The title of this thesis is the URGENCE OF LEGAL POLICY FOR FULFILLMENT OFCONSTITUTIONAL RIGHTS ON SOCIAL SECURITY EMPLOYMENT OF WORKERS OFVULNERABLE GROUP IN THE NATIONAL SOCIAL SECURITY SYSTEM, the problems studied inthis thesis are regarding legal policy from the point of view of the prevailing regulations inIndonesia, especially those relating to the fulfillment of constitutional rights. employmentsocial security for workers and the urgency of Fulfillment of social security rights for workersof vulnerable groups who are unable to pay contributions.The research method used is juridical-normative research using an approach thatsynchronizes the applicable legal provisions in the legal protection of norms or other legalregulations with their relation to the application of legal regulations in practice in the field.The result of the study is that there is a conflict between Article 14 paragraph (1) of UU. NO.40 of 2004 concerning the National Social Security System and the mandate of the 1945Constitution. Social security only targets workers who are wage earners and those who areable to pay contributions, but vulnerable workers are not protected under the SocialSecurity.Keywords: Urgency, social security, vulnerable workers
本文的题目是《国家社会保障体系中弱势群体劳动者社会保障就业宪法权利的法律政策落实的紧迫性》,本文从印尼现行法规的角度研究法律政策方面的问题,特别是与宪法权利的落实有关的问题。劳动者就业社会保障和无缴费能力弱势群体劳动者社会保障权利实现的紧迫性。所使用的研究方法是司法规范研究,使用的方法是将规范或其他法律法规的法律保护中的适用法律规定与该领域中法律法规在实践中的应用关系同步化。研究的结果是UU第14条第(1)款之间存在冲突。关于国家社会保障制度和1945年宪法授权的2004年第40号决议。社会保障只针对工薪阶层和有能力缴纳养老金的劳动者,而弱势劳动者不受社会保障的保护。关键词:紧迫性,社会保障,弱势劳动者

Kedudukan Akta Jual Beli dan Tanggung Jawab Pejabat Pembuat Akta Tanah dalam Kasus Adanya Sertipikat Ganda yang Dikeluarkan oleh Badan Pertanahan Nasional (Studi Kasus: Putusan Pengadilan Tata Usaha Negara Bandar Lampung No. 24/G/2017/PTUN-BL)

Kepemilikan atas sebidang tanah di Indonesia mengharuskan adanya sertipikat tanah, dalam hal ini para calon pemilik tanah wajib melakukan pendaftaran tanah terhadap sebidang tanah yang akan dimilikinya tersebut. Namun dalam praktik dan pelaksanaannya masih terdapat banyak permasalahan terkait hak atas tanah yang menimbulkan sengketa di tengah masyarakat Indonesia, walaupun pendaftaran tanah tersebut sudah dilakukan sesuai dengan ketentuan perundang-undangan, seperti halnya pada kasus pembahasan ini dimana adanya penerbitan sertipikat ganda atas sebidang tanah Hak Milik dengan sertipikat Nomor 646 antara Sa’diyah sebagai Penggugat terhadap Kepala Kantor Pertanahan Kabupaten Lampung Tengah sebagai Tergugat yang diselesaikan melalui Pengadilan Tata Usaha Negara Bandar Lampung berdasarkan putusan No. 24/G/2017/PTUN-BL. Hasil keputusan Pengadilan Tata Usaha Negara Bandar Lampung menyatakan tergugat diwajibkan mencabut atau menarik sertipikat hak milik atas nama Nyonya A. Ruyanti dan bagaimana peran serta tanggung jawab PPAT terhadap bukti adanya Akta Jual Beli berupa tanah dan bangunan yang objeknya sama. Jenis penelitian yang digunakan ialah yuridis normatif dengan bentuk penelitian berupa deskriptif analitis. Dalam kasus ini, mengenai perlindungan hukum telah terpenuhi sebagian namun PPAT dan kepala kantor pertanahan dalam kasus ini masih dipertanyakan keabsahannya dalam menjalankan prosedur yang ada terkait dengan penerbitan sertipikat dan terbitnya akta jual beli atas obyek yang sama. Kata Kunci: Penerbitan Sertipikat Ganda; Sertipikat Ganda; Pendaftaran Tanah.

PEMBATALAN AKTA NOTARIIL YANG DIBUAT OLEH NOTARIS YANG DILAKUKAN SECARA TIDAK SAH DAN MELAWAN HUKUM (STUDI KASUS NOTARIS DAN PPAT X KOTA TANGERANG ) 取消公证人非法和非法的公证契约(公证个案研究和PPAT X城市TANGERANG)

Notaris sebagai Pejabat Umum merupakan Profesi untuk memberikan pelayana secara hukum kepada Masyarakat, Notaris yang telah diangkat oleh Negara berwenang untuk membuat alat bukti ataupun surat yang sah di mata Hukum. Alat bukti yang sah dibuat oleh Notaris berbentuk Akta Otentik atau Akta Notaris, yang memiliki kekuatan pembuktian yang sah dan sempurna di mata hukum. Oleh karena itu Peran Notaris dalam pembuatan Akta Otentik sangatlah penting bagi kebutuhan masyarakt banyak yang merupakan dokumen negara. Oleh sebab itu diperlukan prinsip kehat-hatian dapat menjalankan tugas sebagai seorang Notaris. Permasalahannya adalah bagaimana seorang Notaris melahirkan akta autentik yang sah dan tidak berlawan dengan hukum, Bagaimana tanggung jawab Notaris sebagai Pejabat Umum atas pembatalan akta yang dibuatkan karena tidak sah dan melawan hukum?, Apakah akibat hukum atas pembatalan akta autentik yang dibuat oleh Notaris tidak sah dan  melawan hukum ?  Untuk menjawab permasalahan tersebut, tipe penelitian ini ialah normatif. Data yang digunakan adalah data sekunder, pengumupulan data studi kepustakaan, dan analisi data kualitatif serta penarikan kesimpulan metode deduktif. Kesimpulan dari penulis ini menyebutkan bahwa (1) Seorang Notaris melahirkan Akta Autentik yang sah dan tidak berlawan dengan hukum dengan memilik kekuatan Pembuktian Akta Otentik yang sempurna dan mengikat , (2) Sebagai seorang Notaris harus memiliki sikap tanggung jawab atas atas yang telah dibuatnya , apabila suatu saat terjadi sengketa atau kesalahan pelanggaraan atas akta yang dibuatnya maka Notaris harus bertanggung jawab atas kesalahan yang dibuatnya. dan (3) Semua dokumen akta-akta dibuat oleh Notaris dan PPAT X Kota Tangerang batal demi hukum atau setidak-tidaknya cacat yuridis dan bertentangan dengan hukum.   Kata Kunci : Pembatalan Akta Notariil, Notaris , Tanggung Jawab Notaris.

Lingkungan hidup merupakan kesatuan ruang dengan semua benda,daya,keadaan dan makhluk hidup termasuk  manusia dan juga perilakunya yang mempengaruhi kelangsungan kehidupan serta kesejahteraan  manusia dan makhluk hidup lain yang terdapat di dalamnya. Setiap aktivitas manusia dan seiring bertambahnya penduduk akan diiringi dengan adanya kebutuhan manusia yang harus dipenuhi yaitu kebutuhan mengenai sumber daya yang ada di lingkungan hidup atau alam,oleh karena itu diperlukan adanya kontrol dalam setiap aktivitas manusia pada saat memanfaatkan sumber daya alam sehingga tidak menimbulkan pencemaran lingkungan hidup serta rusaknya lingkungan.Peran hukum lingkungan disini sangat penting sebagai upaya dalam pencegahan terjadinya kerusakan lingkungan.Penelitian ini merupakan penelitian yuridis normatif yaitu mengkaji permasalahan hukum dengan menggunakan studi kepustakaan,peraturan perundang-undangan,dan literatur lainnya yang berkaitan dengan hukum.Metode pendekatan yang digunakan dalam penelitian ini yaitu pendekatan perundang-undangan (statute approach).Tujuan dari penelitian ini yaitu untuk mengetahui peran penting hukum lingkungan sebagai sarana pencegahan kerusakan lingkungan akibat dari adanya pembangunan.
环境是一个空间的统一,所有的物质、力量、环境和生物包括人类,以及影响生命的延续和人类及其内在生物的福祉的行为。随着人口的增长和人类活动都会伴随着需求必须满足人类需求的就是在环境或自然资源的各项活动中,因此有必要控制人类利用自然资源时,以免引起环境污染和环境破坏。环境法在防止环境破坏方面发挥着至关重要的作用。该研究是一项规范法律研究,利用文学研究、法律法规和其他与法律相关的文献来审查法律问题。本研究采用的方法是法律方法。本研究的目的是确定环境法在防止环境破坏方面的重要作用。

PERLINDUNGAN HUKUM BAGI NASABAH TERHADAP RISIKO DALAM PERJANJIAN BANK DI INDONESIA

This research was conducted with the aim of finding out how legal protection measures for customers (debtors) as consumers of bank service users and how the accountability of the bank in the event of risks related to bank credit agreements. By using the normative juridical research method, the credit agreement is a standard contract, where the contents or clauses of the credit agreement have been standardized and set forth in a form (blank), but are not bound in a particular form. Prospective debtor customers only need to sign if they are willing to accept the contents of the agreement, not giving the prospective debtor the opportunity to further discuss the contents or clauses submitted by the bank. Standard agreements are needed to meet practical and collective needs. Phrase "significantly equal" isn’t regulated in Law 31 of 2000 about Industrial Design, it’s cause in multiple interpretations related to the meaning of "novelty". The novelty element should refer to TRIPs Agreement, which isn’t the same or not similar to the previous disclosure. This study uses a normative juridical method, with a theoretical approach that is relevant to industrial design protection. This is what underlies research to determine the effectiveness of industrial design rights protection based on the novelty principle, and how to formulate law of industrial design in the future. ANALYSIS OF LEGAL PROTECTION FOR CAPITAL MARKET INVESTORS 资本市场投资者的法律保护分析

This reseach  discusses the legal protection for capital market investors. The capital market industry in a country is urgently needed as a source of national development funds. In its activities, there are actors who fully support and support capital market activities in accordance with their respective duties and functions. The existence of investor funds has been able to move the capital market industry in particular. In general, investor funds can be a source of funds for national development. However, due to the unbalanced share composition between founders and public investors, this weakens the position of investors, so that investors often become victims of crimes and capital market violations. Law No. 8 of 1995 concerning the Capital Market which is The legal basis for the existence of the capital market in Indonesia has provided legal guarantees for the parties conducting activities in the capital market sector as well as protection for investors. Protection for investors is a requirement to establish the principle of full and fair disclosure or transparency. The writing method used by the writer in this research is the normative method. The results show how legal protection for capital market investors is based on Law Number 8 of 1995 concerning the Capital Market and Law Number 21 of 2011 concerning the Financial Services Authority.

Municipal bonds are debt securities issued by local governments that are offered to the public through public offerings on the capital market. The issuance of debt securities is evidence that the local government has made a loan or debt to the holders of the debt securities. The choice to develop municipal bonds is based on the small development budget in the regions which makes public services neglected. In addition, there is a trend of capital spending in the APBD that does not support development and provision of infrastructure that supports economic development. On the other hand, regional loans in developed countries have become a trend of sources of financing for infrastructure development, for example in Vietnam, China, Japan and other countries. In the national context, Indonesia's status as a middle income country makes it increasingly difficult for Indonesia to obtain soft or cheap loans from international donor agencies and from bilateral countries. However, local governments in issuing regional bonds on the capital market, there are obstacles in terms of regulations, including the approval of the DPRD and the obligation to audit regional finances by public accountants. Therefore it is interesting to do research, using normative juridical research methods with descriptive analytical.

RASIONALITAS MAHASISWA BERPARTISIPASI DALAM POLITIK UANG PADA PEMILIHAN KEPALA DESA KENEP 学生的合理性参与了肯普村长选举的金钱政治

The election of the village head is a manifestation of the existence of a democratic party, in which the people are directly involved in it. Various attempts have been made by the candidate for village head in order to win the village head election process, one of which is money politics. Money politics is a form of cheating at a democratic party. Students as agents of social change are required to show their role in real life. However, there were still many students participating in money politics. Max Weber's social action theory is used as an analytical tool on the rational actions of students who participate in money politics in village head elections. Rational action is divided into four types namely instrumental rational action, value rational action, affective action, and traditional action. The method used in this research is qualitative, using a phenomenological approach. The data from this study were obtained primary  data and secondary data from national and international journals, books, internet, and scientific articles. The purpose of this study was to identify sources of information, perspectives, factors, processes and the rationality of students participating in money politics in the village head election. The results show that the rationality of students participating in money politics is caused by internal factors and external factors.

License is an instrument of environmental resource management. Law No. 32 of 2009 on Environmental Protection and Management (UU-PPLH) states that environmental permits are integration of various previously separate permits. In order to accelerate licensing including the environmental sector, the government issued PP Number 24 Year 2018 on Electronically Integrated Business Licensing Service (PP OSS). The PP is published in the frame of reorganization of the One Door Integrated Service (PTSP) system through the Online Single Submission (OSS) system. However, with the presence of PP OSS does not transfer the authority and responsibility of issuance to OSS Institutions because oss institutions issue licenses for and on behalf of ministers, agency leaders, governors or regents / mayors in accordance with attribution, delegation or delegation of authority given to them. With the use of OSS system is expected to minimize gaps or potential occurrence of corruption in the field of environmental licensing which is actually one of the manifestations of environmental protection.
