Corruption is a cross-cutting problem that affects the daily life of citizens, their relationship with public institutions and the quality of the rule of law. The law as a tool of formal control is obliged intervenes from a normative an operational perspective social problem. Regarding the Uruguayan legal system, this article identifies two problems related to the preventive function of corruption. On one hand, Uruguayan criminal law is limited to prohibiting only the corruption of public officials and, on the other hand, the administration of justice focuses on the prosecution of public servants in the performance of their duties. We argue that this criminal policy is deficient because the apparently criminal acts related to the problem of GALAIN PALERMO, Pablo: “Los problemas de una política criminal de lucha contra la corrupción política mediante el castigo del abuso de la función. ¿Una estrategia exclusivamente uruguaya?”. 746 corruption would allow deeper inquiries to get to know the causes, relationships, intervening parties, connections, modes of conduct and consequences of such corrupt activities.

This paper questions the judicial practice wich subsume the criminal complaint of a non-existent crime in article 269 bis of the Chilean Criminal Code. Two problems are identified about the interpretation of the verb «provide» and the legal requirement «criminal offence», and the study concludes the non-criminality of the act respect the obstruction of criminal investigation.

espanolEl presente trabajo tiene como objetivo exponer como la tendencia global de incentivar las denuncias ciudadanas como medio de prevencion y descubrimiento de delitos se esta concretando en las politicas publicas y en el sistema juridico chileno. Con tal proposito el articulo analiza cuales son los recursos que los poderes publicos en cualquier pais tienen a su alcance para lograr que los ciudadanos se sientan movidos a denunciar, asi como las ventajas y desventajas de cada uno de estos estimulos. Se ofrece tambien una panoramica del estado de la cuestion sobre la presente materia en Chile y una valoracion de las alternativas que se presentan a las autoridades chilenas en este ambito. EnglishThis paper exposes how the global trend of encouraging citizen report for crime prevention and discovery is taking shape in public policies and in the Chilean justice system. This article analyzes the resources that the State and its agencies in any country have at their disposal to promote citizens to denounce, as well as the advantages and disadvantages of each of these incentives. This article also offers an overview of the state of play on the subject in Chile and an assessment of the alternatives that are presented to the Chilean authorities in this area.
