KEDUDUKAN ADILLAH ISTI’NASIYYAH DALAM PENGUATAN HUKUM FIKIH NORMATIF

In Islamic jurisprudence issues, sometimes problems are found for which there are no valid, clear, and firm evidences, whether from the agreed upon evidence or not. There is also issue that has evidences but there are other things that also strengthen the basis. This is not in the context of arguing, but is sometimes used to further solidify the outlook and action. The evidence is called adillah isti’nasiyyah. There are eleven adillah isti’nasiyyah found in this discussion. Two of them deserve to be promoted to adillah mukhtalaf fihi status. The two which went up in status were al-akhzu bi aqalli maqiila and al-istiqra’. The others are al-akhzu bil akhaff, al-akhzu bil aktsar, al-akhzu bil asyaq, al-akhzu bil wasth, dalalatus siyaq, dalalatul iqtiran, weak but has authentic eaning hadiths, al-ihtiyat, al-ilham. Discussions about the adillah isti’nasiyyah separately and comprehensively have not been found and discussed, although they still exist. Of course, it is necessary to elaborate further on this issue in order to add to the body of scientific knowledge. In discussing an Islamic jurisprudence issue, etc., scholars sometimes use this term in order to increase the basis for argumentation, even though in essence the evidences presented are sufficient.

STATUS HADIS-HADIS YANG DINILAI DA’IF DALAM SAHIH BUKHARI 圣战者的身份由达伊夫在三日决定

A critique of Sahih Bukhari has been from Islamic scholars from time to time. Even if a hadith researcher opens the Sahih Bukhari book and then examines the hadith, sometimes he finds a narrator who is not thiqah in his lineage. This of course raises the question, whether the scholars agree on the validity of all the hadiths contained in the book, or whether there are hadith that are not valid, which Imam Bukhari deliberately included in order to explain its status. Then if it is not valid, can the hadith be used for h}ujjah. In this paper, using a qualitative research approach and the type of library research, we will explain the status of the authenticity of the hadith that were criticized in Sahih Bukhari. The results of this study conclude that there is nothing in Sahih Bukhari’s hadith that cannot be used as hujjah, but there are hadith that are included with the aim of explaining their invalidity.

ANALISIS UNDANG-UNDANG HUKUM KELUARGA MESIR NOMOR 100 TAHUN 1985 PASAL 11 TENTANG POLIGAMI DAN RELEVANSINYA DENGAN MAQASHID SYARIAH

This study examines and analyses the Egyptian Family Law Number 100 of 1985 Article 11 concerning polygamy and its relevance to maqashid sharia. This research is a library research, and the data analysis technique used in this research is content analysis and deductive analysis approach. This study concludes that, firstly, the substance of the Egyptian Family Law Number 100 of 1985 Article 11 concerning polygamy is: a. The husband must explain his marital status in the marriage certificate. b. The husband who will be polygamous must explain in a statement, the names of his wives and their places of residence. c. The notary must notify the first wife of her husband's marriage. d. A wife whose husband is polygamous can file for divorce if she experiences material or immaterial harm. e. If the judge is unable to reconcile between the husband and his first wife or his previous wives, the judge separates the two with the status of talak bain. f. The right of filing for divorce for the first wife or the previous wives is abolished if one year has elapsed since they ascertained of their husband's new marriage. g. The new wife can file for divorce if it turns out that her husband is hiding his old marriage. Secondly, this study concludes that the Egyptian Family Law Number 100 of 1985 Article 11 is relevant to maqashid sharia, the maqshad ashli (main goal) in it is hifzhun nasl, which is preserving the lineage and the continuity of offspring. As for the maqashid tab'iah (supporting goal) in the law is to create tranquillity in married life, the protection of the wives and children’s rights, and the protection of the husband’s rights

MODERNISASI PEMBUNUHAN ANAK 儿童谋杀的现代化

This study aims to reveal the continuity and development of one of the deviant human behaviors to their own offspring, that is killing their children. This study examines historical data as well as the role of various technological and scientific advances on child homicide. By analyzing historical data that has been summarized from various references, the researchers try to find similarities and differences between the practice of child homicide in the past and the practice of child homicide in the modern era. At the same time, researchers are also trying to find the influence of modern technology on some child homicide attempts. The results of this study indicate that the motive for child homicide still revolves around two things; gender discrimination and economic concerns. These two things are the most common reasons behind the practice of child homicide. And in the modern era, there is another reason why child homicides are increasing, namely unwed pregnancy, especially in women at an early age, as a result of the rampant promiscuity in society.

المنهج العلمي على ضوء مذهب السلف 基于先天理论的科学方法

هذا البحث يتكلم عن المنهج العلمي على ضوء مذهب السلف من خلال دراسة تحليلية لمحتوى كتاب "فضل علم السلف على الخلف" لابن رجب المتوفى (795ه)، وموضوع البحث ينحصر في بيان معالم رئيسية وأصول واضحة لمنهج السلف في العلم، والمقصود بالسلف هم القرون الثلاثة المفضلة. ويعد هذا البحث من البحوث المكتبية القائمة على المنهج الكيفي الاستقرائي التحليلي. وتتخلص معالم المنهج العلمي السلفي في الأمور التالية: العلم ينقسم إلى النافع وغير النافع ولكل منهما علامات يعرف بها، ومصدر العلم النافع هو الكتاب والسنة والمأثور عن الصحابة ومن بعدهم من أئمة الدين، وحقيقة العلم النافع هو ضبط نصوص الوحي وما أثر عن السلف الصالح والتفقه فيها، وأصل العلم هو العلم بالله وأحكامه، والعالم الرباني الذي يتصف بخشية الله، والمنهج العلمي السلفي مبني على العلم والعمل، وضبط النص وفهمه، وتعظيم السلف الصالح والاقتداء بهم، والمعيار الصحيح لمعرفة العالم هو موافقة الحق وليس بكثرة الكلام، ومن أنفع الطرق وأعظم الأسباب لتحصيل العلم النافع: الإخلاص، والاستعانة بالله، والاجتهاد في ضبط نصوص الوحي وفهمها، وعلم الجرح والتعديل والعلل، ومن العلوم ما يطلب بقدر الحاجة ويذم التوسع فيه، كعلم الأنساب والحساب والتسيير والعربية، وضرورة الحذر من العلوم المحدثة بعد السلف الصالح، كعلم الكلام المأخوذ من الفلسفة وما يتفرع عنه من المسائل المغلوطة والاعتقادات الباطلة.

PERAN SYARIAT POLIGAMI DALAM MENGATASI PROBLEMATIKA HIDUP WANITA PASCA PERCERAIAN DAN KEMATIAN SUAMI 一夫多妻制在解决离婚和丈夫去世女性生活中的问题方面所起的作用

A marriage has an important role for human in realizing their happiness. Marriages that are permitted by the Shari'a are not only monogamous, but also polygamous. However, polygamy often gets a negative stigma from some circles, including as one of the triggers for divorce. Women who no longer have husbands (widows), either because of divorce or death, have to face various difficult life problems. Therefore, it is necessary to find a solution to the widows’ problems. Despite getting a negative stigma, polygamy should be a solution to the problems of widows' lives. From these problems, the researchers want to know the concept of polygamy according to Islamic Law, the problems of womans’ life after divorce and the death of their husband, and the role of polygamy in resolving them. In collecting data, the researchers used a qualitative approach with literature study techniques and then analyzed it using a descriptive method. The results of this study are: 1) Polygamy in Islam must follow the provisions: able to provide physical and spiritual support, a maximum of 4 wives at a time, able to be fair, and not marrying two women who are close in lineage; 2) Women's life problems after a divorce or the death of their husband include: domestic problems, economic problems, and psychological problems. 3) The application of a healthy polygamy based on the Shari'a is able to overcome the problems of women's life after divorce and husband's death. Therefore, women who are widowed can be reduced and the problems of their lives can be resolved.

Despite getting a negative stigma, polygamy should be a solution to the problems of widows' lives. From these problems, the researchers want to know the concept of polygamy according to Islamic Law, the problems of womans’ life after divorce and the death of their husband, and the role of polygamy in resolving them. In collecting data, the researchers used a qualitative approach with literature study techniques and then analyzed it using a descriptive method. The results of this study are: 1) Polygamy in Islam must follow the provisions: able to provide physical and spiritual support, a maximum of 4 wives at a time, able to be fair, and not marrying two women who are close in lineage; 2) Women's life problems after a divorce or the death of their husband include: domestic problems, economic problems, and psychological problems. 3) The application of a healthy polygamy based on the Shari'a is able to overcome the problems of women's life after divorce and husband's death. Balaghoh is a study that discusses words in Arabic, regarding their composition, meaning, as well as the beauty and accuracy in choosing the right words. The Qur’an which is considered to be at the peak of the beauty of language is a holy book that was revealed by Allah to the Prophet Muhammad through the intermediary of the angel Gabriel to mankind, as a guidance of life in this world and the hereafter. The Qur’an Interpretation is a study that helps to uncover and clarify the meaning of the Qur’an verses and extract the laws from it. This study aims to examine the correlation between balaghoh education and interest in studying the Qur’an interpretation. The approach used in this research is quantitative. The population of this study is female students who take part in the Advanced Language Preparation Program. The number of samples is at least 30 students taken by simple random sampling technique. The instrument used is a questionnaire with a Likert scale. The data analysis technique used simple linear regression with the help of SPSS version 23. The results of this study indicated that there is a significant positive correlation between balaghoh education and interest in studying the Qur’an interpretation of the Advanced Language Preparation Program participants. So, the higher the education of balaghoh is, the higher the interest in studying the Qur'an interpretation is. The level of correlation between balaghoh education and interest in studying the Qur'an interpretation is moderate.

Education is a virtue that makes scientific regeneration work. Through education the quality of understanding can be improved. So that slowly the ignorance that exists in a community can be eliminated. Social change can be realized through continuous education. Especially if the education given to the community is qudsi hadith that are sourced from the holy word of Allah. Hadith qudsi education is teaching and educating others about the hadith qudsi narrated by the Prophet – may Allah’s peace and blessings be upon him – from Allah the Exalted and Glorious, while religious character is a religious trait that is inherent and manifests in behavior and actions. The approach used in this study is a quantitative approach with the type of correlational research to determine the correlation between hadith qudsi education and religious character. The population of this research is the Islamic Lectures community in Probolinggo. The number of samples in this study were 30 people taken by simple random sampling technique. The results showed that there was a significant positive correlation between hadith qudsi education and religious character in the Probolinggo Lecture community, so that the higher the education of hadith qudsi, the higher the religious character. The level of correlation between hadith qudsi education and religious character is a strong correlation.

منهج السخاوي والسيوطي في إيراد الأحاديث المشتهرة بين ألسنة الناس في كتابيهما 慷慨解囊和排泄物的方法在他们的书中引用了人们的的谈话

من أهم المباحث في علوم الحديث الشيقة والمناسبة لمر الدهور هو مبحث الحديث المشهور. والشهرة هنا الشهرة اللغوية التي بمعنى ما اشتهر على ألسنة الناس. قد ألف كثير من العلماء في جمع الأحاديث المشتهرة في زمانهم لبيان درجتها، منهم الإمام السخاوي والإمام السيوطي، وهما عاشيا في عصر واحد، وكتاباهما يعتبر من أشهر كتب في هذا الباب و أوسعه، لذا اخترناهما ليكونا موضعي الدراسة. والغرض منها معرفة مناهجهما المثلى في كتابيهما، ليتمكن من بعدهما الاستفادة منها واتباعها في جمع الأحاديث المشتهرة على الألسنة أو المشتهرة على وسائل التواصل الاجتماعي في عصرنا الحاضر مع بيان درجتها.  وهذا البحث بحث مكتبي، ومنهجه كيفي مقارن، بحيث إننا نستقرئ منهج الإمام السخاوي من كتابه المقاصد الحسنة و منهج الإمام السيوطي من الدرر المنتثرة ثم نقارن بينهما حتى نقف على أوجه الشبه والاختلاف منهما. النتيجة: من أوجه الشبه بينهما ما يلي: أنهما قدما كتابيهما بمقدمة بينا فيها سبب التأليف وشروطهما وبعض مناهجهما. وذكرا درجة الحديث غالبا عقب الحديث. وأحالا الحديث إلى كتب الحديث غالبا. ومن أوجه الاختلاف : أن السخاوي ألف كتابه تأليفا لم يبنه على تأليف غيره بخلاف السيوطي أنه بنى كتابه على كتاب غيره تلخيصا وزيادة عليه. وعدد أحاديث كتاب السخاوي أكثر بكثير من عدد أحاديث كتاب السيوطي. وجمع السخاوي منهجين في إيراد أحاديثه: ترتيبها على حروف المعجم تارة و على الموضوعات أو تراجم الكتب تارة أخرى، بخلاف السيوطي فإنه رتبها على حروف المعجم فقط. والسخاوي يحكم على أحاديثه صحة أو ضعفا أو نقل الحكم عليها من غيره من المحدثين، وأما السيوطي قل أن يحكم على أحاديثه بل أنه نقل الحكم من كتاب الأصل  في الغالب. والسخاوي يتكلم كثيرا في فقه الحديث ومعنى الحديث وذكر الشواهد له إن وجد، واستشهد بالشعر فيه أحيانا، بخلاف السيوطي أنه لا يتكلم عن فقه الحديث ولا عن معناه ولا يذكر الشواهد له إلا قليلا، و لم يستشهد بالشعر في فقه الحديث. والسخاوي أورد كلام شيخه ابن حجر العسقلاني كثيرا واستفاد منه تلقيا منه، وأما السيوطي فإنه قل أن يورد كلام ابن حجر العسقلاني وإن أورده واستفاد منه فإنه استفاد من كتبه.

STRATEGI DAKWAH KEPADA KELUARGA 针对家庭的达瓦战略

This study aims to explain the da’wah strategy to the family in Ustaz Khalid Basalamah’s perspective. Especially da’wah strategy used by the husband to appeal to his wife and vice versa from the wife to the husband. This study is conducted as a qualitative research with a character study approach as to be able to understand a character point of view. This study reveals Ustaz Khalid Basalamah’s perpectives in da’wah strategy of a husband towards the wife is a sentimental strategy (al manhaj al a’thifi) and that of the wife towards the husband is a rational strategy (al manhaj al aqliy). Ustaz Khalid Basalamah stated three types of sentimental strategy (al manhaj al a’thifi) that a husband could use towards his wife which are: da’wah with an embrace, da’wah with love, and da’wah with firmness. He also stated two types of rational strategy (al manhaj al aqly) that a wife could use towards the husband, they are: da’wah with questions and da’wah by telling stories.

This study reveals Ustaz Khalid Basalamah’s perpectives in da’wah strategy of a husband towards the wife is a sentimental strategy (al manhaj al a’thifi) and that of the wife towards the husband is a rational strategy (al manhaj al aqliy). Ustaz Khalid Basalamah stated three types of sentimental strategy (al manhaj al a’thifi) that a husband could use towards his wife which are: da’wah with an embrace, da’wah with love, and da’wah with firmness.
