AbstractAfter Law No. 11 of 2020 concerning Job Creation has been enacted, there are several changes regarding the provisions related to fixed-term employment agreements previously regulated in Law No. 13 of 2003 concerning Manpower. Law No. 11 of 2020 experienced rejection from many workers because there were several changes to the provisions regarding fixed-term employment agreements which were feared to cause problems in its implementation. One of them is related to changes in the provisions regarding the period of time for a fixed-term employment agreement which is determined by the employment agreement itself and is not limited by law. This research uses normative legal research methods. The results of the analysis show that there have been several changes related to the regulations regarding fixed-term employment agreements in Law No. 11 of 2020 and with these changes, there are still some problems and legal voids in several provisions, thus the government should issue government regulations and/or other implementing regulations deemed necessary to address these problems.Keywords: employment agreement; fixed-term employment agreement; job creation lawAbstrakSetelah diundangkannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja, terdapat beberapa perubahan mengenai ketentuan-ketentuan terkait perjanjian kerja waktu tertentu yang sebelumnya diatur dalam Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan. Penelitian hukum ini merupakan penelitian hukum normatif. Hasil dari analisa menunjukkan bahwa terdapat beberapa perubahan terkait aturan-aturan mengenai perjanjian kerja waktu tertentu dalam Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja dan terhadap perubahan-perubahan tersebut masih ditemukan beberapa permasalahan serta kekosongan hukum pada beberapa ketentuan, sehingga pemerintah patut menerbitkan peraturan pemerintah dan/atau peraturan pelaksana lainnya yang dianggap perlu untuk menangani permasalahan tersebut.

As a quick response to the Supreme Court in ensuring the protection of judicial officials, justice seekers, court users including defendants who are dealing with the law, the Supreme Court has issued Supreme Court Circular (SEMA) Number 1 of 2020 concerning Guidelines for Implementing Tasks During the Prevention Period of the Spread of Covid-19 in The environment of the Supreme Court and the Judiciary Bodies that are under it. AbstractThis study aims to make the public aware of the importance of awareness of the laws, norms, and ethics that apply in society. With the rule of one garage one car through the perspective of rights and obligations according to the law, it is hoped that the public will have more legal awareness. The research method uses empirical methods by digging information from several supporting sources in the form of interviews and going into the field to find more valid data so that from this research we get final results that provide solutions. The novelty that researchers offer is the imposition of hourly fines for residents who violate the minimum fine of Rp. 20,000 (Twenty Thousand Rupiah), the existence of a new regulation regarding parking, as well as socialization to the community. The lack of legal awareness of the Pucangan residents has led to the neglect of the regulations that have been implemented in their area. There is no place to park their private car. Pucangan residents often park their cars on the shoulder of the road so that it disturbs the comfort of other residents. So there needs to be a regulation in the form of a regional regulation so that residents who still park their cars are given strict sanctions and this rule applies and must be binding on the public.Keywords: garage; parking; regulationAbstrakPenelitian ini bertujuan untuk menyadarkan masyarakat mengenai pentingnya kesadaran hukum, norma, dan etika yang berlaku di masyarakat. Dengan adanya aturan satu garasi satu mobil melalui prespektif hak dan kewajiban menurut undang-undang diharapkan masyarakat memiliki kesadaran hukum yang lebih. Metode penelitian menggunakan metode empiris dengan menggali informasi dari beberapa sumber pendukung berupa wawancara dan terjun ke lapangan untuk mencari data-data yang lebih valid agar dari penelitian ini didapatkan hasil akhir yang memberikan solusi. Kebaharuan yang peneliti tawarkan yaitu pengenan denda per-jam bagi warga yang melanggar dengan denda minimal Rp. 20.000 (Duapuluh Ribu Rupiah), adanya regulasi baru mengenai perparkiran, serta sosialisasi kepada masyarakat Masih kurangnya kesadaran hukum warga Pucangan menyebabkan abainya peraturan yang sudah diberlakukan di wilayahnya. Tidak ada tempat untuk memarkirnya mobil pribadinya dengan sengaja warga Pucangan sering kali memarkirkan mobilnya di bahu jalan sehingga mengganggu kenyamanan warga lain. Sehingga perlu adanya regulasi berupa perda agar warga yang masih memarkirkan mobilnya diberikan sanksi secara tegas dan aturan ini berlaku dan harus mengikat untuk umum.

AbstractThe purpose of this study is to determine the form of responsibility of business actors to consumers who are harmed because the prices of goods listed on the goods display rack are different from those on the cashier's receipt. The method used in this research is empirical juridical. The technique of this research approach is a qualitative approach by emphasizing aspects in depth (in depth analysis) on a problem. The data collection technique in this research is by conducting interviews aimed at consumers of Ria Swalayan Mojosari. The existence of supermarkets adds to the satisfaction of consumers in shopping because of its advantages compared to traditional markets. But behind these advantages, self-service also has several disadvantages, one of which is the difference in the price listed on the display rack with the price to be paid at the cashier. This is of course detrimental to consumers, because the consumer does not get certainty on the price of an item. Therefore, there is a need for regulation regarding this matter to protect consumer rights which have been regulated in Law Number 8 of 1999 concerning Consumer Protection. Where business actors must provide clear information to consumers. AbstractThe purpose of the study to see Indonesia as a legal state by article 1 verse (3) the constitution of 1945, each citizen has the right to legal protection, every citizen has the right to a decent job and livelihood, each citizen has the same position in the eyes of the law and in government. In reality, however, there are still obstructing freedom for others, as is the case with a mental person in the stocks, alien to the environment, and even for years. It is reasoned that the economy is minimal, the needs are large, and not only the mentally ill need the expense but there are other families to care for. So, the disturbed ones only felt the agony of being locked up in a room that had no residents, they threw people into a state of isolation. This sort of reasoning is often raised from related relatives: economic reasons, but some still try to cure them and hope that if treatment fails to cure crazy families, then most people reimprison them and supply them because the cost is depleted but have no healing effect on mentally ill families. AbstractThis writing is intended to convey the analysis and critiques on issues and situations of the Lamaholot inheritance customary law must not only be under the ancestor's values that developed in the society but also following the development of the society that has gone through modernization and emancipation, which has resulted in equal positions between men and women in every aspect of human life. Through juridical normative research method, and the emphasis on the Lamaholot tribe, it is found that there are an imbalance position and rights between male and female successor, where the right to inherit is only owned by the male successor. This creates an injustice for the female successor, which fundamentally violates the concept of inheritance in the Indonesian Civil Law Code as the national guidelines of the private sphere of society. The existence of law has greatly impacted human life because where there are humans, that is where the law is. The law will only be classified appropriate if it achieves legal objectives, namely justice, legal certainty, and legal benefit. One of the spheres of human life which are also regulated by law is in the process of inheritance by the predecessor to the successor. This inheritance then enters the realm of private law, which is still dominated by customary law. Customary law as a form of cultural diversification of Indonesia and a core element of the development of the national law itself is still upright and implemented in the practice of inheritance. As a result, it can be concluded that gender-based rights disparities are evident in the socio-cultural life of the Lamaholot indigenous tribe. Thus, through this research, two paths should be implemented by the state. AbstractThis study aims to offer solutions related to the prevalence of pigeon gambling in the Rungkut Tengah area of Surabaya. Through an empirical approach which is sourced from existing data in the field such as interviews and observations. Through this research, researchers offer a way out of the existence of pigeon gambling which is expressly prohibited in statutory regulations. By holding counseling and providing a forum such as an official competition to be able to channel hobbies in raising and caring for pigeons without having to participate in gambling. Law enforcement related to the prevalence of gambling cases that develop in the community certainly makes it difficult for the authorities to eradicate various gambling so that the law appears in line with existing norms. Through the efforts of the government and law enforcement officials, the making of regulations regarding the sanctions imposed by the practice of gambling does not make the public afraid of these threats. Tujuan penelitian untuk mengetahui pihak yang dapat menjadi adressaten dalam lalu lintas hukum administrasi dan rumusan aturan hukum yang dibutuhkan untuk mengakomodir hak adressaten dalam lingkup PTUN. Penelitian menggunakan metode historis, dapat ditemukan tentang asal dari sistem hukum suatu negara tertentu. Secara singkat dapat disimpulkan bahwa terdapat banyak kesamaan dalam sistem hukum administrasi Indonesia dan Belanda. Kesamaan-kesamaan tersebut dapat dilihat dalam konsep-konsep umum yang diterapkan seperti KTUN dengan beschikking, pejabat tata usaha negara dengan bestuursorgaan, dan juga PTUN dengan administratieve /bestuursrechtspraak. Akan tetapi terdapat juga perbedaan yang prinsipiil antara kedua sistem hukum tersebut.Kata kunci: badan hukum; publik; peradilan tata usaha negaraAbstractThe purpose of this research is to find out which parties can become addressees in administrative law traffic and the formulation of legal rules needed to accommodate address rights within the PTUN scope. Research using historical methods, can be found about the origin of the legal system of a particular country. In short, it can be concluded that there are many similarities between the Indonesian and Dutch administrative law systems. These similarities can be seen in the general concepts applied such as KTUN with beschikking, state administrative officials with bestuursorgaan, and also PTUN with administratieve/bestuursrechtspraak. However, there are also principal differences between the two legal systems.

Penelitian menggunakan metode historis, dapat ditemukan tentang asal dari sistem hukum suatu negara tertentu. Secara singkat dapat disimpulkan bahwa terdapat banyak kesamaan dalam sistem hukum administrasi Indonesia dan Belanda. Kesamaan-kesamaan tersebut dapat dilihat dalam konsep-konsep umum yang diterapkan seperti KTUN dengan beschikking, pejabat tata usaha negara dengan bestuursorgaan, dan juga PTUN dengan administratieve /bestuursrechtspraak. Akan tetapi terdapat juga perbedaan yang prinsipiil antara kedua sistem hukum tersebut.Kata kunci: badan hukum; publik; peradilan tata usaha negaraAbstractThe purpose of this research is to find out which parties can become addressees in administrative law traffic and the formulation of legal rules needed to accommodate address rights within the PTUN scope. Research using historical methods, can be found about the origin of the legal system of a particular country. In short, it can be concluded that there are many similarities between the Indonesian and Dutch administrative law systems. These similarities can be seen in the general concepts applied such as KTUN with beschikking, state administrative officials with bestuursorgaan, and also PTUN with administratieve/bestuursrechtspraak. Abstract The Covid-19 pandemic that has plagued various fields of life, both in the economic, political, education, until the Covid-19 pandemic outbreak was declared as national disaster. Based on that, various efforts are continuously being pursued for strategies to tackle the spread of the virus which has claimed a relatively large number of lives. Among other things, these efforts are through the policy of Large-Scale Social Restrictions, social distancing, including efforts to find the vaccine. The purpose of this study is to analyze the legal aspects of the Covid-19 vaccine and the responsibility of the State in fulfilling the Covid-19 vaccine. This research typology is a doctrinal research using primary and secondary legal materials using analytical descriptive. Based on the results of the analysis, it can be explained that the Covid-19 vaccine, besides having economic aspects, also has legal aspects that deserve attention. The economic aspect is that the Covid-19 vaccine is a necessity for everyone in the face of a pandemic, so that vaccines will become a sexy commodity that is definitely targeted and has high selling power. On the other hand, in supporting these commodities, it needs to be protected through a legal instrument known as protection of intellectual property rights, namely through a patent regime or trade secret. Choosing one of these has both advantages and disadvantages, so it needs to be considered carefully. The exclusivity of the Covid-19 vaccine in IPR is not something that can be exploited indefinitely, but the State can exist as a form of its responsibility through the application of compulsory licenses or disclosure of confidential information. Tipologi riset ini merupakan penelitian doktrinal dengan menggunakan bahan hukum primer maupun sekunder dengan menggunakan deskriptif analitis. Berdasarkan hasil analisis dapat dijelaskan bahwa vaksin Covid-19 di samping memiliki aspek ekonomi juga memiliki aspek hukum yang sangat patut diperhatikan. Aspek ekonomi bahwa vaksin Covid-19 sebagai kebutuhan semua orang dalam menghadapi pandemi, sehingga vaksin akan menjadi komoditi seksi yang sudah pasti diincar dan memiliki daya jual tinggi. AbstrakPenelitian ini mengusulkan model Judicial Preview yang dapat berfungsi untuk mengurangi perilaku koruptif dalam hal fungsi anggaran yang dilakukan lembaga legislatif. Perilaku koruptif sering terjadi dalam fungsi anggaran yang dilakukan oleh anggota legislatif sendiri, hal ini menjadi cerminan rendahnya kualitas lembaga legislatif. Penelitian ini merupakan penelitian normatif, dengan menggunakan menggunakan metode pendekatan perundang-undangan dan pendekatan konseptual. Penelitian ini menggunakan metode deduktif sebagai metode analisisnya, serta menggunakan bahan hukum yang dikumpulkan melalui metode studi kepustakaan. Hasil dari penelitian menawarkan cabang kekuasaan yudikatif untuk dapat melakukan konsep judicial preview tanpa perlu mengurangi independesi yang dimiliki lembaga tersebut, sehingga lembaga yudikatif tidak akan ikut serta dalam political arena secara praktis. Organ yudikatif ini hanya berfungsi untuk melakukan tindakan hukum pada fase pencegahan sehingga permasalahan tidak kembali terjadi.Kata kunci: judicial preview; legislasi; penyusunan anggaranAbstractThis research proposes a Judicial Preview model that aims to reduce corrupt behaviour in terms of the budget function performed by the parliament. Corruption behaviour often occurs in the budget function performed by members of the parliament is a reflection of the low quality of the legislature. This research is normative research, using the statute approach and conceptual approach. This research uses the deductive method as the method of analysis, as well as using legal material collected through the literature study method. The results of this research are that the judicial branch of power can conduct the judicial preview model without reducing the independence of the institution so that the judiciary will not practically involved in the political arena. This judicial organ only functions to take legal action in the prevention phase so that problems do not re-occur.
