Analisis Terhadap Kendala Perlindungan Konsumen oleh Majelis Permusyawaratan Ulama Aceh Terhadap Sertifikasi Label Halal Produk 亚齐神职人员委员会对消费者保护限制进行的分析,以证明该产品的合法标签

Aceh as a Province that implements Islamic Sharia is required so that every product circulating to be certified halal before being consumed by the public. The task was given to the Aceh Ulama Consultative Assembly through the Institute for the Assessment of Food, Medicine and Cosmetics Aceh Ulama Consultative Assembly (LPPOM MPU) Aceh. In fact in 2017 the discovery of the same noodle products traded in the city of Banda Aceh and not halal certified. This study discusses to explain and analyze the causes of ineffective consumer protection by the Aceh Ulama Consultative Assembly on Samyang Noodle Product Halal Certification Certification. This research is an empirical juridical legal research using a legal sociology approach and a qualitative analysis approach using an inductive mindset. Based on the results of research that prove the obstacles-which cause less effective consumer protection by the Aceh Ulama Consultative Assembly on the certification of halal labels for Samyang noodles are that the Aceh Government has not issued a Governor Regulation which is a derivative of Qanun Number 8 of 2016 concerning the Halal Product Guarantee System. And the socialization of the Qanun has not been communicated to the wider community and business people Aceh sebagai Provinsi yang melaksanakan syariat Islam diwajibkan agar setiap produk yang beredar untuk disertifikasi halal sebelum dikonsumsi oleh masyarakat. Tugas tersebut diberikan kepada Majelis Permusyawaratan Ulama Aceh melalui LPPOM MPU Aceh.. Kenyataanya pada tahun 2017 ditemukannya produk mie samyang yang diperdagangkan di Kota Banda Aceh serta tidak bersertifikasi halal. Penelitian ini bertujuan untuk menjelaskan dan menganalisis hambatan yang menyebabkan kurang efektifnya perlindungan konsumen oleh Majelis Permusyawaratan Ulama Aceh Terhadap Sertifikasi Label Halal Produk mie Samyang. Penelitian ini merupakan penelitian hukum yuridis empiris dengan menggunakan pendekatan sosiologi hukum dan pendekatan analisis secara kualitatif menggunakan kerangka pikir induktif. Berdasarkan hasil penelitian diketahui bahwa hambatan-hambatan yang menyebabkan kurang efektifnya perlindungan konsumen oleh Majelis Permusyawaratan Ulama Aceh terhadap sertifikasi label halal produk mie Samyang yaitu, Pemerintah Aceh belum mengeluarkan Peraturan  Gubernur yang merupakan turunan dari Qanun Nomor 8 Tahun 2016 tentang Sistem Jaminan Produk Halal. Dan belum tersosialisasinya Qanun tersebut kepada masyarakat luas dan para pelaku usaha.

Mereposisi Korban dalam Sistem Peradilan Pidana di Indonesia: Suatu Keterlemparan (gowerfen-sein) dalam Mitos Modernitas 印度尼西亚刑事司法系统的受害者复审:现代性中的gowerfensein神话

Myths in the modern era are things that are considered like truth. It arises through the process of hegemony and dialectical domination by the authority in history. So, myth is a phenomenon of common sense without criticism. The state's presence in the criminal justice process as a grand narrative identified with the interests of victims and society, in general, is common sense without criticism. This study aims to reveal whether the myth of modernity is a representation of victims in the Criminal Justice System. This study uses a normative juridical method based on secondary data with several models of approaches, including conceptual approaches, philosophical approaches, and critical approaches. The result of this research shows the phenomenon of objectification and reification of the people as victims in the Criminal Justice System in Indonesia. Mitos dalam era modern merupakan hal-hal yang diandaikan begitu saja sebagai suatu kebenaran. Hal tersebut tampil melalui proses hegemoni dan dominasi dalam dialektika otoritas dalam sejarah. Sehingga, mitos merupakan suatu fenomena common sense tanpa kritik. Kehadiran negara dalam proses peradilan pidana sebagai narasi tunggal (grand narrative) yang diidentikan dengan kepentingan korban dan masyarakat secara umum, merupakan common sense tanpa kritik. Penelitian ini ditujukan untuk membongkar apakah mitos modernitas tersebut merupakan representasi korban dalam Sistem Peradilan Pidana. Penelitian ini menggunakan metode yuridis normatif yang berbasis kepada data sekunder dengan beberapa model pendekatan, antara lain pendekatan konseptual, pendekatan filsafat, dan pendekatan kritis. Hasil penelitian ini menunjukkan adanya fenomena objektivikasi dan reifikasi terhadap masyarakat sebagai korban dalam Sistem Peradilan Pidana di Indonesia.

Pendekatan Restorative Justice dalam Penyelesaian Tindak Pidana di Tingkat Penyidikan 司法恢复的方法是在刑事层面上解决犯罪问题

As the gateway to the criminal justice system, law enforcement that carried out by polri always influenced by social change factors. In accordance with the development of law today, polri required to be able to resolve criminal acts by prioritizing restorative justice approach. However it hasn’t been regulated in statutory. The research purposes to describe and analyze the settlement of criminal acts with restorative justice approach in investigation level at the present and the future. The research used normative legal research, using a statute approach, historical approach and comparative approach, using primary and secondary legal materials that collected by a systematic method and then analyzed by descriptive and interpretation techniques. The research show that polri has carried out several policies to answer the community expectations and demands in accordance with the development of law today by issuing several letters and regulations, namely Surat Kapolri No. Pol. B/3022/XII/2009/Sde Ops, ST Kabareskrim No. ST/110/V/2011, STR Kabareskrim No. STR/583/VIII/2012, Perkap 15/2013, Perkap 3/2015, SE Kapolri No. SE/7/VII/2018 and SE Kapolri No. SE/8/VII/2018. In perspective of “ius constituendum,” it is needed criminal law policy to regulate the settlement of criminal acts with restorative justice approach in investigation level, by carrying out a renewal of material criminal law, including the understanding of criminal acts, objectives and guidelins for criminal actions and also renewal of formal criminal law including updating KUHAP, Perkap 14/2012 and Perkap 3/2015. Sebagai pintu gerbang sistem peradilan pidana, penegakan hukum yang dilakukan polri selalu dipengaruhi oleh faktor perubahan sosial. Dalam perkembangan hukum dewasa ini, polri dituntut mampu menyelesaikan tindak pidana dengan mengedepankan pendekatan restorative justice. Akan tetapi hal itu belum diatur dalam peraturan perundang-undangan. Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis pendekatan restorative justice dalam penyelesaian tindak pidana di tingkat penyidikan pada saat ini dan pada masa yang akan datang. Metode penelitian yang digunakan adalah jenis penelitian hukum normatif, menggunakan pendekatan perundang-undangan, pendekatan kasus, pendekatan historis, pendekatan perbandingan dan pendekatan konsep, dengan menggunakan bahan-bahan hukum primer dan bahan-bahan hukum sekunder yang dikumpulkan dengan metode sistematis yang selanjutnya dianalisis dengan teknik deskriptif dan interpretasi. Hasil penelitian menunjukkan bahwa polri telah melakukan beberapa kebijakan untuk menjawab harapan dan tuntutan masyarakat sesuai dengan perkembangan hukum dewasa ini dengan menerbitkan beberapa surat dan peraturan, yaitu Surat Kapolri No. Pol. Position of Collective Labor Agreement as a Company Autonomous Law: Industrial Relation Dispute Settlement Approach 集体劳动协议作为公司自治法的地位:劳资关系争议解决途径

Collective Labor Agreement (CLA) is one of the main pillars that can be used in resolving disputes that occur in the company, However, there are problems concerning the implementation of CLA. The purpose of this research is to find and identify factors that can trigger disputes in the implementation of CLA, the probability of amendment of the CLA, identify the position of CLA in resolving Industrial Relation Disputes and find a mechanism of settlement in the implementation of the CLA. The research was carried out using empirical legal methods and analyzed using qualitative methods. The results are presented in a descriptive analysis report. The results of this research showed differences in interpretation, when unclear validity arrangements and adjustments of the new legislation happen were triggering disputes in the implementation of the CLA. Based on goodwill from the CLA parties, amendments could be made through negotiations in accordance with the mechanism stipulated in the Laws and Regulations. The position of CLA is an autonomous law that applies to the company and is an important element in preventing and resolving Industrial Relation Disputes. Finally, the settlement through bipartite, tripartite and Industrial Relation Court are the mechanism that can be taken for interest disputes.

Implementasi Kebijakan Gubernur Bali Tentang Komisi Penyelenggara Perlindungan Anak Daerah dalam Perlindungan dan Pemenuhan Hak Anak 巴厘岛州长对保护和履行儿童权利委员会的政策实施

Supervision of child protection was legitimized within Policy of the Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali. In this study, there are two issues that will be examined namely how is the implementation of the Bali the Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali and how are the efforts being made to overcome obstacles in the protection and fulfillment of children's rights in Bali? This research uses the theory of the Van Metter and Van Horn Implementation Model. The research method used is to use a qualitative approach. Data analysis in the study was carried out interactively using interactive models from Miles and Huberman. The results of the study concluded that the implementation of the Bali Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali has not been effective in fulfilling and protecting children's rights. Regional Child Protection Organizing Commission has not been able to optimally carry out its duties as a supervisor of the implementation of child protection in the Province of Bali. Efforts are being made to overcome obstacles in the protection and fulfillment of children's rights in Bali by establishing communication and coordination and making a joint commitment in the form of an MoU with several parties organizing child protection in the Province of Bali. Pengawasan terhadap perlindungan anak di Provinsi Bali dilegitimasi melalui Gubernur Bali membentuk Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali melalui Kebijakan Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali. Dalam penelitian ini, terdapat dua permasalahan yang akan dikaji yakni bagaimanakah implementasi Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali dan bagaimanakah upaya yang dilakukan untuk mengatasi kendala dalam perlindungan dan pemenuhan hak anak di Bali? Penelitian ini menggunakan teori Model Implementasi Van Metter dan Van Horn. Metode penelitian yang digunakan adalah mempergunakan pendekatan kualitatif. Analisis data dalam penelitian dilakukan secara interaktif dengan menggunakan model interaktif dari Miles dan Huberman. Hasil penelitian menyimpulkan bahwa implementasi Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali belum efektif dalam memenuhi dan melindungi hak anak. Perpajakan Optimal dalam Perspektif Hukum Pajak Berfalsafah Pancasila 从税收法的角度来看,税收是最优的

Pancasila as philosofiche grondslag guides positioning tax law in Indonesia. While taxation as a science has developed from the ability to pay's principle towards the optimal taxation concept. There are two main objectives in this research such as identifying the characteristics of tax law based on the Pancasila philosophy and describing tax law based on the Pancasila philosophy in the context of optimal taxation. To answer both questions, normative research method was utilized by identifying the Pancasila philosophy of tax law and the concepts and principles of tax law and optimal taxation. This research reveals two things: firstly, the characteristics of tax law based on the Pancasila Philosophy include tax compliance, welfare, and burden prevention. Secondly, optimal taxation is compatible with the last two aspects of tax law based on Pancasila Philosophy. Yet, we found conflicting concept between tax compliance based on Pancasila philosophy and horizontal equity as part of optimal taxation. The object of conflict is a progressive tariff tax. Pancasila sebagai philosofiche grondslag memberikan pegangan mengenai pemosisian hukum pajak di Indonesia. Sementara perpajakan sebagai suatu disiplin keilmuan telah berkembang dari prinsip kemampuan bayar menuju konsep perpajakan yang optimal. Ada dua tujuan artikel penelitian ini yakni mengidentifikasi karakteristik hukum pajak berfalsafah Pancasila, serta menjelaskan hukum pajak berfalsafah Pancasila dalam konteks perpajakan optimalPenelitian ini menggunakan metode normatif melalui identifikasi pajak berfalsafah Pancasila, serta identifikasi konsep dan asas-asas hukum pajak dan pajak optimal. Hasil temuan penelitian terdiri atas 2 hal, yaitu pertama, karakteristik hukum pajak berfalsafah Pancasila meliputi kepatuhan pajak, kesejahteraan, dan pencegahan beban. Kedua, perpajakan optimal sesuai dengan dua aspek terakhir dari hukum pajak berfalsafah Pancasila. Namun, terdapat ketidakcocokan diantara kepatuhan pajak berdasarkan Pancasila dengan keadilan horizontal berdasarkan konsep perpajakan optimal. Objek konflik yang dimaksud adalah tarif pajak progresif.

This study aims to analyze the problems of the Company's Responsibility towards Fulfilling the Wages of Employees in the Bankruptcy Boedel Delivery Process; And to find out the factors that inhibit the prior rights of fulfilling the wages of workers in the process of bankruptcy in Boedel. The study used the Normative-Empirical Legal Research method. The Results of the Study Show That: First: The Responsibility of the Company for the Fulfillment of Workers' Rights in the Process of Bankruptcy Boedel Giving Based on the Emergence of Rights and Obligations Between Entrepreneurs and Workers Poured in Work Agreements as Strong Engagement for the Fulfillment of Rights and Obligations (Achievements ) Each Party. Legal Protection of Workers' Rights in the Process of Bankruptcy Boedel Giving Can Be Taken Through 3 (Three) Ways, Namely: 1. Strengthening the Position of the Priority Rights of the Workers / Laborers in the Law, Especially the Bank Law; Second: Factors that Inhibit the Priority Rights of Fulfillment of Workers' Rights in the Process of Bankruptcy Boedel Giving Is Weak Supervision, Absence of Sanction Enforcement and Lack of Transparency in the Process of Bankruptcy of Boedel Companies Penelitian ini bertujuan untuk menganalisis permasalahan Tanggung Jawab Perusahaan Terhadap Pemenuhan Upah Pekerja Dalam Proses Pemberesan Boedel Pailit; Serta Untuk Mengetahui Faktor Yang Menghambat Hak Mendahulu Pemenuhan Upah Pekerja Dalam Proses Pemberesan Boedel Pailit. Penelitian menggunakan metode Penelitian Hukum Normatif-Empiris. Hasil Penelitian Menunjukkan Bahwa:  Pertama: Tanggung Jawab Perusahaan Terhadap Pemenuhan Hak-Hak Pekerja  dalam Proses Pemberesan Boedel Pailit Adalah Berdasar Pada Timbulnya Hak Dan Kewajiban Antara Pengusaha Dan Pekerja Yang Dituangkan Dalam Perjanjian Kerja Sebagai Perikatan Yang Kuat Untuk Pemenuhan Hak Dan Kewajiban (Prestasi) Masing-Masing Pihak. Perlindungan Hukum Atas Hak-Hak Pekerja (Buruh) Dalam Proses Pemberesan Boedel Pailit Dapat Ditempuh Melalui 3 (Tiga) Cara, Yakni: 1. Delegation of Governor Regulation in Ensuring Utility and Justice 确保效用与正义的州长监管授权

Delegation means delegation of authority to make Law and Regulations. Article 246 paragraph (1) of Act No. 23 of 2014 on Regional Government stipulates that “to implement the Regional Regulation or over the power of Law and Regulations, the Head of Region shall pass the Head of Region Regulation.” The words "implement" and "over the power" which contains ambiguity of command cause philosophical problem related to the validity value. It becomes a sociological problem if such delegation cannot predict the dynamics of society. Furthermore, it becomes a juridical problem due to the existence of vague norm which creates multi interpretation which could potentially miss the aim of delegation of regulation. Specifically, this article has specific aims to examine philosophically concerning the need for delegations of authority to regulate, examine and find the direction of regulation in the delegation of regulation to governor regulation in ensuring utility and justice. This is a normative legal research with literature study which employs statute, philosophy, theories, conceptual and contextual approaches. The study so that with regard to the philosophical basis, delegation of regulation to Governor Regulation is needed to formulate technical and detail norms, the urgent factor contained herein as well as brief discussion and The direction of regulation to the Governor Regulation in the Regional Government Act to implement Regional Regulation or over the power of law and regulations. Such direction is based on command from the higher law and regulations, or established based on delegation.

Article 14 of the penal law regulates prisoners' rights, namely Health Service Rights and consumption in prisons and detention centers. The Correctional Law provides legal certainty for the obligation to provide optimal service so the aim of related serve achieved. Health and consumption services in Class II A Banda Aceh Lapas and Class II B Jantho Detention Centers shortage and ineligible. It’s Health Service Rights and consumes inmate’s centers. Indeed, the writer observed that health consumptions served at prison class II A Banda Aceh that inmates at class II B Jantho Inefficiency. This study aims to describe the fulfillment of basic rights in health services and consume Its influence and efforts them. Types of legal research and empirical juridical approaches or sociological. The data analysis technique used in this research is qualitative. It’s used so that the writer tends under study. Based on observed, the writer knows that health served and consumption inefficient constitutes in facilities health boosted. Its still inadequate, indicated by claims about food and nutrition, Its Overcapacity, facilities and infrastructure, limited budgets, the substance of the rules the relationship between legal structures is inadequate, Efforts to increase claim internally and externally in the form of socialization, fighting for the budget through the legislature, optimally implementing inmates rules, then health serve and food proper. UU pemasyarakatan pasal 14 salah satu nya mengatur tentang hak-hak narapidana yaitu Hak Pelayanan Kesehatan dan konsumsi di Lapas dan Rutan. Ada nya pasal 14 UU Pemasyarakatan tersebut memberikan kepastian hukum terhadap kewajiban memberikan pelayanan se optimal mungkin agar tujuan pemasyarakatan tercapai. Pada kenyataannya pelayanan kesehatan dan konsumsi yang penulis teliti baik di Lapas Klas II A Banda Aceh maupun Rutan Klas II B Jantho masih kurang memadai dan belum memenuhi standar yang ditetapkan. Penelitian ini bertujuan untuk menjelaskan dan menganalisis pemenuhan hak-hak dasar narapidana atas pelayanan kesehatan dan konsumsi, faktor-faktor yang mempengaruhinya, dan upaya peningkatan pemenuhannya. Jenis penelitian hukum dan pendekatan yuridis empiris, atau penelitian hukum sosiologis. Teknik analisis data yang digunakan dalam penelitian ini ialah data kualitatif, metode kualitatif ini digunakan agar penulis dapat mengerti dan memahami gejala yang diteliti. Berdasarkan hasil penelitian penulis diketahui bahwa pelayanan kesehatan dan konsumsi di Lapas masih belum efektif, terlihat dari sarana dan prasarana penunjang pelayanan kesehatan, frekuensi kunjungan tenaga kesehatan, dan anggaran yang tersedia. Konsumsi yang disajikan bagi narapidana masih kurang layak, terindikasi dari keluhan tentang makanan serta gizi yang kurang seimbang, kebersihan kurang diperhatikan. Oversight of foreigners becomes very important in line with the increase in international crime, one of which is a narcotics crime. Through technological developments, the spread of narcotics has reached almost all regions in Indonesia. The state does not want its territory to have people involved in narcotics crimes. The main objective of the supervision of foreigners is to protect the community and the sovereignty of the State. The aim of the study to analyze who has authorized to conduct surveillance of foreigners related to narcotic crimes. This research is a normative legal research using the legislation approach and concept approach. The results of the research are: The authority to supervise foreigners related to narcotics criminal acts based on the Immigration Act is carried out by the Minister by forming a team consisting of relevant government agencies or agencies both at the central and regional levels. The institution is the Immigration Agency and is also carried out by the National Narcotics Agency which coordinates with the Police. Furthermore, based on the Law on narcotics that is authorized to conduct surveillance of Narcotics crime as regulated under the provisions of Article 61 paragraph (1) is the Government. The government supervises all activities related to Narcotics.. Oversight of Foreigners related to narcotics crime, is not only done when they enter, but also while they are in the Territory of Indonesia, including their activities. Immigration Supervision covers the enforcement of immigration law, both administrative and Immigration.
