Volume 11, Issue 1 (2023) of the Malaysian Journal of Syariah and Law (MJSL) showcases a diverse collection of articles and case studies that make significant contributions to the international scholarly community. The articles delve into crucial topics such as the treatment of uncontrollable children, offering a comparative analysis of international and Malaysian legal frameworks. Another article examines cultured meat through the lenses of fiqh and Sufism, providing valuable insights into its compatibility with Islamic principles. The study on punitive labor in Oman analyzes its application within the Omani legal system, considering its alignment with international standards. Additionally, the volume addresses the challenges of controlling territorial borders during the COVID-19 pandemic, focusing on maritime areas. The use of gelatin in halal pharmaceutical products is explored, ensuring compliance with Islamic dietary regulations. The volume also includes studies on the application of non-ratified international treaties, offering new perspectives on their judicial implementation. Furthermore, the contextualization of Maqasid al-Shariah according to the objectives of the individual, family, society, and humanity is thoroughly examined. A comparative analysis of social solidarity in Islam and contemporary economic systems contributes to the discourse on economic justice. The case studies within this volume provide insights into the constitutional position of the continental shelf in Malaysia, shedding light on the legal provisions and implications surrounding its resources. Additionally, protocols for validating the status of illegitimate children in Syariah law are presented, offering valuable guidance in teaching and learning approaches for this area of study. Lastly, an intellectual dialogue with an esteemed professor in peace and conflict studies enriches the scholarly conversation. A book review on advancing the legal status of women in Islamic law provides critical insights into this significant subject. The contributions within this volume deepen our understanding of these topics, stimulate further scholarly exploration, and foster the advancement of knowledge in the field of Syariah and Law.

This comprehensive study examines al-hadyu and al-udhiyyah sacrifice rituals within the framework of the major objectives of the Hajj tradition. The research aims to shed light on the profound role these rituals play in Islam, transforming them from a symbol of showmanship, association, and arrogance during the era of Jahiliyya (pre-Islamic period of ignorance) into a manifestation of monotheism, gratitude, and remembrance of the Creator. Employing a meticulous research methodology, this study explores the historical context surrounding al-hadyu and al-udhiyyah rituals, analyzing their evolution and transformation under the influence of Islam. The researcher highlights the authentic scriptural references from the holy Quran and Sunnah, emphasizing the rituals' significance and their role in shaping the ethical and theological identity of Muslims. Additionally, the study underscores their contribution to the cultivation of virtuous manners that uplift individual spirits and foster self-dignity, ultimately contributing to the establishment of a peaceful, stable, and secure society. Furthermore, this research brings attention to recent civilizational advancements in the execution of these rituals, particularly exemplified by the Kingdom of Saudi Arabia's initiative to harness the potential of al-hadyu and al-udhiyyah rituals. The study examines the impact of this initiative on achieving the objectives of Shari'a (Islamic law) and its vital role in preserving the sanctity of places of worship, ensuring their cleanliness, and safeguarding them against harm and corruption. The research is structured into an introduction, three sections covering the historical context, the significance of the rituals, and their impact on social cohesion, and a conclusion summarizing the findings. The outcomes of this study hold significant implications for the international community, as it contributes to a deeper understanding of the transformative power of religious rituals in fostering unity, cooperation, and the promotion of noble values across cultures and societies.

Since the Muslim population has increased around the world, they are more concerned about halal awareness. Therefore, there are a lot of emerging halal industries nowadays, and among them is halal pharmaceuticals. However, with the advancement of technology, gelatin-based products have been widely developed and are being used in the pharmaceutical industry. Nevertheless, its halal status can be questionable (mashbooh). Hence, this paper is aimed to study the Islamic perspective on gelatin-based products in pharmaceuticals. The study uses a qualitative method which involves a literature review from al-Quran, as-Sunnah, articles, journals, and some other references from the internet that can be trusted as data sources. Apart from that, the methodology of this study is by researching the istihalah method and fatwa in Malaysia to determine the halal status of gelatin in pharmaceutical products. Besides, this paper also focuses on the Malaysian Standard of Halal Pharmaceuticals- General Requirements (MS 2424:2019) and Malaysian Halal Certification Procedure Manual- Domestic 2020 (MPPHM 2020). The finding of this study shows that gelatin mostly comes from animal sources. Therefore, its halal status can be questionable even if it comes from permitted animals such as cows or chickens. This is because the animals are considered halal if they were slaughtered according to Islamic law only. Hence, to avoid religious concerns, there is a lot of research on the alternatives to animal gelatin such as from marine sources and plant-based sources. From the Islamic perspective, the use of gelatin from marine sources and animals that have been slaughtered according to Islamic rules is halal. However, gelatin sources from pork and its derivatives are still haram after going istihalah because its chemical substances remain the same and unchanged even after istihalah. Nevertheless, during an emergency, it is permissible to consume it accordingly if there is no replacement or alternative for pork gelatin even if it is from haram sources.

The Malay states remain sovereign from the pre-Federation of Malaya in 1957 until today. They acquired external sovereignty in the form of international recognition. International law recognizes the continental shelf of a coastal state vis-a-vis Malaysia, a federation that comprises a few coastal states. A local issue close to this subject is the Malay States’ right in the Federation of Malaysia over petroleum production within the continental shelf adjacent to their territorial waters. Hence, this paper examines a Malay State's rights over Malaysia's Continental shelf territory. This study is a legal analysis using a case study design promoting the method of watanic jurisprudence. Therefore, the Federal Constitution, UNCLOS, the Continental Shelf Act 1966, and the Territorial Sea Act 2012 were analyzed to answer many related issues beforehand. This paper found that the territorial waters of the Malay States cannot be limited to 3 nautical miles from the low tide line in pursuance of the Territorial Sea Act 2012 without strict compliance with Article 2 of the Federal Constitution. The legitimacy of the territorial limits of the Malay States' waters is essential as it determines the Malay States' rights to the Continental shelf and its petroleum production.

This article is a review of a book that presents a detailed and thorough analysis of women’s legal status in the Islamic legal system. The book consists of six chapters that include a historical overview of women who held power in Islam, classical and contemporary sources of Islamic law, women’s legal status, and measures taken by male-dominated societies to circumvent or restrict women’s rights. The author’s arguments are based on the position of women in the Islamic legal system, in the light of the sources of Islamic law and Islamic traditions. The book is a valuable resource for scholars, students, and activists interested in understanding women's legal status in Muslim societies. The author argues that it is not Islamic law per se but rather the juristic interpretations that cause the inequalities faced by women. The author suggests revisiting laws, policies, and practices to strengthen the legal status of women by incorporating human values such as human dignity, fairness, and justice, as laid in the Quran, as the jus divinum for any law affecting women as a class.

This dialogue highlights why knowledge on conflict and conflict resolution is an essential skill for the society. It serves a broad introduction to the nature, scope and practices of conflict resolution. Knowledge on conflict resolution allows the society to understand the fundamental problems that give rise to conflicts, the power dynamics and recognition of interests of all parties. It emphasizes the contextual nature of descriptions of peace and conflict and the importance of a thorough analysis in determining the most effective course of intervention. Here, the notion of wise and unwise approaches in conflict resolution is explained referring to the actions taken by parties to curb escalations of disputes, by shifting the emotional positions to the achievement of interests of both parties. Another crucial observation is the relationship between law and the solutions proposed in peace and conflict studies, with examples from both interpersonal and international conflicts. The elaboration is based on the C.R SIPPABIO framework as a comprehensive approach to study conflict resolution introduced by Emeritus Professor Dr Amr Abdalla in his scholarly works. The Islamic viewpoints on conflict resolution are discussed in an interesting way, and it is highlighted how, in addition to focusing on legal interpretations, Quranic interpretations must also take into account ethical dimensions and accountability to God.

The issue of verification of child status is one of the issues that is always discussed in the community. However, this issue gets lost amidst various issues that come up every day. For a while, it was a hot topic of discussion at various levels of society, but there was a time when it was eclipsed by other issues that came up later. One of the reasons for this is that there is still no final verdict from an authoritative religious body in Malaysia. There is no denying that one of the reasons is that there is disagreement among scholars on the issue, apart from the fact that religious matters are the responsibility of the Sultan, the King and the States under Article 3 (2) of the Federal Constitution and the Eighth Schedule II in the same Act. This study was written within the framework of the problem-based learning method used in Shariah lectures. The objectives include sharpening the thinking of law pupils/students in identifying problems objectively, providing answers to the problems at hand and finally justifying the solutions found. In this process, pupils/students are encouraged to explore various methods of data collection and analysis in order to understand the concept, digest the study and analyse it. The methods of analysis used include descriptive, deductive, inductive and comparative analysis. The outcome of this process enables pupils/students to understand the problem-solving process in a systematic way. Moreover, it affects the solution of legal problems in a more detailed, clear and systematic way, while contributing to the improvement of law students' skills, especially Shariah in solving a case. This study proposes to adapt the learning and teaching process based on case studies such as this one to other related cases in order to improve the skills of law pupils/students especially in the field of Shariah. 3 (2) . This study proposes to adapt the learning and teaching process based on case studies such as this one to other related cases in order to improve the skills of law pupils/students especially in the field of Shariah.\u0000 \u0000Abstrak\u0000Isu pengesahan taraf anak adalah antara isu yang sentiasa menjadi perbincangan dalam kalangan masyarakat.
