Locking up and detaining children and young people is and should be a human rights issue per se (Aymer et al., 1991). The United Nations Convention on the Rights of the Child provides that ‘no child shall be deprived of his or her liberty unlawfully…the restriction of liberty shall be used only as a measure of last resort and for the shortest appropriate period of time’ (United Nations General Assembly, 1989). It follows on to state that legal safeguards should be put in place to protect children’s human rights in settings where their rights and liberties are restricted. Despite this there is overwhelming evidence that in the Children and Young People Secure Estate (CYPSE) in the United Kingdom, children’s rights are inconsistently and excessively restricted, suggesting insufficient protection of their human rights (Goldson, 2006). Although the CYPSE is a highly restrictive setting in which children and young people are deprived of their rights and liberties for welfare or criminal justice reasons, there has been very little focus on power, voice, participation and human rights within these settings. In this article the authors outline the narratives of nine children and young people detained in the CYPSE through semi structured narrative interviews. Analysis of the interviews produced themes around experiences of powerlessness, control and restriction, voice & participation and resistance. This paper presents a detailed focus on the narratives around voice and resistance. The authors offer critical insights into how the lived experiences of children and young people in these settings strengthens the need for practice and policy to be informed by children’s rights, power and participation. Implications for how clinical psychology is enacted in these settings is also explored and interrogated, with a deconstruction of the role of a Clinical Psychologist.

Counselling psychologists working in Human rights & social justice 在人权领域工作的咨询心理学家;社会正义

We argue in this paper that counselling psychologists have been championing human rights and social justice in different ways and since the Division was first being considered. We draw on counselling psychology historical literature, and from responses from our colleagues within the profession. As part of our preparation for this paper we put out a call to counselling psychologists through the Division of Counselling Psychology to invite our colleagues to share with us the work they are engaged in relating to Human Rights and Social Justice. In this paper we share themes from the responses we received on the various areas covering human rights aspects of counselling psychology and social justice, for example championing climate justice, equality, diversity, and inclusion. Our call was operationalised through a Questback survey which comprised of 10 questions. These included demographic questions, questions which enquired about areas of respondent’s work which covered human rights aspects of psychology and social justice. The responses for example included mental health work with refugees, asylum seekers, trafficked people, torture survivors; Black and Minoritised Ethnic adults aged 18+; people from what one respondent noted as ‘the profoundly deaf community’ who use BSL (British Sign Language) as their first language; and other aspects of equality, diversity, and inclusion. Furthermore, we enquired whether our counselling psychology respondents had faced experiences in which they have wanted to engage with human rights-based/focused work but had been prevented from doing this. These questions could be responded to through qualitative responses, and we offer example of quotes from respondents throughout different sections of this paper. The respondents also replied at a specific time period and the issues raised might differ if the questionnaire was answered at an earlier or later time period.

Upholding children’s rights to support their psychological wellbeing: Reflections on a workshop with school staff during the Coronavirus pandemic 维护儿童权利,支持他们的心理健康:对冠状病毒大流行期间与学校工作人员举办的研讨会的思考

In this article we reflect on the development of a workshop within a schools’ context that addresses children’s rights through a psychological lens, and considers how both upholding children’s rights supports their psychological needs and vice versa. This workshop was developed in Wales during the Covid pandemic, when the need to protect and promote children’s rights was even more in focus, with children being in and out of school for two years. We reflect on two general ideas in relation to children’s rights; how the interpretation of children’s rights can be influenced by views on childhood; and how uncoupling of rights and responsibilities is important if we consider rights as universal and unconditional. We then consider three rights through a psychological lens and in particular drawing on attachment theory; the right to be listened to; the right to have adults do what’s best for me; and the right to be safe (to be protected from harm).

Human rights and psychology in the Republic of Ireland: Aspirations for everyday practice and introducing the Kyrie Farm model 爱尔兰共和国的人权和心理学:对日常实践的渴望和介绍凯里农场模式

The Republic of Ireland is introducing major human rights-based reform to its mental health laws. This paper outlines the new legal landscape in which psychologists must operate against the backdrop of present-day effects of Ireland’s dark legacy of institutionalisation. A rights-based approach aims to positively transform mental health service delivery and we advocate for person-centred treatments as the ‘new normal’. We summarise the recent advocacy work undertaken by the Psychological Society of Ireland’s Special Interest Group in Human Rights & Psychology. Finally, we present an innovative best practice case promoting future rights-based delivery via the Socio-Ecological Model of Health – Kyrie Farm.

The September issue editorial characterises the emerging disruption to the climate and environment system as important determinants of human rights violations; the implication being that as professionals we need to step up our defence of human rights. Here I want to develop this idea a bit further by considering what this means for our ethical stance as a profession. I want to consider whether the climate and environmental crisis we are living through has a bearing on the ethical principles we currently include in our Code of Ethics and Conduct, or whether they need to be enhanced.

A human rights based approach to transgender and gender expansive health 对跨性别者和性别扩展保健采取基于人权的办法

Trans and gender expansive (TGE) people can often be subject to an oppressive and abusive climate that consistently violates their human rights. This affects the availability, accessibility, quality, positioning, and relevance of healthcare services for TGE people, who report poor experiences and outcomes. Drawing upon the Human Rights Based Approach (HRBA) to Applied Psychology developed by Patel (2019), we share a vision for a HRBA to TGE health. This approach encourages clinicians to take a ‘practitioner-activist’ position in relation to five principles: protecting the person, respecting the person, involving the person, balancing the rights of the person, and seeing the person. We consider for each of these principles how healthcare services are failing to uphold the human rights of TGE people, how clinicians may meet their obligation to ensure TGE human rights are respected and advocated for in their clinical practice, and how aligning clinical practice with human rights principles benefits everyone. The article concludes with reflections from the TGE members of our team who invite all clinicians to stand alongside the TGE community by committing to four key areas of development: allyship, training, clinical practice, and research.
