Data mengatakan Indonesia merupakan negara yang kaya akan sumber daya alam, bahkan menjadi negara dengan sumber daya alam paling melimpah di dunia. Perspektif kekayaan intelektual, potensi-potensi itu merupakan produk yang dapat dilindungi berdasarkan kepemilikan komunal indikasi geografis. Setelah meratifikasi beberapa perjanjian internasional, terutama Persetujuan TRIPs, Indonesia berkewajiban memiliki regulasi yang memberikan perlindungan kepada indikasi geografis. Pada beberapa regulasi yang pernah ada, pemerintah daerah diberikan kewenangan sebagai pemohon saat pendaftaran sebuah produk sebagai indikasi geografis di kementerian. Faktanya, peran pemerintah daerah kurang optimal, terutama bila dilihat dari potensi yang dimiliki, ditambah regulasi sifatnya tidak imperatif. Penelitian ini bersifat normative dengan pendekatan perundang-undangan. Dari hasil kajian yang sudah dilakukan, didapati hasil bahwa kedudukan pemerintah daerah dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis tidak imperatif mengatur secara spesifik kedudukan pemerintah daerah, sehingga dengan yang melimpah hanya sedikit yang didaftarkan akibat kurangnya kontribusi pemerintah daerah.

Kekuatan Hukum Perjanjian Pengikatan Jual Beli Tanah Dibuat Dibawah Tangan 《买卖土地契约》的力量

This research discusses the legal force of binding sale and purchase agreements under the hands made by the parties without witnesses and only waarmarking by a notary. The research method used is the analytical descriptive method, a research method that reveals problems, analyzes a problem, examines, and interprets it into conclusions and suggestions in a systematic way so that it is easy to understand. Normative Juridical approach method, namely legal research that uses secondary data sources such as principles the doctrines in the science of law. The results of the study can be concluded that the underhand Sale and Purchase Agreement (PPJB) is a form of agreement between two parties who agree to bind themselves, which is made jointly. Even though PPJB under the hand can be made freely by the parties who want to make an agreement, it may not violate the provisions of Article 1320 of the KUHPerdata. PPJB made before an authorized official and PPJB made privately have the same legal force. PPJB under the hand made by the parties without witnesses and only waarmarking by a notary, the strength of proof is only between the parties. If the parties do not deny and acknowledge the signature in the agreement, then the PPJB under the hand has perfect power as an authentic deed.

Ambiguitas dan Inkonsistensi Kedudukan serta Kewenangan Wakil Kepala Daerah dalam Sistem Pemerintahan Daerah 地方政府系统中副处长的模糊和不一致

This research is addressed to theoretically examine authority and position of deputy head of region in local government system in the post-reform time, in particular by using Philipus M Hadjon's authoritative theory as an analytical tool. We apply normative juridical approach through analysis of theory, concepts, legal principles as well as law and regulation which have correlation with this research. Our result shows that the authority of the deputy head can be achieved in three different ways: first, direct or explicit power governed by the law, second and third through delegation and mandate from higher authority (e.g. regional head), respectively. Interestingly, we notice that most of the tasks are unfortunately mostly in assisting mode, while we argue that this can be also carried out by local secretary. This power overlapping could actually create ambiguity and further have implication in the urgency of deputy head position in the regional government system.

Calon Presiden dan Wakil Presiden Independen: Studi Perbandingan dan Tawaran Implementasinya di Indonesia

Stagnannya diskusi untuk mengakomodir calon Presiden dan Wakil Presiden independen boleh jadi karena belum ditemukannya pola penerapan yang sesuai. Oleh karena itu, penting untuk belajar dari praktik terbaik di negara lain. Dari perbandingan tersebut diharapkan dapat menjadi dasar gagasan penerapannya di Indonesia. Untuk mendiskusikan hal tersebut, tulisan ini menggunakan perpaduan antara pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan. Hasilnya menunjukkan, pertama, di negara Amerika Serikat dan Mesir lebih fleksibel dalam mengatur pencalonan Presiden dan Wakil Presiden dengan menerapkan sistem multi-jalur. Kedua, terdapat dua model implementasi yang dapat diadopsi, yaitu dukungan publik dan pencalonan oleh lembaga negara. Dalam konteks Indonesia, keduanya dapat diterapkan dengan beberapa penyesuaian karena secara prinsipil telah dipraktikkan.

Abstract Justice collaborators are very much needed by law enforcement in uncovering certain criminal acts. The fact is that in the formulation of the justice collaborator arrangement in the law, especially the problem of determining the main actor, there are still many juridical problems that have an impact on its application and implementation. This research is classified into normative legal research (normative juridical), using primary legal materials and secondary legal materials. The approach used is a statutory approach to review all relevant rules and regulations. In this study, we will discuss the problem of legal arrangements related to the provisions for determining the provision of a justice collaborator for a particular crime, and the juridical problem of determining the main actor in the provision of a justice collaborator for a particular crime. The findings in this study indicate that there is no juridical definition of the main actors who cause legal problems at the level of norms and practice. The next finding is the difference in perception and the unclear determination of authority to determine the main actors between law enforcers which results in legal uncertainty. Keywords: Juridical Problems, Main Actor, Justice Collaborator, Certain Criminal acts.

Kepastian Hukum Hak Informasi: Problematika Konsumen dan Rahasia Dagang 信息权利法的确定性:消费者问题和商业秘密

This research is a juridical study of the information rights contained in teh Act Number 8 of 1999 of years and the Act Number 30 of 2020 of years. Within the regulatory framework regarding the right to information on a product, it is a legal issue that has caused a lot of polemic in the business sector. One side, consumers have the right to obtain correct, clear and honest information on any goods/services purchased, and the other side, business actors also have the right to close information on goods/services sold on the grounds that they are protected by trade secrets. This research was conducted using a normative juridical method with conceptual approach and normative approach. This research proved, that there is a conflict of norms regarding the regulation of information rights between The Act Number 30 of 2000 of years and the Act Number 8 of 1999 of years, so that the regulation of information rights does not bring a legal certainty. Therefore, it is necessary to synchronize the arranggement on the regulation of information rights between The Act Number 30 of 2000 of years and the Act Number 8 of 1999 of years.

In principle, only Indonesian citizens can own land in Indonesia. With the government's program to improve development and the Indonesian economy by promoting investment by bringing in foreign investors, the government issued a policy to regulate property ownership for foreign citizens who wish to own a residence in Indonesia. Property that can be owned by foreign nationals can only be owned with the status of Right to Use and Right to Rent for a certain period of time. The purpose of this limitation of the period of property ownership for foreign nationals is to protect land owned by Indonesian citizens from various exploitation and covert foreign domination. Ownership of property by foreign nationals is regulated in various laws and regulations and their implementing regulations. With the issuance of these various regulations, it is hoped that there will be harmonization between property ownership arrangements for foreign citizens and residential ownership for Indonesian citizens.

Status barang bukti ikan hasil tindak pidana Ilegal Fishing tiga tahun terakhir Pada Pengadilan Negeri Tanjungpinang dimusnahkan di tahap penyidikan. Tujuan penelitian yaitu untuk mengetahui hambatan dan penyelesaian yuridis ikan hasil tindak pidana Ilegal Fishing dalam tinjauan asas manfaat. Metode penelitian yang akan dilakukan adalah penelitian yuridis empiris.Penyelesaian yuridis ikan hasil tindak pidana Ilegal Fishing dalam tinjauan asas manfaat pada Pengadilan Perikanan Tanjungpinang sejatinya dapat dilaksanakan melalui pelelangan dan hibah. Hambatan dalam pemanfaatan ikan hasil tindak pidana Ilegal Fishing pada Pengadilan Perikanan Tanjungpinang yaitu ikan yang ditangkap tersebut kebanyakan busuk sebelum kasus hukumnya selesai atau penetapan pengadilan dikeluarkan, Permasalahan selanjutnya ialah apabila ikan tersebut dilelang, kebanyakan ikan itu tidak laku, Hambatan lainnya PSDKP Batam tidak memiliki tempat penyimpanan freezer beku untuk ikan-ikan tersebut, Cara lain untuk menyimpan ikan-ikan hasil tangkapan tersebut ialah menyewa tempat ke pihak swasta, namun harga terkait penyewaan itu akan bernilai tinggi dan nantinya akan merugikan Negara.

The state of absence (afwezigheid), that is, where a person is not at his or her residence at any given time. A person declared for afwezigheid resulting in his position by civil law was considered to have died jurisdictionally, resulting in the potential removal of his rights and obligations. A legal issue arising from the issue of afwezigheid is that there are serious implications for the fulfilment of a person's rights and obligations in marriage. Whether his position is likened to a broken up because of death or divorce, then what is his position when the individual returns. Research methods used in discussing this writing legal issue, using a normalized jurist study type by examining library or secondary data consisting of primary legal materials, secondary law materials and tertiary law materials related to the absence of present (afwezigheid) and their position in marriage. Then, with his research approach using 3 (three) the approach of legislation (approach approach), the conceptual approach (conceptual approach), the historical approach). Next, for the method of collecting legal materials using the document study method (literature study). This technique provides the basis for theory by reviewing and studying books and regulations of legislation, which relate to afwezigheid.

This research is motivated by the implementation of decentralization in a country that cannot be separated from mineral resources owned by each region. The arrangements of management of mining become an inseparable part in the editorial discussion of the policy directions and thw arrangements of regarding decentralization. The Regions that have the potential for explorative natural resources are faced with a complicated situation and full of pros and cons when discussing about mining in their area. The revised of the act of regional government certainly contributes to the political of decentralized law and the arranggement of mining. The relationship between the central government and regional governments, especially the provinces in mining management based on the Act of Mineral and Coal must receive special attention, because it has a direct orientation towards the perspective of decentralization. To discuss these issues, conducted by normative legal research method with the statute approach. The authority of the central government in managing mineral and coal mining has a paradigm of decentralization that is felt to be getting stronger. Exceptions to government affairs which by acts are determined as central government affairs are the constitutional basis of legislators as the basis for decentralization.
