Aquesta recerca examina la polemica institucio de la preso provisional a Espanya a l’albir de dues realitats punyents: d’una banda, l’omnipresencia d’aquesta mesura cautelar com a practica judicial —a principis d’any, un 16% de la poblacio reclusa es trobava en situacio de preso preventiva—; de l’altra, un sistema d’indemnitzacio, en cas d’absolucio, per responsabilitat patrimonial de l’Estat jutge, que s’ha mostrat ineficac des de 1985 i que recentment s’ha vist sacsejat en els seus fonaments per la intervencio del Tribunal Europeu de Drets Humans i la declaracio, per part del Tribunal Constitucional, de la inconstitucionalitat de diferents incisos de l’article 294 de la LOPJ. L’article planteja, mes enlla del repas del proces que ens ha portat fins a la situacio actual, els termes del debat per poder afrontar amb garanties dues reformes legislatives, que s’intueixen mes necessaries que mai.

Dret a decidir i dret constitucional dels estats 国家的决定权和宪法权利

Le “droit de decider”, qui serait reconnu a une partie de la population d’un Etat, n’est pas inscrit expressement dans les constitutions. Si certaines notions s’en rapprochent, tel que le droit a l’autodetermination, la revendication du droit de decider defend de plus en plus frequemment un fondement a part afin de contourner les obstacles, a la fois internationaux et constitutionnels, a la secession unilaterale. Meme si les contours de ce droit restent encore ambigus, un statut constitutionnel de celui-ci commence a se dessiner a travers la jurisprudence constitutionnelle du Tribunal constitutionnel espagnol en particulier, qui pour rejeter ce droit dans sa version extreme (la secession unilaterale) n’en consacre pas moins l’existence dans un arret de 2014. Or, s’il est logique que les Etats contestent ce droit d’un point de vue strictement constitutionnel, il n’en demeure pas moins que cette revendication exprime un souhait politique. La dimension politique du conflit opposant l’Etat a l’entite qui revendique le droit de decider marque sans doute les limites de l’apprehension strictement constitutionnelle de ce droit. Pour autant, le droit constitutionnel garde un role de premiere importance dans la definition des garanties democratiques qui pourraient entourer l’exercice de ce droit.

Dossier sobre la llibertat d’expressió a l’era digital 关于数字时代言论自由的文件

Aquest dossier te com a objectiu principal recollir recursos relacionats amb l’exercici de la llibertat d’expressio a traves d’Internet i els seus diversos contextos digitals. Especialment en la darrera decada, la normativa, la jurisprudencia, els informes i la bibliografia han experimentat un creixement exponencial. Aquest document tracta de sintetitzar i recollir les principals aportacions en els diversos ambits. Atenent l’amplitud de la materia, s’ha ordenat en quatre apartats: sobre la llibertat d’expressio a Internet i xarxes socials, control de continguts, i responsabilitat dels proveidors de serveis d’Internet (ISP); sobre discurs d’odi i ciberdelinquencia; sobre llibertat d’expressio i d’informacio, desinformacio i dret a l’oblit; i, finalment, un breu apartat sobre propietat intel·lectual.

Pandèmia i Constitució: l'experiència d'Alemanya 流行病与宪法:德国的经验

La lluita contra la pandemia, que fins ara ha tingut exit a Alemanya, ha donat lloc a una restriccio sense precedents dels drets fonamentals. No obstant aixo, aquestes restriccions sempre han seguit els requisits i els limits establerts a la Constitucio, respectant el principi de proporcionalitat i l'essencia dels drets fonamentals. La suspensio dels drets fonamentals es desconeguda per la Constitucio, la llei fonamental. La gestio de l'emergencia sanitaria es va basar essencialment en la llei federal ordinaria de proteccio contra les infeccions. Els reglaments dels Estats membres de la Federacio, que establien les mesures essencials, es basaven en aixo. La revisio judicial de totes les restriccions va ser possible sense impediments. Fins ara, la jurisprudencia nomes ha fet correccions en alguns pocs casos. Els requisits de l'Estat de dret s'han mantingut incolumes. Protección de datos personales en el contexto de la Covid-19: legitimación en el tratamiento de datos de salud por las administraciones públicas 新冠病毒背景下的个人数据保护:公共行政部门处理健康数据的合法性

This study offers a thorough, systematic, up-to-dale analysis of declaration of the State of Alert and the processing of personal data concerning the heath of people affected and/or potentially affected by the exceptional situation stemming from COVID-19. Specifically it analyses the distinction between the state of alert and the states of exception and siege, and the possible effect on the fundamental right to personal data protection in the exceptional circumstances of health crises, as well as the effects said declaration could have on applicable legislation stemming, on a European level, from the General Data Protection Regulation (GDPR) and, on a Spanish level, supplementing and developing the GDPR, the Organic Law on Personal Data Protection and Guarantees for Digital Rights (LOPDGDD). Then, taking into account both general and sectoral legislation applicable to health and data protection, the study proceeds to analyse the legitimate bases and exceptions applicable to health emergency situations like the current one which enable data processing bearing in mind the nature of the controller placing special emphasis on the public interest pursued by the public administrations and the vital interest of the person concerned.
