EnglishThis article aims to reflect on the form that the educational process takes in the daily work of the Social Worker of the Center for the Study and Defense of the Rights of Children and Youth (NEDDIJ) and the content that these practices reveal in the relationship with subjects. It is a qualitative research, produced through the procedures of bibliographic research, documentary research and content analysis, with a one-year time frame, which runs from June 2019 to June 2020. The text contextualizes the conceptual debate on educational practices and the fundamental right to family and community coexistence of children and adolescents and, at the end, it analyzes the educational practices undertaken. In the empirical context studied, the practices have emancipatory characteristics and constitute themselves as an ontological dimension of the performance and as a resource portuguesEste artigo se propoe a refletir sobre a forma que o processo educativo assume no cotidiano do trabalho do Assistente Social do Nucleo de Estudos e Defesa de Direitos da Infância e da Juventude (NEDDIJ) e o conteudo que essas praticas desvelam na relacao com os sujeitos. Trata-se de uma pesquisa qualitativa, produzida por meio dos procedimentos da pesquisa bibliografica, da pesquisa documental e da analise de conteudo, com recorte temporal de um ano, que vai de junho de 2019 a junho de 2020. O texto contextualiza o debate conceitual sobre as praticas educativas e o direito fundamental a convivencia familiar e comunitaria de criancas e adolescentes e, ao final, analisa as praticas educativas empreendidas. No contexto empirico estudado, as praticas tem caracteristicas emancipatorias e se constituem como uma dimensao ontologica da atuacao e como um recurso.

In Child and Adolescent Statute’s (ECA) thirty years’ celebration, this article, a bibliographic and documentary research’s, aims to enable a critical reading on the deviations / ways of protecting children and adolescents from of the ECA’s institution. The text, with a critical bias, presents initiatives from the legal point of view and public policies, which elucidate the protective enlargement that the ECA generated to childhood and adolescence. The conception of children and adolescents as subjects of rights is problematized based on human rights and considers, above all, the differentiation between the quantity and quality of the right. The achievements and advances in this historical path still limited and insufficient in a scenario of worsening inequalities produced and reproduced by the capitalism and that generate the most diverse situations of violation of rights, such as the right to adequate food, which still reveals the lack of Brazilian’s children and adolescent protection.
