التخريج الأصولي: دراسة تأصيلية تطبيقية 原教旨主义:应用型研究

The study of takhrij (retrieval) is one of the most important mechanisms in ijtihad (independent reasoning) by fuqaha’ (jurists) and usuli (lit. those who go back to first principles). In usul (principles) and furu’ (branches) of Islamic law, the usulis were deliberately referring to madhab (school of law) founders especially after the decrease of mujtahids who managed to attain a level of independence and able to deal with detailed evidences in finding solutions to legal problem. Among the attention of takhrij of usuli is to expound legal maxim principles from fundamental sources the Quran and hadith contained of principle of legal reasoning and branches of Islamic jurisprudence. Utilizing descriptive analytical method, this article scrutinizes the concept of takhrij of usuli, its categories and some of its applications. The research found that the takhrij of usuli is concerned with the derivation of Islamic legal maxims, the principles of legal reasoning as well as the branches of law. However, the derivation is unconcerned about specific evidence of Islamic jurisprudence topics but the whole evidence whether literal, divergence or conformity of ibadat (submissive obedience), mu’amalat (transactions), and personal interest topic.

This study is concerned with the issue of rhetorical science (ilm al-ma`ani), namely the concept of disjunction and conjunction (al-fasl wa al-wasl). Building on the beautiful language and methods embedded in the Quran, an attempt will be made to study the aesthetics of rhetoric described by the concept of disjunction and conjunction. In light of this attempt, our study will examine the disjunction and conjunction as advanced by Imam Abd al-Qahir al-Jurjani and identify every locations of this concept. Our applied analytical approach will also include a clarification of the rhetorical meanings that arise from the analysis of some verses of Surah al-Kahf. We infer from this study that there are places where disjunction is necessary as well as where the conjunction is imperative. If a listener does not take into account the recognition of these locations, and its familiarity, the meaning will change as it will corrupt the understanding and intention of the listener, and the whole meaning is unreachable as it should be. In conclusion, it would appear that the aesthetic picture painted by the concept of disjunction and conjunction might change, or might not happen, as would be the case if the conjunction completes what is deserved the disjunction, or vice versa. The danger of mixing the locations of disjunction and conjunction has been pointed out by the researcher through its applications to some verses of Surah al-Kahf.

جهود العلماء حول كتاب "السنن" للإمام أبي داود

The Sunan of Abu Dawud, known as Sunan, is one of the six canonical hadith collections which occupies great place among the Sunni Muslim community. The Sunan is usually ranked as the next hadith collection after Sahihayn i.e Sahih Bukhari and Sahih Muslim. Author of this great book, al-Imam Abu Dawud Sulayman b. al-Ash'ath b. Ishaq b. Bashir b. Shaddad b. Amr al-Azdi al-Sijistani (202 -275 AH) tries to collect 5274 hadiths for this book. Due to the reputation and importance, many scholarly works have appeared to the extent of discussion, commentary, evaluation, editing its hadith corpora. Some scholars scrutinize the Sunan in a very brief fashion along with the retrieval of its hadith. Several detailed commentaries on this Sunan have been written, estimated to number around twenty versions between manuscript and printed edition. Hence, this study comes to shed light on the efforts of scholars for this major hadith collection. This study uses data collection method which includes content analysis and inductive method. Through these analyses, the study finds that the Sunan has several other commentaries or works that could be included as the extension of Abu Dawud scholarship in addition to the current twenty manuscript forms or publication.

Some exegetes explained the Qur’anic verses about the mercy of Allah through ṣūfī al-ishārī (mystical allegorical allusion) interpretation which is one of the exegetical approaches to describe the meaning of the Qurʾān. This interpretation is based on hidden symbolic imagery contrary to the conventional interpretation of the Qurʾān. The purpose of this article is to extrapolate the concept of raḥmat Allāh (the mercy of Allah) in Quranic verses with reference to tafsīr ṣūfī al-ishārī. This research is based on the textual study by using content analysis method in criticism and evaluation. The paper opines that adopting tafsīr ṣūfī al-ishārī in the concept of the mercy of Allah is in agreement with the conditions of conventional tafsīr.

This article deals with a terminology of asah al-shay’ fi hadha al-bab (the most correct thing for this section) as described by hadith scholars of four Sunan collections. The study elaborates the possible meaning of this terminology according to the contextual perspective of how it was established and the effect on regulating process of jurists’ rulings. Hence the purpose of this paper first is to determine the meanings of the terminology then takes a protracted encounter with the impact on the ruling of jurists. This qualitative research which focuses on the inductive, descriptive, critical, and analytical approach are used to the hadiths contained of asah al-shay’ terminology as adopted by the jurists. The finding shows the practice of hadith scholars in using this terminology is not to authenticate the hadiths but contrasting the level of veracity among the hadith transmissions and prioritize them although a hadith would not reach authentic level. And the jurists evidently quote the terminology in a manner agreed upon their principles. Noticeably, they applaud hadith scholars’ viewpoint antecedent to their principles with certain justification if there is any dissimilitude.

Konsep Umum Rahmat Terhadap Alam Sekitar Menurut Perspektif Pentafsiran Al-Ra’yi 对自然的普遍理解是基于Al-Ra - yi的视角

One of the fundamental principles of Islamic legislation is mercy pertaining to the environment as contained in al-Qur’an al-Karim. In this paper, the concept of mercy to the environment is derived from two exegetes’ discourses that are Rashid Rida (d. 1935CE) and Sayyid Qutb (d. 1966). The objective of this paper is to expose the views of these two prominent figures which focus on environmental texts. The interpretations based upon al-ra’yi (rational) approach will lead to increase the understanding of current needs as well as the emphasis of auxiliary sciences in environmental conservation issues. The study is significance in determining the concept of mercy according to exegetes from outside of al-ma’thur (interpretation based on tradition or text) framework. Critically, the pursuit of environmental preservation is accomplished through the appreciation of rational exegetes’ approaches. In analyzing data, this study employs the deductive method and descriptive methods in applying the concept of environmental mercy from Rashid Rida’s Tafsir al-Manar and Sayyid Qutb’s Fi Zilal al-Qur’an. Through the Quranic verses of environmental preservation, this study demonstrates that the notion of environmental preservation is emphasized by Rashid Reda and Sayyid Qutb with the obligation of all parties to execute. Although the period and background of exegetes are different, the similarity of their global interpretations suggest more mechanism are made for the environmental awareness. The most important conclusion is the concept of mercy contained in the Quranic verses can be interpreted and appreciated with the struggle of the environmental movement. This understanding of al-ra’yi interpretation give insight into Muslim scholars’ exposition and demonstrate that their intellectual capacity is far-reaching and develops a conclusive concept for universal humanity.

In analyzing data, this study employs the deductive method and descriptive methods in applying the concept of environmental mercy from Rashid Rida’s Tafsir al-Manar and Sayyid Qutb’s Fi Zilal al-Qur’an. Through the Quranic verses of environmental preservation, this study demonstrates that the notion of environmental preservation is emphasized by Rashid Reda and Sayyid Qutb with the obligation of all parties to execute. Although the period and background of exegetes are different, the similarity of their global interpretations suggest more mechanism are made for the environmental awareness. The most important conclusion is the concept of mercy contained in the Quranic verses can be interpreted and appreciated with the struggle of the environmental movement. Eloquence is one of the miracles the Qur’ān possesses. Among the type of verses in the Qur’ān are metaphorical verses or amthāl verses. The amthāl verses provide readers with a clear picture on the Qur’ānic understanding. Islamic scholars have produced numerous writings specifically on amthāl verses which displays their importance in Quranic exegesis. As for the Malay world, especially in Quranic scholarship, translation of the Qur’ān in Malay language began in the 17th century. This expertise of Quranic translation requires a translator to master the knowledge of Quranic exegesis including the knowledge on amthāl in the Quran. The purpose of this study is to analyze the translation of amthāl verses in Malay Indonesian language based on Quranic translation written by Prof. Dr. Mahmud Yunus. The study is conducted by comparing Mahmud Yunus's translation of amthāl verses with exegeses of Abd al-Nāṣir al-Sa'dī’s Taisīr al-Karīm al-Rahmān and Ibn Ashur’s al-Tahrīr wa al-Tanwīr. This study is a qualitative study using deductive analysis and comparative method. The study suggests that Mahmud Yunus adopted a clear method of explaining Quranic metaphors by using additional interpretations in parentheses as well as additional comments in footnotes. However, there are also places where Mahmud Yunus simply translates the Quranic metaphor without any additional explanation.

This paper focuses on the issue of islah (reform) of people, and the necessity of reform to be leaded by people who is free from any personal interests but vow to serve nation. This notion is vital in order to achieve security and safety for the community as well as to eradicate strife and dispersed among people. The main aim of this research is to clarify the viewpoint of Qur’an and hadith regarding the urge of reform among the people and to establish beneficial conclusion and lessons from these sacred sources. An inductive and analytical approaches based upon extensive review of literatures have been used to compile and study the concept of reform in the light of Qur’an and hadith. Certain cases are investigated such as the unresolved problem of people within courts and government departments which uphold the importance of local reform in resolving the disputes. It has also been forwarded through this research that the emphasis of Quran is focusing on the reform of family considering family as the nucleus of community. This will include a set of specific Qur’anic verses addressing the requirement of reform in Muslim community and the preservation of social fabric. While the hadith or sunnah was full of practical applications of what is mentioned in the Holy Qur’an.

معاني الرحمة ومظاهرها في التشريع القرآني 《可兰经》中慈悲的含义和表现

Mercy is a feature of Islamic religion as well as a distinctive feature in its legislation. The word of His Almighty, “And We sent thee not, save as a mercy unto the worlds” is among the famous Quranic verses on the tongues of many people to express the majesty of this religion and the tolerance of its legislation. The new government of Malaysia has taken the meanings of this verse as a shibboleth to articulate Islamic projects, works and plans under its rule of the country so to eliminate current trend in presenting Islam in stringent approaches, uncivilized methods and distorted images of the beauty and splendor of Islam. There are certain degrees where many people are plunged into bewilderment the reality of this religion between mercy and ferocity, clemency and cruelty, serenity and agitation, amplitude and narrowness. Likewise, the meanings of mercy, their depictions and their manifestations were veiled from people forasmuch as there are also provisions and statue that may conceal their realities or cover their details. This research is an attempt to delve into the meanings of mercy, its facts and minutes, and to reveal its images and manifestations through the Quranic verses in which the word mercy or its derivatives are mentioned and extract the location of mercy and its true position from these Quranic legislations. It is a library research that relies on extrapolating the Quranic texts in which the word mercy and important models were mentioned including its meaning, depictions, and manifestations of the legislative verses. Special attention is devoted to scholars’ discourse regarding this concept starting with challenges, problems and proposed solutions with a particular focus on contemporary researchers’ books and articles. The main contention of this paper is that the entire Quran by way of teachings, legislations, rulings, works, principles, essentials and rules does not vacate the circle of mercy and compassion yet is rooted in them. The mercy comes from The Most Merciful of The Merciful through His prophet, the faithful, the Compassionate, the Merciful.

مصطلح الخِصَام في القرآن الكريم دراسة دلاليَّة موضوعيَّة 《可兰经》中提到者是一项客观的语义研究

This article aims to examine the term al-khiṣām (dispute) in the Holy Quran. This qualitative study uses the inductive and deductive approaches to extract dispute terms in the Holy Qu'ran. This approach enables to explain considerable dispute meanings, its concept and regulations revealed in the Holy Qu'ran. Hence, through the study of ontological concept, it can encompass many significations of the term dispute in the manner of arguments or disputes among different groups of belief or the exertion of each group in attempt to succeed the dispute. In addition, this study discovers certain regulations in disagreement or dispute such as the renunciation of dispute without knowledge, the enhancement of evidence in dispute as well as the avoidance of useless argument. Among the findings highlighted are four types of disputes mentioned in the Holy Qur'an; first, Angels dispute before the creation of Adam (Peace be upon him); second, the character of human being is a clear adversary; third, dispute between believers and non-believers; fourth, dispute among non-believers in hell of the Judgment Day.
