Evolución jurídica de la responsabilidad del Estado por actos terroristas en Colombia 哥伦比亚国家对恐怖主义行为责任的法律演变

The evolution of the Judicial Precedent of the Council of State, regarding the issue of the non-contractual liability of the Colombian State for terrorist acts, has been setting some guidelines which must be taken into account in order to determine or impute liability to the State, in the events in which a State entity omits the warning or prevention of a threat of a terrorist act, or when it puts at risk the population where a military base is established that is declared objective of the illegal terrorist groups, generating to itself a failure of the service in the protection of the population or placing it at risk which it is not obliged to bear. The objective of the present work is to determine, based on the jurisprudence of the State Council, when the Colombian State has the legal duty to compensate people when they have suffered damage due to a terrorist attack, starting from the antecedents to international level about the object of study and conducting a study of the main decisions of the State Council on state responsibility for this type of acts, for the development of the same will be used the deductive method because of the initiation of investigation of the concepts general of the State’s non-contractual liability and the different titles of attribution of state responsibility, applying them in a special way against terrorist acts. As a conclusion, it is established that in Colombia, despite the fact that there is a normative field through which victims of terrorism can claim some compensation or compensation, it is the administrative contentious jurisdiction that the victims prefer to go and thus obtain a comprehensive reparation to their damages caused by a terrorist act that the State had to avoid

La registrabilidad del olor en Colombia, una posibilidad marcaria para el siglo XXI 哥伦比亚气味的可登记性,21世纪的一个可能标志

The present article of reflection, seeks to determine if it is or not possible to register an olfactory sign in accordance with the provisions of Andean Decision 486 of 2000 according to the methodology of analytical dogmatics, it is firstly sought to establish what are the criteria required In Andean legislation to register a sign as a trademark. Once the registration requirements have been explained, it will be examined whether the signs formed by odors or aromas comply with these requirements; Then a comparative law analysis will be done on the applications and registrations of olfactory marks and finally a study on the applications of olfactory signs made in Colombia. In practice, the registrability of olfactory signs is uncertain because there are no uniform criteria for an odor to meet the requirements of distinctiveness, perception and graphic representation required by Andean Decision 486 of 2000.

Equidad Ética-Jurídica de la Ciencia, para la Emancipación del Conocimiento y los Saberes 科学的伦理-法律公平,解放知识和知识

El estudio tiene el proposito de generar la discusion sobre la Equidad Etica-Juridica de la Ciencia para la Emancipacion del Conocimiento y los Saberes, a partir de la indagatoria reflexiva de los principios etico-juridicos que fundamentan en la Constitucion Nacional de paises como Chile, Peru, Ecuador, Colombia y Venezuela la significacion de la ciencia construida desde los cimientos contextuales del conocimiento, los saberes y el sentido comun originarios de America del Sur. La indagatoria reflexiva esta orientada desde la sociologia juridica, para abordar desde la contrastacion y la sistematizacion de los articulos constitucionales, que visibilizan la emancipacion del conocimiento integrado a los saberes originarios en los citados paises. El articulo es un avance del proyecto de investigacion titulado "Contextualizacion del conocimiento emancipador, desde lo local", que los autores adelantan en la Linea de Investigacion Ethos y culturas en la Organizacion (UNERMB-CDHCT). Se llega a la consideracion final que se evidencian la equidad en los principios eticos-juridicos en las Constituciones Nacionales de Chile, Peru, Ecuador, Colombia y Venezuela para integrar saberes y sentido comun al conocimiento, desde una ciencia construida por y para America del Sur.

Análisis del nivel de competitividad empresarial en el panorama publicitario colombiano fundamentada en el éxito creativo y la responsabilidad ética y jurídica 基于创意成功、道德和法律责任的哥伦比亚广告界商业竞争力水平分析

Las agencias que participan en sistemas de evaluacion competitiva, acuden a los festivales de publicidad donde la creatividad es especialmente valorada. El objetivo de este trabajo es medir y analizar la posicion actual de las agencias de publicidad Colombianas en el Ranking Iberoamericano de Publicidad. Para ello, se evalua la competitividad de las agencias a traves de su nivel de creatividad y segun una ponderacion rigurosa de los premios que obtienen y los festivales en los que son galardonados. Asimismo, se estudia la tendencia y se realiza una clasificacion de agencias segun su posicion y puntuacion en el ranking de Publicidad. El calculo del valor de las agencias para una edicion se hace sobre los premios recibidos en los dos anos anteriores. Para el caso de Colombia, se analizan el ranking de agencias 2014, 2015 y 2016 para una muestra total de 69, 98 y 73 agencias respectivamente en Colombia. Se observa que las mejor situadas son las agencias internacionales.

Disciplinary law as all areas of law is dynamic and accordingly cannot stand inane situations and changes that occur to her around, this paper discusses the impact against the Colombian penalties the decision with precautionary measures to the Mayor of Bogota Gustavo Petro Urrego analyzing block of constitutionality in framing the American Convention on human rights and the binding force that they have the precautionary measures against the Colombian State.

En este articulo se realiza un estudio a la diversa normatividad aplicable en el Departamento del Cauca: Jurisdiccion Especial Indigena, legislacion de proteccion a comunidades afrodescendientes y justicia ordinaria, para establecer su articulacion al marco juridico nacional para la paz. En esta investigacion socio-juridica a traves del metodo cualitativo de entrevistas y analisis documental, y cuantitativo, se logra evidenciar la existencia de colisiones juridicas entre las normativas aplicables en el Departamento del Cauca y el marco juridico nacional para la paz y concluir que la implementacion de lo acordado entre el Gobierno de Colombia y las FARC–EP debe estar en armonia con la normatividad aplicable y comunidades que habitan este Departamento
