Family relationships and migrations between law, religions and culture ABSTRACT: In recent years, the social and multi-religious evolution of the family has contributed to redefined its morphology, varying its traits through a continuous work of cultural, ethnic and religious relocation. It frequently clashes with resistance typical of an institution that is in some ways still linked to traditional legal paradigms. It is consequently increasingly necessary to acquire technical tools that allow people to govern family relationships in the current “multicolor” context. The essay investigates the possibility of leaving ample space for private autonomy in the regulation of family relationships in the belief that in this way families are provided with flexible tools that conform to their own cultural and religious identity. La riforma del diritto di famiglia e delle Family courts nella Repubblica di Cipro ABSTRACT: This essay addresses the 2023 amendments to Article 111 of the 1960 Constitution of the Republic of Cyprus, as well as family law reforms in the light of the religious or belief minority rights protection, promotion, and implementation. In doing so, the article relies on the findings of the Atlas of Religious or Belief minority Rights research project. The aim is to highlight how the legal system of Cyprus is slowly detaching itself from the millet logic inherited from the Ottoman past and it is further aligning with European and international standards on the protection of minority rights in different policy areas, including family law and marriage. However, religious affiliation and religious legal systems still bear significance on some issues pertaining to family law, marriage, and dissolution of marriage. SUMMARY: 1. Introduction - 2. The mediation of the Holy See in the process of normalization of Cuban-American bilateral relations ABSTRACT: This article aims to illustrate the fundamental stages and final moments of the singular and complex mediation conducted by the Holy See in the Cuban-American dispute, whose greatest success was the signing in the Vatican in 2014 of a protocol for the normalization of relations bilateral agreements interrupted in the aftermath of the Castro Revolution. In particular, the specificity, in terms of diplomatic dynamics, of this pontifical initiative is analysed, which inaugurated a new phase of negotiations in the stagnant talks that had already begun secretly in Canada between the two parties in 2011. Finally, the system of agreements of medium level concluded between the parties after the re-establishment of normal diplomatic channels, achieved thanks to the proactive role of the Pope and Vatican diplomacy. Religiously oriented eating styles and sustainability in the legal experience of the territories facing the Mediterranean Sea ABSTRACT: The paper presents the different eating styles created by religious confessions, which were born in the territories facing the Mediterranean Sea, and by oriental religions, which have also taken root in Europe. Some problems that arise in the exercise of religious food freedom within civil legal systems are analyzed. The interrelationships between political institutions, religious confessions and communities ethically committed to sustainable development are studied, in order to use the different food codes to more effectively pursue the unitary objective of improving the health and well-being of living beings in the Euro-Mediterranean area, of wisely exploit environmental resources and redistribute food more equitably. By law or by statute. Belonging and autonomy in the legal experience of contemporary Italian Judaism ABSTRACT. The essay retraces the salient passages of the juridical condition of the Jews of Italy, from the second emancipation (1848) onwards, around the pivotal principles of community autonomy and individual belonging, which during the different eras - liberal, fascist, republican - have taken on different normative qualifications and consequent historical meanings. The historical perspective thus illustrates the unique and paradigmatic character of the Jewish case for the tension that has gradually been established between institutional reasons and individual demands, between the 'necessity' of the community and the 'freedom' of the Jews. From the reconstruction it emerges how, in the different moments, the initiative of the minority prevailed over the action of the State, mostly called upon to acknowledge the requests and solicitations of the Jewish leadership. (2018-2023) ABSTRACT: The right to religious freedom is constantly changing, following the contemporary treatment of the religious phenomenon within the public sphere of the states. This finding is also evident in the ECHR's jurisprudence, which since the Kokkinakis case seems to have made great progress in the development of the more specific manifestations of religious freedom, such as religious autonomy. In this context, an attempt is made to draw conclusions regarding the right of religious freedom under the related ECHR’s case law. SOMMARIO: 1. Introduction - 2. The “reasonable accommodation” in Italian jurisprudence in ecclesiastical matters ABSTRACT: With judgment n. 24414/2021, the United Sections of the Supreme Court suggested “reasonable accommodation” as a key to resolving conflicts over religious symbols in public school classrooms. This approach, which is typically used to promote equality for workers with disabilities, has been applied to this dispute in a novel way. This paper intends to reconstruct the Court’s proposal of a “reasonable accommodation” model after analyzing the original features of this approach. From the investigation of nature and the application of “reasonable accommodation” in the decision of the Court, this work seeks to verify whether this model can be effectively and legally relevantly applied in the public school context. The Church "is" communio fidelium and "has" communio hierarchica: foundation and consequences from a canonic constitutional approach ABSTRACT. Ecclesiology has undergone an important development since the Second Vatican Council: it has moved from an institutional ecclesiology to an ecclesiology of communio. Canonical science seeks to adapt to this reality. But in some approaches, communio fidelium and communio hierarchica are still considered on the same plane; in practice, communio fidelium would become a “product” or a “result” of communio hierarchica. But this introduces a “harmful separation between theory and practice” (cf. Veritatis gaudium, n. 4). In this paper I will explain, from a constitutional canonical approach more in line with the ecclesiology of the Second Vatican Council, the foundations and consequences of the instrumentality of the communio hierarchica in relation to the communio fidelium, and what it means that the ‘institutional principle’ is born of the ‘communitarian principle’ (Hervada). The origins of the idea of Russkij mir ABSTRACT: The doctrine of Russkij mir is the result of a long historical process marked by the progressive distancing of Russian Orthodoxy from Constantinople with the refusal of the Grand Prince of Moscow to accept the decisions of the Council of Florence. In the space of a few years, the metropolis of Moscow proclaimed its de facto autocephaly and the bond of subordination of the Sacerdotium to the Imperium was strengthened, especially starting from the Council of 1503 which saw the monastic current led by Iosif of Volokolamsk, who stated a close bond between Church and sovereign. prevail on that represented by Nil Sorsky, who supported the independence of the Church from civil power.
