The paper aims at investigating the current status of Afghan women’s human rights from the perspective of constitutional and comparative public law in light of the debate on minority women’s condition in multicultural and multiethnic legal systems. Moving beyond the analysis of the Afghan legal system and hinging on selected statistics on Afghanistan’s ethnically diverse composition, the first part of the paper examines Afghan’s women condition following the coming into force of the 2004 Constitution by interlacing the constitutional provisions with the existing rules of Personal and Customary Law. The second part of the paper goes on by comparing the Afghan legal system with selected European and extra-European Countries featured by systems of law, that similarly to Afghanistan rely on a mixture of State Laws, Personal, and Customary Laws to highlight the extent to which these systems affect women’s human rights and, especially, those of minority women

The increasing abuses and human rights’ restrictions whose Afghan women are victims arise the question as to what remedies are provided by international law in order to address this dramatic situation. To answer this question the paper focuses first on the role played by the United Nations, that in 2002 established the United Nations Assistance Mission in Afghanistan (UNAMA), which was entrusted to implement and to monitor the application of human rights in the State. Secondly, it seeks to frame the legal obligations that international law place upon States, and upon Afghanistan in particular, as regards the protection of women’s rights, in order to finally question, both in a de iure condito and in a de iure condendo perspective, the effectiveness of the remedies provided by international law in addressing the continuous and systematic violations of international human rights perpetrated against Afghan women

The paper focuses on women’s condition in totalitarian regimes, in the light of the principles of the Italian Constitution. To this end, the paper will examine three main aspects. Firstly, the analysis will focus on the condition of women during the Nazi and Fascist totalitarian regimes. The proposed historical and legal reconstruction aims at identifying some key traits featuring the condition of women in the context of totalitarian regimes: the exclusion of women from the labour market and, more broadly, from the public sphere; the propaganda of an ideal-type of woman; the segregation of minority women (e.g. prostitutes, homosexuals, women with disabilities); the creation of masses of refugees fleeing regimes. Secondly, the paper will hinge on the Italian Constitution, that promoted a vision in clear rupture with the previous fascist regime with regard to women’s condition and to the strong protection granted to people fleeing regimes set forth under Article 10, paragraph 3 of the Italian Constitution. At the outset, the paper aims at reflecting on the current system of human rights protection in light of the 2021 takeover of the Taliban regime in Afghanistan, by way of underlying the specifics of the actual status of Afghan women

Dopo aver brevemente occupato giornali e telegiornali nei mesi successivi al ritorno dei Talebani a Kabul, la “questione afghana” è entrata in un cono d’ombra, per poi scomparire definitamente, oscurata dalla guerra in Ucraina. Questo volume – che raccoglie gli atti del convegno “Donne e regimi: spunti a partire dal caso afghano” che si è svolto il 10 dicembre 2021 all’Università degli Studi di Milano – è dunque particolarmente prezioso. Intanto perché conserva memoria degli ottimi interventi degli studiosi e delle studiose che parteciparono a quel convegno; e poi perché contribuisce a recuperare dall’oblio le donne afghane e in generale il popolo afghano tutto.

The author offers an overview of the Afghan people's situation after the restoration of the Taliban regime. Following an analysis of the measures enacted by the Taliban regime to limit the exercise of some fundamental rights, the A. warns about the negative consequences that would arise as a consequence of the possible recognition by the international community of the legitimacy of the Taliban regime established in Afghanistan in August 2021. Eventually, the A. calls on foreign countries not to ignore the abuses committed by the Taliban and urges the international community's intervention to support the Afghan population.

The collapse of the Afghan regime that safeguarded Western interests has laid bare its various roles: multiplier of dependence, war factory, impunity guarantor, impassable border. But the West doesn’t consist only of institutions and governments: the civil society plays its own role, raises contradictions, and creates opportunities for exchange.

In the past, the spread of a pandemic has often overlapped and exacerbated its impact on the socio-economic conditions of the affected populations. When a significant contraction in economic activities occurred to contrast the epidemic, the result was a worsening of the gaps among social classes and an expansion of existing inequalities. Based on these assumptions, the article presents the effects that the COVID-19 pandemic has had on Namibia. Through the review of the existing literature and secondary sources, the relationship between the COVID-19 infection and the socio-economic conditions in the country was analyzed, concluding that, in order to have long-term effects and not to harm the more marginalized social classes, the measures put in place by the government should have been holistic, and aimed at combating both the biological factors of the pandemic and existing inequalities.
