The 12-month period that started July 1, 2022, and ended June 30, 2023, was a historic one for all the wrong reasons for the sports wagering public. Nearly every state with legal commercial wagering saw notable year-over-year gains versus the previous 12-month period from July 2021–June 2022, even among those who saw declines in handle.

It's a busy time, and the month always feels like it flies by. Every child is gearing up for Halloween, with parents focused on decorating and finding that perfect costume, while at the same time preparing for autumn and winterizing the house. And then there is the baseball. October is synonymous with playoff baseball. It's the time when nicknames like Mr. October are doled out. October is also a magical time in the gambling world. Every October, the industry descends on Las Vegas, Nevada for Global Gaming Expo, better known as G2E.Few events in the gambling universe can rival G2E. The International Casino Exhibition (ICE) in London is a bit bigger, but it lacks the backdrop of Las Vegas. I've been to both, and there is something about G2E that is different. This year will be no different, tens of thousands of people will attend, from top executives of global firms to a table game supervisor representing a family-owned regional casino to the movers and shakers in state legislatures and offices, G2E brings the gaming world together.News will break, deals will be made, new buzzwords will be adopted, massive dinner bills will be put on expense accounts, and it will all take place over four furiously-paced days—the last two most people seem to have trouble remembering.The state of Florida will be the leading topic at G2E and throughout the rest of 2023.Florida sports betting hangs in the balance of the West Flagler case, which is now on parallel tracks running to the Supreme Court of the United States and the Supreme Court of Florida. And lurking in the shadows is a recent cease-and-desist letter from Florida regulators to fantasy sports companies operating in the state.Another hot topic will be the recent cyberattacks that sent MGM back to the Stone Age for a week, with rival Caesars also victimized but choosing the path of least resistance and paying a ransom to the hackers. What happened/What is the extent of the damage? How do we safeguard from future attacks?And then there is the industry's recent embrace of all things responsible gambling (RG). I have no doubt that RG will be peppered into every panel discussion and product pitch. G2E always has a theme, and this year, I would be shocked if the theme was anything other than RG. And that's a good thing. These conversations are long overdue. The relationship between legal contents/practices and the development of casino tourism in Macao (or Macau) is deconstructed through an institutional analysis. Specifically, the role and impacts of the Macanese legal system in the advancement of casino tourism, evolution of the industrial organization and business routines in its modern history, and the dramatic expansion of the industry in the first two decades of the twenty-first century, are elucidated. It is found that a lagging legal and regulatory environment actually constitutes as an essential but controversial basis for a series of unorthodox business activities, which is exacerbated by a group of particular gaming agents. Nevertheless, their business practices have clearly diverted Macao from the public vision of the city as a world-class casino tourism destination. Thus, the MSAR government has made profound revisions and promulgated a new version of gaming laws in 2022 for the retendering of new gaming concessions. An investigation into the contents of these new laws and the related documents shows that while the long-established business practices of this industry which have been dominated by gaming agents will come to an end, new business routines will be subsequently instituted for sustained growth. To conclude, positive actions taken by the industry to comply with the new gaming laws and effective enforcement of these laws by the government will revert casino tourism in Macao back to a sustainable trajectory of development.

When unraveled, a lot of these threads will be interconnected. Whether it's the sudden emphasis on responsible gambling policies and procedures, the expansion of regulated online gambling around the globe (although much of the focus has been on the U.S.), or the rethinking of the Indian Gaming Regulatory Act (IGRA) and how tribal gaming fits into the landscape.One of the most significant developments on the tribal gaming front is playing out in the U.S. legal system, as the Seminole Tribe and the state of Florida scored a decisive victory at the D.C. Circuit Court of Appeals, which found their 2022 compact legitimate.The case will be discussed at length in the September issue, and in this issue, we have the first part of an exclusive roundtable on the proposed changes by the Bureau of Indian Affairs (BIA) with some of the top minds in the areas of tribal gaming law. The wide-ranging discussion touched on many different areas, which explains why the entire conversation will take up space in two issues.Beyond the BIA rules and the West Flagler case, there are also tribal developments in California, where the ongoing dispute between the state's gaming tribes and commercial cardrooms over so-called player-banked games is being discussed in the legislature. The new bill would grant tribes a one-time exception to file suit against cardrooms they believe are violating tribal gaming exclusivity. Previous legal efforts by California tribes have been dismissed for lack of standing due to tribal sovereignty. This is a topic Gaming Law Review would like to cover in-depth. One of the top issues the U.S. gambling industry will need to grapple with in the coming months and years is clarity, or better said, lack thereof. Anyone reading this knows how varied, complex, and contradictory gaming laws can be. Add to that the frenetic pace of legalized sports betting in the U.S., and you have a recipe for disaster, and an additional murky layer of regulations isn't helping.Is it any wonder U.S. sports betting operators don't know what type of marketing is and isn't allowed? Whether it's Barstool's “Can't Lose Parlays” or Fanatics offering free bets to customers who purchase merchandise, operators are in a difficult position.Further complicating factors, 12 months ago, using terms like “risk-free bet” was commonplace, as were partnerships between sportsbooks and colleges. In a rush to legalize and launch, states failed to consider the ends operators would go to as they fought for market share and instead quibbled about tax rates and whether they should prohibit betting on in-state college teams.Now some states are trying to correct and clarify. They are finding that it is much easier to build something correctly from the start than go in and try to solve issues after the fact. The corrections add layers of complexity or conflict with other aspects of the laws and regulations, resulting in more problems to be fixed.That should be a lesson for the dozen or so states that haven't passed sports betting laws or the 43 states that may pass online poker or online casino laws. One of the top issues the U.S. gambling industry will need to grapple with in the coming months and years is clarity, or better said, lack thereof. Anyone reading this knows how varied, complex, and contradictory gaming laws can be. Add to that the frenetic pace of legalized sports betting in the U.S., and you have a recipe for disaster, and an additional murky layer of regulations isn't helping.Is it any wonder U.S. sports betting operators don't know what type of marketing is and isn't allowed? Whether it's Barstool's “Can't Lose Parlays” or Fanatics offering free bets to customers who purchase merchandise, operators are in a difficult position.Further complicating factors, 12 months ago, using terms like “risk-free bet” was commonplace, as were partnerships between sportsbooks and colleges. In a rush to legalize and launch, states failed to consider the ends operators would go to as they fought for market share and instead quibbled about tax rates and whether they should prohibit betting on in-state college teams.Now some states are trying to correct and clarify. They are finding that it is much easier to build something correctly from the start than go in and try to solve issues after the fact. The corrections add layers of complexity or conflict with other aspects of the laws and regulations, resulting in more problems to be fixed.That should be a lesson for the dozen or so states that haven't passed sports betting laws or the 43 states that may pass online poker or online casino laws. That should be a positive development, but considering the current debates raging, I fear the end result is an industry no closer to making a dent in problem gambling than it is today.So far as I can tell, the plan is to throw more money at the problem and rush through untested policies being hatched in a problem gambling bubble. Many of the ideas being peddled merely nibble around the edges and feel more like semantic arguments than actual solutions. If we look ahead ten years, will prohibiting “risk-free” or “can't lose” verbiage be a difference-maker? Will sterilizing how we talk about the subject—a “person experiencing gambling disorder” instead of a “problem gambler”—change the percentage or severity of gambling addiction? Is unsolicited outreach a beneficial policy?If these were headlines, applying Betteridge's Law seems appropriate.Increased funding and awareness are long overdue, but consumers deserve more than new academic terms, checking boxes, and knee-jerk policy decisions with the potential for severe, long-lasting implications that can be difficult to reverse.The recent successes on the responsible and problem gambling fronts read like a wish list from 1997.
