A case study on bid rigging in centralized procurement of audit consulting services in Italy 意大利审计咨询服务集中采购中的串通投标案例研究

Purpose

The aim of this case study is to review the in-depth (and successful) investigation carried out in 2016 by the Italian Competition Authority [Autorità Garante della Concorrenza e del Mercato (AGCM)] on a nation-wide (multi-lot) framework agreement for consulting services. We also critically assess the tender design and emphasize which dimensions may have facilitated the uncovered anticompetitive agreement.

Design/methodology/approach

The case study borrows from the official Antitrust Authorities’ findings and from the tender documents to paint a comprehensive picture of the cartel’s strategy.

Findings

The case study emphasizes that AGCM’s the “conjectured logic” of the cartel’s behaviour (endogenous evidence) did coincide with those pieces of evidence seized by police forces for criminal crimes at the cartel members’ premises (exogeneous evidence). This infrequent feature of bidding rings investigations underlines the importance of theoretical as well as practical analyses of cartels’ behaviour in public procurement markets.

Social implications

As the antitrust investigation was triggered by a confidential report sent by the awarding authority (Consip, the Italian national central purchasing body), the case study also emphasizes the importance of informal as well as formal co-operation between awarding authorities, especially central purchasing bodies, and competition authorities.

Originality/value

The case study belongs to a small set of applied research papers attempting at building a bridge between public procurement design, particularly of sizeable framework agreements, and the mechanisms devised by cartels to “game” procurement procedures. All this is accomplished by looking at all design dimensions that were exploited by cartel’s members.

Choosing the most economically advantageous tender using a multi-criteria decision analysis approach 使用多标准决策分析方法选择最具经济优势的投标

PurposeThe purpose of this paper is to propose and test a multi-criteria decision analysis (MCDA) approach based on an additive value function (AVF) to select the most economically advantageous tender under European Union public procurement regulations.Design/methodology/approachA case study in which the AVF tender evaluation model is constructed by the procurement personnel and the results of the original, real-life public procurement evaluation model are compared to those discovered by the MCDA approach.FindingsThe AVF model captures the preferences of the procurement authority in a more reliable and transparent manner than commonly used evaluation models based on scoring formulas.Practical implicationsWhile commonly used in public procurement, relative scoring formulas can neither present the preferences of a procurement unit accurately nor do they enable bidders to draft bids according to these preferences. The proposed MCDA approach can achieve both.Originality/valueThe contribution of this paper is threefold. First, the successful construction of the AVF model with procurement personnel is introduced. Second, the model is used in an actual, real-life case. Third, a thoughtful comparison of features, structures and results of the AVF model and the evaluation model using scoring formulas is presented.

Leadership and stewardship in public procurement: roles and responsibilities, skills and abilities 公共采购的领导和管理:作用和责任、技能和能力

PurposeThe purpose of this paper is to identify the roles and responsibilities most important to public procurement practitioners to learn about procurement’s influence in the public management setting. Also, the skills and abilities associated with these roles and responsibilities are identified and discussed to implicate the strategic orientations of practitioner work and the skills and abilities that support these endeavors.Design/methodology/approachThe 2020 National Institute of Governmental Purchasing (NIGP) survey is used as a method of primary data collection and analysis. Factor analyses are run to yield relationships between the roles and responsibilities in public procurement to determine what it is that public practitioners value the most in their work, as well as to control for skills and abilities, to implicate the ways in which these roles and responsibilities are approached from a strategic perspective.FindingsThe results demonstrate that public procurement roles and responsibilities do not easily fit into any one category of public management, and that qualitative factors in public procurement are rated to be more important than quantitative factors. Additionally, the skills and abilities deemed to be most important in completing these roles and responsibilities implicate qualitative traits such as building trust and credibility, effective communications and relationship management.Social implicationsThe study demonstrates that although public procurement practitioners view the socio-economic roles and responsibilities to be most important, such as in creating a culture of continuous improvement, developing a thriving workplace, supporting an ethical workplace and providing professional development opportunities, that public procurement falls short because the actual implementation of social and environmentally sustainable policies and fostering of an ethical professional culture are not viewed to be important by practitioners. The study offers leadership and stewardship as an approach to combat this lack of follow-through by public procurement departments.Originality/valueThis study provides exclusive access to the 2020 NIGP study and, to the best of the author’s knowledge, is the first research of its kind to highlight the roles and responsibilities, skills and abilities viewed to be most important by public procurement practitioners. Additionally, the link between skills and abilities, and roles and responsibilities is discussed to implicate leadership and stewardship in the strategic orientations of public procurement.

Pursuing ways to improve the Brazilian procurement system: a comparison between the framework agreements in the United Kingdom and the Brazilian price registration system 寻求改进巴西采购制度的途径:联合王国框架协议与巴西价格登记制度的比较

PurposeThe purpose of this paper is to conduct a literature review on framework agreements, an instrument for demand aggregation adopted in the UK, to recommend improvements to the price registration system (SRP), a mechanism often used with reverse online auctions in Brazil envisaged to promote more flexibility in centralized tenders, allowing public bodies to establish contracts when the need arises, based on registered prices.Design/methodology/approachA literature review was undertaken to analyze the UK framework agreement approach and the Brazilian SRP. In addition, in-depth interviews with civil servants from the Brazilian Ministry of Economy were conducted to examine the SRP.FindingsThe experience with framework agreements in the UK reveals at least four ways to improve the Brazilian SRP: i) extending the legal maximum duration of a price registration minute (ARP) ; ii) allowing the registration of additional suppliers in the ARP, instead of only the first lowest bidder; iii) conducting mini-competitions when a contracting authority decides to use the ARP to enter into a contract; and iv) including additional criteria for awarding suppliers, in line with the most economically advantageous tender (MEAT) approach.Social implicationsThe flow of government financial resources into procurement accounted for approximately 16.5% of gross domestic product in Brazil and for an average of 12% in OECD countries in 2017 (OECD, 2019: 135). Public procurement is a strategic function for enabling an efficient public services delivery and infrastructure deployment. It is, therefore, relevant to examine instruments of demand aggregation to improve the outcomes of public procurement.Originality/valueFramework agreements are currently not used in Brazil. This paper examines the UK experience with framework agreements to propose potential improvements to the Brazilian SRP, a procurement instrument vastly used in the country.

SME’s disinclination towards subcontracting in the public sector markets: an attributional perspective 中小企业不愿在公共部门市场进行分包:归因视角

PurposeThis study aims to examine the causes of small and medium-sized enterprises (SMEs) disinclination towards subcontracting in public sector markets. Previous studies have revealed that UK SMEs are reluctant to do business with the public sector through the subcontracting route, but the reasons for this lack of enthusiasm have not been widely researched.Design/methodology/approachDrawing on semi-structured interviews with SMEs competing for public contracts in North West England, a qualitative study was performed, from which several themes emerged.FindingsThe findings were synthesised into a framework underpinned by attribution theory, to portray situationally and dispositionally caused factors that were used to interpret SMEs’ behaviour.Social implicationsThe findings can guide policy development and government interventions in developed and developing countries, aimed at using public procurement as a policy tool to develop the small business sector.Originality/valueThis paper contributes in a unique way to an emerging discourse on how subcontracting can facilitate the access of SMEs to government procurement spending. It adds to knowledge regarding the explanatory power of attribution theory – from its base in social psychology.

Previous studies have revealed that UK SMEs are reluctant to do business with the public sector through the subcontracting route, but the reasons for this lack of enthusiasm have not been widely researched.\u0000\u0000\u0000Design/methodology/approach\u0000Drawing on semi-structured interviews with SMEs competing for public contracts in North West England, a qualitative study was performed, from which several themes emerged.\u0000\u0000\u0000Findings\u0000The findings were synthesised into a framework underpinned by attribution theory, to portray situationally and dispositionally caused factors that were used to interpret SMEs’ behaviour.\u0000\u0000\u0000Social implications\u0000The findings can guide policy development and government interventions in developed and developing countries, aimed at using public procurement as a policy tool to develop the small business sector.\u0000\u0000\u0000Originality/value\u0000This paper contributes in a unique way to an emerging discourse on how subcontracting can facilitate the access of SMEs to government procurement spending. PurposeThe media is an important actor in public procurement, but research on its role is limited. This paper aims to investigate how the media has engaged with public procurement, using UK newspapers as a case example.Design/methodology/approachThe method consisted of searching Nexis database for news articles on public procurement; automatic extraction of article attributes such as length, section, authorship; and manually coding each article for its theme and industry context. This produced quantitative indicators about the extent and focus of press coverage on public procurement.FindingsPress coverage of public procurement increased between 1985 and 2018. The focus of coverage has been on governance failure and socio-economic policy. Governance failure, which includes corruption, cronyism and supplier malpractice, is associated with construction, outsourcing and professional services sectors. Socio-economic policy, which includes supporting small suppliers and favouring domestic industry, is associated with manufacturing, defence and agriculture.Research limitations/implicationsThe analysis included UK media only. While the trends observed on the extent and focus of public procurement news coverage likely reflect the situation in other countries, international comparative research is still required.Practical implicationsGovernment officials should be more proactive in countering the “negativity bias” in news coverage of public procurement by showcasing projects where value-for-money has been achieved, services have been successfully delivered and social value has been realised.Social implicationsThe media accentuates the negatives of public procurement and omits positive developments. The end-result is a selective and, at times, self-serving media narrative that is likely to engender cynicism towards public procurement.Originality/valueTo the best of the authors’ knowledge, this is the first study on media coverage of public procurement. It highlights that while there are similarities between media and academic treatment of public procurement, particularly in relation to its socio-economic side, the media emphasises governance failings and negative developments to a greater extent.

PurposeThis paper aims to study the short-term effects of a new procurement policy document on the inclusion of environmental requirements and green award criteria in tenders. The policy document is named “Procurement with Impact” and was released by the Dutch central government to further stimulate Sustainable Public Procurement (SPP).Design/methodology/approachCentral government tenders were quantitatively analyzed in the six months prior and after the release of the new policy on their inclusion of environmental concerns. This judgment was made based on the role of environmental concerns in the requirements and the award criteria. As a control group, the same was done on a municipal level, for which the new policy document does not apply. Each of the four samples contained 60 tenders. Data was acquired via the European public procurement database TED. In the analysis, a chi-square test was used to measure whether a significant difference exists between the two periods for each group.FindingsResults show that central government has procured in a more environmentally concerned way after the release of “Procurement with Impact.” Within a year, the number of green tenders conducted by central government significantly increased from 30% to 55%. No significant difference was found on a municipal level.Social implicationsSPP has received increasing attention over the past few decades but has not led to implementation of its principles in most public tenders. As SPP can have a major impact on a more sustainable and social society, it is important to understand how policy can influence the sustainability of tenders. The findings of our study show that “Procurement with impact” had a significant positive short-term effect on the inclusion of green award criteria and requirements in public tenders. Implementing similar SPP policies in other government sectors and other countries could have a substantial effect on the worldwide uptake of SPP.Originality/value“Procurement with Impact” contains a clear sustainable vision embracing the principles of SPP. This government policy takes into account several SPP barriers and drivers and satisfies several policy theory conditions. The authors show in the paper that this policy is an effective instrument for increasing the inclusion of environmental concerns in tenders. As the difference is already significant within a year, this could also reflect the readiness of tenderers to turn to SPP once there is a clear organization wide policy.

PurposeThe SARS-CoV-2 pandemic has had severe effects on economies worldwide and, in particular, on public institutions that must keep their operations running while supply chains are interrupted. The purpose of this study is to examine how public institutions act during a pandemic to ensure the security of supply.Design/methodology/approachThe distinct focus is if, why and how public institutions have adopted additive manufacturing (AM) – a production technology colloquially known as three-dimensional printing in which a product is created by joining raw material layer by layer based on a digital model (computer-aided design [CAD] file) of the product – in reaction to supply disruptions caused by the SARS-CoV-2 pandemic. For this purpose, four cases within the context of the pandemic supply disruption are used as the units of analysis.FindingsThe findings are twofold: public institutions reacted, on the one hand, with a behavioral solution approach, trying to solve the supply disruption with new or changed forms of cooperation and collaboration. On the other hand, public institutions used a technical solution approach (TSA) as a supply disruption response and intensified their use of AM.Research limitations/implicationsThis research derives an implications model that focuses on the TSA. Considering the ex ante and ex post phases of the disruption, several effects of AM on resilience are identified. The most relevant is the long-term learning effect (i.e. AM data created during this disruption might also help in a new disruption).Practical implicationsPractitioners who act under extreme pressure and uncertainty are informed by cases that have managed to close bottleneck situations with either a behavioral or TSA. Specific strategies are given for how public buyers could use AM within a pandemic situation to mitigate supply bottlenecks, such as increasing their robustness by localizing sourcing and increasing agility by combining traditional and additive supply sources. Additionally, insights are provided into how public organizations can increase their level of preparedness by including disruption paragraphs, establishing CAD databases, in contract clauses and keeping reserve contracts with AM service providers.Originality/valueThis research contrasts behavioral and technical solution concepts for a pandemic in the public sector. Thus, it provides insights into the relative benefits of AM and causes and effect with regard to how AM affects supply robustness and agility.
