présente le cadre juridique spécifique - international et national - applicable au Laos, avant d’analyser de façon critique ce dernier. Cet article montre que les traités d’investissements auxquels le Laos est partie mentionnent seulement rarement les questions environnementales et sans constance. Cela peut être lu comme une crainte de freiner les investissements étrangers et d’adopter un positionnement ferme en faveur de l’environnement, mais pourrait aussi être vu comme une attitude attentiste (« wait and see ») ne fermant pas la voie à des traités d’investissement plus protecteur. L’auteur suggère notamment que le Laos devrait réévaluer les investissements étrangers existants et sa stratégie pour les attirer en révisant à la fois sa politique internationale et interne. Les traités d’investissements devraient intégrer des dispositions relatives à la protection de l’environnement pour encourager le développement durable à côté de la promotion des investissements étrangers. Les traités internationaux d’investissements pourraient alors être un outil d’interprétation pour les tribunaux internationaux en ce qui concerne les questions environnementales. Au-delà de la dimension externe de ces derniers, ce type de dispositions pourrait renforcer le pouvoir des États hôtes de réglementer la protection de l’environnement et avoir ainsi une dimension interne. Enfin, cette contribution insiste sur la nécessité d’améliorer les mécanismes existants, particulièrement le rôle des autorités nationales de supervision dans l’application du droit existant pour prévenir les dommages écologiques.

In March 2020, during the first wave of the COVID-19 (Coronavirus SARS-CoV-2) pandemic in Europe, several Member States, including the Federal Republic of Germany, saw fit to resort to the reintroduction of border controls with some of their neighbours, including the Grand Duchy of Luxembourg. This reintroduction was then justified by the urgency and the need to contain the spread of the virus. So that there is no misunderstanding: these were exclusively identity checks and checks on documents authorizing their holders to cross borders and not health checks to detect carriers of the virus. This contribution aims to establish, using the example of the German-Luxemburg border controls, that the use of this extraordinary means does not stand the test of its effectiveness, proportionality and even less of its legality. To the extent that the perpetrator was himself a victim of this extraordinary measure, he may be forgiven for the somewhat militant character of the following lines. The German Minister of the Interior, Mr Horst Seehofer, who took this decision on behalf of Germany, may have invoked the European Union (EU) Border Code as the legal basis for his decision to reintroduce internal border controls in the Schengen area, but it must be questioned whether he has complied with the letter and spirit of this regulation. An in-depth analysis of the provisions of this Borders Code (I.) shows indeed that the unilateral decision taken by Minister Seehofer was taken arbitrarily (II.) and does not stand the test of its validity under Union law (III.)
