El Corpus politicum de San Pío X: una interpretación antimoderna 圣庇护十世的政治文集:反现代的解释

espanolResumen En las ultimas decadas, el corpus politicum de San Pio X ha sido objeto de diversas lecturas. En este trabajo se vuelve a la postura originaria: la que inserta el corpus politicum pianum dentro de la amplia mirada antimoderna del pontifice, enves de su designio positivo de Instaurare omnia in Christo. Para tales efectos, se revisan las lineas fundamentales de la bibliografia existente y se expone el nucleo de la doctrina politica del papa Sarto sin intermediaciones, a partir de las fuentes directas, desde la clave de interpretacion elegida. Los principios del corpus politicum pianum mantienen, en lo sustancial, su vigencia. EnglishAbstract In recent decades, the corpus politicum of Saint Pius X has been the subject of various readings. In this work we return to the original position: the one that inserts the corpus politicum pianum within the broad anti-modern view of the pontiff, the reverse of his positive design of Instaurare omnia in Christo. For such effects, the fundamental lines of the existing bibliography are reviewed and the core of the political doctrine of Pope Sarto without intermediaries is exposed, starting from the direct sources, from the key of interpretation chosen. The principles of the corpus politicum pianum maintain, in substance, its validity.

Los secretarios del Despacho Universal de la monarquía hispánica durante el reinado de Felipe IV (1621-1665) 菲利普四世统治时期(1621-1665)西班牙君主世界办公室的秘书

espanolResumen En este trabajo se presenta una aproximacion a la secretaria del Despacho Universal a traves de los secretarios que ocuparon este empleo durante el reinado de Felipe IV. Nos proponemos saber quienes fueron y comprobar si existieron patrones comunes. Nacida en el siglo XVII, esta secretaria tuvo una enorme importancia para reforzar el poder de los validos en la monarquia hispanica y, una vez desaparecidos estos, para agilizar las tareas de gobierno. Conocer quienes fueron estos secretarios nos permitira, por tanto, profundizar en las estructuras de poder de la alta administracion espanola. EnglishAbstract This paper presents an approach to the secretariat of the Universal Office through the secretaries who occupied this job during the reign of Felipe IV. We propose to know who they were and to check if there were patterns shared. Born in the seventeenth century, this secretariat had an enormous importance to strengthen the power of the favorite in the Hispanic Monarchy and, once these disappeared, to streamline the tasks of government. Knowing who these secretaries were will allow us, therefore, to deepen the power structures of the Spanish top management.

Concubinos y admisión a los sacramentos en el ius antiquum: a propósito de algunas excepciones en las fuentes canónicas 在古代法中,妾和圣礼的准入:关于规范来源中的一些例外

espanolResumen El objetivo de este estudio es ofrecer un analisis historico y juridico de fuentes canonicas del ius antiquum sobre el concubinato y la admision de quienes se encontraban en dicha situacion a los sacramentos. A traves de una lectura utroquistica de las fuentes y del contexto historico, social y juridico relacionado, se propondra una revision historiografica del tema, demostrando que la admision de los concubinos a los sacramentos no constituye una forma de abuso o de traicion a la Tradicion; por el contrario, las fuentes analizadas constituyen un testimonio de la capacidad de la Iglesia del primer milenio -cuyas aspiraciones no distan mucho de las de la Iglesia actual- de comprender en un dialogo armonioso entre la Justicia y la Misericordia los problemas y las inquietudes presentes en la sociedad de un determinado momento historico, teniendo siempre como objetivo de su accion de gobierno el bienestar social y espiritual de la comunidad de fieles. EnglishAbstract This study aims at offering a historical and legal analysis of canonical sources of the ius antiquum on concubinage and the acceptance of those who were in that situation to participate in sacraments. By reading Utraquist writings of the historical, social and legal sources and contexts, a historiographical analysis on this subject will be presented, demonstrating that the acceptance of concubines in sacraments is not a type of abuse or betray to the Tradition; on the contrary, the analysed sources are a testimony of the capacity of the Church of the first millennium-whose aspirations are not too different from the modern Church- to understand, by means of a harmonious dialogue between Justice and Mercy, the problems and concerns of the society of a particular historical time, always making the social and spiritual well-being of the community of the faithful as a governance objective.

espanolResumen Una perspectiva evolutiva de los principales hitos normativos que demarcan el surgimiento del judicial case management en Europa, permite constatar que el mayor control judicial sobre la litigacion civil, como herramienta de eficiencia, constituye una tendencia muy consistente. Las mayores responsabilidades asignadas a los jueces han generado una transformacion y ampliacion del rol que tradicionalmente se les ha asignado, lo que se justifica en cambios de la filosofia sobre los fines del proceso. EnglishAbstract An evolutionary perspective on the main regulatory milestones that determine the beginning of the judicial case management in Europe makes it possible to verify that an increased judicial control over civil litigation, as an efficiency tool, comprises a highly consistent tendency. The main responsibilities assigned to judges have promoted a transformation and growth of the role that has been assigned to them, which is justified through changes in philosophy regarding the aims of the process.

Causae credendi y obligatio re contracta en las res cottidianae 信用的原因和合同义务

espanolResumen A diferencia de las Instituciones de Gayo, en las que la mutui datio aparece solitaria, como unico supuesto de obligatio re contracta (Gai. 3,90), las res cottidianae agregan inmediatamente despues de la explicacion de esta figura (D. 44,7,1,2) la obligaciones contraidas, respectivamente, por el comodatario, el depositario y el acreedor pignoraticio, mediante el uso de las expresiones genericas re obligatur y re tenetur (D. 44,7,1,3-6). EnglishAbstract Unlike the Institutes of Gaius, in which mutui datio stands alone, as the only assumption of obligatio re contracta (Gai. 3,90), the res cottidianae, right after the explanation of this leading legal aspect (D. 44,7,1,2), add the obligations undertaken by the bailee, custodian and the pledgee respectively, by using the generic terms re obligatur and re tenetur (D. 44,7,1,3-6). Nonetheless, the technical term re contrahitur obligatio refers, in this work, to the mutuum. This has encouraged the communis opinio, by which this writing is the starting point for the real contracts category from the Romanistic tradition up to the present day, that is, composed of mutuum, bailment, deposit and lien. However, we believe that in res cottidianae, far from establishing a new concept of re contrahere, it instead confirms its classical structure, restricted to the mutuum and the approach that is verified between the mutuum, on one hand, and the commodatum, depositum and pignus, on the other hand. This is rather driven by the practical need to prove that, from a procedural perspective, the obligation of the bailee, depository and pledgee to reddere is availed through strictly restorative honorary actions, built on the basis of the condictio model that the lender applies against the borrower. Then, these four business activities are linked on the basis of the causae credenda and not on obligations re contractae.

Lo anterior ha motivado la communis opinio segun la cual este texto seria el punto de partida de la categoria de los contratos reales de la tradicion romanistica hasta nuestros dias, es decir, compuesta por mutuo, comodato, deposito y prenda. Sin embargo, a nuestro juicio, en las res cottidianae, lejos de establecerse una nueva nocion del re contrahere, lo que se hace es confirmar su estructura clasica, restringida al mutuo, y el acercamiento que se verifica entre el mutuum, por una parte, y el commodatum, el depositum y el pignus, por la otra, obedece mas bien a la necesidad practica de constarar que, desde una perspectiva procesal, la obligacion de reddere del comodatario, el depositario y el acreedor pignoraticio, se hace valer por medio de acciones honorarias estrictamente restitutorias construidas segun el modelo de la condictio que el mutuante ejerce contra el mutuario. Luego, estos cuatro negocios se vinculan no en cuanto obligationes re contractae, sino que en cuanto causae credendi. EnglishAbstract Unlike the Institutes of Gaius, in which mutui datio stands alone, as the only assumption of obligatio re contracta (Gai. 3,90), the res cottidianae, right after the explanation of this leading legal aspect (D. 44,7,1,2), add the obligations undertaken by the bailee, custodian and the pledgee respectively, by using the generic terms re obligatur and re tenetur (D. 44,7,1,3-6). Nonetheless, the technical term re contrahitur obligatio refers, in this work, to the mutuum. This has encouraged the communis opinio, by which this writing is the starting point for the real contracts category from the Romanistic tradition up to the present day, that is, composed of mutuum, bailment, deposit and lien. However, we believe that in res cottidianae, far from establishing a new concept of re contrahere, it instead confirms its classical structure, restricted to the mutuum and the approach that is verified between the mutuum, on one hand, and the commodatum, depositum and pignus, on the other hand. This is rather driven by the practical need to prove that, from a procedural perspective, the obligation of the bailee, depository and pledgee to reddere is availed through strictly restorative honorary actions, built on the basis of the condictio model that the lender applies against the borrower. espanolResumen El presente articulo busca esclarecer la relacion entre el pensamiento juridico de Emer de Vattel y el voluntarismo en distintas obras del intelectual suizo hasta ahora poco atendidas en el ambito iberoamericano. En este analisis teorico, se revalora la concepcion de derecho natural de Vattel, topico muchas veces olvidado en comparacion con su famosa teoria sobre derecho de naciones. Se concluye que Vattel reprocho tempranamente un voluntarismo de corte protestante para continuar con esta posicion epistemologica inicial al momento de abordar las relaciones internacionales y negocios de las naciones. Su voluntarismo representa mas el producto de una construccion historiografica moderna ligada al Estado-centrismo de la investigacion internacional que una autentica expresion de su pensamiento legal. EnglishAbstract The following paper explains the connection between the legal thought of Emer de Vattel and the voluntarism thorough different works which are rarely researched in the Ibero-American field. In this theoretical analyze, it revalues the Vattel’s understanding of the natural law, a topic that is commonly under looked in compare with his law of nations’ theory. It concludes that Vattel rejects early the protestant voluntarism in his natural law’s conception, continuing with this epistemological view in his interpretation on the international relations of nations. His voluntarism represents more a historiographical modern construction tied to State-centrism view in international scholarship than an authentic expression of his legal thought.

espanolResumen Los tratados juridico-politicos de la Edad Moderna constituyen una fuente primaria a la que es imprescindible acudir para estudiar de la burocracia de la epoca, un tiempo que se caracterizo por lo fructifero que fue en la impresion de libros de contenido juridico y politico. Gran parte de ellos fueron elaborados por miembros de la burocracia y los convirtieron en un medio para expresar su opinion y valoracion, en ocasiones critica, de la realidad. En aras de contribuir al estudio de la modernidad, en este trabajo analizamos diversos tratados para descubrir la perspectiva que tenian sus autores sobre la Corte, los validos, privados y otros miembros de la burocracia. EnglishAbstract The legal-political books of the Modern Age are an essential primary source essential to study the bureaucracy of the time, a time that was characterized by the impression of many books devoted to politics and law. Most of the books were written by members of the administration and turned them into a means to express their opinion and valuation, sometimes critical. We have the purpose of contributing to the study of modernity and we will analyze various treaties to discover the perspective they provide on the court, the valid, private and other members of the administration.

EnglishAbstract This article seeks to show the social context within which Tomas Alvarez de Acevedo’s visita was carried out, the strong ties between local magistrates and their subsequent resistance to any kind of reform that threatened to alter their position as local authorities as well as their economic and social status, and the obstacles the Visitador Regente faced in completing his task while, at the same time, adapting many of the new policies to the local circumstances, thereby achieving his commitment to the Spanish Crown.
