The word ‘silence’ can evoke a variety of different meanings and understandings: a sense of peace and quiet, solitude, escape; ‘far from the madding crowd’ of unwelcome chitter-chatter, the vagaries of everyday life. Alternatively it can be looked upon as a verb, to silence or to be silenced. Quite different concepts depend on whether you are the one being silenced, choose to keep silent, or indeed, are the one doing the silencing, though I very much doubt whether perpetrators of such silencing would ‘frame’ it in quite the same way: truth and justice often reside at very opposite ends of a continuum.

The starting point of ‘Justice Matters’ is simple: the criminal justice system is far too big; far too costly; far too intrusive. Far from being a means of delivering social justice, it is the cause of much social injustice. The large footprint in society occupied by the combined criminal justice institutions is profoundly socially harmful.

Electronic monitoring (EM) of offender technologies developed as responses to the problem of prison overcrowding and the enhanced focus upon re-introducing market values to the criminal justice sector, incorporating advances in information and communication technological infrastructures into new modes of crime control. At first glance, EM technologies appear to be tools with the potential to stimulate criminal justice innovation: new modes of virtual regulation suited to the digital world that global citizens inhabit. Yet, closer scrutiny of the use of EM across the globe unveils a sprawling, amorphous industry in commercial techno-corrections that both stimulates penal growth in domestic markets and facilitates policy transfer across international jurisdictions. The pioneering EM markets of North America, the UK and Australasia act as testing stations for the next generation of developers across Europe, Latin America and South East Asia. Viewed more closely, EM appears indicative of an intensification of surveillance and electronic population governance that has emerged from neo-liberal states and dispersed across the globe in a myriad of shapes and forms.

I have spent several years working within the probation service and prison service as a researcher, consultant and mentor for veteran affairs. This paper emerges out of a doctoral project concerned with the investigation into the crimes (in particular of violence) committed by Iraq and Afghanistan veterans post war and conflict, and their experience of punishment in England and Wales. The analysis of the project has motivated and liberated a small but reoccurring idea (that I have coined ‘veteranality’) which asks: how are veterans caught up in the criminal justice system perceived by practitioners and how are those perceptions mobilised into practice?
