The fundamental aim of the present research involves conducting a comparative study of the Islamic East and West in relation to the ritual of the bay‘a within a broad chronological framework (8th-15th centuries). We attempt to extract the different elements making up the act and to establish differences and similarities in order to reach a series of conclusions. The Christian world also provides interesting data on accessions and enthronements. Insofar as possible, we will explore certain elements that merit comparison with the Islamic world. El objetivo fundamental de este estudio es ofrecer una perspectiva comparada entre Oriente y el Occidente islámicos en torno al ritual de la bay‘a, optando por un marco cronológico amplio (ss. VIII-XV). La idea es extraer los diversos elementos que integran el acto y buscar diferencias y similitudes para establecer una serie de conclusiones. El mundo cristiano también cuenta con interesantes datos sobre los ascensos y entronizaciones. En la medida de lo posible, examinaremos algunos aspectos y elementos que merecen ser confrontados con el mundo islámico.

This essay analyses some of the regulatory provisions regarding family and inheritance that were applied in Tortosa after the feudal conquest in 1148. On one hand, the Liber Iudiciorum, which follows Germanic law, and on the other, the Costums of Tortosa, a Common law corpus which was compiled in the last third of the 13th century. It was based on the Costums of Valencia, and these on the Roman Law. The essay’s aim is to analyse the main characteristics of each book and, subsequently, to trace their implementation on documentation from Diplomatari de la Catedral de Tortosa. This has allowed to point an early cohabitation, as well as the later widespread triumph of Common law. En este artículo se analizan algunas disposiciones normativas sobre familia y sucesión vigentes en Tortosa tras la conquista feudal de 1148: por una parte, el Liber Iudiciorum, de tradición germánico-hispánica, por la otra, las Costums de Tortosa, un corpus compilado en la década de los 70 del siglo XIII, basado en las Costums de Valencia (1238) y estas, a su vez, en el derecho romano de recepción. El objetivo es analizar las principales características de cada códice para, posteriormente, rastrear su aplicación en las escrituras notariales del Diplomatari de la Catedral de Tortosa. El estudio documental ha permitido constatar la convivencia inicial entre ambas tradiciones jurídicas en una sociedad de frontera como Tortosa, así como la generalización del derecho común.

In the process of revitalisation of Diplomatic there is an area that has hardly been dealt with, although it is known and studied from other perspectives. It is the set of gestures and signs that used to be reflected some documentary typologies, rarely analysed in relation to the document itself, to which they are associated: touching with the hands, the ceremonial of taking possession; some relevant signs, such as the key, the book or the tree; privileged spaces; cutting the document to indicate multiple originals or their cancellation, and the materiality of the details. In this paper we seek to examine some of these gestures in the medieval documentation of the kingdom of Valencia. The reading of these gestures, together with the documents they accompany, allows us to improve the understanding of the meaning of the document in a specific society. En el proceso de revitalización de la Diplomática existe un ámbito apenas tratado, aunque conocido y estudiado desde otras perspectivas, se trata del conjunto de gestos y signos que suelen acompañar a algunas tipologías documentales, pocas veces analizado en relación con el mismo documento, al quese asocian: tocar con las manos, el ceremonial de las tomas de posesión; algunos signos relevantes, como la llave, el libro o el árbol; espacios privilegiados; cortar el documento para indicar originales múltiples o su cancelación, y la materialidad de los detalles. Con el presente trabajo pretendemos realizar una aproximación a algunos de estos gestos en la documentación medieval del reino de Valencia. La lectura de éstos, unidos a los documentos, a quienes acompañan, nos permite identificar mejor el significado del documento en una sociedad concreta.

This article investigates the specific conditions that made Majorca one of the strategic places for the development of captive redemption processes in the late Middle Ages. Through the study of the tax levied on the departure of Muslims from de Kingdom of Majorca, the eixides de sarraïns, a privileged way of access to the rescue of Muslims is revealed in which the Majorcan Jewish convert merchants played a relevant role. Likewise, the same source allows to trace direct connection routes between the greater Balearic Island and the Hafsid sultanate of Tunisia, considered secondary until now with respect to the routes directed to other areas of the Maghreb. El presente artículo indaga en las específicas condiciones que hicieron de Mallorca un lugar estratégico para el desarrollo de procesos de redención de cautivos en la Baja Edad Media. A través del estudio de los impuestos de salida de musulmanes del reino de Mallorca, las eixides de sarraïns, se desvela una vía privilegiada de acceso al rescate de musulmanes en la que los mercaderes mallorquines judeoconversos jugaron un papel relevante. Asimismo, la misma fuente permite trazar rutas de conexión directa entre la isla balear mayor y el sultanato hafsí de Túnez, consideradas hasta el momento secundarias respecto a las dirigidas a otros puntos del Magreb.

In this article we delve into de consilium entitled Mulier striga, attributed to Bartolo de Sassoferrato and dated between 1331-1334. We contribute to spread the fact it is a forgery and that its author was Giovanni Battista Piotti, a sixteenth-century lawyer, a fact hardly known by many specialists who continue to present the texto as medieval. On the other hand, we will analyze in detail the portrait ot the witch present in this work, never examined by the experts before, in order to determine whether the picture offered is anachronistic, as it happens with other aspects of the document, or matches the beliefs of the first half of the fourteenth century. En este artículo profundizamos en el consilum Mulier striga, atribuido a Bartolo de Sassoferrato y fechado entre 1331-1334. Contribuimos a difundir el hecho de que se trata de una falsificación y que su autor fue Giovanni Battista Piotti, jurista del siglo XVI; cuestión apenas conocida por muchos especialistas que siguen presentando el texto como medieval. Por otra parte, analizaremos pormenorizadamente el retrato de la bruja presente en este escrito, no abordado por los expertos, con el fin de determinar si la imagen ofrecida es anacrónica, como sucede con otros aspectos del documento, o se ajusta a la primera mitad del siglo XIV.
