Vatican geopolitics, political institutions and episcopal ordinations in the People's Republic of China. Reflections on State-Church Relations ABSTRACT: The agreement between the Holy See and the People's Republic of China, concluded in 2018 ad experimentum, has been extended until 31-12-2024.Relations between the Vatican and the Holy See do not follow a linear trend, due to the recurring attempts of some Chinese clergy-so-called patriot clergy-to accept appointments as Diocesan Ordinary without the mandate of the Holy See. In such cases, the relevant regulatory provisions entail excommunication latae sententiae. This contribution, analysing some historical precedents such as the struggle for the endowments and the separation of the constitutional clergy in the period of the French Revolution, proposes an interpretation of the events to understand the Holy See's attitude in the remission of the excommunication to the patriot bishops: the realisation that Catholicism was no longer a phenomenon limited to the European world. ABSTRACT: The current article analyzes the inextricable and instrumental link between intangible religious heritage and tangible religious heritage. More specifically, UNESCO’s nomination processes are examined in order to investigate the evolution and the approach of national and global institutions to intangible religious heritage. Rituals, architectural techniques of constructions and several UNESCO’s nomination dossiers of religious towns are used to shed a light on problematic aspects. Among them, we should wonder if intangible religious heritage underwent a process of political “instrumentalization”, “scientificization” and “objectivization”: which are the consequences of this institutional activity? The long road after WWII until today (1944-2023): from the reinstatement of the rights denied to Jews victim of the racist laws of fascist Italy to recovering the Memory of the Holocaust to fight against prejudice and antisemitismABSTRACT: This paper who served as a basis of the author’s speech at the official remembrance of the Holocaust at the residence of the President of the Republic of Italy (Quirinale palace) on 27 January 2023 examines the various phases of this process. First from 1944 to the mid-1980 the key element is the enactment of more that 90 pieces of legislation abrogating the antisemitic laws of 1938-45 and granting some compensation to the victims. In a second phase (until the end of the XX century) Judaism is recognized as religious entity with parity of rights as compared with the Catholic Church (the Agreement - “Intesa” - between the Italian State and the Union of Italian Jewish Communities of 1987) thus empowering Judaism in Italy to be an active and distinct contributor to Italy’s society. In that period the “Mancino law” of 1993 enacts criminal provisions to fight racism in Italy more effectively. The last phase from 2000 until to-day, witnesses, after the official recognition of the “Holocaust Remembrance Day” each 27 January (“Giorno della Memoria”) witnesses an engagement of Italian institutions to fight antisemitism through education and cultural initiatives.SOMMARIO: 1. The Messina genesis of the dual vocation of Giorgio La Pira, a scholar of Roman law and Venerable of the Catholic Church ABSTRACT: In the same Messina environment in which the religious conversion of the young La Pira grew, his vocation as a historian of Romanity was also defined as being able to gather the typical unity profile with respect for the diversity of faiths and Mediterranean cultures. Therefore, it is not surprising that Pope Francis, once the "Holy Mayor of Florence" was proclaimed Venerable, agreed with him in recognising the Mediterranean as a place of communication between different worlds. 1 - Un rigoroso pensatore teutonico, Ludwig Wittgenstein, della cui dottrina, pur nel dissenso, non può non farsi carico ogni serio ambito di studi, ha enunciato, fra gli altri, due asserti piuttosto allarmanti in ordine a quanto ci si prefigge di trattare, e cioè: a) che il passato non ci direbbe molto del presente e b) che quando non si ha una conoscenza logico-empirica, cioè fondata sull’esperienza sensibile, sarebbe meglio tacere. Abstract: In his brilliant work on «La laicità penale alla sfida del "secolo delle paure"» Carlo Enrico Paliero highlighted the distance between positive legal systems and a supposed (ideal-typical) archetype of 'laicità', of which the single legal system represents a "mestizo" model. The iconic image restores the complexity of any definitional challenge on 'laicità'. Law, unfolding as a practical science, has gradually managed to circumvent the obstacle through a process of empirical signification, derived, at times, from concrete needs. Therefore, it would be improper, if not arbitrary, to attempt to offer a contribution on legal 'laicità' in disregard of the events that have characterized its absence from the text of the Charter and the demands of ordinal self-protection that have determined, instead, the subsequent 'unveiling' or 'creation' of the unexpressed principle.

Notes on the theory of the validity of the canonical norm: existence, formal validity, substantive validity, efficacy and effectiveness SOMMARIO: 1. La rationabilitas como elemento central de la teoría de la norma canónica - 3. Conveniencia de la teoría de la norma canónica - 4. Notas sobre la teoría de la validez de la norma canónica - 5. Existencia / Inexistencia - 6.I. Validez formal / Invalidez formal; Validez material / Invalidez material - 6.II. Origen y necesidad de la distinción - 6.III. ABSTRACT: Canonical science, since its birth, has contributed to the progress of canon law when it has maintained a dialogue with the juridical theory and dogmatic of each epoch. In this direction, the Italian secular school gave canonical science a decisive impulse, later paralyzed as a result of some theories such as the canonizatio of Vincenzo del Giudice. The dialogue between canon law and juridical science is necessary to extract the progress made by the 1983 Code with the formalization of fundamental rights. With some excesses corrected thanks to the proposals of Lombardia and Hervada, the original intuition of the Italian secular school was correct and it is convenient to accompany and clarify the growing protagonism of the legislative activity of the Church. From this perspective favorable to dialogue with juridical science, revalued by the call to interdisciplinarity of the Apostolic Constitution Veritatis Gaudium, the article continues the reflection on the canonical norm raised with various nuances by the doctrine, and offers some notes on the theory of the validity of the canonical norm.

The Tragic Choices during the Covid Health Emergency: When the Resources are Limited, Who Should be Cured First among Several Patients? A Comparative Law Analysis SOMMARIO: 1. Introduzione - 2. L’approccio italiano: le raccomandazioni di etica clinica della SIAARTI e le linee guida SIAARTI-SIMLA - 3. La gestione della scarsità di risorse sanitarie a livello comparato - 4. Considerazioni (finali) comparatistiche - 5. Uno sguardo verso il futuro. ABSTRACT: During the Covid-19 health emergency, a situation of scarcity of resources of different nature, albeit all somehow connected with the “medical world” (e.g. nurses and doctors), dramatically unfolded. This organisational “catch-22” induced the SIAARTI (the Italian Medical Society) to issue some recommendations of clinical ethics. The last ones turn out to be the subject matter of multiple criticisms: given the potential criteria of allocation of resources, one of those adopted the chronological one. Starting from this reflection, the paper discusses and analyses, from a comparative perspective, the approach taken by further countries: in this respect the demarcation lines existing between the Italian responses to the pandemic and those coming from other European - but not EU, namely Switzerland and the United Kingdom - countries will be highlighted.

And he criticizes the contents, highlighting the incompleteness of the scientific reconstruction regarding the effects of emergency hormonal contraceptives and the danger of the choice to alienate the dispensing of over-the-counter drugs from the general rules of health treatment. Especially in the case of minor women whose sexual and reproductive health requires not abandoning them but really taking charge of them without medicalising their choices.

SUMMARY: 1. Introduction - 2. The SMOM self-qualification as full member of the international community: critical notes - 3. The nature and scope of the international legal subjectivity of SMOM - 4. The non-relevance of the canonical status and the relationship with the Holy See for the international subjectivity of SMOM - 5. Conclusions. ABSTRACT: The presence of the Order of Malta (acronym SMOM) on the international scene, because of its singularity, has been the subject of debate and discussion among scholars of international law as well as canon law. In fact, the SMOM’s juridical subjection to the Holy See because of its nature as a Catholic Religious Institute is a critical point under the traditional international legal theory that seems to be inconsistent with the Order’s international subjectivity. The aim of this study is to point out that, using a broad and modern notion of international subjectivity, there is no incompatibility between the canonical nature of the Order of Malta and its membership in the international community.
