THE CONTRIBUTION OF JASSER AUDA IN MAQASHID AL SYARI’AH CONCEPT ON ISLAMIC EDUCATION PSYCHOLOGY 贾西尔·奥达在伊斯兰教教育心理学上的贡献

The academic problems in this research is to answer the position of Islamic Educational Psychology that should be, by trying to view Islamic Educational Psychology from a philosophical perspective, for more precisely maqashid shari'ah.Maqashid syari'ah which was initiated by Jasser Auda is actually used for legal/sharia studies as a form of contemporary philosophy that responds to the dullness of the two previous philosophies, which are modern and postmodern philosophy. The concept of maqashid shari'ah that is often called the system philosophy approach has contributed to analyze the Islamic Education Psychology. With the six features, which are: Cognitive traits, Wholeness, Openness, Interrelated Hierarchies, Multi-dimensional, Always Aiming (purposefulness), that become the frame of reference in this paper to analyze Islamic Educational Psychology.This research began by reviewing the biography and thoughts of Jasser Auda about maqashid shari'ah, that continued by Jasser Auda's recommendations in system analysis. The next study examines the contribution of Jasser Auda's maqashid al syari'ah in Islamic Educational Psychology which shows that Islamic Educational Psychology is a dynamic discipline. Keywords: Maqashid Al-Syari’ah, Jasser Auda, Islamic Education Psychology

Kekerasan Fisik dalam Rumah Tangga Perspektif Hukum Islam 从伊斯兰法律的角度来看,家庭暴力

This study aims to explore the extent to which the relevance of Islamic legal norms to the spirit of non-violence, especially in the household, considering that the topic of domestic violence is not a specific discussion or has received little attention in discussions on Islamic law. This study uses a normative juridical approach. Data was collected using documentation techniques on Islamic legal literature, in the form of fiqh books, as well as the texts of the Koran and Hadith. This study shows that acts of domestic violence are prohibited in Islam. Islamic law in this topic is very relevant to the spirit of non-violence and laws and regulations in Indonesia related to acts of violence, both in general and in the family context.
本研究旨在探讨伊斯兰法律规范与非暴力精神的相关性,特别是在家庭中,考虑到家庭暴力的主题不是一个具体的讨论,或者在伊斯兰法律的讨论中很少受到关注。本研究采用规范的司法方法。数据的收集使用了关于伊斯兰法律文献的记录技术,以伊斯兰教法典的形式,以及古兰经和圣训的文本。这项研究表明,伊斯兰教禁止家庭暴力行为。这一专题中的伊斯兰法与非暴力精神以及印度尼西亚有关暴力行为的法律和条例,无论是一般情况下还是家庭情况下,都非常相关。

Nafkah Madyiyah for Children in Supreme Court Plenary Session 2019 as a Reform of Islamic Family Law in Indonesia Nafkah Madyiyah在2019年最高法院全体会议上作为印度尼西亚伊斯兰家庭法的改革

This study is intended to examine the formulation of the results of the 2019 Plenary Meeting of The Supreme Court of the Republic of Indonesia relating to the nafkah madhiyah for children. This formulation is important, because previously the Supreme Court through its decision number 608K/AG/2003 stated that a child's nafkah madhiyah cannot be prosecuted after a husband and wife divorce, so this Supreme Court decision is often used as jurisprudence by judges to reject lawsuits about nafkah madhiyah for child. However, by issuing the formulation of the results of the plenary meeting, The Supreme Court opened up the opportunity for a lawsuit regarding the nafkah madhiyah for child. This study is a normative legal study by relying on library data, then providing an ushul fiqh approach, especially mashlahah analysis. This study shows that the plenary meeting of the Supreme Court chambers in 2019 not only provided a different formulation from the previous decision, but also showed a different paradigm in viewing the livelihood of children. If the previous The Supreme Court decision views the nafkah madhiyah for child as li al-intifa', that is, living as the fulfillment of benefits only and cannot be prosecuted if the benefits have been fulfilled even though the material is not provided, then the formulation of the Plenary Meeting of the Supreme Court positions the nafkah madhiyah for child as li al-tamlik, namely maintenance as a child's property that can be sued if the material is not fulfilled. This formula contains useful values, in accordance with Islamic law, and is relevant to laws and regulations related to children's rights, human rights, and the elimination of domestic violence.

URGENSI LEGITIMASI DAN KOMUNIKASI DALAM MENYUSUN KEBIJAKAN PENDIDIKAN 教育政策制定中合法性和沟通的紧迫性

ABSTRACTThis article will discuss the urgency of legitimacy and communication in formulating education policy. The purpose of this research is to describe a process and problems and then analyze the importance of communication and legitimacy in education policy. The research method is a qualitative research with a literature study approach. The results of the study indicate that the legitimacy of educational policies is needed so that a policy that has been formulated can be ratified as a valid policy to be enforced. Likewise, communication in policy making is also very necessary so that there are no obstacles in the form of misunderstandings in the preparation of education policies. So it can be concluded that legitimacy and communication are very urgent factors in the formulation of educational policies.Keywords: Urgency, Legitimacy, Communication, Education Policy ABSTRAKArtikel ini akan membahas mengenai urgensi dari legitimasi serta komunikasi dalam menyusun kebijakan pendidikan. Tujuan dari penelitian ini adalah memaparkan suatu proses serta problem-problem selanjutnya menganalisis pentingnya komunikasi dan legitimasi dalam kebijakan pendidikan. Metode penelitian yang dilakukan berupa penelitian kualitatif dengan pendekatan studi pustaka. Hasil penelitian menunjukkan bahwa legitimasi kebijakan pendidikan diperlukan agar suatu kebijakan yang telah dirumuskan dapat disahkan sebagai kebijakan yang valid untuk diberlakukan. Begitupun dengan komunikasi dalam penyusunan kebijakan juga sangat diperlukan agar tidak terjadi hambatan yang berupa kesalah pahaman dalam penyusunan kebijakan pendidikan. Sehingga dapat ditarik kesimpulan bahwa legitimasi dan komunikasi menjadi faktor yang sangat urgent dalam perumusan kebijakan pendidikan.Kata kunci : Urgensi, Legitimasi, Komunikasi, Kebijakan Pendidikan
摘要本文将讨论在制定教育政策时合法性和沟通的紧迫性。本研究的目的是描述一个过程和问题,然后分析沟通和合法性在教育政策中的重要性。研究方法采用文献研究法进行定性研究。研究结果表明,教育政策的合法性是必要的,这样制定的政策才能被批准为有效的政策并得到执行。同样,在制定政策的过程中,沟通也是非常必要的,这样在制定教育政策的过程中就不会出现误解的障碍。因此,在制定教育政策的过程中,合法性和沟通是非常紧迫的因素。【关键词】紧迫性、合法性、沟通、教育政策。Tujuan dari penelitian ini adalah memaparkan suatu proserta - problem-problem - selanjutnya menganalis - peningnya komunikasi dan legitimasi dalam kebijakan pendidikan。方法penpenlitian yang dilakukan berupa penpenlitian quality dengan penpenkatan study pustaka。Hasil penelitian menunjukkan bahwa legitimasi kebijakan pendidikan diperlukan agar suatu kebijakan yang telah dirumuskan dapat disahkan sebagai kebijakan yang valid untuk diberlakukan。Begitupun dengan komunikasi dalam penyusunan kebijaan juga sangat diperlukan agar tidak terjadi hambatan yang berupa kesalah pahaman dalam penyusunan kebijaan pendidikan。这是一种新的生活方式,它可以使我们的生活更有意义,更有意义。Kata kunci: Urgensi, Legitimasi, Komunikasi, Kebijakan Pendidikan

Penolakan Permohonan Itsbat Nikah Oleh Hakim di Pengadilan Agama Kelas 1A Padang 反对巴东1A班宗教法庭法官的婚姻申请

This article explains the application for marriage certificate which was rejected by the Religious Court. This research is focused on what are the reasons that lead to the rejection of the application and what are the efforts, both legal and non-legal, made by the applicant whose application was rejected. This study uses a normative-empirical legal research method with a judicial case study approach. Data was collected from documents and from informants through interviews. The source of the document is in the form of a request document and a judge's decision at the Class 1A Padang Religious Court; while interviews were conducted with applicants whose applications were rejected, from officials at the Office of Religious Affairs, and from officers from the Population and Civil Registry Service. This study shows that there are five reasons for rejection by the Religious Court Class 1A Padang of filing a marriage certificate application, namely because the applicant is still married to another person, the guardian who is marrying is invalid, the marriage is still under public, witnesses cannot provide information that can accepted, and the applicant was not present at the trial. The efforts made by the applicant whose application was rejected were only in the form of non-legal efforts. Of all the cases examined, none of the applicants made further legal efforts in the form of cassation due to their ignorance. They made other efforts in the form of re-marriage at the Office of Religious Affairs and determining the origin of the children.

This study shows that there are five reasons for rejection by the Religious Court Class 1A Padang of filing a marriage certificate application, namely because the applicant is still married to another person, the guardian who is marrying is invalid, the marriage is still under public, witnesses cannot provide information that can accepted, and the applicant was not present at the trial. The efforts made by the applicant whose application was rejected were only in the form of non-legal efforts. Of all the cases examined, none of the applicants made further legal efforts in the form of cassation due to their ignorance. تهدف هذه المقالة إلى شرح موقف جمع الأحكام الإسلامية بإندونيسيا بين آراء علماء الفقه المختلفة فيما يتعلق بقانون نكاح الزنا الحامل. وهذه الحالة، فإن جمع الأحكام الإسلامية فصل ٥٣ يسمح بنكاح الزنا الحامل، حينما ذهب بعض الفقهاء مكروه نكاح الزنا، وذهب بعضهم حرامًا مطلقًا، وذهب آخرون بجوازه بشروط. اعتمد الباحث المنهج النوعي. باستقراء البيانات من جمع الأحكام الإسلامية بإندونيسيا والكتب الفقهية، والمصادر الثانوية، ثم قدم الباحث بطريقة وصفية تحليلية. واستنتج الباحث إلى أن الرأي الذي اختاره جمع الأحكام الإسلامية فصل  ٥٣  هو الرأي المرجوح بين آراء الفقهاء. بينما فإن اختيار هذا الرأي ليس محظورًا على الإطلاق ولا يجعل جمع الأحكام الإسلامية مخالفًا للفقه، لا سيما، تكاتف هذا الرأي بخلال النظر في مصالح المجتمع الإندونيسي.

Forced Marriage: The Authority of Custom Law in The Practice of Marriage In Kerinci, Jambi 强迫婚姻:习惯法在占比克林奇婚姻实践中的权威

This study discusses the authority of customary law in the practice of forced marriage in the community of Lekuk Limapuluh Tumbu Lempur, Kerinci, Jambi. Forced marriages were carried out against men and women who went out together and only returned after 20.00. They have to get married, even though they are not willing to do so, they are not even asked to be willing at all. This study uses a qualitative descriptive method. Data collection is done by observation, interviews, and documentation. This study shows that the decision to implement forced marriages was issued by four elements holding customary authority, namely the depati, ninik mamak, alim ulama, and cerdik pandai. This punishment is enforced in order to maintain religious rules, because a man and a woman who travel together until late at night have the potential to commit various violations of religious norms, especially adultery. The application of the forced marriage rule is intended as a preventive measure against these violations. Here the role of adat is to make forced marriage as a customary punishment intended to maintain religious norms.

EFEKTIVITAS AUDIO VISUAL DALAM MENINGKATKAN MINAT BELAJAR SISWA MATA PELAJARAN PENDIDIKAN AGAMA ISLAM 视听效果提高学生对伊斯兰教教育课程的兴趣

Learning media is an important part in the world of education. Through learning media, educators can build student excellence in realizing learning goals to the fullest. By utilizing this learning media, it can provide unlimited advantages in learning, because it will make it easier for a teacher to provide explanations to students so that students more easily understand the subjects given. The purpose of this study was to increase students' interest in learning in PAI subjects through audio-visual media for class X at SMA Darul akhlak Ambulu, Sumberasih District, Probolinggo Regency. The configuration of the exam used is Classroom Action Research (CAR) which is expected to increase student interest in learning towards students in class X SMA Darul Akhlaq. From cycle I and cycle II, it can be seen that some students who were initially less interested and less interested in PAI subjects, are now very enthusiastic through audio-visual media. It can be seen that the effective level is at 80% and ineffective at 20%, resulting in an expanded level to be real, in the primary cycle of 40%, the second cycle of 80%.

Salah seorang diantara sahabat Nabi Saw. selain Khulafa'ur Rasyidin yang berempat (Abu Bakar, Umar bin Khattab, Usman bin 'Affan dan Ali bin Abi Thalib) yang dikenal sebagai mufti dan memberi fatwa hukum adalah Abdullah bin Mas'ud. Beliau memiliki pandangan luas dan berpengetahuan komprehensif dalam bidang keagamaan, sehingga fatwa-fatwa yang diintrodusirnya mendapat epresiasi sebagai rujukan dalam penetapan hukum Islam. Latar belakang Ibnu Mas'ud mampu melahirkan fatwa-fatwa, karena kedekatannya dengan Nabi Saw, ia sering melihat dan mendengar bagaimana cara Nabi Saw. dalam memutuskan suatu hukum yang dihadapinya.
