Berdasarkan data Kepolisan Reserse Demak tahun 2023 terlihat adanya perununan tersangka wanita yang merupakan kasus narkotika di Polres Demak ini menunjukkan langkah pencegahan sudah optimal, namun disisi lain perlu dianalisis apakah memang telah optimal dilakukan para penegak hukum serta apakah disebabkan adanya pemberian hukuman terhadap pengguna dan pengedar yang sudah tepat, atau karena adanya pembinaan/penanganan yang khusus. Metode penelitian yang digunakan adalah penelitian hukum yuridis empiris. Hasil penelitian Polres Demak sudah melakukan Kebijakan hukum pidana yang tepat yaitu meliputi perbuatan apa yang seharusnya dijadikan tindak pidana dan sanksi apa yang sebaiknya diberikan kepada si pelanggar. Sehingga dapat disimpulkan Penegakan hukum terhadap tindak pidana narkotika yang dilakukan oleh perempuan di wilayah hukum Polres Demak yaitu Pertama, adalah dengan dimulai dari tindakan pencegahan (preventif) dan yang kedua dengan cara represif apabila dengan cara preventif tidak berhasil yang merupakan inti dari tugas dan wewenang kepolisian sebagai penegak hukum dalam kapasitasnya sebagai penyidik. Serta tidak ada perbedaan (semua sama) penegakan hukum antara penyalahgunaan yang dilakukan oleh laki-laki ataupun perempuan baik Bandar, Pengedar/Kurir dan Pemakai tetapi sama perlakuannya dalam hal penyelidikan. Yang membedakannya hanyalah pada saat penggeledahan tubuh perempuan di lakukan oleh polisi Wanita.

In practice of criminal justice system, a judge plays a fundamental role in making decision that will be imposed on the defendant. The Law on Judicial Power requires judges to widely disclose information and opinions from various groups and public participation. Amicus curiae concept is a mechanism that permits third parties who believe they are interested in a particular criminal case. However, the existence of amicus curiae in positive law has not been regulated explicitly or formally to explain how it is applied in criminal justice. While the judge plays a part in delivering a verdict on the defendant, it is anticipated to be founded on legal principles and a commitment of substantive public justice. This study employs a normative juridical research approach, utilizing secondary data acquired through library research and analyzed using qualitative methods and presented in a descriptive and explanatory format. The findings of this investigation that the position of amicus curiae can be known as stipulated in Article 5, paragraph (1) of the Judicial Power Act. In the application of the judge's decision to realize substantive justice, the judge does not only see a settlement in terms of formal law as a form of legal certainty, but the judge must also be able to see aspects of a sense of substantive justice by the expectations of the community as a seeker of justice.

Pembentukan produk hukum menjadi suatu kebutuhan dalam merespon kepentingan masyarakat. Pembentukan peraturan perundang-undangan menentukan apakah mampu membagikan kenyamanan dan kesejahteraan bagi masyarakat atau menimbulkan konflik. Mendapatkan aspirasi serta kesepakatan dari masyarakat menjadi bentuk hukum yang responsif. Partisipasi seluruh elemen masyarakat menjadi hal yang penting dalam proses melahirkan produk hukum, khususnya KUHP Nasional yang telah disusun sejak tahun 1963, namun masih banyaknya pasal kontroversial dan menimbulkan perdebatan di masyarakat. Penulisan ini menggunakan metode serta teknik pengumpulan data secara yuridis normatif untuk menemukan better law dan menawarkan solusi terhadap permasalahan hukum, secara deskriptif analisis kritis dengan studi dokumen. DPR sebagai wakil rakyat menjadi peran penting dalam menampung dan menindaklanjuti aspirasi rakyat. Mampu mengenali keinginan publik demi mewujudkan konsep negara kesejahteraan dan hukum responsif. Evaluasi lebih lanjut perlu diadakan proses legislasi dengan diikutsertakannya aspirasi masyarakat. Kata Kunci: Partisipasi Masyarakat, KUHP Nasional, Negara Kesejahteraan, Hukum Responsif.

Indonesia is an archipelagic country that has a pluralistic society consisting of diverse ethnicities, customs and cultures. Each group lives by using rules nor established good norms written or unwritten and originating from habit Indonesian society or the customs in which it is used to regulate life behavior _ society , which is often referred to as "customary" or "customary law". As a country in the form of a republic , Indonesia is regulated by law in statutory regulations , where these statutory regulations are written laws. To carry out a marriage, for a country and nation like Indonesia it is It is absolute that there is a National Marriage Law that also accommodates principles and provide a legal basis for marriage which has been the guideline and has been applied to various groups in society us . Penelitian ini akan menitikberatkan pembahasan penggunaan teknologi ETLE pada era digital dalam mengoptimalkan penegakan hukum di bidang lalu lintas demi menekan angka pelanggaran lalu lintas yang terjadi saat ini. Melalui pemanfaatan teknologi ETLE tersebut, maka pihak Satlantas akan lebih mudah melaksanakan tugasnya dalam bidang lalu lintas. Metode penelitian yang digunakan adalah penelitian hukum yuridis empiris. Penelitian bersifat deskriptif analitis. Hasil penelitian menunjukan Permasalahan dalam penelitian ini mengacu pada banyaknya pelanggaran lalu lintas yang terjadi di Indonesia pada tahun 2022 terkhusus di Wilayah Hukum Jakarta Selatan. Tercatat pada tahun 2022, penindakan terhadap pelanggaran lalu lintas sejumlah 57.756, berbanding pada tahun 2021, 29.349. Walaupun pengaturan hukum lalu lintas telah diperbaharui, akan tetapi masih banyak pelanggaran lalu lintas yang terjadi. Dalam pelaksanaan ETLE di Polres Metro Jakarta Selatan terbukti efektif dalam menangkap pelaku pelanggaran lalu lintas namun dijumpai beberapa kendala dalam pelaksanaannya. Seperti kelemahan kamera E-TLE selain itu sanksi tilang juga tidak tepat sasaran dimana mekanisme kerja ETLE ini memunculkan kemungkinan bahwa pelanggar lalu lintas bukanlah pemilik kendaraan bermotor, sedangkan Surat Tilang akan dikirimkan dengan basis data pemilik kendaraan bermotor dalam database registrasi danidentifikasi kendaraan bermotor.

The enactment of the Basic Agrarian Law (UUPA) has changed the constellation of land in Indonesia. The spirit of anti-colonialism is eliminated as much as possible in the regulation of land in Indonesia. There is land that functions as agricultural land that is owned by parties who do not even live where the land is located, known as Absentee. This can hurt the spirit of the UUPA which wants to protect land ownership by indigenous people who live where the land is located. It is felt that the criminal law approach needs to be considered in an effort to protect the spirit of the BAL, in this case absentee land ownership. This legal research is normative legal research using a statutory approach, a conceptual approach that aims to analyze the criminal law approach to absentee land ownership in realizing social justice for all Indonesian people.

Mobilization of workers between countries easily occurs in the era of globalization causing foreign workers (TKA) to enter Indonesia easily. The basic philosophy of using TKA is needed in the context of increasing investment, exports, transferring technology and transferring expertise to Indonesian Citizen Workers (TKI), as well as expanding employment opportunities. Therefore, in accordance with the Job Creation Law No.11 of 2020 the Employment Cluster in Article 45 paragraph (1) it is emphasized that in hiring foreign workers, employers are required to appoint migrant workers as companions for foreign workers and carry out training for technology transfer and skill transfer from foreign workers. to the TKI companion. The research method used in this study is a normative juridical approach. This approach method is carried out in order to be able to make changes or changes from various theories in the discipline of law through a scientific process. Normative juridical research is research conducted by examining library materials or primary legal materials. The research specification used in this research is descriptive analytical method by explaining, describing, and correlating legal regulations and theories with the problems that occur. The researcher will read and then organize every legal material collected. In this study, conclusions are drawn using the deductive method, namely drawing conclusions from a general problem to a specific one so that it becomes a reference for answering the problems in research relating to the categorization of foreign workers as foreign workers the application of illegal and sanctions against corporate crimes against companies that carry out smuggling of illegal foreign workers in Indonesia. The results of the study show that the category of illegal foreign workers are foreign nationals who enter and work in the territory of the Republic of Indonesia without following the migration regulations and the rules for using foreign workers in force in Indonesia and any company that is proven to have committed a corporate crime. smuggling of illegal foreign workers must be strictly processed by imposing criminal sanctions in the form of imprisonment, fines and revocation of company licenses.

Penelitian ini akan menitikberatkan pembahasan Pemerintah harus bersikap adil dalam bersikap dan memberikan kemudahan bagi seluruh subyek hukum, termasuk investor yang berusaha untuk mendapatkan hak-haknya dalam menjalankan usaha Tetapi hal tersebut tidak tercermin di dalam Sikap Pemerintah atau BKPM yang melakukan pencabutan izin pertambangan kepada pelaku usaha tanpa adanya kejelasan. Sebagaimana dalam Putusan Nomor 215/G/2022/PTUN.JKT. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukan Pencabutan IUP merupakan upaya terakhir bagi perusahaan yang telah secara nyata tetap tidak mampu memenuhi kewajiban hukumnya, setelah diberikan sanksi peringatan dan penghentian kegiatan eksplorasi/operasi produksinya baik Sebagian maupun seluruhnya. Adapun prosedur pencabutan IUP, IUP tidak dapat serta merta dicabut tanpa melalui prosedur peringatan tertulis dan penghentian sementara terlebih dahulu yang juga diatur dalam Pasal 188 PP 96 Tahun 2021. Dalam kasus pada Putusan Pengadilan Tata Usaha Negara No. 215/G/2022/PTUN.JKT, diketahui bahwa BKPM menerbitkan Surat Keputusan Pencabutan Izin Pemerintah Republik Indonesia Nomor 20220218-01- 35400 mengenai Pencabutan Izin Usaha Pertambangan Kepada PT Megatop Inti Selaras tanpa adanya surat peringatan sebanyak 3 (tiga) kali sebagaimana diatur dalam Pasal 186. Perbuatan yang dilakukan oleh tidak sejalan dengan Pasal 183 Peraturan Pemerintah Nomor 96 Tahun 2021

The thick smoke resulting from forest fires in Indonesia has caught the attention of foreign countries. Through their news channels, foreign nations have commented on the frequent occurrences of forest fires in Indonesia. The phenomenon of forest fires remains an unresolved issue for Indonesia. Deforestation resulting from forest burning continues to persist, especially when carried out deliberately by human activities. While Indonesia has regulations prohibiting land and forest fires, the author will analyze the issues surrounding why land and forest fires incidents persist in Indonesia and how to address them. The researcher employs a descriptive research method with a literature review in data collection, drawing from primary and secondary legal materials. The author s observes inconsistencies in norms regarding the prohibition of land and forest burning. Sanctions for land and forest fires outlined in related regulations vary, lack consistency and lead to overlapping rules. Therefore, there is a need for reformulation of regulations with loopholes. Additionally, regulations concerning indigenous communities should be established to ensure clear recognition and legal certainty for these communities.

Dalam Putusan Nomor 898/Pdt.G/2016/PN.Jkt.Sel, memutus gugatan Penggugat kabur dan tidak dapat diterima karena telah mencampur-adukkan antara wanprestasi dengan gugatan perbuatan melawan hukum. Sementara itu, pada tingkat banding atas Putusan Tersebut, Pengadilan Tinggi Jakarta melalui Putusan Nomor 164/Pdt/2018/PT.DKI. yang dikuatkan pada tingkat kasasi melalui Putusan Nomor 930 K/PDT/2019, mengabulkan pembatalan klausula eksonerasi tersebut dengan alasan wanprestasi dan bukan atas dasar perbuatan melawan hukum. Sehingga menarik untuk membahas mengenai Pencantuman Klausula Eksonerasi Dalam Perjanjian Sebagai Perbuatan Melawan Hukum. Untuk menjawab hal tersebut, maka metode penelitian yang dipakai adalah penelitian hukum yuridis-normatif. Hasil penelitian menunjukkan Dalam mengajukan pembatalan klausula eksonerasi melalui gugatan perbuatan melawan hukum, di bagian posita gugatan Penggugat harus terlebih dahulu menguraikan unsur-unsur perbuatan melawan hukum sebagai berikut: Perbuatan yang Melawan Hukum, Kesalahan, Kerugian dan. Terhadap pencuntaman klausula eksonerasi dalam Perjanjian, maka Majelis Hakim pada Putusan Nomor 930 K/Pdt/2019 keliru dalam pertimbangannya menilai bahwa klausula eksonerasi yang telah dibuat secara standar oleh Tergugat yang isinya mengecualikan ataupun membebaskan Tergugat dari tuntutan dan/atau tanggung jawab dinyatakan tidak berlaku. Hal ini dikarenakan apabila Tergugat tidak ingin menerima klaim Penggugat, seharusnya Tergugat melakukan seleksi sedemikian rupa dengan mengharuskan Penggugat melakukan cek kesehatan terlebih dahulu. Tanpa dilakukannya cek kesehatan, kemudian saat Penggugat tiba-tiba sakit dan Tergugat tidak mau menanggung dapat diartikan bahwa Tergugat tidak beritikad baik dan melakukan perbuatan melawan hukum dan bukannya wanprestasi
