This study aimed to analyze the existence of Pancasila Education before the issuance of Government Regulation Number 57 of 2021 concerning National Education Standards and analysis of legal certainty for the implementation of Pancasila Education through Government Regulation Number 57 of 2021. This study used a qualitative approach, with normative and empirical legal research types. Sources of data obtained from secondary data and primary data. The study results showed that the existence of Pancasila Education experienced various dynamics before the issuance of Government Regulation Number 57 of 2021. Pancasila began to lose its role after issuing Law Number 20 of 2003 concerning the National Education System by eliminating Pancasila Education from primary education to higher education. The main issue of Government Regulation Number 57 of 2021 was based on the findings of inconsistent legal drafting with one another. The issuance of Government Regulation Number 57 of 2021, which did not include the contents of the Pancasila Education material, created legal uncertainty, which had implications for contradicting the laws and regulations on it.

Implikasi Yuridis Undang-Undang Nomor 28 Tahun 2004 Terkait Penyesuaian Anggaran Dasar Yayasan

This study aimed to adjust the statute for foundations established before the enactment of Law Number 28 of 2004 and analyze the legal consequences for foundations established before the enactment of Law Number 28 of 2004 that did not make adjustments to the articles of association. This study used a normative juridical method with a statutory and case approach. The results showed that the purpose of adjusting the articles of association for foundations that were established before the enactment of Law Number 28 of 2004 was to obtain recognition as a foundation, either technically or administratively. The legal consequences for foundations that were established before the enactment of Law Number 28 of 2004 that did not make adjustments to the statute were in the form of losses due to loss of previous history and wealth in the form of assets that had been obtained by the foundation so that the foundation became like a new foundation.

Perlindungan Hukum terhadap Anak Korban Kekerasan Seksual 对性暴力受害者的保护

This study aimed to analyze the implementation of legal protection for child victims of sexual violence in Singaraja City and the efforts of law enforcement officials in reducing the number of sexual violence in Singaraja City. This study used an empirical legal research approach with a descriptive type. Sources of data were obtained from primary data and secondary data. Data collection techniques through observation, interviews, and documentation studies. Determining the sample uses a non-probability sampling technique called purposive sampling. The data is processed and analyzed qualitatively. The results study indicated that the implementation of legal protection for child victims of sexual violence in Singaraja City had not run optimally. Some several facilities and services had not been fulfilled. The Buleleng Police took preemptive, preventive, and repressive measures to reduce the number of sexual violence in Singaraja City. The Social Service of Buleleng Regency assisted in assistance, trauma recovery, and counseling services for children who were victims of social violence.

This study aimed to analyze changes in the provisions for registering limited partnership after enacting the Minister of Law and Human Rights Regulation Number 17 of 2018 and the position of Minister of Law and Human Rights Regulation Number 17 of 2018 on the hierarchy of laws and regulations in Indonesia. The type of research used was normative juridical law with a conceptual, historical, and statutory approach. After the enactment of Minister of Law and Human Rights Number 17 of 2018, the authority to register limited partnerships, which was previously the authority of the Minister of Trade, was transferred to the Minister of Law and Human Rights. The position of Minister of Law and Human Rights Regulation Number 17 of 2018 is seen from the procedure for forming ministerial regulations that do not meet the requirements as implementing regulations and are contrary to the principle of business certainty.

Formulation of Legal Protection for Persons with Disabilities in The Civil Service Recruitment System in The Perspective of Human Rights 从人权角度制定公务员录用制度中对残疾人的法律保护

This research aimed to fulfill the rights of persons with disabilities to get jobs according to their fields without reducing their rights. One of them was the recruitment of civil servant candidates. The research method used was normative juridical with literature study. Decent work is a right for every human being without exception. Various racial, ethnic, and religious backgrounds that are part of human identity do not prevent him from getting his rights, likewise with the physical or non-physical conditions that underlie a human being. Every human being who has a certain physical or non-physical background also has the same right to get a decent job, including people with disabilities. The State of Indonesia has ratified the Convention on the Rights of Persons with Disabilities into Law Number 19 of 2011. In the preamble to the law, it is explained that countries that sign the Convention should promote and protect the rights and dignity of persons with disabilities and increase the participation of persons with disabilities in the civil, political fields, economic, social, and cultural-based on an equal opportunity. It means that the Indonesian government is legally obliged to fulfill the rights of persons with disabilities, especially regarding the right to work in Indonesia.

This study aimed to analyze the limits of the meaning of the technical error phrase in Article 57 paragraph (2) of Government Regulation Number 80 of 2019 on the validity of electronic contracts and analyze legal protection for business actors, system makers, and recipients of goods/services related to the phrase technical error in Article 57 paragraph (2) Government Regulation Number 80 of 2019. This study used a normative juridical method with a statutory and analytical approach. The results showed that the technical error phrase in Article 57 paragraph (2) of Government Regulation Number 80 of 2019 contained the meaning of default, resulting in the electronic contract being null and void. Legal protection for business actors was included in Article 6 of Law Number 8 of 1999, in the form of guarantees for self-defense when a dispute occurred due to consumers who had bad intentions. Article 12 of Law Number 19 of 2002 explicitly explained that computer programs were one of the protected copyrighted works. It was legal protection for system makers. Legal protection for recipients of goods/services was contained in Article 46 of Law Number 8 of 1999, in the form of guarantees of justice related to the quality of the product received.

Implikasi Keputusan Majelis Utama Desa Pakraman Bali Nomor 01/KEP/PSM-3/MDP BALI/X/2010 tentang Kedudukan Wanita Bali dalam Keluarga dan Pewarisan

The purpose of this study was to analyze the philosophical basis and implications of the Decision of the Main Assembly of Bali Pakraman Village Number 01/Kep/Psm-3/MDP Bali/X/2010 on the position of Balinese women in the family and inheritance. This study used a normative juridical method with a philosophical and conceptual approach, which discussed legal rules or regulations as a system associated with legal events. The study results showed that the philosophical basis for the Decision of the Main Assembly of the Bali Pakraman Village Number 01/Kep/Psm-3/MDP Bali/X/2010 was a patrilineal system Balinese society which did not provide opportunities for Balinese women to become heirs. The implication of the decision of the Main Assembly of the Bali Pakraman Village Number 01/Kep/Psm-3/MDP Bali/X/2010 was the realization of gender equality between Balinese men and women in obtaining rights, although with different amounts of inheritance.

This study aimed to analyze the meaning of love for the homeland from time to time, the concept of world citizenship, global citizenship, and cosmopolitanism in the global era, and analyze the urgency of patriotism education in the global era. This study used a qualitative method by explaining the feelings and ideas of the informants regarding the occurrence of a specific behaviour or symptom. The meaning of love for the homeland had shifted from ancient times, medieval times, to modern times. In ancient times, love for the homeland was regional; in the Middle Ages, it was personal; while in modern times, it was more national and national. The concepts of global citizenship, global citizenship, and cosmopolitanism in the global era showed connectivity and interdependence between humans in all parts of the world. The urgency of patriotism education in the global era was related to providing learning materials about global citizenship education or global citizenship education to instil awareness of universal humanitarian issues.

This study aimed to analyze the judges' considerations in the Constitutional Court Decision Number 16/PUU-XVI/2018 regarding the provisions of Article 245 paragraph (1) of Law Number 2 of 2018, and to analyze the legal consequences of the Constitutional Court Decision Number 16/PUU-XVI/2018 regarding written approval of the President in the examination of members of the House of Representatives suspected of committing a crime. This study used a normative juridical method with a statutory approach. The data sources (the primary and secondary legal materials) were analyzed descriptively qualitatively. The study results showed two judges' considerations regarding the provisions of Article 245 paragraph (1) of Law Number 2 of 2018. First, it was contrary to the principle of equality in law and government. Second, the assumption that the Honorary Court of the Council was an ethical institution with no direct relationship with the criminal justice system. The legal consequences of the Constitutional Court's Decision Number 16/PUU-XVI/2018 regarding the written approval of the President in the examination of members of the House of Representatives were causing legal uncertainty, legal injustice, and abuse of authority that could trigger a politics of retaliation.

Isu Politik Identitas dan Dinasti Politik dalam Kampanye Pilkada Serentak Tahun 2020 2020短桩运动中的政治认同与王朝问题

This study was intended to explain the phenomenon of identity politics and political dynasties in the holding of simultaneous elections in 2020. The focus of this study was looking at the issue of identity politics and political dynasties in several regions, including Solo, Medan, South Tangerang, and Central Kalimantan, which were case studies of identity politics and political dynasties issue in the 2020 elections. This research used a type of qualitative research with a descriptive approach. Data was obtained through literature studies by looking at previous research based on the same topic and news in the mass media about the issue of identity politics and political dynasties. The study found that identity politics and political dynasties still occurred in some regions, i.e., in Solo, Medan, South Tangerang, and Central Kalimantan. In addition, hate speech, black campaigns, and hoax issues had sprung up with different models through social media and billboards.
