This research has two problem formulations, First, how the Constitutional Court's construction in giving consideration to "open legal policy"; Second, what is the urgency of the Constitutional Court's reconstruction in giving consideration to"open legal policy"? This research uses a normative juridical study using the statutory and conceptual approach. The results of this study are: First, that is a lack of clarity and consistency from the Constitutional Court in determining benchmarks for open legal policy considerations. Second, there are new concept been proposed: a) applying the doctrine of "political question"; b) The Constitutional Court still tests a norm based on formal and substantial requirements. The advice given is that Constitutional Court should take a position in accordance with the reconstruction proposed in this study.

Dalam pelaksanaannya, pemilihan umum sering dijumpai dengan berbagai pelanggaran bahkan tindak pidana di dalamnya, oleh karena itu legislator memuat ketentuan tindak pidana pemilu di dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu. Dengan diaturnya ketentuan tindak pidana dalam pemilu, hal ini menunjukkan bahwa legislator menganggap bahwa pemilihan umum merupakan hal yang sangat penting dalam kehidupan demokrasi di Indonesia, sehingga pemilihan umum wajib diupayakan untuk terlaksana secara bersih dari tindak pidana. Alih-alih menjaga prinsip kedaulatan rakyat, di dalam Undang-Undang Pemilu terdapat ketentuan tindak pidana pemilu yang justru berpotensi mereduksi nilai-nilai prinsip kedaulatan rakyat itu sendiri. Seperti dijumpai pada Pasal 509 terkait larangan pengumuman hasil survei atau jajak pendapat di masa tenang. Berdasarkan hal itu maka peneliti tertarik segera mengidentifikasi dan menganalisis ketentuan tindak pidana pemilu tersebut dalam perspektif prinsip kedaulatan rakyat di Indonesia. Penelitian ini mengkaji dengan metode penelitian yuridis normatif (legal research) yang bersifat deskriptif, menjabarkan penelitian secara kualitatif untuk menjawab permasalahan ketentuan tindak pidana pemilu yang dimuat dalam Undang-Undang Pemilu dilihat dari perspektif prinsip kedaulatan rakyat. Hasil dari penelitian ini adalah ketentuan terkait pengumuman survei atau jajak pendapat di masa tenang dalam perspektif prinsip kedaulatan rakyat merupakan suatu ketentuan yang mereduksi perkembangan demokrasi di Indonesia, karena membatasi kebebasan masyarakat dalam mendapatkan dan menyebarkan informasi terlebih dengan menggunakan metodologi ilmiah. Some cases of financial business transactions practices in Indonesia had caused financial damages were suffered by the consumers. Eventhough Indonesia had well regulated the protection of financial service cunsumers, in practices of dispute settlement oftently the concumers could not got fair solutions, so their rights could not be well fullfiled. The problem in this research was studied by a normative legal research, the data were analyzed by qualitative and comparative methods, and the conclusion was done by deductive method. From the analyzed data, it could be concluded that the effectiveness of the consumers protection in the sector of financial services business regulation in Indonesia was not high due to some reasons, such as, the weakness of the law enforcement, the OJK had not been pro-active in giving protection to the financial service consumers and the problem of legal culture of the Indonesian society.

Bilyet giro is a payment instrument that use for a non cash payment. It’s a payment order for the bank to transfer a money form drawer‘s giro account to receiver’s giro account. Bilyet giro users know term the empty of bilyet giro, that is a bilyet giro that has been rejected by bank so bank don’t take order from bilyet giro. Someone that draw it, also known as defaulting party in civil law. Society development make the empty of bilyet giro become a criminal acts of fraud, through KUHP article 378. This research gaols is to find out, is it possible for that case that related to a civil law can be implement with a criminal acts of fraud. Analysis method in this research used a qualitive method that analyzing obtained data and conclude them with deductive way that relate to how to implement a criminal acts of fraud this case. This study aims to know and analyze and examine the realization of good governance principles in fisheries management regulation in Indonesia; analyze and formulate the ideal fisheries management regulation model in accordance with the concept of good governance.This research is normative juridical research, which is research that puts law as a building of norm system, consisting of principles, norms, rule of law, judgment, agreement, and doctrine. The approach used in this normative legal research is the statute approach and the conceptual approach. The data obtained were analyzed by qualitative method. Based on data analysis, it can be concluded that 1) Realization of 8 Main Characteristics of good governance according to UNESCAP are participation, orientation on consensus, accountable, transparent, responsive, effective and efficient, fair and inclusive and follow the rule of law in law, and efficient that cannot be applied; 2) The ideal fisheries management model in accordance with the principle of good governance is a co-management model, because this model use community empowerment and involve all stakeholders as well.

AbstractThe general election is a means of implementing the people's sovereignty to elect people who will occupy the seat of government. This general election was held to realize a democratic country, where the leaders were chosen based on the majority of votes. Countries that adhere to democracy generally accommodate the political rights of their citizens in an election, whether they are direct or indirect. Basically everyone has the right to participate in government in other words everyone has the right to be elected or elected. Regarding to Election Commission Regulation Number 20 Year 2018 regarding the Nomination of Members of The House Representatives, Assembly at Provincial and Assembly at Regional, there is one requirement for legislative candidate became controversial because there is a prohibition on ex-prisoners of corruption, drugs (as a dealer), and sexual crimes against children to be the Nomination of Members of The House Representatives, Assembly at Provincial and Assembly at Regional. Some ex-convicts already did judicial review, therefore we need to understand the legality of the regulation for ex-convicts regarding to election.Key Words: Human Rights, Right to Participate in Government, Ex-convictAbstrakPemilihan umum adalah adalah sarana pelaksanaan kedaulatan rakyat untuk memilih orang-orang yang akan menduduki kursi pemerintahan. Pemilihan umum ini diadakan untuk mewujudkan negara yang demokrasi, di mana para pemimpinnya dipilih berdasarkan suara mayoritas terbanyak. Negara-negara yang menganut demokrasi, pada umumnya mengakomodir hak politik warga negaranya dalam suatu penyelenggaraan pemilihan umum, baik itu bersifat langsung maupun tidak langsung. Pada dasarnya setiap orang memiliki hak untuk berpartisipasi dalam pemerintahan dengan kata lain setiap orang memiliki hak untuk dipilih maupun memilih. Peraturan KPU Nomor 20 Tahun 2018 tentang Pencalonan Anggota DPR, DPRD Provinsi dan DPRD Kabupaten/Kota memberikan batasan satu syarat bagi calon anggota legislatif yang menjadi kontroversi karena adanya larangan bagi mantan narapidana korupsi, narkoba (sebagai bandar), dan kejahatan seksual terhadap anak untuk mencalonkan diri sebagai anggota DPR, DPRD Provinsi dan DPRD Kabupaten/Kota. Beberapa pihak yang merasa dirugikan oleh peraturan tersebut mengajukan judicial review, oleh karena itu, patut dikaji bagaimana legalitas hak yang dimiliki oleh mantan narapidana dalam pemilihan umum.Kata Kunci: Hak Asasi Manusia, Hak untuk Turut Serta dalam Pemerintahan, Mantan Narapidana.
