Use of Aspiration Funds of The Council of Representatives; Study on Constitutional Court Decision Number 106/PUU-XIII/2015 (三)代表会议愿望基金的使用情况;宪法法院第106/PUU-XIII/2015号判决研究

The background to this research is that Article 80 Letter J of Law Number 17 of 2014 has been reviewed by the Indonesian Constitutional Court. The Petitioner in this case represents the people of Papua, who believe their constitutional rights have been violated because the petition will result in unfair management of state finances that benefits only the people in the area chosen to have the most seats in the House of Representatives. However, the Constitutional Court rejected the request brought against article 80 letter j in decision 106/PUU-XIII/2015. This research employs normative legal analysis by collecting data from the Research Library, which examines relevant documents. The findings of this study indicate that the use of aspiration funds as defined in Article 80 Letter J of Law Number 17 of 2014 does not reflect people's justice, as the allocation of aspiration funds is unfair, as it is based on electoral districts and the number of House of Representatives seats. Individuals within an area are not identical, which may result in development injustice.

Position of the Presidential Staff Office in the Indonesian State Administration System 总统办公厅在印尼国家行政系统中的地位

The primary issue addressed in this research is the Presidential Staff Office's position in the Indonesian constitutional system following the issuance of Presidential Regulation No. 26 of 2015 regarding the Presidential Staff Office. According to Articles 1 to 4 of Presidential Regulation Number 26 of 2015, the Presidential Staff Office's role is to improve the smooth control of national priority programs and to organize presidential political communication as well as to manage strategic issues. This research employs a normative legal methodology. The findings of this study indicate that the Presidential Staff Office (KSP) falls into a category of state organs that are auxiliary/supporting (auxiliary organ state) to the implementation instruments of the primary state institutions (main organ state/constitutional organ), with a hierarchical structure of group/third-tier state institutions that derive their authority from the regulator/establishment under the law or via a Presidential Decree.
本研究解决的主要问题是2015年关于总统办公厅的第26号总统条例颁布后,总统办公厅在印尼宪法制度中的地位。根据2015年第26号总统条例第1条至第4条,总统秘书室的作用是改善国家优先项目的顺利控制,组织总统的政治沟通,以及管理战略问题。本研究采用规范的法律方法。本研究结果表明,总统办公厅(KSP)属于辅助/支持(辅助机关国家)主要国家机构(主要机关国家/宪法机关)的执行工具的国家机关类别,具有集团/三级国家机构的等级结构,根据法律或通过总统令从监管机构/机构获得权力。

Constitutional Complaint Sebagai Penambah Kewenangan Baru Dalam Undang-Undang Mahkamah Konstitusi Republik Indonesia

Guarantee the rights of every citizen for violations of constitutional rights by seeking to increase the authority of the Judicial Review Request by every justice seeker for violations of constitutional rights, but not at least the petition was granted.  The Mahkarnah of the Constitution, which checks what the petition is made of, often considers that what the Judicial Review proposes is not the subject of acknowledgment.  Constitutional Court Judges considered it to be a Constitutional complaint in which this constitutional complaint was not part of the Court's authority in accordance with the Constitution of the Republic of Indonesia and the applicable Law on the Understanding of the Constitution.  As a legislative body, the DPR is the one who has the right to change the Constitutional Court Law by including the authority of Constitutional complaint to the Constitutional Court. In this paper the author uses a research method in the form of quality data analysis with secondary sources of literature and deductive logic analysis.  Consitional Complaint to the Constitutional Court.

Implementasi Disiplin Aparatur Desa di Desa Gantar Kecamatan Gantar Kabupaten Indramayu

AbstractThe performance of village office staffs that still has many weakness related to the recruitment which was based on the family relation and not based on professionalism and also there were many public service that did not run well and smoothly. Islam rules this life based on Al-Qur’an and Hadith and it has good management in regulating the government by prioritizing the education of aqidah Islamiyah as the base of organizing the country and nurturing the noble attitude and behavior. The researcher was interested and encouraged to study and investigate the discipline of village office staffs especially at Gantar Village The aims of this research are to find out how is the discipline of village officestaffs in running their daily duties and how is the discipline implementation of village office staffs according to The Law Number 6 in 2014. This research employed analytical descriptive research by describing the discipline practice applied by the village chief of Gantar as the person in charge of the village government. The results of this research, it is found out that the work discipline expected by the government through The Law Number 6 in 2014 for each staff of village office at Gantar Village is less maximal. This was proven by the village office staff who did not obey the work hours either when it supposed to be started or when it supposed to go home, even the performance is still very poor. The control of the village chief as the executif officer at the village is not maximal yet. There are still some village office staffs that are not active for three months but still free of any reprimand letter, sanction until firing based on the suggestion from BPD (The Board of Village Representative) and The Law Number 6 in 2014. This condition is complained by most of the villagers because they need good public service. Keputusan Mahkamah Konstitusi No. 97/2017 dan Pengaruhnya Terhadap Perubahan Identitas Perempuan Penghayat 宪法法院2017年11月7日的判决以及它对改变残疾人女性身份的影响

Sejak diberlakukannya PenPres No 1 tahun 1965 tentang Pencegahan Penyalahgunaan dan atau Penodaan Agama, aliran – aliran kepercayaan di Indonesia dianggap bukan bagian dari agama- agama yang diakui di Indonesia. Meski sebelumnya keberadaan mereka telah menjadi polemik dan perdebatan namun dikarenakan kebijakan tersebut telah membuat penganut aliran kepercayaan mengalami banyak diskriminasi dan stigmatisasi di masyarakat serta membawa pengaruh pada kehidupan ekonomi sosial politik serta nasib anak-anak mereka. Nasib bisa saja berubah dikarenakan kebijakan baru diakhir tahun 2017 melalui keputusan Mahkamah Konstitusi No 97 tahun 2017 tentang diperbolehkannya mengubah ‘agama’ menjadi ‘kepercayaan’ pada kolom agama yang tertera di KTP dan KK. Adakah niat mengubah identitas dan mencantumkan ‘Kepercayaan’ pada kolom agama pada kartu identitas mereka? Ataukah ini sekedar awal dari sebuah perjuangan yang masih panjang? Tulisan ini membahas bagaimana respon kelompok penghayat perempuan terkait adanya keputusan MK 97/17. Kajian literasi dilakukan disertai wawancara beberapa perempuan penghayat sebagai bahan konfirmasi data dari dokumen- dokumen yang tersedia. Pengalaman yang dimiliki perempuan tentunya berbeda dengan pengalaman laki-laki, dan tentunya mempengaruhi perempuan dalam menyikapi keputusan MK 97/17. Akhirnya agama atau kepercayaan sebagai identitas menjadi pilihan, bagaimana perempuan penghayat yang ditemui ternyata lebih memilih tidak merubah identitas mereka di kolom KTP dan KK. Mereka lebih mengutamakan membangun komunitas mereka sebagai sesama perempuan penghayat dan saling menguatkan ditengah-tengah situasi sosial politik yang kurang berpihak dan kebijakan negara masih setengah-setengah mengakui keberadaan mereka. Steve Bruce mengistilahkannya sebagai proses ‘culture transition’ yang dihadapi individu yang teralienasi didunia baru, kadangkala agama dibutuhkan demi menghindari resiko-resiko sosial dan politik sehingga mereka rela mengkosongkan atau bahkan menyembunyikan identitas diri sebagai penganut kepercayaan agar bisa diterima masyarakat luas.

Meski sebelumnya keberadaan mereka telah menjadi polemik dan perdebatan namun dikarenakan kebijakan tersebut telah membuat penganut aliran kepercayaan mengalami banyak diskriminasi dan stigmatisasi di masyarakat serta membawa pengaruh pada kehidupan ekonomi sosial politik serta nasib anak-anak mereka. Nasib bisa saja berubah dikarenakan kebijakan baru diakhir tahun 2017 melalui keputusan Mahkamah Konstitusi No 97 tahun 2017 tentang diperbolehkannya mengubah ‘agama’ menjadi ‘kepercayaan’ pada kolom agama yang tertera di KTP dan KK. Adakah niat mengubah identitas dan mencantumkan ‘Kepercayaan’ pada kolom agama pada kartu identitas mereka? Ataukah ini sekedar awal dari sebuah perjuangan yang masih panjang? Tulisan ini membahas bagaimana respon kelompok penghayat perempuan terkait adanya keputusan MK 97/17. Kajian literasi dilakukan disertai wawancara beberapa perempuan penghayat sebagai bahan konfirmasi data dari dokumen- dokumen yang tersedia. Pengalaman yang dimiliki perempuan tentunya berbeda dengan pengalaman laki-laki, dan tentunya mempengaruhi perempuan dalam menyikapi keputusan MK 97/17. Akhirnya agama atau kepercayaan sebagai identitas menjadi pilihan, bagaimana perempuan penghayat yang ditemui ternyata lebih memilih tidak merubah identitas mereka di kolom KTP dan KK. Mereka lebih mengutamakan membangun komunitas mereka sebagai sesama perempuan penghayat dan saling menguatkan ditengah-tengah situasi sosial politik yang kurang berpihak dan kebijakan negara masih setengah-setengah mengakui keberadaan mereka. Perlindungan Hukum Terhadap Justice Collabolator Dalam Perkara Pidana Korupsi 刑事腐败中对正义与发展党的法律保护

AbstractCorruption is an extraordinary and difficult problem to eradicate so that one of the responsibilities in the Corruption Criminal Court is needed to resolve other corruption cases. The witness of the offender or known as the Justice Collaborator is a secret leaker who works with Law Enforcement Officials to dismantle another crime by giving information or testimony to the crime he has committed with his colleagues. A person who is a witness or a criminal is very much getting threats from outside parties, both for himself and for his family. Therefore, legal protection is needed that guarantees the safety of the witnesses given. Legal protection is the protection given to every citizen is no exception, because Indonesia is a legal state that upholds the values of justice and law enforcement and human rights. Protection of Justice Collaborator has been regulated in Law Number 31 of 2014 as regards Protection of Witnesses and/or Victims. In the Law, a Justice Collaborator has the right to get protection for his personal, family and property security, and is free from Threats relating to the testimony that he will, is or has given. Witness Actors have the right to obtain protection, this is in accordance with the LPSK and the 1945 Constitution regulations, so that the state is obliged to respect, protect and fulfill human rights, even though the Justice Collaborator is someone who has committed a crime.Keywords: Legal Protection, Justice Collaborator, Corruption.

Abstract:The Constitutional Court in its position as guardian of the constitution has the authority to examine laws against the Constitution. The position of the Constitutional Court is only limited to negative legislature. However, in its implementation many Constitutional Court decisions sometimes make positive legislature decisions. This has become a debate among observers of state administration law. This research method uses a normative juridical legal research approach, while the type of research used is descriptive qualitative analytical, and data collection techniques are library research. From this research it is known that the constitutional court has raised new norms in judicial review.Keywords: New Norms, Laws, Constitutional Court

AbstractThe philosophy of Value-Added Tax (VAT) is a tax on consumption which is severely influenced by the development of business transaction and consumption pattern of society. In order to be the tool of social engineering and give legality of justice, Law Number 42 of 2009 should give certainty of law related to VAT imposition on transaction influenced intensely by business model growing in line with social development. Information technology development endorses the digital economy. Despite the fast growth of the digital economy in Indonesia, in line with the consistent growth of public and government consumption, the VAT revenue does not grow for consecutive three years. Law Number 42of 2009 does not prescribe explicit imposition VAT. Provision of VAT imposition on the digital economy makes VAT Law does not give justice legality and does not function as a tool of social engineering.Keywords: Value-Added Tax (VAT), Digital Economy, Justice Legality.

Abstract:Impeachment can occur in every country, even it must be accommodated in the state administration system in a country based on a democratic system, including in this case the State of South Korea. The implementation of dismissal from the highest executive power is due to violations of the provisions of the applicable laws and regulations. This research method uses a normative juridical legal research approach, while the type of research used is descriptive qualitative analytical, and data collection techniques are library research. From this research it is known that the country of South Korea also provides opportunities in the country's constitution to impeach a president who is considered to have violated the laws and regulations. Although the implementation mechanism is slightly different from the mechanism of impeachment in Indonesia.Keywords: Impeachment, President, South Korea

Eksistensi Calon Perseorangan Dalam Pemilukada di Indonesia 个人候选人在印度尼西亚的存在

Abstract.Every citizen has the right to get the same opportunity in government. Therefore, the state must facilitate the rights of its citizens, because it is regulated in the constitution. This study uses normative legal research methods and literature studies. The results showed that the existence of individual candidates in the political and democratic system occurred because Law No. 32/2004 on Regional Government only limited and facilitated candidates for regional heads who came from political parties only. Individual candidates in the post-conflict local election in Indonesia are insignificant because one of them is the regulation governing individual candidates considered burdensome for individual candidates, even though the individual candidates have been regulated in the 1945 Constitution and strengthened by the Constitutional Court Decision Number 5/PUU-V/2007 which is the political right of the community to be chosen as a form of democracy and human rights. Deparpolization is caused by a decrease in public trust in political parties, so that people look for other political channels and provide space for people who do not have political vehicles, which are expected to be able to answer the deadlock of political parties so that their political rights can run well.Keywords: Individual Candidates, Democracy, Political Parties, General Election.
