Anche se la recente ricusazione della dottrina della scoperta da parte del Vaticano è davvero benvenuta, il silenzio in merito a qualsiasi responsabilità politica per quelle bolle papali, vecchie di 500 anni, che autorizzavano le potenze coloniali a impadronirsi delle terre indigene, significa che la battaglia è vinta solo a metà. Ancor più negativamente, il fatto che il Vaticano abbia evitato ogni riferimento al collegamento tra i crimini di massa avallati contro i non cristiani e le loro conseguenze, indica che il bersaglio è stato mancato. Le bolle, infatti, sono state emanate dai «rappresentanti di Dio sulla Terra» e una tale negazione implicita è una debolezza strutturale che difficilmente potrebbe completare quella «architettura della riconciliazione» a cui si dice Papa Francesco miri. Questo saggio si propone di rievocare le testimonianze storiche della responsabilità diretta e indiretta del Papato, discutendo le circostanze che sono all'origine dell’organizzazione gerarchica di questo mondo, che ha avuto un impatto non solo sul continente americano ma anche su quello africano, con conseguenze permanenti su generazioni dei suoi popoli e dei loro discendenti nella diaspora.

The contribution reconstructs the theme of mass surveillance, intertwined with the protection of personal data. It starts to investigate the criticality profiles connected to the treatment of some specific categories of data, in particular biometric data, the treatment of which –systematically and on a large scale – is likely to define new surveillance models. Under these profiles, the article analyzes the jurisprudence of the European Court of Human Rights and Court of Justice.

This paper aims to illustrate the legal framework related to the right to food and food sovereignty in Nepal, highlighting some problematic aspects related to access to food. In particular, the paper focuses on provisions that aim to counteract land grabbing and seed biopiracy. The research reveals that in Nepal the concept of food sovereignty is considered equivalent to the right to food security and the right to be free from hunger.

The rise and consolidation of neoliberalism witnessed, inter alia, the emergence of a discourse on the causes of poverty centred on public corruption, which has informed the mainstream of development. In this perspective, the goal of “long-term economic growth and shared prosperity” has to be achieved – parallel to the implementation of core economic reforms – by combating corruption. As a matter of fact, governments of developing countries are called upon to fight corruption, under the watchful eye of a civil society, which is presumed not to question the framework of neoliberal reforms. Here, we would like to propose a critical reading of this normative framework by questioning, in a historical perspective, the main theoretical assumptions underlying it as well as the notion of corruption, which informs it. Not least, we will raise the question of which spaces, if any, are left to take into consideration the role to be played by redistributive public policies in the struggle against poverty in the world’s South. Finally, we will propose some reflections resulting from a long period of fieldwork research in the Indian state of Odisha, historically plagued by severe levels of material poverty and social inequality, and affected by the proliferation of corruption practices inherent to the exploitation of its abundant natural resources.

In October 2022, the Court of the Eurasian Economic Union (EAEU) adopted the first Advisory Opinion fully devoted to the interpretation of the tax provisions of the EAEU Treaty. While reiterating its previous findings that the powers to impose taxes fall within the jurisdiction of the Member States, for the first time, the Court has argued in favour of limiting these powers by the law of the EAEU. Such limitations derive from the principles of non-discrimination and free competition of goods and services regardless of the country of production. In such a manner, the Court has made a significant contribution to the establishment of a single common market within the Union and has enriched the understanding of the principles governing the division of competence between the Member States and the bodies of the Union. The only conclusion that could be seen as dubious by the Court was regarding the collection of VAT on the basis of the country of destination and the fact that this is necessary to maintain competition and avoid double taxation and that the reasoning for such a mechanism is also predetermined by the nature of this tax

Brazil’s presidential elections held last October were the closest in the country's history. The results reflect the polarized political environment and the scenario of political violence, institutional delegitimization, and social unrest perpetuated by the bolsonaristas, which reached its peak with the assault on the Palácio do Planalto This was the concluding act of a process of construction of dialectical and visual violence, steeped in denialism and delegitimization of the opponent. This led to a highly conflictual and aggressive electoral space, that institutions like the Tribunal Superior Eleitoral and Transparência Eleitoral Brasil tried to counter. This essay investigates the pre-and post-electoral violence and the role of the institutions designated to mitigate it.

In Chile, the beginning of the work of the Consejo Constitucional – the conservative-majority body that will draft within four months a new constitution that should replace the existing 1980 Constitution – serves to outline the ongoing constitution-making process. This can be done considering the first year of the presidency of progressive Gabriel Boric, who was its promoter but will not be able to lead it. Instead, it will be led by the ultra-conservative José Antonio Kast, leader of the Partido Republicano de Chile, which has always declared itself opposed to a reform of the Fundamental Charter and which holds precisely the majority in the Consejo Constitucional.

What are the motivations that support Ukrainians’ strenuous and unexpected resistance to the invasion, which began in 2014, of their republic? For many political observers, journalists, researchers and scholars, the Ukrainians’ tenacity, courage, and determination remain little or not fully understandable to this day. In reality, the reasons for that tenacity are many. However, the main has been and continues to be the opportunity, in the thirty years of Independence, to discover one’s own history, both from the period of the Russian and the Soviet Empires. Ukraine’s history has been difficult, punctuated with long denied, counterfeited, and obscured tragedies. Its discovery is the most important reason that supports the will to resist today. What is taking place today thus is the intensification of a centuries-long process of de-colonization that not only affects the ethnic Ukrainian component, but also becomes an attempt to block the way for the return of autocratic and totalitarian rule that threatens to overwhelm a fragile civic nation in the making for the past 30 years.
