SOSIALISASI QANUN JINAYAT ACEH NO. 6 TAHUN 2014 PADA MADRASAH ALIYAH BLANGKEJEREN KABUPATEN GAYO LUES

There are two questions in the study under study, namely: First, what is the knowledge and understanding of students in Gayo Lues District Madrasah Ali about the implementation of the Jinayat Aceh Qanun Number 6 of 2014? Secondly, What is the knowledge and role of the Gayo Lues District Madrasah Aliyah religious teacher in disseminating to students about the enactment of the 2014 Jinayat Aceh Qanun? This study uses a normative juridical and sociological juridical approach. The normative juridical approach is done by first examining the Aceh regulation or qanun that is relevant to the problem under study. In other words the normative approach is to examine library materials or secondary data which includes primary, secondary and tertiary legal materials. The results showed that Gayo Lues State students in general knew about the implementation of Islamic Shari'a in Aceh, but the majority of them did not know and understand about the material regulated in Aceh No. 3 Qanun. 6 of 2014. Especially they do not know and understand about the terms contained in the Aceh jinayat qanun. Among the terms referred to in the Jinayat Aceh Qanun Number 6 of 2014 are Jarimah / Jinayat, Uqubat, Hudud, Ta'zir, Khamar, Maisir, Khalwat, Ikhtilath, Adultery, Sexual Harassment, Rape, Qadzaf, Liwath, Business. Students only know the term zina, sexual harassment, rape. While the Fiqh teacher knows and understands the qanun, but does not have the authority to socialize it, because the subjects in this madrasa refer to the 2017 revised 2017 curriculum, so the syllabus and lesson plans have been determined by the government based on the curriculum.Keywords: Socialization, Qanun Jinayat Aceh, Madrasas, Gayo Lues

Tulisan ini bertujuan menjelaskan pemikiran Khaled tentang otoritas. Munculnya sikap sikap otoriter dalam memahami teks-teks keagamaan akibat dari kewenangan yang dimiliki seseorang dalam menempatkan makna tunggal dari sebuah teks. Sikap ini disebabkan mandegnya hubungan dialogis antara teks, pengarang dan pembaca dalam khazanah pemikiran keislaman. Khaled menawarkan upaya mengkaji kembali kompetensi sebuah teks, penetapan makna teks dan sikap pembaca teks dalam mengungkapkan makna yang ada di balik teks sehingga seseuai dengan maksud pengarang teks. Di samping itu ia juga menawarkan lima persyaratan yang harus ada bagi pembaca teks, kejujuran, kesungguhan, rasional, menyeluruh dan pengendalian diri.kata kunci: Tafsir, hermeneutika, Khalid Abou el Fadl.

WANITA SALAT BERJAMAAH DI MASJID (KAJIAN TEORI DOUBLE MOVEMENT TERHADAP AYAT 33 SURAH AHZAB DAN NAS-NAS TERKAIT)

Permasalahan keluarnya seorang wanita dari rumah untuk berbagai kegiatan telah ada larangan dalam Alquran surah al-Ahzab ayat 33 jika dipahami secara umum.  Hal ini juga disebutkan dalam hadis riwayat ibnu khuzaimah bahwa seorang wanita merupakan aurat yang tidak selayaknya keluar terlebih tanpa adanya yang mendampingi. Namun  ada hadis lain yang yang diriwayatkan dari Abu Hurairah yang menyatakan bahwa seorang suami tidak boleh melarang istrinya mendekati rumah Allah. Lantas bagaimana hukum wanita salat berjamaah di masjid berdasarkan Teori Double Movement terhadap ayat 33 surah al-Ahzab dan nas-nas terkait. Metode penelitian yang digunakan dalam tulisan ini adalah Library Research.Dalam kasus wanita salat berjamaah di masjid, klausa mengenai mengangkat derajat perempuan dan memberi kesempatan kepada perempuan untuk ikut dalam ruang publik harus mendapat perhatian dan ditetapkan memiliki kepentingan mendasar.Lebih jauh, melalui teori double movement dapat di pahami bahwa dalam kasus tersebut, Alquran berkehendak untuk memaksimalkan kesetaraan antara laki-laki dan perempuan, dan untuk tujuan ini dinyatakan bahwa suatu kebebasan perempuan dalam ranah publik secara normal adalah ideal. Kata Kunci: Wanita Salat Berjamaah, Masjid dan Double Movement.

Sejarah Perkembangan Hukum Lingkungan di Indonesia 印尼环境法发展史

World War has produced many negative effects. Environmental pollution is one of the negative effects of world war. Pollution in the world is increasingly alarming. On this basis, the United Nations conducted an environmental conference in June 1972 in Stockholm, Sweden. The Stockholm Conference is considered the highest peak of environmental awareness at the international level. The Stockholm Conference produced an environmental legal concept called suitanable development. The results of the Stockholm conference underwent follow-up and obliged the conference participant countries to ratify it. Indonesia fulfilled this obligation by establishing Law No. 4 of 1982 concerning the basic provisions of environmental management. The law has several important instruments in environmental protection, namely an analysis of environmental impacts and environmental quality standards. In 1997 the law was revised and underwent several additions to environmental protection instruments. The final revision of environmental law is Law No. 32 of 2009 concerning environmental protection and management. "نظرية العقوبات في الفقه الإسلامي"

على حمايتهم من المفاسد وارشادهم إلى الطريق السليم وأن العقاب رحمة بالعباد. وأن الأسس العامة التي تقوم عليها العقوبة هي أن تكون العقوبة بحيث تمنع الناس من إرتكاب الجريمة، ولحاجة الناس ولمصلحتهم، وإذا اقتضت حماية الجماعة استئصال المجرم من الجماعة أو حبس شره عنها وجب أن يعاقب بالقتل أو الحبس حتى يموت ما لم يثبت أو ينصلح حاله، وتعتبر العقوبة مشروعة إذا كانت تؤدي إلى صلاح الافراد وحماية الجماعة، ولا يقصد بالعقوبة الانتقام من المجرم بل يقصد بها استصلاحه. وقد اختلف الفقهاء في العقوبات بين زواجر أم جوابر. فقال بعض أن العقوبات جوابر ويرى البعض أن العقوبات الشرعية زواجر وجوابر معا. ومن أهداف الشريعة من العقوبات هي عقوبات لحماية الدين، والأنفس، والعقل، والنسل،والأموال. وأما شروط العقوبة هي أن تكون العقوبة شرعية، وشخصية، وعامة. وقد قسمت العقوبات الدنيوية منها تقسيم العقوبة من حيث نوعها، وبحسب الرابطة القائمة بينها، ومن حيث سلطة القاضي في تقديرها، ومن حيث وجوب الحكم بها، ومن حيث محلهاوالجرائم. وأما المنهج الذي سلكته الباحثة في هذا البحث هو المنهج الاستقرائي والمنهج التحليلي في عرض المعلومات عن تعريف العقوبة لغة واصطلاحا، والأسس العامة التي تقوم عليها العقوبة، وعرض آراء العلماء في العقوبات زواجر أم جوابر، وبيان أهداف الشريعة من العقوبات، مع شرح شروط العقوبة وأقسامها الدنيوية.

This study aims to test the influence of free cash flow, profitability, firm size and leverage to the earnings managemen to non financial companies listed in Indonesia Stock Exchange in 2011-2014. There search type used in this research is hypothesis testing, by using purposive sampling method and there are 240 samples of data that become the object to be researched. The data type used is secondry data obtained from the financial statements ended on 31 December, published by the capital market reference center in the Indonesia Stock Exchange. The analysis used is multiple linear regression to test the hypothesis. The research results show that free cash flow, profitability, firm size and leverage with the same effect to nearnings management, never the less there lation partially show that (1) Free Cash Flow has significant influence toward earnings management. (2) Profitability has significant influence toward earnings management. (3) Firm Size has significant influence toward earnings management. The application of waqf originally rated to immovable things or properties The properties donation and the corporate to be waqf of land (donation for religious or community use) which will become public properties should be based on the Islamic law in accordance with The Quran in al-Baqarah letter from 215 verse, the land which has been waqf should be correspondent to the waqf land declare. In article 3 of law number 41 of 2004 regarding the waqf land in states “the waqf of land which has been officially declared in Islamic way cannot be cancelled”, and cannot be changed if the wakif declare it for a certain use. However, the exchange use of the waqf property is not based on the traditional regulation. The objective of this research is to find out explain the implementation of waqf of land based on the prevailing laws, to explain the waqf of land for certain use which can and cannot be changed with other object, and to explain the law about the waqf of land which can be changed. The method used in this research is a normative and sociologic juridicial method in which the writer should study laws and regulations which are relevant to the research, the normative approach is the study of library material including primary, secondary and tertiary materials. The sociologic juridicial opproach is used to study the positive law.

Hukum internasional banyak dipengaruhi oleh hukum nasional. Sebagai contoh hukum internasional dapat tercipta dengan adanya kebiasaan nasional suatu Negara yang dianut oleh banyak Negara, kebiasaan ini disepakati sebagai hukum internasional. Hukum internasional publik adalah keseluruhan kaidah dan asas hukum yang mengatur hubungan atau persoalan batas Negara (hubungan internasional) yang bukan bersifat perdata, sedangkan hukum nasional adalah sekumpulan hukum yang sebagian besar terdiri atas prinsip-prinsip dan peraturan-peraturan yang harus ditaati oleh masyarakat dalam suatu negara, dan oleh karena itu juga harus ditaati dalam hubungan-hubungan antara mereka satu dengan lainnya. This paper presents information on the efforts inherent in the customs of the people of Aceh to maintain the sustainability of fisheries resources is sustainable. Considering almost the bulk of the Aceh region surrounded by Sea and nearly the majority also mayasrakatnya berpropesi as fishermen make ketergantunagan to fisheries resources, especially fisheries is very high. Despite the high dependence meliki, Aceh remains meliki rules contained in the customs begaimana sustainable fishery resource management and the rule known as adat laot Hukom. Indigenous Hukom LAOT a local wisdom in the form of systems and rules that shape and mensinerjiskan common understanding among the Acehnese fishermen to exploit fishery resources in an ethical, responsible and sustainable. Moreover this wisdom capable of directing every character fishermen to act wisely in resolving problems between fishermen and has strict sanctions for the offenders. Wisdom, therefore, needs to be maintained / dilestarika from being displaced by the changing times and should be supported by all stakeholders for the task of protecting nature is not only charged on one community. PRAKTEK RE-UPLOAD VIDEO OLEH YOUTUBER DAN KEABSAHAN PEMBAYARANNYA 由YOUTUBER和他的支付能力重新上传视频的实践

Youtube is a video sharing website created by three former Paypal employees in February 2005, this site allows users to upload, watch and share videos. The company is based in San Bruno, California, and uses Adobe Flash Video and HTML5 technology to display a variety of user-made video content, including movie clips, TV clips and music videos. In addition there are also amateur content such as video blogs, short original videos and educational videos. Currently YouTube has provided two types of licenses on its site, namely Copyright frequency (cannot be re-uploaded by other parties) and Creative Commons BY Protection (CC BY) (may be re-uploaded by other parties). Even so it is not a problem without problems, the problems that still occur on Youtube are cases of copyright on the site, such as the practice of re-uploading videos here for example.             This study examines how the validity of income obtained from the video re-upload activity on Youtube in terms of the Ibtikar Rights Perspective in Islam and Muamalah Fiqh. This thesis research includes the type of library research, which is data collection using study studies of books, journals, printed documents, and from sites on the internet.            The results of the research conducted by the author in this thesis are unlawful in the practice of re-uploading videos that are carried out solely to obtain personal gain without giving royalties to the relevant producer / label, in other words the act is the same as a trader selling people's property otherwise without the permission of the owner or selling stolen goods, this is clearly detrimental to the creator or copyright holder because the video circulating on youtube is not given permission by the video creator to spread the creation to the public using the Youtube website. In Islam, copyright is known as Haq Ibtikar, namely a special right attached to the original video owner and part of intellectual property, both material and immaterial, so that it must be protected by law. Islam highly respects copyright as a private property right so that the right to ibtikar is classified into the Maqashid Sharia to maintain the existence of ownership of the assets of every Muslim. Every treasure that results from a video re-upload in Islam and Muamalah Fiqh is unlawful, because it is included in violating the rights of others in a vanity. Keywords: Hak Ibtikar, video re-upload, Youtube, copyright infringement
