The European Union is a cooperative club to generate benefits for all member states. In order to do justice to the different preferences of the members, the EU was only given specific and unanimously decided competences. After the welfare economist Vilfredo Pareto, a Pareto-optimal state is created in the internal market, which is named after him. However, as a non-cooperative actor in areas without mandates (collective bargaining autonomy), the ECJ creates a Pareto deterioration, although it is secured as a central labor market policy in the Charter of Fundamental Rights (Article 28 CRCh). The core content of Article 9(3) of the Basic Law, protected by the Federal Constitutional Court, also falls victim to the ECJ. A solution model is presented to ensure collective bargaining autonomy.

Using the example of the ECJ's decision on the German infrastructure use charge for passenger vehicles (C-591/17), the article addresses methodological questions of indirect discrimination in the context of the EU`s fundamental freedoms. In doing so, the question is raised whether the construction of the passenger vehicle use charge is – due to the controversy – a legal example of what can be described as a reversible figure. The central thesis is that this impression only arises due to a certain methodological perspective. The impression of a reversible figure can be dissolved as a mere illusion if one broadens the methodological perspective for the understanding of indirect discrimination. Figuratively speaking, one has to take a step back and not only focus on the discriminatory character of the vehicle use charge.

The law governing the German intelligence services lacks a consistent concept, is non-transparent, fragmented and in urgent need of reform. In May 2020, the First Senate of the Federal Constitutional Court held that the Federal Intelligence Service (Bundesnachrichtendienst - BND) is bound by the fundamental rights of the Basic Law when conducting telecommunications surveillance of foreigners in other countries (so-called Foreign-Foreign Strategic Surveillance), and that the statutory bases in their current design violate the fundamental right to the privacy of telecommunication and freedom of the press. The judgment put an end to the long-running discussion about whether intelligence operations abroad are suitable for statutory regulation at all. Moreover, the Constitutional Court’s decision provided the impetus for one of the most significant reforms in recent German security law. By April 2021, the amendment of the BND Act was finally on the books. It will enter into force in January 2022. It codifies important new rules about the practice, authorization and oversight of foreign data collection by the BND as well as legal requirements for Germany’s participation in international intelligence cooperation. The reform’s provisions implement the constitutional requirements, as stated in the judgement, almost literally. Nonetheless, the reform created a number of new problems and left major deficits in German intelligence law unresolved. It is far from creating a clear and consistent legal framework for the activities of the three federal intelligence services, in particular their surveillance practices. The article outlines the major shortcomings, developments and perspectives in this field of security law.

The article aims at a coherent regulatory goal of a modern law of protection of cultural property which must find its expression in the notions „cultural property“ and „national cultural property“. In this context the thought that certain objects are involved into practices of today‘s society which characterize cultural life becomes essential. As some of these objects cannot be arbitrarily substituted it is the mission of the law of cultural property to secure that they are handled in a sustainable manner.

Kompetenzen werden in einem diskursiven Prozess abgegrenzt. Dieser Vorgang findet traditionell zu wenig Berücksichtigung. Am Beispiel des Mandats der europäischen Zentralbank und seinen unionsvertraglichen Rahmenbedingungen möchte der Beitrag zeigen, warum das klassische Verständnis allzu klarer und rigider Kompetenzgrenzen bei komplizierten Abgrenzungsfragen nicht weiterführt. Dafür werden zunächst drei Unschärfen bei der Abgrenzung der Kompetenzen der EZB ausgemacht, die für andauernde Kontroversen verantwortlich sind. Die Ausfüllung der dadurch entstehenden Spielräume erfolgt durch die Ausübung von Macht. Diese wird maßgeblich vom juristischen Diskurs in Wissenschaft, Gesellschaft, Politik und Praxis angeleitet, kontrolliert und strukturiert. Die rechtliche Verarbeitung dieses Prozesses gewinnt, wenn die jeweiligen Akteure ihre Rolle stärker als bisher reflektieren und die diskursiven Elemente in der Struktur der rechtlichen Kontrollmaßstäbe berücksichtigt werden.

Cet article traite des rapports entre formation juridique et État de droit au Laos, notamment à travers l’expérience du projet de coopération interuniversitaire entre l’Université du Luxembourg et l’Université Nationale du Laos. L’étude revient d’abord sur le cadre théorique et concret dans lequel intervient cette coopération en s’intéressant au concept d’État de droit et à son lien avec l’aide au développement, à la transplantation du concept d’État de droit dans le droit laotien ainsi qu’à sa mise en œuvre. La contribution propose ensuite un état des lieux de la situation universitaire au Laos en mettant l’accent sur la contribution de l’assistance internationale à l’élaboration d’une Faculté de droit. Enfin, l’article souligne les paramètres culturels et politiques qui viennent limiter les travaux universitaires, particulièrement la difficulté d’accéder à des sources et ressources juridiques. En conclusion, l’auteur insiste sur la nécessité de forger une culture juridique laotienne via l’université pouvant permettre de soutenir une transition effective vers l’État de droit.

Populists are gaining influence worldwide. It is evident from various examples around the globe that they can become a serious threat to liberal democracy by successively transforming democratic systems into autocracies. So far, hardly any effective means has been found to tackle the phenomenon. Reason enough to carefully assess the resilience of the Basic Law against authoritarian-populist attacks and to identify solutions for existing vulnarabilities.
