Peraturan perlindungan data dapat dipahami sebagai langkah penting untuk melindungi data pribadi yang lebih baik di mana privasi dipandang sebagai hak fundamental warga Negara. Urgensi dan tujuan penulisan jurnal ini adalah untuk menganalisis perspektif ekonomi dan hukum data pribadi pengguna e-commerce. Penelitian ini dikaji menggunakan penelitian normatif. Pemerintah harusnya memiliki kebijakan akomodatif yang baik, memotivasi, dan menjanjikan serta memiliki undang-undang yang bertindak sebagai bimbingan untuk e-commerce. Regulasi perlindungan hingga kini masih bersifat sektoral dimana hanya berkaitan dengan sektor esensial contohnya perbankan, teknologi informasi dan keuangan. Selain itu, tidak ada otoritas perlindungan data umum, badan pengatur, atau organisasi yang secara khusus bertanggung jawab untuk melindungi informasi pribadi dan menetapkan pemahaman bahwa setiap subjek hukum yang berkaitan dapat mematuhi aturan perlindungan data. Apalagi, di Indonesia belum ada pusat database arsip. Namun demikian, Kominfo diberi wewenang dalam penyelenggaraan kegiatan pemerintahan di bidang komunikasi atau teknologi informasi, berdasarkan PP 54/2015 dan Permenkominfo 6/2018. Pendekatan analisis ekonomi seharusnya sejalan dengan alasan politik di balik regulasi tertentu, dengan asumsi bahwa itu berasal dari keinginan mayoritas warga negara seperti yang diharapkan terjadi di negara-negara demokratis sesuai dengan amanat UUD 1945 dalam hal mewujudkan negara kesejahteraan.

This study aimed to analyze the green constitution concept as the basis for environmental protection and management in Indonesia. Various problems that occur such as natural disasters, ecosystem damage, and global warming raise concerns and ecological awareness. The problem discussed in this research was what is the importance of implementing the green constitution concept and how it is applied in Indonesia. This research was normative legal research using secondary data. Based on the results of the study, it was concluded that it requires sustainable development-based development for the sustainability of human life, as well as other living creatures on earth. The program is in line with the concept of the Green Constitution. This concept has been embraced by several countries, including Indonesia,the Green Constitution concept is adopted in Indonesia with recognition to the concept in the Constitution of the Republic of Indonesia, which is then relegated to laws and regulations under it.

Metode evaluasi undang-undang di Indonesia belum menjadi isu yang dibahas secara komprehensif. Kajian-kajian sebelumnya lebih banyak fokus pada metode riset dalam penyusunan rancangan undang-undang, misalnya tentang ROCCIPI (Rule, Opportunity, Capacity, Communication, Interest, Process, dan Ideology) atau CBA (Cost and Benefit Analysis). Oleh karena itu, artikel ini mengisi kekosongan kajian tersebut dengan membahas Social Return on Investment (SROI) sebagai metode evaluasi implementasi undang-undang. Metode ini dapat menjadi alternatif wacana dalam evaluasi undang-undang di Indonesia tetapi perlu didukung adanya pedoman evaluasi yang menjelaskan langkah-langkah konkrit dalam evaluasi kuantitatif terhadap undang-undang. Selain itu, metode SROI menuntut pendekatan interdisipliner serta keterlibatan pemangku kepentingan yang terkait dalam berbagai tahapan analisis SROI.

The Republic of Indonesia and Papua New Guinea are land and sea neighbors whose borders are located in the Papua Province in the eastern part of Indonesia. The border area consists of Census Divisions within Papua New Guinea and border villages within the Republic of Indonesia as defined, where the border is part of the boundaries of the Census Divisions and the border villages. State border areas are the main manifestation and have an important role in determining border areas, utilization of natural resources, security and territorial integrity. Supervision is very important because it is to maintain and supervise the presence of foreign nationals who enter with all kinds of activities while they are in Indonesian territory until they depart or leave Indonesian territory. The purpose of the study was to determine the process of immigration control of traditional border crossers in the border areas of Indonesia and PNG in Merauke district. The problem approach used is the empirical juridical approach, which is a research approach carried out to analyze the extent to which the effectiveness of a regulation / legislation or law in society, the research location in Merauke Regency, and the Sota Cross-border Post there was a process of traditional crossing of Indonesian citizens and Papuan New Guinea citizens. This study is intended to see how the application of Indonesian legal regulations, especially immigration in traditional border crossers in border areas in Merauke. In the application of Indonesian laws and regulations, the immigration process uses immigration laws and also with the existence of mutual agreements between Indonesian countries and Papua New Guinea. the implementation of immigration checks uses several mechanisms, namely administration, and the field is carried out by immigration officials in the work area of the Class II Immigration Office of TPI Merauke.

Penelitian ini bertujuan untuk menganalisis tentang jenazah pasien Suspek/Probable Covid-19 dalam Protokol Covid-19 dan tanggungjawab pelaku pengambilan paksa jenazah pasien Suspek/Probable dalam hukum pidana. Penelitian ini merupakan tipe penelitian yuridis normatif, yaitu penelitian yang difokuskan untuk mengkaji penerapan norma-norma dalam hukum positif dengan cara memadukan bahan-bahan hukum yang merupakan bahan hukum sekunder dengan primer. Pendekatan yang dilakukan adalah pendekatan perundang-undangan (statue approach), pendekatan konseptual (conseptual approach). Berdasarkan hasil penelitian ini dapat disimpulkan bahwa jenazah pasien tersebut merupakan jenazah suspek/probable Covid-19, harus diperlakukan seperti Jenazah Covid-19 sampai ada hasil dari tes swab untuk memenuhi hak-hak jenazah, Tanggungjawab pelaku pengambilan paksa jenazah pasien suspek/probable dalam hukum pidana dapat dijatuhi hukuman pidana sesuai dengan Undang-Undang Nomor 4 Tahun 1984 tentang Wabah Penyakit Menular.

Penelitian ini adalah penelitian hukum normatif. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data menggunakan studi pustaka, sementara teknik analisis data menggunakan penafsiran hukum. Many countries are unsure to decide on legal instruments to use to overcome the crisis caused by the Covid-19 pandemic. Some chose to establish a state of emergency based on the constitution, while others used the applicable law regarding disasters or health crises, implemented new legislation, and issued another community restriction enforcement policy namely PPKM. The stipulation of a state of emergency allows the state to deviate from the rule of law. Therefore, the determination of the emergency status is potentially be misused. The method of this research is normative legal research using statute and conceptual approaches. The result of this research experienced that the Indonesian government chose to use Health Emergency in Law 6 of 2018 and Non-Natural Disaster Emergency in Law 24 of 2007 to deal with the Covid-19 Pandemic regardless of Article 12 of the 1945 Constitution providing provisions for a constitutional emergency. The emergency status does not entirely involve Article 12 of the 1945 Constitution as the basis for its formation. Thus, the term emergency is not a state of emergency as referred to in the study of emergency constitutional law (only de facto not de jure). Although there are restrictions, this certainly does not apply to basic rights, especially to non-derogable rights groups.

The existence of illegal fintech is still a public concern due to the inadequate regulation tools that are able to regulate and take firm action against the existence of illegal fintech. The difficulty faced by regulators in taking action against illegal fintech is because it is difficult to be tracked and illegal entities that have been blocked can easily recreate new illegal fintech entities. This study was conducted by using normative legal research, which was reviewing material law that contains normative legal rules. As the result, there are conclusion namely, first Illegal fintech P2PL actors try to trick the public by resembling the company’s platform name and/or logo, name, and identity color from legal fintech P2PL that has been registered/licensed at the OJK and SWI’s efforts to take action against these fintech P2PL companies are by blocking sites, conducting joint inspections of business activities which assumed as illegal investments, ordering illegal fintech P2PL companies to stop business activities, and improving coordination in handling cases with related agencies. OJK through SWI seeks to stop the chain of Illegal fintech P2PL by routinely coordinating with the Minister of Communication and Information to block illegal services

The difficulty faced by regulators in taking action against illegal fintech is because it is difficult to be tracked and illegal entities that have been blocked can easily recreate new illegal fintech entities. This study was conducted by using normative legal research, which was reviewing material law that contains normative legal rules. As the result, there are conclusion namely, first Illegal fintech P2PL actors try to trick the public by resembling the company’s platform name and/or logo, name, and identity color from legal fintech P2PL that has been registered/licensed at the OJK and SWI’s efforts to take action against these fintech P2PL companies are by blocking sites, conducting joint inspections of business activities which assumed as illegal investments, ordering illegal fintech P2PL companies to stop business activities, and improving coordination in handling cases with related agencies. Indonesia merupakan sebuah Negara hukum, yang dimana pada masa pandemi covid-19 ini mengeluarkan kebijakan terkait Vaksinasi yang tertuang di dalam Peraturan Menteri Kesehatan Nomor 84 Tahun 2020 tentang Pelaksanaan Vaksinansi dalam Rangka Penanggulangan Pandemi Corona Virus Disease 2019 (covid-19). Tujuan penelitian ini adalah untuk mengetahui apakah sudah tepat lahirnya kebijakan terkait vaksinasi yang tertuang di dalam Permenkes Nomor 84 Tahun 2020, serta bagaimana pelaksanaannya menurut perspektif teori sistem hukum. Penelitian ini menggunakan pendekatan yuridis empiris yang dimana dalam melaksanakan penelitian mengamati bagaimana bekerjanya hukum di masyarakat. Kemudian metode yang digunakan untuk menganalisis data ialah dengan metode deskriptif analitis, dan dalam mengumpulkan data yaitu melalui wawancara dan observasi secara langsung mengenai implementasi kebijakan di lapangan. Hasil penelitian menunjukkan bahwa lahirnya kebijakan vaksinasi di tengah pandemi covid-19 yang tertuang di dalam permenkes nomor 84 tahun 2021 dalam perspektif teori sistem hukum adalah sudah sesuai sebagaimana teori-teori hukum yang dikemukakan oleh L. M. Friedman maupun Gustav Radburch.

Indonesia merupakan negara yang memiliki komitmen dalam pemenuhan hak pendidikan bagi warga negaranya termasuk untuk anak suku laut. Hak pendidikan telah diatur dalam Undang-Undang Dasar 1945 dan Undang-Undang Nomor 20 Tahun 2003 Tentang Sistem Pendidikan Nasional, Peraturan Pemerintah No. 47 Tahun 2008 Tentang Wajib Belajar. Kabupaten Lingga merupakan salah satu daerah di Provinsi Kepulauan Riau yang masih banyak dikelilingi oleh masyarakat suku laut. Pulau Kelumu adalah salah satu pulau yang berada di Kabupaten Lingga yang masih dihuni oleh masyarakat suku laut. Masyarakat suku laut adalah masyarakat asli di Kabupaten Lingga. Tujuan dalam penelitian ini adalah menganalisis pemenuhan hak pendidikan untuk anak suku laut di Pulau Kelumu Kabupaten Lingga. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris dan menggunakan Teori Efektivitas Hukum Oleh Soerjono Soekanto. Hasil penelitian ini menunjukan bahwa pemenuhan hak pendidikan bagi anak suku laut di Pulau Kelumu Kabupaten Lingga masih belum efektif jika diukur dengan Teori Efektivitas hukum tersebut, karena kurangnya faktor sarana prasarana yaitu ketersediaan sekolah yang terbatas, masyarakat, dan budaya yang melakukan perkawinan anak hingga menjadikan anak tersebut putus sekolah. Oleh sebab itu, rekomendasinya adalah menciptakan lapangan pekerjaan bagi masyarakat suku laut, membangun sekolah pada tingkat SMP dan SMA yang berlokasi di wilayah Pulau Kelumu.
