Good Faith in Construction Contract: A Common Law Perspective 建筑合同中的诚信:普通法视角

The good faith principle requires contracting parties to be honest as well as consideringtheir contracting partners in performing their contractual duties. In the event, contract clauses are insufficient to protect the interests of the innocent party in a breached contract, the said innocent party may rely on the good faith principle to ensure the fair. However, applying good faith principles to construction contracts is a difficult task. By nature, construction contracts are unique due to the fact that parties (Client and Contractor) are presumed competent to carry out their parts of the contractual obligations. Controversially, the construction contract is often unfairly prejudicial as the Client would customarily have the upper hand in deciding the terms and conditions of a contract. It is the objective of the research to examine the relevancy of application of good faith principle in construction contractsby employingqualitative content analysis. This study adopts a qualitative research approach, mainly employing library and internet resources with the intention to explore relevant legislation, textbooks, journals, research papers and articles.The comparative approach in this paper used content analysis from primary and secondary legal resources of different jurisdictions in the United Kingdom, Malaysia and Australia to compare the application of the good faith principle in the context of construction contracts. The findings of the research revealsthat the adoption and application of the good faith principle in construction contracts is of limited usage even though it is widely usedin general contract law of United Kingdom, Malaysia and Australia.This article contributes to the knowledge of the good faith principle in construction contracts, particularly with standard form contracts, by highlighting the importance of the good faith principle in achieving a fairer functioning of construction contracts in its application.

Cloud Computing Adoption Factors Affecting Academic Performance in UAE Public Universities 云计算采用影响阿联酋公立大学学业成绩的因素

Cloud computing helps in reducing costs and providing accessibility, reliability, and flexibility especially in educational sector. This able to provide the best educational resources and facilities to all level of students effectively and efficiently. It also seen as a creative technological innovation that provides stableand on-demand access to the available network. Hence, this study aimed to measure the cloud computing adoption factors affecting the academic performance in UAE university. The factors are clustered into five groups namely, knowledge sharing; knowledge application; learnability; perceived self-efficacy; and perceived enjoyment. A questionnaire survey was conducted with the university students to gauge their opinions on the level of significant of each factor affecting the academic performance using 5-points Likert scale. Out of 400 questionnaire sets distributed using random sampling, 382 valid responses were extracted as the collected data. This data was analysed descriptively. The results of the analysis found that that cloud computing adoption factors inperceived self-efficacy group are ranked first in term of its significance in affecting academic performance. The second rank is factors in learnability group; the third is perceived enjoyment; the fourth rank is knowledge application and finally, the fifth rank is knowledge sharing. The impact of this research will be felt simultaneously in the IT and education sectors, particularly through assisting students in utilising cloud computing to store and exchange information for both their academic and personal lives.

Tourists' Perspectives on Condition of Heritage Buildingsand Resiliency of the Heritage Tourism Industry in Melaka 游客对马六甲遗产建筑状况和遗产旅游业弹性的看法

Heritage buildings have been seen as an asset that needs to be maintained not only for the sake of history and culture but also as a legacy for future generations. In Melaka, heritage buildings have become a source of pride forthe people of Malacca and also the main source of income for the state government through heritage tourism activities. It is important to ensure that these heritage buildings continue to recover and be free from damage so that the tourists who come have agood experience.This study is focused on the issues which were concerning the condition of heritage buildings in Malacca from the perspective of tourists. Heritage buildings around thetourist spot in Malacca were selected as locations for this study. The study adopted a questionnaire survey, that involved 211 local touristsas the respondents of the survey. The respondents were requested to gauge the conditions issue andthe resiliency of heritage buildings using 5-points Likert scale. The collected data were analysed descriptively.The results found thatthe overall average condition issue mean value is high (M = 4.05) and can be interpreted as satisfactory. This indicates that the level of satisfaction with the condition received is high. Although most respondents expressed a good experience with the condition of the heritage buildings that they had visited, there isstill room for improvements. The findings also show that all the agreement statements related to the resiliency of the heritage tourism industry in Melaka have an average score of 79%.As a result of the survey, it is important that the parties involved in heritage management follow theconservation standards, promote,and practice good integrity, especially in ensuring the originality and authenticity of materials used as well as good work procedures to ensure the future resiliency of the heritage tourism industryin Malacca.

Thermal Performance of Horizontal Fixed Sun Shading Device 卧式固定式遮阳装置的热性能

Earlier investigations on passive cooling methods applied software modelling, and the findings were not confirmed through field measurement. Hence, this study applied a stationary experiment on a real structure and weather conditions employing horizontal sun shading (SDH). The purpose of this study was to compare the performance of fixed passive sun-shading devices put on to the bare façade of three-story terrace shophouses in Malaysia. The experiment findings revealed that SDH significantly improved the internal thermal environment by lowering the average monthly indoor air temperature (Ta) by 0.98 K and the peak temperature by 2.11 K. SDH is also effective during the warmest sunny days, lowering 1.23 K on average for the day. Meanwhile, SDH reduced the temperature in the control room by 5.40 K during the warmest peak time.When it came to indoor mean radiant temperature (Tmrt), SDH performed better than the control room in the very hot peakover a month (2.38 K) and on the highest temperature of the day (7.70 K). Finally, it can be inferred that SDH worked better from late at night until early in the morning, cooling the room temperature faster. This quiescent choice is one of the best for enhancing a building's internal thermal performance while also possibly contributing to a decrease in operational energy consumption.

Monitoring of Outdoor and Indoor Air Particulate Matter (PM10) at Buildings Located in An Industrial District 某工业区建筑物室内外空气颗粒物(PM10)监测

Particulate matter (PM10) pollution has become a problem of significant impact in many countries and cities due to its dangerous effects on public health and environmental balance.The current study aims tomonitorthe indoor and outdoor PM10concentrations ofthe buildings located next to an industrialarea that releasing industrial fumes. Three buildings were selected to be investigated. Two factors were considered in the current study, including the outdoor PM10 and wind speed. Response surface methodology (RSM) design was used to identify the relationship between the outdoor and indoor PM10concentration (I/O) through the ANOVA analysis (P<0.05). The obtained results of PM10concentrations were showed an acceptable concentration (PM10.In.max= 34 μg.m-3, PM10.Out.max= 77 μg.m-3) compared to the Malaysian standard of Practice (DOSH) and RMAAQG (150 μg.m-3) for the selected areas. The investigation was showed a relationship between PM10.in, PM10.out, and the wind speed with a significant ANOVA factor (P < 0.05). The study findings are considered a knowledge contribution of the PM10concentrations on the relationship of indoor and outdoor air quality for building surrounded by factories.

Developing a sustainable co-curricular syllabus incorporating competency elements across all three learning domains -cognitive, psychomotor, and affective is challenging. However, this paper focuses on the affective domain, crucial in shaping students' personalities and forming positive values. The study presented here aims to identify the competency elements required for the affective domain in developing the co-curricular Silat syllabus. Thisstudy employed a qualitative research method and gathered data through interview sessions with six Silat experts from PESAKA Malaysia. The experts were asked open-ended questions to guide their opinions on the competency elements in the affective domain. The interview sessions were conducted in an organised workshop where the experts were briefed on the purpose of the interview. The information revealed by the experts was recorded, transformed into transcripts, and analysed using the thematic method. The study's findings revealed that the competency elements required for the affective domain in the co-curricular Silat syllabus are good values, civility, athletic abilities, respect, and morality. These elements are vital in the affective learning domains that shape the personality and competencyof the students in their co-curricular subjects. Theidentified competency elements for the affective domain in the co-curricular Silat syllabuswill aid in shaping students' personalities, forming positive values, and improving their abilities. It is recommended that further studies be conducted to identify competency elements in the cognitive and psychomotor domains, which will contribute to developing a comprehensive and sustainable co-curricular syllabus.

Inappropriate leadership style harms employees and the organization's overall performance. Lack of leadership likely causesunethical practises, high turnover, and employee disengagement. Many of the organization's problems are attributed to incompetent or mismatched administrators. They may use an inappropriate leadership style with project subordinates. There is lack of studies on leadership styles and organisational performance, especially in oil and gas organisations. Hence, this research examines the relationship leadership styles and organisational performanceof ADNOC company. This study involved questionnairesurveyfor data collection andanalysis of 398 questionnaire forms was carried out through structuralequation modelling. Thestudy established a mediationmodelwhere the external factors act as mediator to the relationship. Based on the assessment on the model, it was found that Charismatic and Democratic leadership styles havea significant impact on organisational performance while Transformational and Transactional do not have significant effect on the organization performance. Also, external environment is proven as mediator of Charismatic and Democratic leadership styles. Overall, the developed model can assist for adopting the leadership style in achievingthe successful organizational performanceof ADNOC Company.

Effect of Palm Fiber-Hydrated Lime Composition on the Permeability of Stabilised Sandy Soil 棕榈纤维-水合石灰组分对稳定砂质土渗透性的影响

Sandy soil is one of the most conventional construction materials used as backfill materials in the retention of structures in foundations. Thisstudy to investigate the composition of admixture permeability experimental to stabilized sandy soil use the composition percentage (4, 6, & 8% hydrated lime only), sandy soil with 2% hydrated lime (0.5%, 1%, and 1.5% palm fiber) and 6% of hydrated lime (0.5%, 1% and 1.5% of palm fiber) proportionally. The results presented that the mixture of 2% and 6% hydrated lime with 0.5%, 1%, and 1.5% of palm fiber proportionally, decreased the percentage of reduction of permeability from 94.22% at 0 days to 66.67% at 7 days. The mixture of 6% of hydrated lime and 1.5% of palm fiber at 0 dan 7 curing time give a better performance. Thus, this helps in using the constant head method in Geotechnical practices.

The construction industry is a significant contributor to a country's Gross Domestic Product (GDP). However, construction projects often face many issues especially delay. It is a key contributor to project failure, leading to cost overruns and a decline in quality standards. This study aims to identify the critical factors of delay in building construction projects in Pakistan, and its controlling measures of the critical delay factors. A literature review identified 48common factors of delay in the construction industry worldwide. Based on a structured questionnaire and the average index method, 11 critical factors of delays in building construction projects in Pakistan were identified. Furthermore, a semi-structured questionnaire was used to determine 44 possible mitigation measureswhich were extracted from literature review with the 11 critical delay factors. The results of this study will be useful for stakeholders in building construction projects in Pakistan. By incorporating the recommended mitigation measures, they can identify and control the most critical factors that can cause delays in building construction projects. This study contributes to the existing literature by providing a better understanding of the factors causing delays in building construction projects in Pakistan and proposing effective measures to mitigate these factors.

The term quality of life (QoL) has been broadly used in various disciplines to describe the concept of personal well-being beyond the simple economist equation of well-being in relation to income. Quality of life is conceptualised in three aspects: (a) role functioning (difficulties in social, occupational, and interpersonal functioning), (b) life satisfaction and well-being, and (c) socio-material conditions (health cost, health care utilisation and employer cost). However, this paper presents a study that focused on the satisfactionof residents associated with crime and quality of life in theirresidential area. The studywas conducted in three states to the targeted respondents inPetaling Jaya (Selangor),Sentul(Kuala Lumpur), and Johor Bahru Selatan (Johor).The selection of these sites isbased on a high crime index from 2011 to 2020.Thus,the objective of this paper is to examine the relationship between environmental, psychological, physical, and social towards the quality of life. This research employed a quantitative approach using a random distribution of questionnaires to respondents at the residential areas that are most likely to experience high crime rates. The preliminary survey involved 51 residents as the respondents from the community. The findings of this study showed that there was a significant and positive relationship, witha medium to strong relationship between the environmental, psychological, physical and social towards the quality of life. Thus, it is hoped the findings of this study will highlight the relationship of these elements which are environmental, psychological, physical, and social towards the quality of life.
