Violence in education has led to criminal activities that require special attention from all parties. This paper discusses preventive measures of violence in education through a juridical-religious approach under the criminal justice system. This paper is a doctrinal law study in which an analysis of legal materials is used to answer legal problems and produce legal arguments. This paper demonstrates that the incorporation and operation of these two approaches under the criminal justice system will be very effective and useful for preventing and controlling crimes in schools because, first, the juridical approach can prevent students from becoming victims of violence and educate them not to repeat the same crimes; secondly, the religious approach will instill a faithful, pious character and noble personality into students so that they avoid crimes.

Rumah Negara Golongan II merupakan fasilitas yang disediakan oleh pemerintah untuk dipergunakan sebagai tempat tinggal selama pegawai negeri sipil menjalankan tugas sebagai abdi negara. Setelah pegawai negeri pensiun maka rumah negara golongan II harus dikembalikan kepada pemerintah dan apabila rumah negara golongan II masih dihuni setelah pegawai negeri sipil pensiun adalah pelanggaran hukum yang dapat diberikan sanksi administrasi. Tulisan ini berusaha memaparkan dan menganalisis dua hal, yaitu (1) Pranata hukum Penghunian rumah negara golongan II (2) Tindakan hukum administrasi terhadap penghuni rumah negara golongan II setelah pegawai negeri sipil pensiun. Kesimpulan : (1) Penghunian rumah negara golongan II adalah sah secara hukum apabila memenuhi persyaratan dan sesuai dengan peraturan rumah negara (2) Penghunian rumah negara golongan II setelah pegawai negeri pensiun adalah pelanggaran hukum, terhadap pelanggaran tersebut Pemerintah dapat mengambil tindakan hukum administrasi berupa penerapan sanksi administrasi untuk menghindari penyalahgunaan rumah negara golongan II di luar tugas dan fungsinya.

Pembuktian merupakan satu tahapan penting dalam peradilan yang bertujuan untuk membuktikan apakah yang didalilkan oleh pihak yang berperkara benar ataupun sebaliknya. Untuk membuktikan suatu perkara itu betul atau tidak, undang-undang positif Indonesia telah memberikan garis panduan. Undang-undang tersebut telah memberikan beberapa alat bukti yang bisa diambil dan diajukan oleh kedua belah pihak yang berperkara kepada Hakim. Kajian ini penting karena sampai saat ini peradilan di Indonesia belum mempunyai undang-undang hukum acara produk dan ciptaan orang Indonesia sendiri. Pada prinsipnya yang menjadikan perbedaan mendasar antara bank syariah dan bank konvensional, dimana kegiatan pembiayaan pada bank syariah dilakukan berdasarkan ketentuan syariah sementara pada bank konvensional kegiatan pembiayaan dilakukan berdasarkan prinsip bunga. Pada sistem bunga, balas jasa modal ditentukan berdasarkan persentase tertentu dan resiko sepenuhnya ditanggung oleh satu pihak. Sebaliknya apabila nasabah sebagai peminjam, resiko sepenuhmya berada di tangan peminjam. Sedangkan pada sistem syariah ditetapkan suatu margin keuntungan diperoleh yang berdasarkan “akad murabahah”. Pembiayaan murabahah sampai saat ini masih merupakan pembiayaan yang dominan bagi perbankan syariah maupun lembaga keuangan syariah non bank di dunia, termasuk di Indonesia. Hal ini dikarenakan pembiayaan murabahah bersifat konsumtif.

Consequences of the implementation of the Act Number 23 of 2014 on Regional Government spawned extraordinary complexity of the problems in some areas. One of the problems that arise is a rampant discourse of regional expansion that occurs both at the provincial and district/city. In essence, the establishment, merger, and abolition of the area aim to improve public services to be more optimal, shorten the span of control, and accelerate the welfare of society in strengthening the integrity of the Unitary Republic of Indonesia. The purpose of this study was to determine the implications of the establishment of new autonomous regions in the frame of the Republic of Indonesia based on Act Number 23 of 2014 on Regional Government; and to understand the implications of the establishment of new autonomous regions preparation for improving people's welfare by Act Number 23 of 2014 on Regional Government. This type of research is a normative legal research. Methods and techniques of data collection through library studies or studies document. Mechanicalanalysis of legal material is a descriptive qualitative. Conclusions from this research are that the implications of the establishment of regional preparation of new autonomous within the framework of the Unitary Republic of Indonesia before Act Number 23 of 2014 on Regional Government due to the local communities feel there is an imbalance of equity and fairness between regions with each other in the local government areas. Implications of the establishment of new autonomous regions preparation for improving people's welfare by Act Number 23 of 2014 on Regional Government that in order to establish an area or region of the expansion needed a measure as the basis for the determination. Establishment and expansion of new areas should be based on the divisions that are objective with those aspects of the financing of Human Resources and other support facilities.

This study analyzes the hate speech as a behavior that develops and cause social problems for the population. A speech of hatred into behaviors that are developed today, where the behaviors of people, whether it was saying about something implies write status in the social media or said that implies a hatred of another person may fall into the category of hate speech. The act if it is deliberately then it can be considered a crime, but if it's just pouring anger alone or intend to harm anyone is also categorized as a criminal offense. This social phenomenon that developed in Indonesian society should be anticipated in order not to cause conflict in society. other than that in the view of Islam, that Islam as a religion rahmatan lil Alamin, the basic principle in Islam prohibits defamation and incitement against others which resulted in the dispute, because in the Al-Hujurat: 11, God forbids all human beings to each other to spread hatred and insulting others, where the verse forbids mankind to do the speech of hatred. Kajian ini bertujuan untuk menganalisis perwujudan budaya hukum masyarakat Aceh dalam melakukan perjanjian jual beli, dengan menggunakan metode yuridis empiris. Dalam kenyataan di lapangan masyarakat Aceh mayoritas penduduknya beragama Islam dan kaya dengan budaya, tetapi dalam transaksi jual beli obyek tanah dan rumah masih menggabungkan ketiga sistem hukum tersebut yaitu, hukum Islam, hukum adat dan hukum perdata barat dalam melakukan transaksi jual beli. Pentingnya harmonisasi dalam penggunaan hukum Islam, hukum adat dan hukum perdata di Aceh dalam perjanjian jual beli. Bentuk otonomi yang diberikan khususnya dalam bidang agama dan adat, maka peluang untuk melahirkan produk hukum seperti Qanun yang mengatur bidang mua’malah banyak dipraktikkan ditengah-tengah masyarakat Aceh. Sistem nilai (value system) yang terkandung dalam unsur-unsur hukum Islam dan hukum adat mendapat peluang besar dilahirkan produk hukum dalam bentuk Qanun oleh pemerintah provinsi, Kabupaten dan Kota dalam wilayah hukum provinsi Aceh. Pembentukan qanun dalam bidang jual beli inipun harus diwarnai ketiga sistem hukum yang sudah hidup dalam masyarakat Aceh.

This research about Islamic law is as the applicable and acceptable law in Indonesian society. Islamic law placed inheritance law to regulated directly with the problems of socio-cultural in community, using the theological normative, yuridical and sociological approach. However, the Islamic inheritance lawstill regulated in the Instruction President Number 1, 1991 on KHI. The enforcement of KHI has not given satisfaction among Muslims including Islamic jurists. It caused the existence of KHI was not placed in the hierarchy of legislation Indonesia. Nowdays, the spirit of Islamic Indonesian society in order that the Islamic inheritance law will be legislated as well as marriage law. Even though, when the application of the Islamic inheritance law in the form of legislation as national law, the principle of justice should be Implemented in human life, family and society, even nation life.

Islamic law placed inheritance law to regulated directly with the problems of socio-cultural in community, using the theological normative, yuridical and sociological approach. However, the Islamic inheritance lawstill regulated in the Instruction President Number 1, 1991 on KHI. The enforcement of KHI has not given satisfaction among Muslims including Islamic jurists. It caused the existence of KHI was not placed in the hierarchy of legislation Indonesia. Nowdays, the spirit of Islamic Indonesian society in order that the Islamic inheritance law will be legislated as well as marriage law. Everything in the earth belongs to Allah. Human are given an authority by Allah as kholifah to prosper the earth as the human’s responsibility to Allah. Whoever have/authorize a land considered having a mandate from Allah should comprehend the intended law established by Allah so that what the human do as a kholifah toward the authority and ownership of land in their territorial as the essence of transfer from Allah in order to manage, watch, distribute, and guide the use of land in accordance with Allah’ aim to create the earth for the sake of human’s prosperity and of public goodness (al-maslahah al-’âmmah).

This study aims to examine the existence of the hermeneutic thinking of ijtihad and authentic jurisprudence of Gus Dur in Indonesia. By using Martin Heidegger's hermeneutics, this study produces two conclusions: First, the authentic hermeneutic paradigm of ijtihad Gus Dur seeks to establish a dialectic between the discourse of the past text and the interpreter's current discourse so that the law of fiqih can produce the ultimate benefit of the people. Secondly, the authentic jurisprudence of Gus Dur has given the discourse of new fiqh relevant to the current development of polygamy law, marriage, zakat and the Islamic education system grounded in accordance with Indonesian culture, not Arab culture, so that he wants the earthing of legal discourse of jurisprudence instead of Arabization .
