TINDAK PIDANA MELARIKAN PEREMPUAN DI BAWAH UMUR DAN PENYELESAIANNYA DI WILAYAH HUKUM KABUPATEN TANJUNG JABUNG TIMUR

Marriage is an inner and outer bond between men and women that is entwined in a domestic relationship to create a household that is sakinah mawaddah warahmah. One of the condotiont that must be obeyed in the implementation of a marriage regulated by law is that the bride and groom must be of legal age. Every marriage that has not meet the marriage age limit, is essentially called a underage marriage is affirmed in article 7 of law Number 1 of 1974 and article 1 paragraph (1) of Law Number 23 of 2002 Concerning Child Protecdtion, that is child someone who is not yet 18 years old and is a pruning of the freedom of chldren’s rights in obtaining the rights to life as a teenager who has the potential to grow, develop and potentially positively according to what is outlined in religion. The problems discussed in this thesis are the intercourse of minors in marital relations and the effects arising from such marriages, because in fiqih view no punishman is given for this action. However, if viewed from the perspective of national law, underage marriages have violated several law and regulations. The factors that influence it’s  effectiveness are the subtance of the law Article 332 of the Criminal Code, Law Number 16 of 2019 and Law Number 23 of 2002. The conclusion of this thesis is that the aplication of sanctions against underage run away women in marriage in Tanjung Jabung Timur Regency has never been applied because the are no reports from the victims althought the criminal law regulates sanctions againts the perpetrators because it has caused harm to the victims (women)

Efektivitas Program Asimilasi Warga Binaan Pemasyarakatan Terhadap Kesiapan Integrasi Narapidana ke Masyarakat (Studi pada Lembaga Pemasyarakatan Klas IIA Padang) 将公民同化为社会准备同化的有效方法(大学洛杉矶州立监狱的一项研究)

The purposes of these researches are prisoners to society in the penitentiary of Klas IIA Padang and the obstacles faced in the assimilation program of prisoner to society in the penitentiary of Klas IIA Padang? Third, how is the effective of assimilation program in the preparation of integration of prisoners to society in the penitentiary of Klas IIA Padang. The specification of the research is descriptive analytic. The method uses is the normative and juridical empiric method. From the research results obtained several conclusions: First, the effectiveness of assimilation in the preparation of integration of prisoners to society in the penitentiary of Klas IIA Padang is well and suitable with the law regulation. it is reflected by penitentiary by giving guidance and establishment of prisoner. Second, the obstacles faced in the assimilation program of prisoner to society in the penitentiary of Klas IIA Padang are internal and external obstacles. The internal consist of (a) lack of fund; (b) no expert who has experience; (c) no cooperation to third person. Whereas, the external obstacles are: (a) infectivity of law regulation; (b) the bad society views to the prisoners; and (c) long process to get permission. The efforts to solve the problems are: (a) Looking of alternative to strength law procedural; (b) adding fund and selling product; (c) preparation of alternative expert; (d) cooperate with outside; (e) adding of fund; (f) looking alternative and selling product; and (g) doing social activities.

Pertanggungjawaban Pidana Anak Sebagai Pelaku Tindak Pidana Kekerasan Seksual 对性侵犯儿童罪的指控

Crime against child perpetrators in Indonesia is getting more and more worrying from time to time. One of the most common crimes committed by children and their victims are children is sexual abuse. One of the triggers for the emergence of sexual abuse by children with child victims is the proliferation of pornographic sites on the internet that can be easily accessed by children via mobile phones or the internet due to technological advances. Technological progress has a positive impact because it makes it easier for humans to fulfill their needs but also has a negative impact if it is misused. The type of research used in this research is normative legal research. The main data in this study are secondary data, namely data or information from the review of similar research documents that have been done before, library materials such as books, literature, newspapers, magazines, journals or archives that are in accordance with the research to be discussed. The data analysis in this study was qualitative, which was based on the relevance of the data to the problem, not based on the amount of data (quantitative). Based on the results of research that in Law no. 23 of 2002 concerning Child Protection as amended by Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection also provides regulated child protection. Strictly speaking Article 15 of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection states that: "Every child has the right to obtain protection" from abuse in political activities, involvement in armed disputes, involvement in riots social, involvement in events that contain elements of violence, involvement in war and sexual crimes. The law requires the punishment of children who are perpetrators of criminal acts in the severe category which are punishable by more than 7 years of imprisonment and if the child's age has reached 14 (fourteen) years. Whereas in Indonesia itself, with the issuance of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, applying the concept of diversion and restorative justice as a form of solving the problem of criminal acts committed by children as perpetrators and making sentencing as an ultimum remidium or last resort used when not achieving the right solution through these two concepts.

Pertanggungjawaban Pidana Terhadap Ujaran Kebencian Melalui Transaksi Elektronik 通过电子交易对仇恨言论的刑事责任

Media sosial merupakan sebuah mediainformasi online yang merupakan saran hubunganmanusia yang tidak terbatas ruang dan waktu, dimana penggunanya dapat berbagi lewat media internet, bergabung, berpartisipasi, serta membuat konten berupa youtube, media sosial, blog dan lain sebagainya.  Internet atau jejaring sosial serta media sosial dan teknologi informasi sudah mejadi satu kesatuan yang tidak dapat dipisahkan yang membuat munculnya hal baru dalam kehidupan seperti saaat ini. Jenis penelitian yang dipergunakan dalam penelitian ini adalah penelitian hukum normatif. Data pokok dalam penelitian ini adalah data sekunder, yaitu data atau informasi hasil penelaahan dokumen penelitian serupa pernah dilakukan sebelumnya, bahan kepustakaan seperti buku-buku, literatur, koran, majalah, jurnal ataupun arsip-arsip yang sesuai dengan penelitian yang akan di bahas. Analisis data dalam penelitian ini menggunakan secara kualitatif, yaitu didasarkan pada relevansi data dengan permasalahan, bukan berdasarkan banyaknya data (kuantitatif). Ketentuan yang telah diatur di dalam Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang No. 11 tahun 2008 tentang Informasi dan transaksi Elektronik sudah menjelaskan mengenai batasan dan hal apa saja yang boleh dan tidak boleh dilakukan seseorang dalam bermedia social. Pelanggaran hukum terkait ujaran kebencian di dunia maya sangat marak sekali dilakukan oleh masyarakat terbukti dari data yang diperolehpenerapan dari Direktorat Tindak Pidana Siber Polri bahwa kejahatan dunia maya semakin tahun semakin meningkat. Ketentuan pidana juga telah diatur di dalam Undang-Undang Informasi dan Transaksi Elektronik, selain itu, penegakan hukum telah dilaksanakan secara maksimal dengan melibatkan tim khusus siber Polri guna meminimalisir kejahatan dunia maya terkait dengan ujaran kebencian. Para pelaku ujaran kebencian wajib mempertanggungjawabkan perbuatannya di muka hukum. Pertanggungjawaban pidana telah diatur secara terperinci di dalam undang-undang. Hal yang mendasar adalah perbuatan ujaran kebencian merupakan perbuatan kejahatan di dunia maya yang menimbulkan dampak negatif. Hal ini juga telah di ataur di dalam KUHP namun aturan yang ada pada KUHP di nilai kurang lengkap dan tidak berkesesuaian dengan kondisi saat ini.

Era globalisasi memberikan dampak perkembangan yang sangat signifiikan bagi kehidupan. Perkembangan masa ini tidak terlepas dari berkembang dan bertambahnya tindak kejahatan yang salah satunya disebabkan oleh faktor ekonomi. Kemajuan dan pelaksanaan di segala bidang meliputi sosial, politik, ekonomi dan budaya membawa dampak negatif berupa peningkatan kualitas dan kuantitas berbagai macam kejahatan yang merugikan dan meresahkan masyarakat. Situasi pada saat ini tidak dapat dipungkiri bahwa dalam upaya pemenuhan kebutuhan ekonomi tidak sedikit masyarakat di negara ini maupun di negara berkembang lainnya mengalami kesulitan, hal ini disebabkan karena begitu sulitnya mendapatkan pekerjaan  yang layak. Hal tersebut berakibat kepada beberapa kelompok masyarakat  menggunakan cara pintas seperti melakukan tindak pidana pencurian dengan kekerasan dan pemberatan guna memenuhi kebutuhan hidupnya. Pengaturan hukum  terhadap hak menuntut ganti rugi bagi korban pencurian dengan kekerasan terdapat dalam Kitab Undang-Undang Hukum Acara Pidana dapat dijumpai dalam UU No. 8 Tahun 1981 (LN Tahun 1981 No. 76), dalam Pasal 99-100 serta Pasal lainnya yang terakit ganti rugi dalam KUHP dan Undang-Undang No. 14 Tahun 1970 tentang Pokok-Pokok Kekuasaan Kehakiman. Tindak pidana yang dilakukan dengan kekerasan meurut KUHP Tindak pidana pencurian dengan kekerasan merupakan suatu perbuatan yang menyimpang. Berdasarkan rumusan Pasal 362-363 KUHP maka unsur objektif dan subjektif, Unsur objektif berupa perbuatan mengambil (wegnemen). Unsur subjektif terdiri dari 2 (dua) unsur, yaitu unsur maksud (kesengajaan sebagai maksud atau opzet als oogmerk) berupa unsur kesalahan dalam pencurian dan unsur memiliki. Pencurian dengan pemberatan atau pencurian dengan kualifikasi diatur dalam Pasal 363 dan 365 KUHP. Prosedur permohonan ganti rugi bagi korban pencurian dengan kekerrasan ialah dengan melakukan penggabunngan gugatan dengan ganti rugi, gugatan atas perbutan melawan hukum dan permohonan restitusi

Perkembangan lingkungan strategis yang diiringi dengan maraknya isu globalisasi selain berdampak positif terhadap kehidupan masyarakat, juga telah membawa dampak  yang besar terhadap situasi kamtibmas. Dimana perkembangan tersebut seharusnya menjadikan tatanan masyarakat semakin maju dan berkembang serta terjaminnya keamanan dan ketertiban masyarakat, akan tetapi yang terjadi sebaliknya yaitu memunculkan berbagai gerakan-gerakan ekstrim dan radikal berbasis sosial dan keagamaan yang mengarah kepada bentuk dan tindakan yang tidak sejalan dengan nilai-nilai pancasila berupa aksi kekerasan, teror dan bentuk-bentuk gangguan lainnya yang mengakibatkan terganggunya siuasi kamtibmas yang kondusif. Penanggulangan radikalisme diarahkan untuk mengembangkan potensi dan kekuatan dalam menangkal, mencegah dan menanggulangi segala bentuk pelanggaran hukum dan bentuk-bentuk gangguan lainnya yang dapat meresahkan masyarakat dengan sasaran perioritas untuk dilaksanakan yang dilakukan secara profesional dan proporsional untuk terwujudnya daya cegah dan daya tangkal terhadap gangguan Kamtibmas yang berkadar tinggi yakni radikalisme dan intoleransi. Metode penelitian yang digunakan dalam penelitian tesis ini terdiri dari spesifikasi penelitian, sumber data, teknik pengumpulan data dan analisis data. Jenis penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang mempergunakan sumber data sekunder yang penekanannya pada teoritis dan analisis kualitatif yang juga disebut sebagai penelitian perpustakaan atau studi dokumen. Pemberlakuan Peraturan Presiden (Perpres) Nomor 7 Tahun 2021 tentang Rencana Aksi Nasional Pencegahan dan Penanggulangan Ekstrimisme Berbasis Kekerasan yang Mengarah pada Terorisme tidak diikuti dengan penjelasan secara rinci perihal kegiatan apa saja yang masuk kategori ekstrimisme sehingga terjadinya multi tafsir dan memunculkan stigmatisasi di masyarakat. Hal ini tentunya berimpilkasi terhapap upaya yang dilakukan oleh Polri khususnya Satbrimob dalam penanggulangan aksi radikalsime. Satbrimob Polda Sumatera Utara sesuai dengan tugas dan fungsinya dalam penanggulangan aksi radikalisme adalah  melaksanakan patroli kemitraan di setiap daerah rawan penyebaran dan kegiatan kelompok-kelompok radikal yang menjadi lingkup tugas dimasing-masing Batalyon sebagai salah satu implementasi program Quick Wins Renstra dan transformasi menuju Polri yang PRESISI yaitu “penertiban dan penegakkan hukum bagi organisasi radikaldan anti pancasila

Pemberian Bantuan Hukum Terhadap Aparatur Sipil Negara di Kota Pekanbaru 在北干巴鲁向民政部门提供法律援助

The purpose of the establishment of the government is to provide the best service in the context of meeting the needs of the community, to realize this a professional, responsible, honest and fair state civil apparatus is needed. In carrying out their duties and responsibilities, the state civil apparatus always deals with state administrative affairs, but not all state civil servants have the ability to understand the administrative competence and authority they have, so that it often leads to legal problems, when a state civil apparatus faces legal problems when carrying out its duties. In its duties, the state must be present to provide guarantees of legal protection by taking into account the presumption of innocence. The provision of legal assistance to state civil servants in Pekanbaru City who are involved in legal problems has not been implemented as stipulated in Law Number 5 of 2014 concerning State Civil Apparatus, this is because the Pekanbaru City Government does not have regulations and strategic plans in providing assistance law against the state civil apparatus so that it is necessary to accelerate and assist in accelerating the preparation and making of regulations in the context of providing legal assistance to the state civil apparatus in Pekanbaru City.

The police shoots on the spot against Criminals in the Effort of Criminal Law Enforcement is the last step, however after close attention, the term "shoot on the spot" is not explicitly found in the laws governing the Police. So that research is carried out in the form of a thesis with the following objectives: 1) understanding and analyzing the shooting arrangements carried out by members of the police against criminals in the effort to enforce criminal law according to Indonesian legislation; 2) understand and analyze the legal protection of police officers who shoot on the spot in law enforcement and the exercise of the authority to fire on the spot can avoid acts of abuse and arrogance of power by members of the National Police. The research method used is normative juridical research. Based on the results of the research: 1) Arrangement of shooting at the spot by members of the police against criminals in an effort to enforce criminal law is a right of discretion based on statutory regulations, namely the Criminal Code, Law Number 2 of 2002 concerning the State Police. Republic of Indonesia, Law Number 39 of 1999 concerning Human Rights, Regulation of the Head of the Republic of Indonesia Police Number 1 of 2009 concerning the Use of Force in Police Actions, Regulation of the Chief of Police of the Republic of Indonesia Number 8 of 2009 concerning Implementation of Human Rights Principles and Standards in the Implementation of Republican Police Duties Indonesia. 2) Legal protection for police officers who shoot on the spot in law enforcement and exercising the authority to fire on the spot can avoid acts of abuse and arrogance of power by members of the National Police, namely avoiding police members from acting contrary to human rights, and not only based on discretionary rights. which is owned by the Police but is given a special legal umbrella in the execution of shooting on the spot against criminals who violate the SOPs in law enforcement at the police level in creating ready-to-use Police members who have motivation, dedication, and skills in carrying out their duties, can distinguish which ones become authority and rights in taking action, as well as creating Police who cling to TRI BRATA and CATUR PRASTYA as life guidelines and guidelines

PEGEKAN HUKUM TERHADAP TAMBANG MINYAK ILEGAL DI WILAYAH HUKUM POLDA JAMBI 这是一项针对JAMBI县非法石油开采的法律

Banyaknya   sumber  minyak  yang  ada  di Kabupaten Batang Hari  sehingga  berpotensi  timbulnya  Illegal drilling  yakni aktivitas penambangan minyak yang dilakukan secara ilegal dengan mengeksplorasi dan mengolah minyak dari sumur tua maupun  membuat sumur baru tanpa izin. Setidaknya terdapat 3000  (tiga ribu) titik sumur ilegal yang ironisnya telah masuk ke dalam kawasan hutan lindung dan hutan restorasi yang dilindungi oleh negara.  Undang-Undang  Nomor  22  Tahun  2001  tentang  Minyak  dan  Gas  Bumi,melarang dilakukanya penambangan minyak secara illegal hal ini sebagaimana  diatur  dalam Pasal 52. “Setiap orang yang melakukan Eksplorasi dan/atau Eksploitasi tanpa mempunyai Kontrak Kerja Sama sebagaimana dimaksud dalam Pasal 11 ayat (1) dipidana dengan pidana penjara paling lama 6 (enam) tahun dan denda paling tinggi Rp.60.000.000.000,00 (enam puluh miliar rupiah).  Penegakan  hukum  terhadap  pelaku  Tindak Pidana penambangan  minyak  diwilayah hukum Polda  Jambi  khususnya  yang terjadi di Batang Hari,  kurun  waktu  3 (tiga)  tahun  terakhir  ini  yakni tahun  2018 s/d 2020 telah  dilakukan  dimana  ada 16. Permasalahan    yang  ditemui  oleh Kepolisian Daerah   Jambi  antara   lain, Masalah  penegakan hukum, masih terbatas, sarana  atau fasilitas yang  mendukung penegakan hukum masih kuran,  dilihat  dari  faktor masyarakat  dan budaya Masyarakat, dimana penambang minyak ilegal  sudah menjadi kebiasaan masyarakat, sehingga  sulit untuk  di cegah

PERTANGGUNGJAWABAN PIDANA TERHADAP PELAKU PENGANGKUTAN KAYU TANPA DOKUMEN SAH DI WILAYAH HUTAN TAMAN NASIONAL BUKIT TIGA PULUH KABUPATEN TEBO

Marriage is an inner and outer bond between men and women that is entwined in a domestic relationship to create a household that is sakinah mawaddah warahmah. One of the condotiont that must be obeyed in the implementation of a marriage regulated by law is that the bride and groom must be of legal age. Every marriage that has not meet the marriage age limit, is essentially called a underage marriage is affirmed in article 7 of law Number 1 of 1974 and article 1 paragraph (1) of Law Number 23 of 2002 Concerning Child Protecdtion, that is child someone who is not yet 18 years old and is a pruning of the freedom of chldren’s rights in obtaining the rights to life as a teenager who has the potential to grow, develop and potentially positively according to what is outlined in religion. The problems discussed in this thesis are the intercourse of minors in marital relations and the effects arising from such marriages, because in fiqih view no punishman is given for this action. However, if viewed from the perspective of national law, underage marriages have violated several law and regulations. The factors that influence it’s  effectiveness are the subtance of the law Article 332 of the Criminal Code, Law Number 16 of 2019 and Law Number 23 of 2002. The conclusion of this thesis is that the aplication of sanctions against underage run away women in marriage in Tanjung Jabung Timur Regency has never been applied because the are no reports from the victims althought the criminal law regulates sanctions againts the perpetrators because it has caused harm to the victims (women).
