Tinjauan Hukum Ekonomi Syariah Terhadap Praktik Jual Beli Kulit Hewan Kurban di Mesjid Muslimin Teladan 伊斯兰经济法对穆斯林清真寺祭祀兽皮做法的审查

Abstrak Penjualan kulit hewan kurban pada saat Idul Adha selalu menimbulkan permasalahan hukum di masyarakat, sebagian umat Islam memperbolehkan penjualan kulit hewan kurban dengan alasan kulit tersebut tidak digunakan oleh orang yang menerima daging kurban, jika diberikan kepada mereka maka mereka membuang kulitnya Sementara itu, mengolah kulit hewan kurban adalah pekerjaan yang sulit bahkan memiliki keahlian khusus, untuk itu sebagian muslim menjual kulit hewan tersebut. Adapun sebagian umat Islam lainnya dengan tegas melarang penjualan kulit hewan kurban, dengan alasan segala sesuatu yang berasal dari hewan kurban merupakan bagian yang harus disumbangkan bukan untuk dijual atau dinikmati sendiri setelah kulitnya dijual, salah satunya masjid di Medan. Kota yang telah mempraktikkan Jual beli kulit hewan kurban adalah masjid Teladan Muslimin. Dalam penelitian ini penulis akan mencoba mengkaji dalil dan manfaat pengurus masjid dalam mengamalkan perdagangan kulit hewan kurban.
抽象销售祭祀动物的皮肤Adha总是引起社会的法律问题时,大部分穆斯林允许销售祭祀动物的皮肤和皮肤的原因不被接受的人祭肉,皮肤如果赐给他们,他们就把牺牲的同时,处理兽皮是一项艰巨的工作,甚至有特殊技能,主要是穆斯林的卖掉这些兽皮。至于其他一些穆斯林则强烈禁止出售祭祀动物的皮肤,因为祭祀动物的所有产品都是出售动物皮肤后必须捐赠或自行享用的,这是棉兰的一座清真寺。这座城市实行祭祀皮革交易,是穆斯林的典范清真寺。在这项研究中,作者将尝试回顾清真寺管理人员使用祭祀动物皮肤的提议和好处。

Abstrak Perjanjian kredit bank adalah perjanjian pendahuluan dari penyerahan uang. Perjanjian kredit perbankan pada umumnya menggunakan bentuk perjanjian baku, dalam praktiknya bentuk perjanjiannya sudah disediakan oleh pihak bank sebagai kreditor sedangkan debitor hanya mempelajari dan memahaminya dengan baik. Dimana dalam perjanjian tersebut pihak debitur hanya dalam posisi menerima atau menolak tanpa ada kemungkinan untuk melakukan negoisasi atau tawar-menawar, yang pada akhirnya melahirkan suatu perjanjian yang tidak terlalu menguntungkan bagi salah satu pihak. Dalam perjanjian seperti ini, pihak kedua (debitur) sama sekali tidak dapat mengajukan usul ataupun masukan dan keberatan terhadap format perjanjian dan klausula-klausula yang ada di dalamnya. Tujuan penelitian ini adalah sebagai berikut: (1) Untuk mengkaji dan menjelaskan upaya perlindungan hukum terhadap debitur Kredit Tanpa Agunan terkait dengan Undangundang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. (2) Untuk mengetahui dan menganalisa bentuk peneyelesaian sengketa secara hukum dalam melindungi debitur (nasabah) selaku konsumen dan Penelitian ini dilakukan dengan menggunakan metode penelitian hukum doktrinal/normatif atau penelitian hukum kepustakaan.
银行信贷协议的抽象性质是货币交接的前奏。银行信贷协议通常使用原始形式,在实践中,这种形式是由银行提供的,作为债权人,而债务人只是研究和理解它。在该协议中,借款人只能接受或拒绝,没有谈判或讨价还价的可能,这最终导致了一个双方都不太有利的协议。在这样的协议中,第二部分(债务人)不能对其中的协议格式和条款提出建议或输入,也不能反对。本研究的目的如下:(1)回顾并解释1999年第8条关于消费者保护的法律保护措施。(2)了解并分析消费者保护债务人的合法解决问题的方法,本研究采用教义/规范法研究或文学法律研究的方法进行。

Abstrak Kearifan lokal merupakan pengetahuan yang eksplisit yang muncul dari periode panjang yang berevolusi bersama – sama masyarakat dan lingkungannya dalam sistem lokal yang sudah dialami bersama – sama. Penelitian ini akan membahas tentang kearifan lokal yaitu peranan lubuk arangan dalam meningkatkan ekonomi masyarakat dalam perspektif hukum ekonomi islam. Sebagai hasil dari penilitian ini bahwa masyarakat di Desa Gunung Tua Julu memiliki kebiasaan membuka lubuk larangan pada setiap lebaran atau hari besar agama. Penghasilan dari lubuk larangan akan dipergunakan sebagian untuk kas desa Gunung Tua Julu sebagai salah satu program desa Gunung Tua untuk meningkatkan pendapatan ekonomi masyarakat.   Kata Kunci: Lubuk Larangan, Ekonomi Islam, Pendapatan   Abstract Local wisdom is explicit knowledge that emerges from a long period of evolving together with the community and its environment in a local system that has been experienced together. This study will discuss local wisdom, namely the role of lubuk arangan in improving the community's economy in the perspective of Islamic economic law. As a result of this research, the people in Gunung Tua Julu Village have a habit of opening the pit of prohibition on every Eid or religious holiday. The pattern of economic activity is a form of economic activity whichdoes by people or even a country to improve the quality of the economy from time to time and is carried out continuously. This pattern will always be monitored in terms of strengths and weaknesses which will use it to be a reference to design a better pattern of economic activity. The pattern of economic activity will cover many vital topics such as money, trade and specialties that can be carried out at the economic level of the family to the state. Therefore, each pattern of economic activity will be different depending on the actors of economic activity themselves. Especially for the country, this pattern of economic activity will be highly visible from the monetary policy undertaken. How is the financial management system, revenue flow circulation, and market mechanisms regulated by the government. Therefore, the country will continue to carry out monetary reforms to create a pattern of good economic activity for mutual prosperity.

Distribution of Islamic microfinance is often constrained by the characteristics of the poor who tend to be conservative. This has implications for the difficulty of efforts to improve the welfare of the poor through increased work ethic and productivity. Various discourses propose the application of risk management based on mapping the characteristics of the poor in the distribution of micro-scale financing, including for the sharia segment. Therefore, this study aims to analyze the characteristics of the poor as the basis for risk management of Islamic micro finance. This research takes a case study on the Mitra Manindo Cooperative in Mandailing Natal Regency, North Sumatra Province. The research method was carried out by taking 102 research samples using questionnaires and analyzed through the development analysis approach. The results of the study concluded that: (i) Mitra Manindo Cooperative members have different business characteristics and performance; (ii) each member has a different level of business problems; and (iii) each member has different characteristics, especially in the work ethic. Characteristics of members in general can be categorized into four clusters, namely dynamic, active, passive, and potential. Based on these results, a cluster-based management method is needed which has implications for the urgency of financing management as a form of financing mitigation. Characteristic mapping is an effort to reduce the uncertainty (gharar) of sharia microfinance governance that emphasizes the importance of transparency, fairness, and equity. This finding can be a proliferation in constructing the mapping design of the characteristics of the poor as a single segment of microfinance.

SYIRKAH ABDAN DALAM PERSPEKTIF MAZHAB SYAFI’I: ANALISIS KONTEKSTUALISASI FIKIH ISLAM KONTEMPORER

Syirkah Abdan adalah kesepakatan dua orang atau lebih untuk bekerja dengan mempergunakan kepandaian mereka tanpa adanya harta, disyaratkan mereka sama-sama berusaha dan upah yang mereka terima dibagi menurut kesepakatan mereka. Menurut mazhab Syafi’i, syirkah abdan ini adalah bathil (tidak sah, mereka beralasan bahwa perserikatan hanya berlaku pada serikat percampuran modal dan harta, bukan bekerja dan bukan pula dalam bidang tanggung jawab. Sementara sesuai dengan perkembangan zaman dan tingkat kemajuan ekonomi mengakibatkan semakin banyaknya jenis muamalah yang muncul, seperti syirkah abdan yang sekarang ini sangat banyak digunakan oleh masyarakat. Hasil penelitian menyimpulkan bahwa hukumnya diperbolehkan dengan alasan tujuan utama perkongsian adalah selain untuk mendapatkan keuntungan, akan tetapi dari perkongsian itu akan memupuk rasa kebersamaan, tolong-menolong dan melatih seorang muslim agar bersikap jujur serta mendidik disiplin tinggi dalam bekerja.

Sale and Purchase of Local Wisdom Based Wisdom  (Study of Luat Lombang Village, Sipirok District) This article reviews the models of auction buying and selling in Luat Lombang Village community. For these people, buying and selling auction is no longer seen solely as a provision determined by religion, but has become a habit and need in community life. The approach method used in this article is the empirical juridical approach method, namely research on the effectiveness of law by studying legal regulations which are then linked to data and behavior that lives and develops in the midst of society. So the results of the study show that: First, the factors still carrying out the sale and purchase of auctions in the community of Luat Lombang Village, Sipirok District, because it has become a custom. Second, the sale and purchase of auctions to the public is done in cash, real and clear. Third, the legality of the implementation of buying and selling based on Islamic law in the community of Luat Lombang Village, Sipirok Subdistrict, is legal because it has fulfilled the legal requirements for the sale and purchase agreement and there are benefits for the buyer and the whole community can benefit from the sale of the auction.

Konstruksi Pengembangan Wakaf Saham Dalam Rangka Mengoptimalkan Potensi Wakaf Produktif di Indonesia Wakaf股票开发的建设,以优化印尼生产潜力

Waqf has an important role for improving the quality of development, especially through improving social and economic dimensions. However, the management of waqf on average has not been able to be productively, so that its role for development is still not optimal. This is caused the suboptimal innovation and governance of waqf. The strategy to improve innovation in waqf governance is to create product diversification, one of which is stock waqf. However, the development of stock waqf is constrained by the lack of literature references so that the exploration of the potential and impact of stock waqf is still unknown. Therefore, the purpose of this study is to construct the development of stock waqf in order to optimize the potential of productive waqf in Indonesia. Based on the desk study approach analyzed through literature review, three discussion results can be drawn, namely: (i) the community still has a weak level of knowledge related to stock waqf, which is caused by socialization and literacy that are still low; (ii) the position of stock waqf in the constellation of Islamic financial ecosystem is still weak; and (iii) there are two models of implementing stock waqf that can be done, namely waqf that comes from the profits of stock investors, and waqf that makes Islamic stocks as an object of waqf. To construct the development of stock waqf, policy strengthening is needed, which includes the authorities of the Ministry of Finance, the Ministry of Religion, BWI, BI, and OJK.

Some people need a solution really realize their desire to carry out umrah. One solution offered by Amitra Syariah Financing in the form of financial bailout for prospective pilgrims when they are willing to have Umroh through PT. Wakain Zain Abul Husna. This innovation is a system that solves the financial problems of Muslims. This system innovation focused on the payment system, cooperation with Islamic banking, travel agents, customers, fatwa of National Sharia Board-Indonesian Council of Ulama (DSN-MUI) and other stakeholders and the system as a human creation. This system innovation raises pros and contras, will it be a way out of financial problems for Umrah or become a financial problem after having Umrah? The role of ethics in doing business occurs in this system innovation.

Abstract   In everyday life there are several forms of land pawning / rice fields that are often carried out by our society. As was done by the people of Candi Village, Dungkek. Regency of Sumenep when  wanted to pawn their land / rice fields because of economic problems. However, for whatever the reason, very application of muamalah activities held should not contrary with Islamic law. The purpose of this study is to find out how the pawn system is usually done by people of Candi, Dungkek, Regency of Sumenep is viewed by the perspective of Islamic law. This research uses descriptive qualitative method of analysis. The results of this study are the practice of  the pawn  that occured  in Candi Village can be described as that  A as a person who wants to provide land came to the B with the intention to borrow money. In the transaction, A gives land (paddy / garden) as collateral for the debt. However, the agreement did not determined who would manage the land. Although in reality the person who managed the land is B, besides B is entitled to take all the benefits resulted from the collateral land, there is also no provision between the two parties about the time period of the pawn, so the pawn recipient will return the pawn land until the owner paying the debt off. Viewed from the perspective of Islamic law, the land pawn contract carried out by the people of Candi Village, Dungkek Sub district, regency of Sumenep, in the terms of the availability of pillars and pawning conditions, is valid in accordance with the provisions of Islamic law, although it still needs improvement, especially clarity in the management and safe keeping of collateral items (marhun). because there is indication of  over-exploitation by Murtahin and there is not the clarity of the time of  the Pawn, and this resulted in losses to the Rahin.
