Denmark is a pioneering country regarding digitalization. The Danish public administration is a clear frontrunner and has been submitted to significant changes. Contact between the administrative authorities and the citizens is predominantly digitalized and digital self-service solutions and automated decisions are increasingly used. Theoretically the point of departure is George Ritzer´s theory that societies worldwide are subject to a far-reaching process of McDonaldization, which leads to the implementation of the modes of organisation and production found in fast-food restaurants in other sectors in society. The theory of McDonaldization is applied to the digitalization of the public administration in Denmark. The article further explains the findings from a sample survey on specific digital solutions in Denmark and how the citizens perceive these solutions.

Este trabajo trata de mostrar la evolución de la regulación de la esfera pública en los Estados Unidos durante el siglo XX, desde la perspectiva del derecho a la libertad de expresión. Este derecho, consagrado en la primera enmienda a la Constitución estadounidense, ha sido objeto de un amplio tratamiento, por lo que el recorrido por el mismo muestra los cambios en la interpretación de su dimensión social. Particularmente, permite situar la problemática y contextualizarla en el marco de los cambios en la esfera pública producidos a partir de los avances tecnológicos en la esfera de las telecomunicaciones. En este contexto, el examen de los presupuestos teóricos, jurídicos y pragmáticos de la regulación de la esfera pública sirve de base para reflexionar acerca de cómo aproximarnos a los retos del siglo XXI.

As empirical research into access to justice burgeons around the world, contemporary work offers opportunities for integration and synthesis, generating insights that can inform both policy priorities and practical decisions about program design and implementation. Access to justice is historically a problem-focused research field, but an important strand of contemporary access to justice research focuses on solutions, or a deeper understanding “what works.” This paper offers a three-part framework for thinking about how research about “what works” in one jurisdiction can inform understanding of what might work in others. We propose a common core of research questions; a framework for conceptualizing the objects of study (in the example here, programs); and a framework for conceptualizing the contexts in which those programs might operate.

I will raise the question of whether it is conceptually acceptable and practically useful to speak in terms of rights of Nature. I will answer positively: we may talk about rights of Nature with complete legitimacy. In addition, I will argue that we must do so from an anti-capitalist and postcolonial perspective; that is, not as a metaphor or a legal fiction, but considering that for some peoples of the world, natural entities genuinely have a personality worthy of protection through rights. I will also defend that the expression “rights of Nature” goes beyond the problem of the entitlement (Nature or Earth as “new holders”). Indeed, the emergence of the rights of Nature implies a radical change in the actual concept of rights; a change which compels us to move from humanism to post-humanism. This in turn leads us to dismantle the individualistic, anthropocentric, Eurocentric and ownership-based perspective of rights.

La aceptabilidad de las demandas de protección de asilo por razones de orientación sexual e identidad de género se ha desarrollado recientemente tras un largo proceso de dudas e incoherencias. A pesar de ello, todavía hoy persisten ciertas interpretaciones que se basan estereotipos y que dificultan un procedimiento sensible a la complejidad de las situaciones que viven estos demandantes de asilo. Con el propósito de identificar estos estereotipos, que suelen darse en relación con la prueba de la identidad y la constatación de la persecución, se analizan las sentencias del ordenamiento español en esta materia y se proponen otras interpretaciones que eviten dichos estereotipos.

This article critically analyses the standard of consent in rape law in India by engaging in a doctrinal analysis of the current jurisprudence. It also analyses various extraneous circumstances influencing the determination of consent in Indian rape law. The article will then assess the status of consent jurisprudence and related issues in the English and Canadian jurisdictions for a comparative assessment. Thereafter, it will critically assess the arguments in favour of an affirmative standard of consent before concluding with possible solutions for better interpretation of the law in determining consent by courts during rape trials in India.

El objetivo de este trabajo es hacer un recorrido por algunos de los aportes de la teoría feminista a la reflexión en torno al abuso sexual contra la infancia. Se centrará en los desarrollos planteados por el feminismo radical de los años 70 y 80, principalmente en Norteamérica. Las feministas radicales plantearon críticas a las teorías vigentes sobre el abuso. Así mismo, realizaron valiosas contribuciones teóricas justificadas en el hecho de que casi la totalidad de los abusadores son hombres. Se establece una vinculación entre abuso sexual contra la infancia y la sexualidad masculina, se analiza el papel de la socialización en la feminidad en la prevalencia del abuso sexual y se considera que en gran medida la familia patriarcal promueve y garantiza la impunidad del abuso sexual. Recuperar estas ideas puede servir para construir una teoría de la violencia sexual contra la infancia desde una perspectiva de género.

The topic of human rights in the aspect of relations between the state and addicted patients (and in general relations in the sphere of circulation of drugs) remains scantily explored for modern Ukraine, which actualizes further scientific research. The purpose of the article is to determine the authors’ vision of compliance with international human rights standards of the legal anti-drug prohibitions established by the state. To achieve this goal, using the historical-legal, comparative, dialectical, systemic, hermeneutic, sociological methods and legal method of cognition, national and foreign legislation was critically analyzed, international experience in implementing various models of anti-drug policy was studied, and proposals for the draft of a new Criminal Code of Ukraine were formulated. The authors pay special attention to the problems of protecting the rights of drug addicts, legal liability in the field of drug trafficking, legalization of drugs for non-medical needs and compulsory treatment of drug addicts.

La ignorancia –total o parcial- del derecho por parte de sus destinatarios plantea diferentes problemas, entre los cuales el de que dificulta el acceso a la justicia. Ante esto se han venido planteando diferentes formas de afrontarlo, que van desde la modulación del principio de que la ignorancia del derecho no excluye su cumplimiento, hasta diferentes medidas de protección del acceso a la justicia para quienes pertenecen a grupos vulnerables. Este artículo sostiene que ese enfoque, siendo necesario, da por hecho en todo momento en qué consiste la ignorancia, sin tener en cuenta la disputa política y epistemológica que en ocasiones se produce en torno quién ignora qué. Para dar cuenta de este aspecto, se propone el marco conceptual de la injusticia epistémica, en sus dos manifestaciones de injusticia testimonial e injusticia hermenéutica, explorándose su relevancia en el ámbito jurídico.

En el presente se ahondará sobre si la actividad penal del Estado -en términos de juicio y condena- resulta conveniente para la totalidad de los hechos de violencia machista contra las mujeres, o si, en determinados casos considerados leves, corresponde optar por otros mecanismos que gestionan el conflicto con mayor eficacia. En primer lugar, se hará especial hincapié al debate existente en el plano internacional sobre la aplicación de la suspensión del juicio a prueba en casos de violencia de género y, en particular, al estado de situación en la República Argentina de la mano del fallo Góngora de la Corte Suprema de Justicia. En un segundo tramo, se presentará el análisis realizado sobre siete expedientes judiciales atravesados por la violencia machista -bajo jurisdicción del Juzgado de Garantías Nº 5 de la ciudad de Mar del Plata, Provincia de Buenos Aires- y en los cuales se determinó aplicar una SJP.
