This study aims to determine the regulations regarding standard contracts in the banking sector after the existence of the authority of the Otoritas Jasa keuangan, to find out the legal consequences of violations of the provisions of standard contracts carried out by banking financial services and to determine efforts to prevent violations of standard contracts by banking financial services. This is normative legal research with with statutory approach and a conceptual approach. The results show that the regulation regarding the standard contract after the existence of the OJK as a financial service consumer protection agency is regulated through the Financial Services Authority Regulation (POJK) No.1/POJK.07/2013 concerning Consumer Protection in the Financial Services Sector and in the Financial Services Authority Circular Letter (SEOJK) No. 13 /SEOJK.07 / 2014 regarding the Standard contract. The legal consequences of violating the provisions of the standard contract are not regulated in the POJK and the SEOJK. When it compared with the provisions of article 18 paragraph (3) of the Consumer Protection Law which explicitly states that violations of article 18 paragraphs (1) and (2) result in standard clauses being null and void, POJK and SEOJK only require financial service actors to make action plan, hence it is deemed to have no clear legal consequences. One of the efforts that must be made by banking financial service actors to prevent violations of the provisions of the standard contract is by making standard contract regulations independently and elaborating them in the internal banking regulations.

The conflict between PSIM Yogyakarta and PERSIS Solo supporters is a conflict that has been going on for a long time. These conflicts often cause casualties and damage to public facilities. Severe sanctions do not frighten supporters and a deterrent to take anarchic actions. To overcome this, preventive efforts (non-penal) can be used as an alternative in resolving supporter conflicts. Through socio-legal research, this paper aims to find out more about non-penal countermeasures based on an analysis of the factors that cause supporter conflict. The results of the study, it is known that non-penal countermeasures can be done by emphasizing the efforts of the supporter development process as part of the criminal politics of prevention without punishment. The coaching process is based on three factors that cause supporting conflicts, namely based on the nature, position of the actors, and diversity of society. The police and supporter also have a strategic role in preventing criminal acts to minimize the occurrence of clashes between supporters. These roles include providing security personnel, conducting sweeping, and coordinating between related parties.

The purpose of this study was to determine the role of the Notary Supervisory Council in the inclusion of notary self-protection clause. This study is normative legal research using a statute conceptual approach and analyzed using a pre-descriptive-evaluative.The results showed that the legal effect of the inclusion of a notary self-protection clause is flawed notarial deed as an authentic deed. As a result, the role of the Notary Supervisory Council to oversee the performance of notaries.However, the supervisory authority is only in the context of preventive supervision and oversight, but it is not authorized in the context of curative supervision in matter of the inclusion of a notary self-protection clause. Tujuan penelitian ini adalah untuk mengetahui tentang peran Majelis Pengawas Notaris dalam pencantuman klausula pelindung diri.Penelitian ini dilakukan dengan menggunakan model penelitian hukum normatif melalui pendekatan undang-undang dan pendekatan konsep serta dianalisis dengan cara prekriptif-evaluatif. Hasil penelitian menunjukkan bahwa akibat hukum dari pencantuman klausula pelindung diri adalah cacatnya akta notaris sebagai akta otentik sehingga diperlukan adanya peran dari Majelis Pengawas Notaris untuk mengawasi kinerja notaris. Namun kewenangan pengawasan itu hanya dalam konteks pengawasan yang bersifat preventif dan tidak berwenang dalam konteks pengawasan yang bersifat kuratif dalam persoalan pencantuman klausula pelindung diri.

The present study seeks to find out, examine the effectiveness of criminal sanctions in the form of imprisonment in Bali, as well as discover the basis for the application of punishment with a restorative justice approach. This study belongs to empirical legal research that is descriptive in nature and makes the Correctional Institution in Bali the object of research. The results of the study suggested that the emergence of recidivists in Bali and the still negative stigma among the Balinese community subsequent to the removal of prisoners shows that correctional goals are still unachieved and the emergence of recidivists in Bali implies that the criminal sanction in the form of imprisonment still remains ineffective. The concept of an ideal criminal system to be applied in Bali related to imprisonment is the one adopting the restorative justice approach, because in addition to minimising imprisonment, in this approach, the interests of victims are more concerned by making various efforts to resolve conflicts and by making rehabilitation. Tujuan dari studi ini untuk mengetahui dan menganalisis efektivitas pemenjaraan di Bali dan menemukan landasan penerapan pemidanaan dengan pendekatan keadilan restoratif. Penelitian ini adalah penelitian hukum empiris yang sifatnya deskriptif dan menjadikan Lembaga Pemasyarakatan di Bali sebagai objek penelitian. Hasil studi menunjukkan bahwa munculnya residivis di Bali dan masih adanya stigma negatif dari masyarakat Bali setelah narapidana keluar dari lapas menunjukkan bahwa tujuan pemasyarakatan belum tercapai dan sanksi penjara tidak efektif di Bali. Konsep sistem pemidanaan yang ideal untuk diterapkan di Bali terkait dengan pemenjaraan adalah konsep sistem pemidanaan dengan pendekatan restorative justice yang memperhatikan kepentingan korban dengan melakukan berbagai upaya penyelesaian konflik dan rehabilitasi, serta meminimalisasi penjatuhan pidana penjara.

The basic idea underlying the reform of the Criminal Code Bill has an impact on reforming the pillars of criminal law. The purpose of this research is to find out the new direction of criminal law policy regarding criminal acts, criminal responsibility and punishment. The research method uses normative legal research. The results of the research study in the discussion section are the reform of the pillars of criminal law, namely criminal acts, criminal liability, and punishment oriented to the basic idea of ??the value of balance. The reform of the pillars of criminal acts is aimed at broadening the meaning of the legality principle which provides space for living law as a source of law and also creates juridical terminology regarding criminal acts. The pillar of criminal responsibility accommodates the principle of no crime without error. The pillar of punishment is that the purpose of punishment is no longer synonymous with retaliation, but there are efforts to improve the behavior of the perpetrators of crime. The changes in the three pillars are influenced by the basic idea of ??balancing the values ??of Pancasila, namely the values ??of Divinity, Humanity, and Society. Recommendations in strengthening the direction of criminal law reform are needed in formulating criminal provisions outside the Draft Criminal Code that must be in accordance with the basic idea of ??balance which is the ideal of criminal law reform law. Ide dasar yang melandasi pembaruan RUU KUHP berdampak pada pembaruan pilar hukum pidana. Tujuan penelitian untuk mengetahui arah baru kebijakan politik hukum pidana mengenai tindak pidana, pertanggungjawaban pidana dan pemidanaan. Metode penelitian menggunakan penelitian hukum normatif. Hasil kajian penelitian dalam bagian pembahasan ialah pembaruan pilar hukum pidana yakni tindak pidana, pertanggungjawaban pidana, dan pemidanaan berorientasi pada ide dasar nilai keseimbangan. Pembaruan pilar tindak pidana tertuju pada perluasan makna asas legalitas yang memberikan ruang pada hukum yang hidup sebagai sumber hukum dan melahirkan pula terminologi yuridis mengenai tindak pidana. Pilar pertangungjawaban pidana mengakomodasi asas tiada pidana tanpa kesalahan. Pilar pemidanaan bahwa tujuan pemidanaan tidak lagi identik pembalasan akan tetapi ada upaya memperbaiki perilaku dari pelaku kejahatan. Perubahan ketiga pilar tersebut dipengaruhi oleh ide dasar keseimbangan nilai Pancasila yaitu nilai Ketuhanan, Kemanusiaan, dan Kemasyarakatan. Rekomendasi dalam memperkuat arah pembaruan hukum pidana diperlukan dalam merumuskan ketentuan pidana di luar RUU KUHP harus sesuai dengan ide dasar keseimbangan yang menjadi cita hukum pembaruan hukum pidana

Hasil kajian penelitian dalam bagian pembahasan ialah pembaruan pilar hukum pidana yakni tindak pidana, pertanggungjawaban pidana, dan pemidanaan berorientasi pada ide dasar nilai keseimbangan. Pembaruan pilar tindak pidana tertuju pada perluasan makna asas legalitas yang memberikan ruang pada hukum yang hidup sebagai sumber hukum dan melahirkan pula terminologi yuridis mengenai tindak pidana. Pilar pertangungjawaban pidana mengakomodasi asas tiada pidana tanpa kesalahan. Pilar pemidanaan bahwa tujuan pemidanaan tidak lagi identik pembalasan akan tetapi ada upaya memperbaiki perilaku dari pelaku kejahatan. Perubahan ketiga pilar tersebut dipengaruhi oleh ide dasar keseimbangan nilai Pancasila yaitu nilai Ketuhanan, Kemanusiaan, dan Kemasyarakatan. Geographical indications give a role to the community regarding added value proposition, quality, and property to increase the competitiveness of a product. The purpose of this research is to find and develop potential Geographical Indication in the Trenggalek Regency. Finding means acquiring new knowledge, developing the meaning of expanding, and digging deeper into existing realities. The legal approach used in this research is juridical empirical. The type of research is descriptive, and data collection uses the method of literature study, and empirical legal research, the method of analysis used is qualitative. The results of a study on the legal protection of geographic indications in the Trenggalek Regency show that there are problems that the government must resolve. Because the community and government of Trenggalek Regency have not registered potential geographic indications in their area, the legal protection of potential geographical indications in Trenggalek Regency can be preventive or repressive. Indikasi geografis memberikan peran terhadap masyarakat tentang adanya nilai lebih pada suatu produk yang ditawarkan, baik dari segi kualitas maupun dari segi properti yang dapat meningkatkan daya saing suatu produk. Tujuan penulisan ini adalah untuk menemukan dan mengembangkan potensi Indikasi Geografis ada kabupaten Trenggalek. Menemukan berarti memperoleh pengetahuan yang baru, mengembangkan maksudnya memperluas dan menggali lebih dalam realitas yang sudah ada. Pendekatan ilmu hukum yang digunakan dalam penelitian ini yaitu yuridis empiris, jenis penelitiannya adalah deskriptif, pengumpulan data menggunakan metode studi kepustakaan dan penelitian hukum empiris, metode analisis yang digunakan adalah kualitatif. Hasil kajian tentang perlindungan hukum indikasi geografis yang berada di Kabupaten Trenggalek menunjukkan bahwa terdapat persoalan yang harus diselesaikan pemerintah, hal tersebut dikarenakan masyarakat dan pemerintah Kabupaten Trenggalek belum mendaftarkan potensi indikasi geografis yang terdapat di wilayahnya. Kemudian perlindungan hukum potensi indikasi geografis di Kabupaten Trenggalek dapat dilakukan secara preventif maupun secara represif.

The purpose of this study is to analyze the provision regarding the Termination of Employment and see its effectiveness in the field, especially with the current regulations regarding the current regulations concerning the Protection and the Business Continuity of Worker / Labor in related to the Prevention and Control of Covid-19 outbreaks. This research is using sociological juridical research with a statute approach and an approach called Live Case Study. The research show, these current regulations could not force employers to minimize the employment termination yet many of formal employees being laid off and terminated without any severance payment. Therefore, the government should coordinate with relevant ministries / institutions, especially the Ministry of Manpower as well the Ministry of Tourism and Creative Economy in order to prioritize in providing protection and assistance of government programs for employers and employees to minimize cases in term of the Termination of Employment. Tujuan studi ini adalah untuk menganalisis ketentuan mengenai Pemutusan Hubungan Kerja serta melihat efektifitasnya di lapangan terlebih dengan adanya regulasi terkini tentang Perlindungan dan Kelangsungan Usaha Pekerja / Tenaga Kerja terkait Pencegahan dan Pengendalian wabah Covid-19 khususnya untuk Provinsi Bali yang selalu mengandalkan industri Pariwisata sebagai komoditas utamanya. Penelitian ini menggunakan jenis penelitian yuridis-sosiologis dengan pendekatan Peraturan perundang-undangan dan Live Case Study. Hasil penelitian menunjukkan bahwa peraturan normatif yang berlaku tidak dapat memaksa para pelaku usaha untuk meminimalkan pemutusan hubungan kerja, namun banyak tenaga kerja yang terkena PHK dan diberhentikan tanpa pembayaran pesangon. Oleh karena itu, pemerintah perlu berkoordinasi dengan kementerian / lembaga terkait, khususnya Kementerian Ketenagakerjaan serta Kementerian Pariwisata dan Ekonomi Kreatif agar dapat memprioritaskan dalam memberikan perlindungan dan bantuan program pemerintah kepada pengusaha dan pegawai untuk meminimalisir kasus PHK tersebut.

This article aims to analyze the potential for the practice of buying and selling votes or vote buying in the election of village heads or Perbekel in Tabanan Regency, Bali. This article explores regulatory aspects, views, and variations that occur in society, including efforts to reduce the practice of buying and selling votes. In recent years, in every holding of village head elections or perbekel in several areas, there are always vote buying practices and various activities. To answer this question, the study in this article uses empirical legal research which analyzes the implementation of the law regarding village head elections regulation in reality in the community with a focus on two villages in Tabanan Regency, Bali. This article uses interview and documentation for data collection techniques and uses a rational choice institutionalism framework. With this theoretical framework, it tells the empirical facts that the calculated practice of buying votes is determined by calculations that are all profitable for the candidates and the voters. The opportunity for this practice to occur is considered to be large, carried out by perbekel officers with incumbent status. There are several offers to reduce this problem, namely by using a special website that manages the election of perbekel by loading the profile of the perbekel candidates specifically to ensure the accountability of the election. Artikel ini bertujuan untuk menganalisis potensi terjadinya praktik jual beli suara atau vote buying dalam pemilihan kepala desa atau perbekel di Kabupaten Tabanan, Provinsi Bali. Artikel ini mengeksplorasi aspek regulasi, pandangan, dan ragam benturan yang terjadi di masyarakat termasuk upaya-upaya pereduksian praktik jual beli suara tersebut. Pada beberapa tahun belakangan, pada setiap penyelenggaraan pemilihan kepala desa atau perbekel serentak pada beberapa wilayah senantiasa di ikuti oleh adanya praktik-praktik jual beli suara atau vote buying dengan beragam bentuk aktifitasnya. Untuk menjawab persoalan tersebut, studi pada artikel ini menggunakan penelitian hukum empiris dimana menganalisis implementasi hukum terkait pelaksanaan regulasi pemilihan kepala desa dalam realitasnya di masyarakat dengan fokus dua desa di Kabupaten Tabanan, Bali. The cultural property becomes objects of destruction in armed conflicts, such as Syria and Iraq, which were carried out by ISIS squads (Islamic State of Iraq and Syria). For ISIS’s actions, the ICC should judge ISIS. However, new problems will arise regarding the jurisdiction of the ICC to judge ISIS. Based on the explanation of this background, the question will arise: How are humanitarian law regulations related to protecting cultural property during armed conflict? And what is the regulation of the ICC’s jurisdiction over the protection of cultural property in armed conflict by ISIS? The research in this article is normative legal research with the statue approach. According to humanitarian law, the research results show that the regulations relating to the protection of cultural property during armed conflict are contained in the 1954 Hague Convention, Additional Protocol I and Additional Protocol II of the Geneva Conventions of 1977. The destruction of cultural property carried out by ISIS is included in war crimes, one of the Rome Statute material jurisdictions. In this case, the Rome Statute applied by the ICC has juridical power to uphold justice and punish, including war crimes committed by ISIS. For the destruction of various cultural property in Iraq and Syria, ISIS can be judge by the ICC through a referral by the UN Security Council based on the provisions stipulated in the 1998 Rome Statute.

The purpose of this research is to examine the adequacy of laws and regulations governing investment implementation by the Savings and Credit Cooperative (KSP) and formulate legal constructs related to the determination of investment interest rates by KSP through the regulations of the Indonesian Deposit Insurance Corporation (IDIC/LPS) concerning the Determination of the Deposit Insurance Interest Rate in the form of IDIC Regulation (Surat Edaran). The research method uses a normative juridical approach, descriptive-analytical research specifications, the systematic interpretation and the legal construction of analogy. The results showed that the statutory regulations governing investments made by KSP were insufficient, especially in the section relating to the determination of investment interest rates. There were still many KSPs that set high interest in their investment programs. Law Number 11 of 2020 concerning Job Creation and Government Regulation Number 7 of 2021 concerning Ease, Protection, and Empowerment of Cooperatives and Micro, Small and Medium Enterprises also does not accommodate provisions regarding investment programs that KSP can carry out. It is feared that several new provisions in the two regulations will lead to high-interest investment practices by KSP that prioritize the interests of their institutions over the welfare of members. Through the analysis of legal construction, it was found that the IDIC Regulation (Surat Edaran) regarding the Determination of the Deposit Insurance Interest Rate at Commercial Banks and Rural Banks can be used as a reference by the Ministry of Cooperatives and SMEs to encourage KSP to set investment interest rates fairly. Tujuan penelitian ini adalah untuk mengkaji kecukupan peraturan perundang-undangan yang mengatur tentang penyelenggaraan investasi oleh Koperasi Simpan Pinjam (KSP) dan merumuskan konstruksi hukum terkait penetapan suku bunga investasi oleh KSP melalui peraturan Lembaga Penjamin Simpanan (LPS) tentang Penetapan Tingkat Bunga Penjaminan Simpanan dalam bentuk Surat Edaran LSP. Metode penelitian menggunakan pendekatan yuridis normatif, spesifikasi penelitian deskriptif analitis dan metode analisis data yang digunakan adalah penafsiran sistematis dan konstruksi hukum analogi. Hasil penelitian menunjukkan bahwa peraturan perundang-undangan yang mengatur mengenai investasi yang dilakukan KSP tidak cukup memadai khususnya pada bagian yang berkaitan dengan penetapan suku bunga investasi sehingga masih banyak KSP yang menetapkan bunga tinggi dalam program investasinya.
