¿Hacia dónde van las políticas públicas en educación? Una mirada internacional y mercosureña 公共教育政策走向何方?国际视角和南方共同市场

Desde una mirada internacional, se reflexiona hacia donde se dirigen las politicas publicas en educacion, observando el espiritu del discurso de Irina Bokova, (UNESCO - Milan, 2010). Con un sentido profundamente humanista, se efectua llamamiento a la construccion de una comunidad humana mundial; la educacion, la comunicacion, la cultura y las ciencias, son presentadas adecuadas para dar respuesta sostenible a los problemas de la humanidad. Revisando el objetivo de maximizacion del bienestar por una sociedad y su identificacion cronologica -crecimiento, desarrollo economico, desarrollo sostenible, desarrollo humano, desarrollo humano sostenible (DHS)- y, en concordancia con dicho discurso, se continua analizando la Declaracion de Incheon – Educacion 2030 –con el Marco de Accion para la realizacion del Objetivo de Desarrollo Sostenible 4- “Garantizar una educacion inclusiva y equitativa de calidad y promover oportunidades de aprendizaje permanente para todos”; la III Conferencia Regional de Educacion Superior -CRES 2018, Cordoba-, con el Plan de Accion sobre la Educacion Superior en America Latina y el Caribe, en la perspectiva del DHS y el compromiso con sociedades mas justas e igualitarias; los Acuerdos de Cochabamba (2018) con la Hoja de Ruta Regional para la implementacion del ODS4- E2030 en America Latina y el Caribe. Finalmente, se analiza la labor del Mercosur Educativo en la construccion de una conciencia ciudadana y una identidad regional en la observacion de los Derechos Humanos, y el desarrollo de los Planes Estrategicos llegando al Plan de Accion (SEM) 2016-2020, con objetivos y actividades en concordancia con la Agenda 2030 (ONU), Meta 4 (ODS4).

Mercado de Arte, Integridade e Due Diligence no Brasil e no MERCOSUL Cultural Mercado de Arte, integrade and尽职调查,巴西,MERCOSUL文化

O presente artigo visa oferecer algumas reflexões acerca da due diligence no mercado de bens culturais, explorando seu conceito, sua evolução histórica, sua aplicabilidade no direito comparado e, especialmente, seu uso no direito brasileiro e do Mercosul. Embora a due diligence se trate de um instituto mais conhecido e aplicado nos ramos jurídicos cíveis e domésticos, observa-se sua crescente exigência no mercado internacional de artes, sendo estimulado e valorizado por diversas organizações não-governamentais e organismos públicos dos mais variados países e regiões. O Brasil vem concedendo cada vez mais importância ao tema da due diligence (e suas conexões com compliance e good governance) no mercado de arte, principalmente na última década. Ressalta-se a promulgação da Lei 13.608, de 10 de janeiro de 2018, e a publicação da portaria 396/2016 do IPHAN, ambas relacionadas à Lei 9.613 de 3 de março de 1998, que, há vinte anos, vem aperfeiçoando o combate à lavagem de dinheiro em território nacional. A contrario sensu, ainda é discreta a utilização da due diligence no âmbito cultural do Mercosul. Em linha com preocupações internacionais, é necessário um aprimoramento das diretrizes incumbidas de salvaguardar as relações comerciais envolvendo o patrimônio cultural material no território do bloco.

El control de competencia internacional desde el derecho internacional privado argentino 阿根廷国际私法对国际竞争的控制

International legal cooperation began to be a prominent part of the object of Private International Law a few years ago. Análisis sistémico de la controversia por los neumáticos remoldeados: un caso emblemático a 15 años de conformación del Tribunal Permanente de Revisión 轮胎重塑争议的系统分析:常设审查法庭成立15年后的一个象征性案例

El objetivo general de este trabajo es realizar un estudio de caso sobre la controversia suscitada entre Brasil y Uruguay, en un primer momento, y entre Argentina y Uruguay, posteriormente, dentro del mecanismo de solucion de controversias adoptado en el MERCOSUR, al respecto de una medida adoptada por Brasil y Argentina que prohibia el ingreso de neumaticos remoldeados a sus territorios. Se trata del denominado: “caso de los neumaticos remoldeados”. El trabajo persigue, como objetivos especificos: (i) realizar una comparacion e identificar las conexiones existentes entre las controversias y (ii) determinar las implicancias de los laudos arbitrales emitidos para resolver la controversia desde una perspectiva sistemica. El metodo utilizado para la investigacion fue el de analisis de caso.

La opinión consultiva como herramienta para la uniformización de la interpretación y aplicación del derecho del MERCOSUR, en la temática migratoria 协商意见作为统一南方共同市场关于移徙问题的法律解释和适用的工具

MERCOSUR, in the attempt to form a common market, has as its objective the free movement of people. As the region, historically, has high migratory mobility, whether from intra or extra bloc migrants, it was forced to produce a set of regulatory norms, having developed various measures for the strengthening of the free movement of people, promotion of citizenship and protection of the human rights of the migrant. In this regard, MERCOSUR has worked with the harmonization of national laws, seeking to reduce disparities in the treatment provided by the right of internal source. Given this scenario, and considering the increase in the internal flow of migrants, observed at present, the following research problem arises: is it possible to use the mechanism of advisory opinion, existing in MERCOSUR, for cases dealing with the movement of people, as a tool to standardize the interpretation and application of Mercosurean norms on the issue of migration and, consequently, strengthen the rights of migrants, in the block? To respond to the problem posed, the descriptive and historical normative methods were used, and as a research technique the bibliographic review and the documentary analysis. The response that has been reached says that in spite of the fact that there are still challenges related to the implementation and operation of the advisory opinion, it can be used as a suitable mechanism to promote the standardization of interpretation and attribute effectiveness to the intended rights, in the MERCOSUR rules related to the movement of people, strengthening regional integration, building trust and also deepening the human rights of migrants.

Cooperación jurídica internacional bajo la perspectiva de Brasil: el camino de su aplicabilidad 巴西视角下的国际法律合作:适用之路

A cooperacao juridica internacional ganhou suma importância com a inovacao trazida pelo Codigo de Processo Civil de 2015. No âmbito do direito internacional, a cooperacao existe ha anos, viabilizando o cumprimento de atos judiciais e administrativos de um pais em outro, com fundamento em tratados ou ate mesmo na reciprocidade. A ideia central da cooperacao juridica internacional com seus principais instrumentos de cooperacao – cartas rogatorias, auxilio direto, extradicao, homologacao de sentenca estrangeira - e harmonizar os interesses dos Estados soberanos respeitando a autonomia de cada um. Assim, o direito internacional se fortalece e os paises contribuem para a harmonia internacional. No Brasil ha dispositivos que implementam a cooperacao juridica internacional alem da ratificacao de acordos internacionais para sua viabilizacao. O objetivo e apresentar as modalidades de cooperacao juridica internacional presentes pela legislacao brasileira e demonstrar a concretude por meio de jurisprudencia. Tal instituto em comento resulta para o Brasil em ampliacao do seus contextos judicial e administrativo internacionais.
随着2015年《民事诉讼法》的创新,国际法律合作变得更加重要。根据国际法,合作已经存在多年,使一个国家在条约甚至互惠的基础上遵守另一个国家的司法和行政行为成为可能。国际法律合作的中心思想及其主要合作工具- -请求书、直接援助、引渡、批准外国判决- -以及在尊重主权国家自治的同时协调主权国家的利益。因此,国际法得到加强,各国为国际和谐作出贡献。在巴西,除了批准国际协定外,还有执行国际法律合作的机制。目的是提出巴西法律所规定的国际法律合作模式,并通过判例法证明其具体性质。所讨论的这一机构使巴西扩大了其国际司法和行政环境。

The Hague Conference on Private International Law has signed the Final Act of a new international convention designed to circumvent usual obstacles to international circulation of judgments. The 2019 Convention on the Recognition and Enforcement of Foreign Judgments aims at mitigating uncertainties and risks associated with the international commerce and other civil relationships by setting forth a simple and secure system according to which foreign judgments may circulate from country to country. The purpose of this article is to preserve the historical moment of the negotiations that took place at The Hague Conference, as well as to pinpoint the main issues regulated in the convention, that are of general interest to the subject of international litigation in a global perspective.
海牙国际私法会议签署了一项新的国际公约的最后文件,该公约的目的是规避判决在国际上流通的通常障碍。2019年《承认及执行外国判决公约》旨在通过建立一个简单而安全的制度,使外国判决可以在各国之间流通,从而减少与国际商业和其他民事关系相关的不确定性和风险。本文的目的是保存在海牙会议上进行的谈判的历史时刻,并指出公约中规定的主要问题,这些问题在全球范围内与国际诉讼主题有关。

La aplicación del derecho en el MERCOSUR 南方共同市场法律的适用

La naturaleza intergubernamental del proceso de integracion MERCOSUR, requiere que las NORMAS MERCOSUR aprobadas en el ambito de los organos decisorios del bloque regional (Decisiones, Resoluciones y Directivas) cumplan con el procedimiento de incorporacion de las mismas al ordenamiento juridico de los Estados Parte, adquiriendo la vigencia simultanea prevista en el Protocolo de Ouro Preto. En este documento se analiza el procedimiento establecido en la normativa MERCOSUR, tanto en el Derecho Originario como en el Derecho Derivado, y la respuesta a nivel de los Tribunales Arbitrales, y la necesidad de seguir buscando soluciones en el futuro.
