Victims of terrorism can be considered a special category within the broader and more general group of “victims of crime”. In recent decades, there has been an international trend to develop more specific treatment, both in legal and practical terms, to address their particular needs in unfortunate times of intensification and sophistication of terrorist attacks, with a correlative increase in the harmful consequences for an increasing number of victims of terrorism. At the international level, one such instrument is the Madrid Memorandum, which contains relevant guidelines that serve as a reference for States, who can draw inspiration from them when designing their national standards of protection and support for victims of terrorism. This paper aims to critically analyze the legal framework applicable in Kosovo on the issue of protection and support of victims of terrorism from the pre-trial phase, through criminal proceedings, and after the completion of criminal proceedings, with special emphasis aiming to analyze the compliance of these rules with standards of the Madrid Memorandum. The paper identifies three areas in which the applicable legal framework for the protection and support of victims of terrorism in criminal proceedings needs to be harmonised with the Madrid Memorandum’s standards.

La justicia transicional propone instrumentos excepcionales para gestionar periodos no ordinarios, como las transiciones hacia la democracia o las transiciones hacia la paz. Estos instrumentos, de los cuales las llamadas «Comisiones de la Verdad» las más conocidas, gozan de un éxito considerable a nivel mundial, pero tienen en la Comunidad Autónoma Vasca un eco específico que la sitúan en la encrucijada entre excepcionalidad y normalidad. Este articulo aborda la especificidad de este territorio, donde la complejidad de los procesos de transición hacia la democracia y hacia la paz contribuye a la construcción un panorama victimario inédito. Este contexto único da luz a la aplicación progresiva, pragmática y gradual de instrumentos excepcionales de justicia transicional, en un contexto normalizado de democracia arraigada, e implica a la vez una innovación legislativa y jurídica, adaptados a retos específicos.

A key-goal for governance is the translation of knowledge into planning. We recruited 125 representatives from society, technical-political and the scientific community in a participation process focused on the Urdaibai Biosphere Reserve. We analysed their testimonials by using qualitative and quantitative methods, including Computer Assisted Qualitative Contents Analysis. We validated consensuses for future management, detailing criteria for a sustainable, collaborative, and anticipatory governance. The consensuses that stood out as most important have been the following: 1. Urdaibai should work towards human well-being and prosperity. 2. Synergies between institutions and society through participation strategies are necessary. 3. It is important to have a political leadership to guide governance. We can state that the participatory process carried out allowed participants to express shared horizons on future strategies. We present the methodology of this process as well as its results since we consider that both can be useful for managers of protected areas.

La situación actual de mujeres y niñas se ha agravado dando clara muestra de ello los objetivos de la Agenda 2030 de desarrollo sostenible de Naciones Unidas que indican que con la pandemia las acciones tomadas para el logro de mejores estándares se han visto en retroceso. El caso de las mujeres migrantes, las refugiadas o desplazadas de sus hogares, muchas de ellas víctimas de tratos inhumanos, y de repetidas violaciones. En este artículo pusimos especial énfasis en la relación y articulación constante de los instrumentos normativos internacionales en el ámbito de los Derechos Humanos y del Derecho Internacional Privado con el fin de encontrar posibles respuestas a las problemáticas que se presentan, desde la perspectiva de género.

Este texto introduce el monográfico temático dedicado a problematizar las concepciones de normalidad y excepcionalidad en la producción legislativa, considerando el abordaje de situaciones sociales que rompen también con las consideraciones de lo que es normal o excepcional. Esta introducción contextualiza conceptualmente las ocho contribuciones que componen este número, dividido en dos bloques según el contexto de actuación, País Vasco-Navarra o América Latina, y que analizan casuísticas relativas a cuatro grandes áreas de excepcionalidad: política, sanitaria, económica y las que afectan a las relaciones de género. Los trabajos aquí reunidos comparten el objetivo de comprender las dinámicas que se producen ante la inminente necesidad de aumentar las seguridades de la ciudadanía y las consecuencias que tienen las innovaciones legislativas en los diferentes ámbitos sociales.

Advocacy is one of the central means for supporting access to justice. The social work profession has advocacy as one of its main courses of action. This discusses the components in actions that are considered as good practice for facilitating access to justice in its democratic aspects. More explicitly social workers advocacy for promoting the worth and dignity of human beings in society. Four different ideals in social work are presented, self-help, treatment, philanthropy and bureaucracy. Thereafter, cases presented as best practice from European social workers are used for pointing out the central components described for good advocacy work. These are communication, inclusion and flexibility. Taken together, the aspects all go back to having respect for those in need of advocacy. In advocating for access to justice, it is important that the advocates are actively aware of their own role in a way that their efforts facilitate access to justice.

Cuando los marcos que definen los estados democráticos de derecho resultan insuficientes, se torna primordial repensar de qué manera generar mejores condiciones para una sociedad cansada de la inacción de sus autoridades. Este artículo plantea algunas reflexiones y expone dos ejemplos respecto al rol que juegan aquellos actores jurídicos cuyas labores, por lo general, suelen pasar desapercibidas para los sistemas políticos en los que se insertan; es decir, las personas que ejercen la abogacía. Sin embargo, no refiere cualquier tipo de abogacía sino a uno particularmente comprometida con la acción social en aras de fortalecer las reglas e instituciones que sostienen a las democracias.

La declaración de pandemia mundial de la COVID-19 sorprendió a México a la víspera de numerosos cambios de política pública, entre ellos una reforma educativa cuyas leyes reglamentarias (una nueva Ley General de Educación, La Ley General del Sistema para la Carrera de las Maestras y los Maestros y la Ley para la Mejora Continua de la Educación) se aprobaron hacia el último trimestre de 2019. En el presente texto se sistematizan las medidas de contingencia adoptadas en la esfera educativa. Al respecto, en primer lugar, se valora su adecuación a ciertas recomendaciones internacionales, pero también a las condiciones concretas del contexto nacional. En segundo lugar, se resumen las principales evidencias existentes a la fecha sobre los efectos de la pandemia sobre diversos procesos educativos. Sobre esta base, se pondera cuánto ha afectado la circunstancia pandémica al desarrollo de algunos de los principales cambios previstos con la reforma educativa.

This article analyzes the impact of judicial policies aimed at promoting equity in judge’s career on the race and gender composition of the Brazilian Judiciary. We investigate whether these policies impacted on the way in which judicial careers and internal promotions are gendered and racialized. The article uses quantitative data on the composition of the Brazilian judiciary by gender and race, and qualitative data obtained from various documentary sources, including the media and excerpts from interviews with judges published in academic works. The theoretical approach is the one of differences, conceiving them as constructed within the scope of culture. We conclude that despite the timid increase in the presence of black women and men in the Brazilian judiciary, racial and gender issues have been made visible and disputed, with political movements seeking to implement these agendas, sharing identifications and vocalizing experiences of subtle discrimination.

We investigate whether these policies impacted on the way in which judicial careers and internal promotions are gendered and racialized. The article uses quantitative data on the composition of the Brazilian judiciary by gender and race, and qualitative data obtained from various documentary sources, including the media and excerpts from interviews with judges published in academic works. The theoretical approach is the one of differences, conceiving them as constructed within the scope of culture.
