espanolLa doctrina del control de convencionalidad era practicamente ajena al sistema juridico espanol. Sin embargo, en la STC 140/2018, de 20 de diciembre, el Tribunal Constitucional ha declarado expresamente que este mecanismo en Espana constituye una regla de seleccion de Derecho aplicable, a cargo de la jurisdiccion ordinaria. El articulo analiza los antecedentes del control de convencionalidad en el Derecho comparado –con especial enfasis en la jurisprudencia de la Corte Interamericana de Derechos Humanos– y los problemas que esta nueva doctrina constitucional genera en la aplicacion del Derecho internacional de los derechos humanos en el Derecho espanol. However, in STC 140/2018, of 20 December 2018, the Constitutional Court of Spain construed that this mechanism is within the powers of Ordinary Judges and constitutes a rule of selection of applicable law. The article analyzes the meaning of the Conventionality Control doctrine from a Comparative law perspective, as well as its scope within the Inter-American Court of Human Rights. It also highlights some concerns regarding the implementation of the mechanism vis a vis the enforcement of International Human Rights Law in the Spanish legal system.

El avance mas significativo es que dota de un nuevo estatus juridico a los acuerdos resultantes de mediacion comercial internacional, que pasan a tener fuerza ejecutiva directa en todos los Estados que ratifiquen la Convencion. En este contexto, el objetivo del presente trabajo es analizar las cuestiones clave de la Convencion de Singapur, destacando sus luces y sus sombras, y valorar que repercusiones tendria en el ordenamiento juridico espanol la adhesion a dicho instrumento normativo. EnglishThe Singapore Convention on International Settlement Agreements resulting from mediation represents a milestone in the determined promotion of this dispute resolution mechanism and puts an end to the absence of a harmonized legal framework to regulate this issue. The most significant advance is that it gives a new legal status to the agreements resulting from international commercial mediation, which become directly enforceable in all the States that ratify the Convention. In this context, the objective of this work is to analyze the key issues of the Singapore Convention, highlighting its lights and shadows, and assess what repercussions the adherence to said normative instrument would have on the Spanish legal system.

Por una parte, el proceso en marcha de adhesion de Serbia a la UE, con las interferencias que en el mismo suscita el ascenso de Pekin como potencia global, con su ambicioso proyecto de la Nueva Ruta de la Seda, en especial en los Balcanes Occidentales y, sobre todo en los WB6, escenario natural de ampliacion de la UE. Por la otra, la creciente influencia de China en Serbia, que puede condicionar el futuro de este pais como Estado miembro y, por ende, la politica de ampliacion de la UE en la region. EnglishThe aim of this study is to analyse the relations between Serbia, China and the EU. Such relations had to be seen in the double context: On the one hand Serbia's accession running process, with the interferences on it of China as global rising power. Beijing, with its ambitious New Silk Road project, erupt as an agent in Europe, specially in Western Balkans and quite particularly in Western Balkans 6 (next UE´s enlargement area). On the other hand, China's influence on Serbia could determine the future as a Member State of the EU as well as EU enlargement policy in the region.

En este contexto, es necesario analizar las acciones que pueden llevar a cabo los Estados en los espacios maritimos contra estos grupos. A este respecto, la CNUDM, como marco legal de referencia en materia de seguridad maritima, atribuye competencias de ejecucion a los Estados para interceptar, dentro de ciertos limites, buques sospechosos de dedicarse a actividades ilicitas. Pero este marco juridico adolece de importantes carencias restan eficacia a la accion del Estado en el mar y alientan las actividades de estos grupos delictivos. Estas carencias se ponen en evidencia mas claramente cuando los agentes estatales deben adoptar medidas coactivas, incluido el uso de la fuerza en los casos mas extremos, ante un barco se resiste al apresamiento, pues la CNUDM no ofrece ninguna orientacion al respecto. Ante esta situacion, que ha sido paliada parcialmente por otros tratados internacionales, es importante que los Estados regulen de forma precisa el ejercicio de estos poderes de policia en el mar, asi como las medidas que pueden adoptar en cada caso, para evitar incurrir en abusos o arbitrariedades. EnglishThe expansion of transnational criminal organizations across the seas and oceans has become one of the main threats to maritime security. In this context, it is necessary to analyse the actions that States can carry out against these groups in maritime zones. In this regard, the UNCLOS, as a legal framework of reference in matters of maritime security, attributes enforcement jurisdiction to States to intercept, within certain limits, vessels suspected of engaging in illicit activities. But this legal framework suffers from important shortcomings that reduce the effectiveness of the State's action at sea and encourage the activities of these criminal groups. These shortcomings are most clear when state agents must adopt coercive measures, including the use of force in the most extreme cases, when the ship resists seizure, as the UNCLOS does not offer any guidance in this regard. In this situation, which has been partially mitigated by other international treaties, it is important that States precisely regulate the exercise of these police powers at sea, as well as the measures they can adopt in each case, to avoid incurring abuses or arbitrariness.

De entre los multiples problemas que se han planteado, sobresale el de los derechos de circulacion y residencia de los ciudadanos afectados y sus familiares. A pesar de que, en adelante, los nacionales del RU dejan de ser ciudadanos de la Union, y de que los ciudadanos de la UE ya no podran ejercer los derechos derivados de dicha ciudadania en el territorio de un Estado que ya no es miembro de la UE, la Segunda Parte del Acuerdo de Retirada permite una conservacion parcial del statu quo anterior, en beneficio de los ciudadanos que en el momento de finalizar el periodo transitorio se encontraran en una situacion amparada por la reglas de libre circulacion y pretendieran seguir residiendo o trabajando en el Estado de acogida. El Acuerdo es un instrumento de Derecho transitorio de cierta complejidad, y este trabajo analiza su contexto, sus principios y criterios de aplicabilidad y los derechos que confiere. EnglishThe withdrawal of the United Kingdom from the EU is an important political and legal challenge. Among the many issues it has raised, those related to mobility and residence of citizens and their families are of utmost importance. Even though UK nationals are no longer Union citizens, and Union citizens will not be able to exercise any more the rights related to EU citizenship in the territory of a State that is no longer a member of the Union, the second part of the withdrawal agreement allows to maintain, in part, the former statu quo for those citizens which, at the end of the transition period, find themselves in a situation covered by EU rules on the free movement of persons and intend to keep it afterwards. The withdrawal agreement is a rather complex instrument of transitional law, and this paper intends to analyse its context, principles, applicability criteria and the rights it bestows.
