Violence against women is a gruesome problem in our society. In 2021 alone, there were around 170,000 complaints of gender-based violence in Spain, and this number has been steadily increasing since 2009, when the first data was collected. Complaints of gender-based violence in Spain are handled and decided by exclusive, specialised or compatible courts; if convicted, the perpetrators can then appeal to higher courts. Given the performative nature of language (Austin, 1962; Searle, 1969), it is of the utmost importance to analyse the language used in court by judges and lawyers to refer to violence against women, as this influences the mainstream social perception by facilitating a construal of gender violence. The ways in which language and violence are intertwined have long been studied from various perspectives (Derrida, 2001; Fairclough, 1989; Foucault, 1980). Other authors have explored how language can inflict (and therefore provoke) violence in various forms (van Dijk, 1995; Silva, 2017a, 2017b). In this paper, we examine the representation of gender-based violence in legal language in Spain. We address the language used to refer to violence in the texts analysed; the portrayal in court judgements of participants in acts of gender-based violence; and the resulting social representation of violence, victims and aggressors. We also examine the representation of women from a constructionist perspective (Butler, 1992; 1997; 2004), using corpus pragmatics (Romero-Trillo, 2008) to analyse lexical items and expressions in 20 court judgments in the context of gender-based violence. The results indicate some bias in the representation of violence, aggressors and victims in court judgments.

The focus of this article is forensic linguistics as applied to gender-based violence (GBV), a current social problem which persists despite the many measures adopted to eradicate it. Gender-based violence leads to different kinds of crimes, which have been studied from several perspectives such as psychology, criminology and law. In this preliminary study of forensic linguistics applied to GBV crimes in Italy in particular, we aim to provide a review of the research literature on GBV and forensic linguistics. We begin by considering the discipline of forensic linguistics and introducing two psychological models – Walker (1979) and Pence (1993) – which are helpful in contextualising GBV. We then proceed in two directions: first, we examine communication between victims and legal sector professionals; and second, we consider linguistic evidence for police and judicial investigation through discourse analysis of communication between perpetrators and victims. Finally, conclusions are drawn with an eye to future scenarios.

In this paper we will attempt to establish the reasons for low-quality performance of court interpreters in the context of criminal proceedings in the courts of Barcelona. Drawing on a corpus of authentic recorded hearings, we explore four possible factors that may have an impact on interpreters’ performance: length of the hearing, conversation management problems, interpreters’ experience, and type of offence being tried. Furthermore, we also analyse unjustified nonrenditions, which are considered an important indicator of non-performance. The findings are discussed in the context of the linguistic competence of the interpreter, their role in the interaction with all the participants, and the established rules of professional codes of conduct. This paper will draw attention to the need to improve the qualification of interpreters, but also to raise awareness of the role of the interpreter among members of the judiciary in Spain, with a view to protecting the procedural rights of those who do not speak or understand the language in which the proceedings are conducted.

Interactions between citizens and the public administration are increasingly taking place by electronic means, often referred to as e-government. In Spain, these interactions mostly have to be monolingual, in Spanish, in the case of the central administration, but may be bilingual or even multilingual in autonomous communities that have their own official language. In this paper, we intend to show how state-of-the-art oral and written linguistic technologies for Spain’s coofficial languages could allow speakers of these languages to use them in many of their administrative relations with any Spanish public agency, thereby facilitating the conversion of Spain’s mostly monolingual administration into a multilingual one, enhancing digital language equality and guaranteeing the linguistic rights of speakers of minoritised languages. We will present an overview of the most promising language technologies in terms of their relevance from the point of view of multilingual communication between citizens and the administration. We will also review the existing technologies for Spain’s co-official languages, and present some ideas on how these could be integrated towards the multilingual transformation of Spanish public administrations without neglecting some of the attendant ethical and legal issues. The present work is intended to serve as an introductory and accessible overview for legislators, administrators, or any other person interested in the potential of language technologies to assist in developing a multilingual public administration.

En aquest treball s’explica la primera docència del dret en llengua catalana. Es fa a partir del buidatge del contingut de la revista dels Estudis Universitaris Catalans. La docència del dret en català tingué un temari extens i adaptable als estudis ordinaris de la Universitat de Barcelona; fins i tot, en algun punt fou més innovador. A més, es feia servir de manera reiterada l’aprenentatge pel mètode del cas. També s’expliquen els continguts dels articles jurídics publicats a la revista i es conclou que va tenir una visió historicista marcada, molt influenciada per l’Escola Històrica del Dret i també pel catolicisme social.

Al segon semestre de 2022 s’ha aprovat una nova divisió comarcal amb efectes cartogràfics, tot i que a hores d’ara encara no hi ha una regulació amb efectes jurídics, la qual cosa evidencia la incapacitat del legislador autonòmic per al desenvolupament de les adients disposicions estatutàries. També es dona compte de la nova regulació legislativa per al funcionament de l’Oficina de Drets Lingüístics, imposada per la prèvia anul·lació judicial del Decret de la seua creació. El requisit lingüístic per a la funció pública docent és novament objecte de comentari, així com l’aplicació del dret a rebre les comunicacions en la llengua escollida per l’interessat. Es manté també l’apartat toponímic, en aquest cas impulsat per la normalització lingüística. Finalment es dona raó del compromís del professorat de dret administratiu de les universitats públiques valencianes per a la promoció de l’ús del valencià a l’ensenyament.

Catalonia has developed a model of schooling in which Catalan is the medium of instruction and both Catalan and Spanish are compulsory subjects. In 2020, the Superior Court of Justice of Catalonia ruled that at least 25% of teaching must be delivered in Spanish in all schools in Catalonia, raising the issue of whether this obligation conforms to the undertakings chosen by that Spain under the European Charter for Regional or Minority Languages. To clarify, we first need to answer the following question: what does “education in a regional or minority language” mean? This paper provides an answer to this question based on the interpretation of the Committee of Experts of the Charter, and addresses two side issues: whether education in a regional or minority language can be compulsory for all pupils, and under what scenarios would it be legitimate to enforce the use of the State’s official language in schools where a regional or minority language (RML) is the medium of instruction. A conclusion is reached that may offer guidance for future discussion on the role of the State’s official language(s) in RML-medium schools.

Sen actividade normativa ou administrativa reseñable, este semestre o feito máis destacado é a STXG 7516/2022 polo que se desestiman todos os motivos polos que se tiña impugnado a práctica totalidade da Ordenanza de uso do galego da cidade de Coruña. O TSXG aproveita para construir unha documentada e sólida interpretación do respecto da legalidade vixente e a xurisprudencia dos preceptos da ordenanza que regulaba os usos lingüísticos ad intra e ad extra para favorecer a normalización da lingua galega nas actividades municipais.
