This paper explores the philosophical debate between Muguerza and Habermas, starting with the meeting of the two in the summer of 1994 in Madrid. To this end, some of the core aspects of their respective ethical and legal thoughts are interpreted and apostilled, both in their agreements and in their disagreements. The text focuses on the controversy between two of their apparently irreducible positions. Namely, the “primacy of the moral conscience of the individual”, defended by Muguerza, and the “primacy of the legal law of society”, advocated by Habermas. The paper concludes by suggesting a third approach, which methodically tempers the controversy, in reference to the duality of the “individual” constituted in-intra-societal relationship, and the “society” instituted by individuals-in-inter-relationship

espanolLa ideologia transhumanista ha sido, desde su emergencia hace miles de anos, una constante en la historia de la humanidad. Sin embargo, su materializacion, que no habia parecido posible hasta ahora, se vislumbra como un objetivo alcanzable en un futuro cercano gracias a las nuevas tecnologias biomedicas, roboticas, informativas e incluso militares. En este ambiente de progreso cientifico y humano, este articulo pretende recoger las ideas y pretensiones esenciales del movimiento transhumanista y, al mismo tiempo, dilucidar si estas pueden ser una realidad alcanzable a corto y medio plazo o, si mas bien, son una utopia propia de la literatura y el cine de ficcion. EnglishThe transhumanist ideology has been, since its emergence thousands of years ago, a constant in the history of humanity. However, its materialization, which had not seemed possible until now, is seen as an achievable goal in the near future thanks to new biomedical, robotic, informative and even military technologies. In this landscape of scientific and human progress, this article aims to collect the essential ideas and goals of the transhumanist movement and, at the same time, to clarify whether these can be a reality that can be achieved in the short and medium term or, on the contrary, they are a literature and fiction films utopia.

"At the beginning of 1955 Hannah Arendt began to inquire into the origins and causes of political life for the planning of a book, which never saw the light and which would have borne the title Einführung in die Politik (Introduction to Politics), she asked herself a question with resonance in the thought of Leibniz, Schelling and Heidegger: Why is there someone and not rather no one? With this question Arendt echoes a phenomenon that would run through the whole of her thought: the estrangement from the world (Weltentfremdung), which was widespread among philosophers as an endemic disease when analyzing the conditions of the world. For Arendt this phenomenon represents the first obstacle to overcome in order to understand the reality of politics. The actuality of the political phenomenon, paying special attention to the metaphor of the desert and how it breaks down the relationship between tyranny and the emptying of public space."

The paper focuses on the famous fragment of Ethics, where Spinoza quotes Descartes in order to criticize him, with a little irony.

In the face of the criticism raised against Habermas distinction between morality and ethics and its universalist foundation of morality, it is argued that the priority of moral objectives results constitutively out of the normative reflection structure of the thinking subject, on which depend both the life objectives and corresponding social order in the specific contexts, as well as the personal ones; expanding, thus, the frame of the structurally constitutive in practical reflection. Additionally, the persistence of the Kantian moral thinking in the foundational architecture of ED is reconsidered.
