This article aims to discuss the advances and challenges in the establishment of a new legal framework regarding the migratory flow in Brazil. It presents the theme on the regulation of the granting of visas to migrants from the perspective of n. 13.445/2017 Act. Then, it is approached about the granting of some types of visas, which is the document that gives its holder the expectation of entering the national territory, and its regulation by Decree n. 9.199/2017, pointing out some of its mismatches, which may to curtail the rights of migrants. The research is of theoreticalbibliographic nature following the descriptiveinductive method.

This article discusses Antonio Negri’s view of the constitutive power in the light of Franz Neumann’s theory of law. The text presents the essential characteristics of constitutionalism and its critique by Negri (2015) in the book “The Constituent Power”. For Negri (2015), constitutionalism has as its central function to prevent radical social transformation by restraining the constituent power. Next, the text discusses this criticism in the light of Franz Neumann (2009; 2013), seeking to show that not all radical transformation is necessarily progressive, especially if we leave aside certain assurances present in the tradition of constitutionalism.

Technological advances are increasingly rapid and it is up to the Public Administration to develop a public management environment capable of keeping up with this pace of change. Based on this scenario, this article addresses the possibilities of using Information and Communication Technologies (ICTs) aimed at the realization of social rights, through the direct provision of public services, using the notion of digital government. Therefore, the study is divided into three moments: first, the notion of digital government is presented based on technological advance; then, the possibilities of applying ICTs as tools aimed at providing public services in Brazil are analyzed; finally, the perspectives and challenges of this implementation are discussed, in order to conclude that the digital government corresponds to the use of information and communication technologies in the provision of public services. The research adopts the deductive method and the bibliographic research technique, through indirect documentation.

This article deals with the control of constitutionality in the African human rights system, to verify how the dialogue between jurisdictions is carried out. First, we will talk about the organic-institutional structure of the system. In addition, we will introduce the interpretation of regional and international law by countries such as Angola, Cape Verde, Bissau Guinea, Mozambique and Sao Tome and Principe. The method is comparative. As a conclusion, the legal systems analyzed allow constitutionally the application of international human rights law within their systems, and it is necessary to make the society of these countries aware of the importance of the subject.

We intend to deal with the peculiar way in which Lukacs, in his writings which would result in the essential of History and class consciousness, deals with Morality and Law. The criticism of Hegelian ethics leads the Hungarian author to a rather great emphasis on individual action and responsibility to the extent that there would be, on the one hand, an abyss between moral action and revolution, on the other, an immediate unity between the two. With what the brazilian philosopher Jose Chasin called immanent analysis we will show how morality and Law relate themselves at Lukacs´work of 1919.

The article analyzes the phenomenon of minority participation by the State in business societies. It addresses: (i) the main characteristics of State-owned companies and what differentiates them from controlled companies; (ii) the way in which the State can assume the condition of controlling shareholder without a majority of the share capital and the implications of this control in the legal regime of these companies; (iii) the legal regime of companies with minority State participation under private control and the main causes that justify State participation without control power. It is concluded that the company controlled by the State suffers a partial influx from the publicist regime, since the State cannot detach itself, as a controlling shareholder, from the principles that govern its intervention in the economic domain. On the other hand, minority State participation does not exempt the State from adopting governance and control practices proportional to the relevance, materiality and risks of the business.

The present article analyzes how a famous clash of Criminal Science (late nineteenth and first half of XX), the dispute between Classical School and Positive School, will be reproduced in the brasilian scenario, from two great jurists, references in the period and Criminal Law professors at Law Schools in that period: Moniz Sodre and Filinto Bastos. The first, promoter and confessed adept of the Positive School, while the second will defend and assume the Classical School postulates. From opposite sides in this Criminal Science “dispute”, both, however, declared themselves liberal. Contradiction? The methodology chosen is the theoretical-exploratory of the available and raised literature.

O presente trabalho faz uma investigacao das relacoes entre neoliberalismo, Estado de Excecao e controle social na contemporaneidade do Brasil. Assim, o problema que move este artigo se coloca: diante dos elementos de excecao e de neoliberalismo, pode-se dizer que o controle social da Administracao Publica ja se constitui uma mera ideia vazia de significado? A hipotese e a de que sim, e possivel falar em decadencia do controle social, principalmente por meio de um de seus principais mecanismos, o acesso a informacao. O metodo de trabalho e o hipotetico-dedutivo, testando-se a hipotese a partir da argumentacao desenvolvida.

The research problem concerns which model of democracy is desirable in view of the institutional and political crisis observed today. The analysis performed is monographic. Two models of political participation are evidenced here: the liberal democracy whose main characteristics are competition and political participation and the democracy recommended by Jacques Ranciere through the political practice that operates from the contribution of the popular classes to the installation of public spaces. The democratic crisis is addressed by exposing an annual study that investigates the democracy index in most countries. The paper ends by demonstrating at the end the need to maintain the premises of liberal democracy as a means of defending the very rules of the democratic game.
