AbstrakKearifan lokal merupakan sebuah sistem dalam tatanan kehidupan sosial, politik, budaya, ekonomi serta lingkungan yang hidup ditengah-tengah masyarakat lokal. Sistem budaya masyarakat Melayu di Riau mempunyai muatan yang baik untuk mengelola lingkungan dengan gaya yang harmonis. Dalam sistem budaya orang Melayu di Riau bisa terbaca dengan jelas bagaimana nilai-nilai budaya mereka memberi pedoman dan arah agar lingkungan terpelihara. Masyarakat Melayu sarat dengan nilai-nilai kearifan budaya dalam memelihara lingkungan. AbstrakBantuan hukum merupakan hak setiap orang. Seperti yang tercantum dalam Undang-undang Nomor 16 Tahun 2011 tentang Bantuan Hukum. Terlebih bagi masyarakat yang tidak mampu. Melalui penyelenggara bantuan hukum inilah akses keadilan dapat tersalurkan bagi masyarakat miskin terutama di Jawa Tengah dan salah satunya adalah melalui Lembaga Bantuan Hukum Jawa Tengah. Penulisan Hukum ini adalah menggunakan metode kualitatif dengan pendekatan socio-legal. Data yang digunakan adalah data primer dan sekunder. Teknik studi dokumen dan wawancara adalah yang digunakan dalam hal pengumpulan data. Studi ini menyimpulkan bahwa implementasi bantuan hukum bagi kelompok orang miskin belum diimplementasikan dengan baik. AbstrakCerai gugat adalah perceraian yang diajukan oleh pihak istri yang menghendaki perceraian. Gugatan perceraian yang terjadi adalah adanya pernikahan yang pernah dilaksanakan hanya beberapa bulan, setelah itu pihak istri mengajukan permohonan cerai gugat di Pengadilan Agama (PA) Bengkalis. Tujuan penelitian untuk menganalisis penyelesaian cerai gugat berdasarkan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam (KHI) di Kecamatan Tualang Kabupaten Siak. Metode penelitian menggunakan penelitian hukum sosiologis dengan teknik pengumpulan data melalui wawancara yang dipadukan dengan data kepustakaan. Hasil penelitian menyatakan bahwa pertama, penyelesaian cerai gugat hanya dapat dilakukan di depan sidang pengadilan setelah pengadilan tidak berhasil mendamaikan kedua belah pihak baik yang diatur oleh Undang-Undang Nomor 1 Tahun 1974 maupun KHI. Penyelesaian cerai gugat bagi masyarakat Kecamatan Tualang Kabupaten Siak adalah di Pengadilan Agama (PA) Bengkalis. The purpose of the research is to analyze the settlement of a claim for divorce based on Law of Number 1 of 1974 and Compilation of Islamic Law in Tualang District, Siak Regency. The research method uses sociological legal research with data collection techniques through interviews combined with library data. The results of the study stated that first, the settlement of the claim for divorce can only be done before a court hearing after the court has not succeeded in reconciling the two parties either regulated by Law of Number 1 of 1974 or Compilation of Islamic Law. AbstrakPenelitian ini bertujuan untuk menentukan batasan-batasan antara perbuatan badan atau pejabat pemerintah (bestuurhandelingen) yang merugikan keuangan negara berkualitas sebagai maladministrasi atau merupakan tindak pidana korupsi. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menunjukan bahwa tidak semua perbuatan pemerintah yang dilakukan oleh pejabat publik yang merugikan keuangan negara merupakan tindak pidana korupsi. Dalam menentukan batasan-batasan antara perbuatan maladministrasi dengan tindak pidana korupsi badan atau pejabat pemerintah harus menghindarkan diri dari tindakan diskresioner yang mengandung nuansa hukum pidana seperti kecurangan, manipulasi, penyesatan, penyembunyian fakta, pelanggaran kepercayaan, akal-akalan, atau pengelakan peraturan.Kata Kunci: Korupsi, Tindak Pidana, Maladministrasi AbstractThe aim of this research is to determine the limitations of the act of government officials (bestuurhandelingen) that inflict state financial loss qualified as maladministration or a corruption offense. The research method used is Juridical Normative. The result of the study shows that, not every act of government officials that inflict state financial loss qualified as a corruption offense. In determining of the limits between maladministration act and corruption offense, the government officials must avoid itself from acts of discretion that containing the nuances of criminal law such as cheating (deceit), manipulation, misrepresentation, concealment of facts, breach of trust, subterfuge, or illegal circumvention.Keywords: Corruption, Criminal Act, Maladministration

Pendekatan yang digunakan dalam penelitian ini adalah pendekatan hukum sosiologis, yaitu penelitian yang membahas tentang berlakunya hukum. Pendekatan ini berdasarkan pendekatan hukum adat, dengan kajian terhadap nilai-nilai kearifan lokal pada masyarakat hukum adat Petapahan Kabupaten Kampar Provinsi Riau. Perkembangan arus globalisasi tentunya memberikan dampak terhadap keberadaan lingkungan, tidak terkecuali lingkungan masyarakat adat Petapahan. Semakin banyak persoalan pencemaran dan pengrusakan lingkungan yang berimbas pada kehidupan manusia itu sendiri. AbstrakSalah satu upaya pemerintah dalam memberikan pelayanan kepada masyarakat yang belum mempunyai akta nikah melalui itsbat nikah yang tentunya memiliki aspek positif dalam memudahkan masyarakat mencatatkan kembali perkawinan yang telah dilangsungkan. Kedudukan itsbat nikah dalam peraturan perundang-undangan perkawinan memberi dasar adanya kepastian hukum bagi perkawinan yang tidak dicatat. Perkawinan yang tidak dicatat mesti dilakukan penetapan secara administratif melalui lembaga itsbat nikah. Kepastian hukum itsbat nikah terhadap status anak dan harta perkawinan merupakan sarana untuk menegakkan perlindungan harta, dengan itsbat nikah yang berkonsekuensi diakuinya pernikahan secarah hukum formal, maka secara otomatis status anak dan harta perkawinan menjadi diakui, sehingga kepemilikan harta dan hak-hak lain yang berkaitan dapat terpelihara.Kata Kunci: Kepastian Hukum; Perkawinan; Itsbat Nikah AbstractOne of the government's efforts in providing services to people who do not have a marriage certificate through “itsbat nikah” has a positive aspect in facilitating the public to re-register the marriage that has taken place. AbstrakPenelitian ini bertujuan untuk mengetahui kewenangan Majelis Kehormatan Notaris (MKN) dan implikasi keputusan Majelis Kehormatan Notaris dalam pemeriksaan notaris. Lokasi penelitian dilakukan di Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Sulawesi Selatan. Hasil penelitian menunjukkan bahwa Majelis Kehormatan Notaris berwenang untuk melakukan pemeriksaan dan mengeluarkan keputusan persetujuan atau penolakan terhadap pemanggilan notaris oleh penyidik, penuntut umum, atau hakim. Adanya permohonan pemeriksaan dari penyidik, penuntut umum, atau hakim maka MKN Wilayah akan membentuk majelis pemeriksa untuk memanggil, memeriksa, dan mendengarkan keterangan langsung dari notaris. Hasil pemeriksaan dari Majelis Pemeriksalah yang kemudian menjadi acuan MKN Wilayah untuk memberikan persetujuan atau menolak permohonan pemanggilan Notaris oleh penegak hukum. Keputusan persetujuan atau penolakan Majelis Kehormatan Notaris Wilayah merupakan keputusan final dan tidak ada upaya lain yang dapat ditempuh bagi notaris ataupun penegak hukum sehingga akibatnya pihak-pihak terkait harus menjalankan keputusan tersebut. This study aims to analyze protect the environment through the provision of credit assistance and supervision of credit granting by banks to protect the environment. This research is done by using empirical normative research method The results of this study indicate that: 1) Prevention of the bank in making credit agreements by including clauses prevention of environmental pollution must be done by the debtor.
