This paper is focused on the organization of parental responsibility after family breakdown and on its consequences for the offspring, and especially on joint custody. Therapeutic jurisprudence (TJ) is presented as an appropriate paradigm to guide the modification of laws, judicial proceedings, and the performance of practitioners conducting the cases, as it facilitates that family breakdown management leads to a positive parental co-responsibility that is centered on children's well-being.

The study analyzes the differences in the way violent behavior is perceived by young offenders and innocents. The sample includes 418 teenagers between the ages of 13 and 17 who live in Madrid: 57.4% had “in the last 12 months attacked one or more individuals from another group” (dependent variable). The independent variables measured four factors related to group violent behavior: general assessment, consequences, the degree to which the individual is affected, and perception of the main endogroup. Seven main hypotheses were proposed that were compared with empirical data through the Student's t-test for differences in means. The results could facilitate the development of preventative programs based on the evidence of risk factors and protective factors.

A sample of 1,035 adolescents from El Salvador, Mexico, and Spain, with a mean age of 17 years, participated in the study of the psychometric characteristics of the EPQ-A (Eysenck Personality Questionnaire, form A). EPQ-A internal consistency was calculated through Chronbach's reliability coefficient, with an alpha = .810 for the neuroticism dimension (N), .678 for the extraversion dimension (E), and .702 for the psychoticism dimension (P). As for validity, the factorial structure found explains a high percentage of variance (34.26%); convergent validity was studied by means of correlations between EPQ-A and sociodemographics, criminological information, and other personality scales. Scales were determined for the first time ever in a sample of Spanish-speaking adolescents from three countries. The results suggest that the EPQ-A is a valid and reliable personality inventory in a Spanish-speaking population.

The present study analyzes protective order (PO) violation characteristics in men who had previously been convicted of an offense of intimate partner violence. One hundred and thirty-one condemnatory sentences relating to 80 aggressors are analyzed. Different types of harassment (telephone, domiciliary, going to public places frequented by the victim, etc.) were identified. These behaviors were grouped into three categories: manipulation and seeking reconciliation afterwards, control, monitoring and surveillance, and violence against the victim. The death threats to the victim or people close had occurred in 31.3% and 48% of aggressors who came back to living with his former partner assaulted her again. In conclusion, the OP does not guarantee the ending of abuse or harassment and women who return to her relationship with her ex-partner aggressor are at risk of being re-victimized. The implications for research and clinical practice are discussed.

This study falls under the Legal Psychology framework. Within this area, one of the aspects that raises interest is criminal profiling. The ENCUIST model is proposed as the personality model for the realization of the indirect profile of personality, with the inclusion of the variables of extroversion/sensation seeking, neuroticism (anxiety, anger, and disgust), callous unemotional, impulsivity/aggression, and need for cognition. The application of structural equation models analyzes both the direct and indirect influence of these variables on Gray's model (BIS/BAS). The sample consists of 737 subjects to whom the ENCUIST personality test is applied to evaluate the traits mentioned. The results of the research are discussed below.

The present study takes as a reference the change of Law 15/2005 in the Spanish Civil Code where the concept of shared custody was first introduced in Spain. The objective of this study is to check if a relationship exists between the results of investigations with an empirical base and the judicial decision when considering the effects that shared custody produces in children. With that objective in mind we carried out a qualitative analysis of the investigations related to joint custody consequences, both at national and international level. Then, after carrying out an analysis of the jurisprudence of the Spanish Supreme Court from 2005 to 2015, we compared the results of the investigations with judges’ decisions.

This study deals with the development of a forensic version (EGS-F) of the Posttraumatic Stress Disorder (PTSD) Symptom Severity Scale according to DSM-5 criteria. The aim of this paper is intended to assess the symptoms severity of this mental disorder, as well as to detect probable malingering and symptom exaggeration among victims of gender violence in a forensic context. The sample consisted of 526 victims of sexual or family violence who sought therapy and 74 victims of the same kind who filed a complaint in court. Symptom severity was higher in victims assessed in the forensic context than in victims assessed in the clinical context. Items designed to detect probable malingering adequately discriminated between the two groups (t = 7.3, g = 0.97). A cut-off point of 2 in the subscale of malingering is appropriate to correctly classify the 74% of probable malingerers. This scale is useful for forensic assessment in victims of PTSD.

The sample was made up of 251 adults living in Spain, 28% of them were native and 72% immigrants (Latin America and Africa) of both sexes, aged 18 to 65. Eleven per cent of participants reported some form of intimate partner violence (physical, psychological, and sexual) and 9% of participants were cases of bidirectional violence whereas 2% were cases of unidirectional violence. In general, males and immigrants showed higher scores in different types of sexism, whereas women and natives showed lower scores.
