Today, the ubiquity of the Internet raises the need to study the behavior of consumers and users from a transnational perspective, not even placing them in a region or continent, but as an essential element of world economic development. For this reason, consumer trust in cross-border e-commerce is a challenge for many political and economic global operators. It is therefore essential to create alternative methods of conflict resolution, global and harmonized to ensure the legitimate rights of consumers and users, access to justice in the broad sense, and access to, both individually and collective effective judicial protection. In this paper the concept of access to justice will be analyzed from the perspective of the consumer in e-commerce and its materialization through the Online Dispute Resolution. In particular, the legal implications that it has for cross-border electronic commerce will be analyzed, the fact that the consumer subscribes with the buyer, arbitration clauses, prior to the emergence of the conflict, without the need to be ratified. For this reason, the alternative to a contradictory method complemented with mediation will be studied, different from arbitration but that does not undermine the rights of consumers by undermining their right to effective judicial protection.

This paper aims to address the technology transfer and licensing contracts between public STIs and third parties interested in exploring their technologies, according to article 6 of the Innovation Law, in order to identify the advantages and disadvantages of the exclusivity clause for both public STI and companies, notably, in relation to the procedure to be observed by the STI, its practical problems and the possible adoption of sole licensee and priority to license clauses. For that, the methodology used is the theoretical research of bibliographic and documentary nature, with the reading and interpretation of the legislation, scientific articles and case law, starting from the inductive method to elucidate the formulated problem. It is believed that the transfer of technology between public STI and companies brings greater efficiency in the interaction between them in the production of technological innovation and in economic progress, and its practice should be facilitated and fostered, observing and aligning the economic and social interests of both parties. In this context, the exclusivity clause and its derivations play a prominent role in encouraging technological cooperation between public STI and private entities, due to the economic advantages of such clause for both parties.

: This paper reflects on the disruptions that collaborative labour platforms introduce in the context of work relationships. The work providers are engaged as independent contractors and considered freelancers, allowing companies' owners of digital platforms to exonerate themselves from their responsibilities as employers. Labour platforms radicalise the practice of outsourcing. This phenomenon raises the relevant question of whether these providers should be considered dependent and subordinate workers or mere autonomous providers of the digital platform, in which case labour rules shall not apply, therefore leaving the provider less protected. The doctrine has pointed out the cooperative labour platforms as an alternative way to manage collaborative platforms and ensure work providers' protection. Labour cooperative platforms are organisations of an atypical business nature, collectively owned and democratically managed by their members.

Despite the impossibility to, under Brazilian law, as a rule, an insured or aggrieved third party seek payment of insurance indemnity directly from a reinsurer, it is recurrent the inclusion of reinsurers as defendants in lawsuits, especially in cases involving the purchase of facultative civil liability insurance. As a result of legislative, jurisprudential, bibliographical and documentary research, this study aims to shed light on the relationships and obligations established by reinsurance agreements and reject this unlawful practice at once. This is done through an initial dive into the insurance relationship and the facultative civil liability insurance and through the review of the particularities of reinsurance and the features that differ it from insurance, to, ultimately, reinforce the initial statement that served as a premise for this work.

O caso “Lafarge”, movido junto da justiça francesa, contra a empresa-mãe “Lafarge”, sediada em França, e contra a subsidiária “Lafarge Cement Syria”, sediada na Síria, pelos atos causados pela última no decurso da Guerra Civil na Síria é um importante marco quanto à responsabilização das empresas pelas violações de direitos humanos e de direito internacional humanitário levadas a cabo em contexto de conflito armado. A empresa encontra-se acusada de cumplicidade na comissão de crimes de guerra e de crimes contra a humanidade, do crime de financiamento de terrorismo e do crime de deliberadamente colocar em perigo a vida dos trabalhadores da empresa síria. O caso sob análise, que aguarda decisão do Supremo Tribunal de Justiça francês, ilustra as dificuldades de acesso à justiça e de criminalização da conduta empresarial atentatória dos direitos humanos, tema que exploraremos neste artigo. Analisaremos, nomeadamente: as normas que regulam a conduta empresarial no que toca ao respeito pelos diretos humanos e pelo direito internacional humanitário, a criminalização da conduta empresarial à luz do direito internacional penal, as dificuldades em estabelecer a cumplicidade da empresa na comissão de crimes e ainda as dificuldades em imputar atos praticados pela empresa subsidiária à empresa-mãe.
